		<section display-inline="no-display-inline" id="H0ECA73CB5BB2411B86E9039B69D293E8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>False Claims Act Correction Act of
			 2009</short-title></quote>.</text>
		</section><section id="H8168C856F9344CC586F0FAC91FB212F6"><enum>2.</enum><header>Liability for
			 false claims</header><text display-inline="no-display-inline">Section 3729 of
			 title 31, United States Code, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H4178C56754134F8EA69FC92233EA195A" style="USC">
				<section id="HEBE657897D764443B7B67821D57BA1ED"><enum>3729.</enum><header>False
				claims</header>
					<subsection id="HBCF012C164FB4F85928E13743C1833D2"><enum>(a)</enum><header>Liability for
				certain acts</header>
						<paragraph id="HC655017D8E5242FDB94D28B25D280AE8"><enum>(1)</enum><header>In
				general</header><text>Any person who—</text>
							<subparagraph id="H1DCD96390E4449049CC734793D99EEEF"><enum>(A)</enum><text display-inline="yes-display-inline">knowingly presents, or causes to be
				presented for payment or approval, a false or fraudulent claim for Government
				money or property,</text>
							</subparagraph><subparagraph id="H507FCC098E594F25A6449AE9FFEB56B4"><enum>(B)</enum><text display-inline="yes-display-inline">knowingly makes, uses, or causes to be made
				or used, a false record or statement to get a false or fraudulent claim for
				Government money or property paid or approved,</text>
							</subparagraph><subparagraph id="HFE77A7D3DA20456CB764954CCDB34134"><enum>(C)</enum><text>has possession,
				custody, or control of Government money or property and either—</text>
								<clause id="HDDC467B0282C43518278FE76F2A39079"><enum>(i)</enum><text>fails to comply
				with a statutory or contractual obligation to disclose an overpayment about
				which the person is on actual notice, or</text>
								</clause><clause id="HBE6C1E2180614C42BEBF5F793FCAA53E"><enum>(ii)</enum><text>intending
				to—</text>
									<subclause id="H5572A22B9CE541BD836366CD94292D7A"><enum>(I)</enum><text>defraud the
				Government, or</text>
									</subclause><subclause id="H16B728DC44EB4F97A90352394501E423"><enum>(II)</enum><text>knowingly convert
				the money or property, permanently or temporarily, to an unauthorized
				use,</text>
									</subclause><continuation-text continuation-text-level="clause">fails to
				deliver or return, or fails to cause the return or delivery of, the money or
				property, or delivers, returns, or causes to be delivered or returned less
				money or property than the amount due or owed,</continuation-text></clause></subparagraph><subparagraph id="H764FEA8A2DA34070A809A231AA2EB1D8"><enum>(D)</enum><text display-inline="yes-display-inline">authorized to make or deliver a document
				certifying receipt of property used, or to be used, by the Government and,
				intending to defraud the Government, makes or delivers the receipt without
				completely knowing that the information on the receipt is true,</text>
							</subparagraph><subparagraph id="HD55EB0B6A0914E228D7C1A208A29DB9A"><enum>(E)</enum><text display-inline="yes-display-inline">knowingly buys, or receives as a pledge of
				an obligation or debt, Government money or property from an officer or employee
				of the Government, or a member of the Armed Forces, who lawfully may not sell
				or pledge the money or property,</text>
							</subparagraph><subparagraph id="H2E3462918C524371BEE62A993FB99847"><enum>(F)</enum><text display-inline="yes-display-inline">knowingly makes, uses, or causes to be made
				or used, a false record or statement to conceal, avoid, or decrease an
				obligation to pay or transmit money or property to the Government, or</text>
							</subparagraph><subparagraph id="H44AC6CC5716B4E11A6C3093E443ABEAB"><enum>(G)</enum><text display-inline="yes-display-inline">conspires to commit any violation set forth
				in any of subparagraphs (A) through (F),</text>
							</subparagraph></paragraph></subsection><continuation-text continuation-text-level="section" indent="paragraph">is liable to the United States Government for a civil
				penalty of not less than $5,000 and not more than $10,000, plus 3 times the
				amount of damages that the Government or its administrative beneficiary
				sustains because of the act of that person, subject to paragraphs (2) and
				(3).</continuation-text></section><paragraph id="HA0D39F3D6E1F4F40813DF26144CBBD2F"><enum>(2)</enum><header>Lesser penalty
				if defendant cooperates with investigation</header><text display-inline="yes-display-inline">In an action brought for a violation under
				paragraph (1), the court may assess not less than 2 times the amount of damages
				that the Government or its administrative beneficiary sustains because of the
				act of the person committing the violation if the court finds that—</text>
					<subparagraph id="H04834DDF7E77483FBCA244C49EB18523"><enum>(A)</enum><text display-inline="yes-display-inline">such person provided to those officials of
				the United States who are responsible for investigating false claims
				violations, all information known to the person about the violation within 30
				days after the date on which the person first obtained the information;</text>
					</subparagraph><subparagraph id="HF66C4B2608644B748B53C2B4CD35116E"><enum>(B)</enum><text display-inline="yes-display-inline">such person fully cooperated with any
				Government investigation of the violation; and</text>
					</subparagraph><subparagraph id="H3F1D27045B934ECD8C5C8E52896201CD"><enum>(C)</enum><text display-inline="yes-display-inline">at the time such person provided to the
				United States the information about the violation under subparagraph (A), no
				criminal prosecution, civil action, or administrative action had commenced with
				respect to such violation, and the person did not have actual knowledge of the
				existence of an investigation into such violation.</text>
					</subparagraph></paragraph><paragraph id="HE80E50ACE2E8429599DE2B61A01A4960"><enum>(3)</enum><header>Assessment of
				costs</header><text display-inline="yes-display-inline">A person violating
				paragraph (1) shall, in addition to a penalty or damages assessed under
				paragraph (1) or (2), be liable to the United States Government for the costs
				of a civil action brought to recover such penalty or damages.</text>
				</paragraph><subsection id="HE04E23130AD24751995012039674C25F"><enum>(b)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
					<paragraph id="H100FB14FB77044458C8772930970CA6C"><enum>(1)</enum><text display-inline="yes-display-inline">the terms <term>known</term>,
				<term>knowing</term>, and <term>knowingly</term> mean that a person, with
				respect to information—</text>
						<subparagraph id="H752FBD56AF0745EEABB83ABD6FAD579D"><enum>(A)</enum><text display-inline="yes-display-inline">has actual knowledge of the
				information,</text>
						</subparagraph><subparagraph id="H37E1C4884BCF48D39290AB897E8AE684"><enum>(B)</enum><text>acts in deliberate
				ignorance of the truth or falsity of the information, or</text>
						</subparagraph><subparagraph id="H7C5C50B9B7F64121B5559D32429FAAF9"><enum>(C)</enum><text>acts in reckless
				disregard of the truth or falsity of the information,</text>
						</subparagraph><continuation-text continuation-text-level="paragraph">and no
				proof of specific intent to defraud is required;</continuation-text></paragraph><paragraph id="HA4EC8687121549D588D68FDA305F4268"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>Government money or
				property</term> means—</text>
						<subparagraph id="H7755D513935347E1906161F14AF3BFF0"><enum>(A)</enum><text>money or property
				belonging to the United States Government;</text>
						</subparagraph><subparagraph id="H7B4D1E80FDB8423CB084502180AA8D94"><enum>(B)</enum><text>money or property
				that—</text>
							<clause id="HF98C4F3FA0714FC3BB37C057FCCEBE63"><enum>(i)</enum><text>the United States
				Government provides or has provided to a contractor, grantee, agent, or other
				recipient, or for which the United States Government will reimburse a
				contractor, grantee, agent, or other recipient; and</text>
							</clause><clause id="H371699D7666144BDA67FAAD58C8816F4"><enum>(ii)</enum><text>is to be spent or
				used on the Government’s behalf or to advance a Government program; and</text>
							</clause></subparagraph><subparagraph id="H9F665775D89842E39D11502F3C786618"><enum>(C)</enum><text>money or property
				that the United States holds in trust or administers for any administrative
				beneficiary;</text>
						</subparagraph></paragraph><paragraph id="HABE95122619B482C8E1B623514E996D8"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>claim</term> includes any
				request or demand, whether under a contract or otherwise, for Government money
				or property; and</text>
					</paragraph><paragraph id="H46FBAC7C71384828B28213C56F64804F"><enum>(4)</enum><text>the term
				<term>administrative beneficiary</term> means any entity, including any
				governmental or quasi-governmental entity, on whose behalf the United States
				Government, alone or with others, serves as custodian or trustee of money or
				property owned by that entity.</text>
					</paragraph></subsection><subsection id="HC8CD5C5B2C664F93A92D1C07E3134613"><enum>(c)</enum><header>Statutory cause
				of action</header><text>Liability under this section is a statutory cause of
				action all elements of which are set forth in this section. No proof of any
				additional element of common law fraud or other cause of action is implied or
				required for liability to exist for a violation of subsection (a).</text>
				</subsection><subsection id="HF410123D5701438DA397A6A27BDA08AD"><enum>(d)</enum><header>Exemption from
				disclosure</header><text>Any information that a person provides pursuant to
				subparagraphs (A) through (C) of subsection (a)(2) shall be exempt from
				disclosure under section 552 of title 5.</text>
				</subsection><subsection id="HF89513279518426FBEB04EE622BB8B41"><enum>(e)</enum><header>Exclusion</header><text>This
				section does not apply to claims, records, or statements made under the
				Internal Revenue Code of
				1986.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H2F343581401C4B7383EFFDB095F37D2D"><enum>3.</enum><header>Civil actions for
			 false claims</header>
			<subsection id="H363A06AD6E5644299969354457EAA746"><enum>(a)</enum><header>Actions by
			 private persons generally</header><text>Section 3730(b) of title 31, United
			 States Code, is amended—</text>
				<paragraph id="H635F101CA9E84DC3846E236B35C12C2C"><enum>(1)</enum><text>in paragraph (1),
			 by striking the last sentence and inserting the following: <quote>The action
			 may be dismissed only with the consent of the court and the Attorney
			 General.</quote>;</text>
				</paragraph><paragraph id="H9C2E2D07E2F04DC0BD774415907A7066"><enum>(2)</enum><text>in paragraph (2),
			 by inserting after the second sentence the following: <quote>In the absence of
			 a showing of extraordinary need, the written disclosure of any material
			 evidence and information, and any other attorney work product, that the person
			 bringing the action provides to the Government shall not be subject to
			 discovery.</quote>;</text>
				</paragraph><paragraph id="H8D1391ACB0CA44739A62E1B48F763F17"><enum>(3)</enum><text>in paragraph (4),
			 by striking subparagraph (B) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H80E5C550A7614F00877C7C0A53D87F30" style="OLC">
						<subparagraph id="HF2B1C8E26F0949FF9AA54F89E80E9C42" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">notify the court that it declines to take
				over the action, in which case the person bringing the action shall have the
				right to conduct the action, and, within 45 days after the Government provides
				such notice, shall either—</text>
							<clause id="H397491F36F1440BB81ADA4DA7B3E1F63"><enum>(i)</enum><text>move to dismiss the action without
				prejudice; or</text>
							</clause><clause id="HF4539B6C3E994A27A525464BD1C9E8A8"><enum>(ii)</enum><text>notify the court of the person’s
				intention to proceed with the action and move the court to unseal the
				complaint, and any amendments thereto, so as to permit service on the defendant
				and litigation of the action in a public forum.</text>
							</clause></subparagraph><quoted-block-continuation-text quoted-block-continuation-text-level="subsection">A person
				who elects to proceed with the action under subparagraph (B)(ii) shall serve
				the complaint within 120 days after the person’s complaint is unsealed under
				such subparagraph.</quoted-block-continuation-text><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H8DE6027E125B4774B38146D7A35157B8"><enum>(4)</enum><text>by amending
			 paragraph (5) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H835EAF74342341AFB5872BB972EFFF68" style="OLC">
						<paragraph id="HA42C913C55C94C099280977724E8DCC3" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">When a person brings an action under this
				subsection, no person other than the Government may join or intervene in the
				action, except with the consent of the person who brought the action. In
				addition, when a person brings an action that is pled in accordance with this
				subsection and section 3731(e), no other person may bring a separate action
				under this subsection based on the facts underlying a cause of action in the
				pending
				action.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HCB65CA88B8294A86BC70C7BAFED98F29"><enum>(b)</enum><header>Rights of the
			 parties to qui tam actions</header><text display-inline="yes-display-inline">Section 3730(c)(5) of title 31, United
			 States Code, is amended by striking the second sentence and inserting the
			 following:</text>
				<quoted-block display-inline="yes-display-inline" id="H646B77D775AE47CB93490C48C6F5DDFF" style="OLC">
					<text>An alternate remedy
			 includes—</text><subparagraph id="H93E0654280CC4B51972AA69563B184C9" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">anything of value received by the
				Government from the defendant, whether funds, credits, or in-kind goods or
				services, in exchange for an agreement by the Government either to release
				claims brought in, or to decline to intervene in or investigate, the action
				initiated under subsection (b); and</text>
					</subparagraph><subparagraph id="H6421F9F66A874FC283E106D3763C5C1F" indent="up1"><enum>(B)</enum><text>anything of value received by the
				Government based on the claims alleged by the person initiating the action, if
				that person subsequently prevails on the claims.</text>
					</subparagraph><quoted-block-continuation-text quoted-block-continuation-text-level="subsection">If any
				such alternate remedy is pursued in another proceeding, the person initiating
				the action shall have the same rights in such proceeding as such person would
				have had if the action had continued under this section, except that the person
				initiating the action may not obtain an award calculated on more than the total
				amount of damages, plus any fines or penalties, that could be recovered by the
				United States under section
				3729(a).</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB6DA8D314EF84BAFBA3726C16BD7D747"><enum>(c)</enum><header>Award to qui tam
			 plaintiff</header><text>Section 3730(d) of title 31, United States Code, is
			 amended—</text>
				<paragraph id="HD4C26E14EA8A46DF8C99DBA872089142"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="HE189819D46984D8EABF9607823838A76"><enum>(A)</enum><text>in the first
			 sentence, by inserting <quote>an award of </quote> after
			 <quote>receive</quote>;</text>
					</subparagraph><subparagraph id="HDE0EB93D1CD3469B849E527AC94D7CEE"><enum>(B)</enum><text>by striking the
			 second and third sentences and inserting the following: <quote>Any payment to a
			 person under this paragraph or under paragraph (2) or (3) shall be made from
			 the proceeds, and shall accrue interest, at the underpayment rate under section
			 6621 of the Internal Revenue Code of 1986, beginning 30 days after the date the
			 proceeds are paid to the United States, and continuing until payment is made to
			 the person by the United States.</quote>; and</text>
					</subparagraph><subparagraph id="H695CDBB5E8CB46E6BCF8E83C244978ED"><enum>(C)</enum><text>in the next to the
			 last sentence, by striking <quote>necessarily</quote>;</text>
					</subparagraph></paragraph><paragraph id="H461899572A4B41FE932BEB1F41FEEF22"><enum>(2)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="H6578B6BCE92E4D2F938EAF0CEC028D05"><enum>(A)</enum><text>in the second
			 sentence, by striking <quote>and shall be paid out of such proceeds</quote>;
			 and</text>
					</subparagraph><subparagraph id="H153091108AFA4602A6A4A4F120D7E312"><enum>(B)</enum><text>in the third
			 sentence, by striking <quote>necessarily</quote>; and</text>
					</subparagraph></paragraph><paragraph id="HDDEA1805CA984B39BA36ADC74D9CF6E2"><enum>(3)</enum><text>by amending
			 paragraph (3) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H1BC8CC721B99487B831C27B3059A983F" style="OLC">
						<paragraph id="H82FCA5AC6A964908B861368E691F5EA7" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HC40A2CE35C504A2C911D62DA99FCA63F"><enum>(A)</enum><text>Whether or not the
				Government proceeds with the action, if the court finds that the action was
				brought by a person who either—</text>
								<clause id="H4997F8BDCDBC419CAAB99AA6ED4EF65E" indent="up1"><enum>(i)</enum><text>planned and initiated the violation of
				section 3729 upon which the action was brought, or</text>
								</clause><clause id="H8957B13B2ABB4237A9908CB5ECFE3097" indent="up1"><enum>(ii)</enum><text>derived his or her knowledge of the
				action primarily from specific information relating to allegations or
				transactions (other than information provided by the person bringing the
				action) that the Government publicly disclosed, within the meaning of
				subsection (e)(4)(A), or that it disclosed privately to the person bringing the
				action in the course of its investigation into potential violations of section
				3729,</text>
								</clause></subparagraph><continuation-text continuation-text-level="paragraph">then the
				court may, to the extent the court considers appropriate, reduce the share of
				the proceeds of the action that the person would otherwise receive under
				paragraph (1) or (2) of this subsection, taking into account the role of that
				person in advancing the case to litigation and any relevant circumstances
				pertaining to the violation. The court shall direct the defendant to pay any
				such person an amount for reasonable expenses that the court finds to have been
				incurred, plus reasonable attorneys’ fees and costs.
				<editorial></editorial>
							</continuation-text><subparagraph id="HAF61DCC330B44BAD957CB3ED66B76778" indent="up1"><enum>(B)</enum><text>If the person bringing the action is
				convicted of criminal conduct arising from his or her role in the violation of
				section 3729, that person shall be dismissed from the civil action and shall
				not receive any share of the proceeds of the action. Such dismissal shall not
				prejudice the right of the United States to continue the action, represented by
				the Department of
				Justice.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H6FECC739428B4359AE4767A99E8BE456"><enum>(d)</enum><header>Certain actions
			 barred</header><text>Section 3730(e)(4) of title 31, United States Code, is
			 amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HAB4BA26D5C5E45DFB158802DBC448A51" style="OLC">
					<paragraph id="H6C27FEF3FA16411DA1632D8EA68B4ED5" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H176338DB9D4748F0ABBD345EE4DA46B8"><enum>(A)</enum><text>Upon timely motion of
				the Attorney General of the United States, a court shall dismiss an action or
				claim brought by a person under subsection (b) if the allegations relating to
				all essential elements of liability of the action or claim are based
				exclusively on the public disclosure of allegations or transactions in a
				Federal criminal, civil, or administrative hearing, in a congressional, Federal
				administrative, or Government Accountability Office report, hearing, audit, or
				investigation, or from the news media.</text>
						</subparagraph><subparagraph id="HED8B317EF6484512882F8877C5012928" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">For purposes of this paragraph, a
				<quote>public disclosure</quote> includes only disclosures that are made on the
				public record or have otherwise been disseminated broadly to the general
				public. An action or claim is <quote>based on</quote> a public disclosure only
				if the person bringing the action derived the person’s knowledge of all
				essential elements of liability of the action or claim alleged in the complaint
				from the public disclosure. The person bringing the action does not create a
				public disclosure by obtaining information from a request for information made
				under section 552 of title 5 or from exchanges of information with law
				enforcement and other Government employees if such information does not
				otherwise qualify as publicly disclosed under this
				paragraph.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2D02A6C3552440A7851BB64B26E46D1E"><enum>(e)</enum><header>Relief from
			 retaliatory actions</header><text display-inline="yes-display-inline">Section
			 3730(h) of title 31, United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H18C6C95AACBE4F92A0B41EC109AD4BA3" style="OLC">
					<subsection id="H25EFC35AED2D4C9F9FCE75F590617123"><enum>(h)</enum><header>Relief from
				retaliatory action</header><text display-inline="yes-display-inline">Any person
				who is discharged, demoted, suspended, threatened, harassed, or in any other
				manner discriminated against in the terms or conditions of employment, or is
				materially hindered in obtaining new employment or other business
				opportunities, by any other person because of lawful acts done by the person
				discriminated against or others associated with that person—</text>
						<paragraph id="HC4EFD00E034F43598A7EBBDC5CE4CDF1"><enum>(1)</enum><text>in furtherance of
				an actual or potential action under this section, including investigation for,
				initiation of, testimony for, or assistance in an action filed or to be filed
				under this section, or</text>
						</paragraph><paragraph id="HB4BAA8E12C734C63BAE1B83F9A822361"><enum>(2)</enum><text>in furtherance of
				other efforts to stop one or more violations of section 3729,</text>
						</paragraph><continuation-text continuation-text-level="subsection">shall be
				entitled to all relief, from the person who has engaged in the discrimination,
				that is necessary to make the person whole. Such relief shall include
				reinstatement with the same seniority status such person would have had but for
				the discrimination, 2 times the amount of back pay or business loss, interest
				on the back pay or business loss, and compensation for any special damages
				sustained as a result of the discrimination, including litigation costs and
				reasonable attorneys' fees. An action under this subsection may be brought in
				the appropriate district court of the United States for the relief provided in
				this
				subsection.</continuation-text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H563F3317FA844D1C851BF3B47C4C6FA3"><enum>(f)</enum><header>Relief to
			 administrative beneficiaries</header><text display-inline="yes-display-inline">Section 3730 of title 31, United States
			 Code, is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HFA489D571CB4497EB620C12AC13CA14B" style="OLC">
					<subsection id="HE5DA204E103B40AB8C7638D414D1F121"><enum>(i)</enum><header>Damages
				collected for financial losses suffered by administrative
				beneficiaries</header>
						<paragraph id="H5DA7641787AF46EB9E2786761ED8933A"><enum>(1)</enum><header>In
				general</header><text>After paying any awards due one or more persons who
				brought an action under subsection (b), the Government shall pay from the
				proceeds of the action to any administrative beneficiary, as defined in section
				3729(b), all amounts that the Government has collected in the action for
				financial losses suffered by such administrative beneficiary. Any remaining
				proceeds collected by the Government shall be treated in the same manner as
				proceeds collected by the Government for direct losses the Government suffers
				because of violations of section 3729.</text>
						</paragraph><paragraph id="H1BF09B845A224E12AC9B1248855A244D"><enum>(2)</enum><header>Alternative
				remedies</header><text>Nothing in section 3729 or this section precludes
				administrative beneficiaries from pursuing any alternate remedies available to
				them for losses or other harm suffered by them that are not pursued or
				recovered in an action under this section, except that if proceedings for such
				alternate remedies are initiated after a person has initiated an action under
				subsection (b), such person shall be entitled to have such alternative remedies
				considered in determining any award in the action under subsection (b) to the
				same extent that such person would be entitled under subsection (c)(5) with
				respect to any alternate remedy pursued by the
				Government.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H495754E9704C4EEB83CBE47026FF0CD5"><enum>4.</enum><header>False claims
			 procedure</header>
			<subsection id="H23C224C50037433E8F3B6BC079E1613D"><enum>(a)</enum><header>Statute of
			 limitations; intervention by the Government</header><text>Section 3731(b) of
			 title 31, United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H8AC1950B216F49B2A63386D99E0EE98A" style="OLC">
					<subsection id="H2D0FF4B92B4949549CB5FDB83CB064C0"><enum>(b)</enum><header>Statute of
				limitations; intervention by the Government</header>
						<paragraph id="H29451F8FEFBA42EB8AF728EDAB2B031A"><enum>(1)</enum><header>Statute of
				limitations</header><text>A civil action under section 3730 (a), (b), or (h)
				may not be brought more than 8 years after the date on which the violation of
				section 3729 or 3730(h) (as the case may be) is committed.</text>
						</paragraph><paragraph id="HF4CCFD2A6D6B4ED89133543F27748A91"><enum>(2)</enum><header>Intervention</header><text>If
				the Government elects to intervene and proceed with an action brought under
				section 3730(b), the Government may file its own complaint, or amend the
				complaint of the person who brought the action under section 3730(b), to
				clarify or add detail to the claims in which it is intervening and to add any
				additional claims with respect to which the Government contends it is entitled
				to relief. For purposes of paragraph (1), any such Government pleading shall
				relate back to the filing date of the complaint of the person who originally
				brought the action to the extent that the Government’s claim arises out of the
				conduct, transactions, or occurrences set forth, or attempted to be set forth,
				in the person’s prior
				complaint.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H4D68BCF15F284E209144B7B3EB5F1BDB"><enum>(b)</enum><header>Standard of
			 proof</header><text>Section 3731(c) of title 31, United States Code, is
			 amended—</text>
				<paragraph id="H18CB97051BCF4B4B956737B7B7967A85"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>(c) In</quote> and
			 inserting <quote>(c) <header-in-text level="subsection" style="OLC">Standard of
			 Proof</header-in-text>.—In</quote>; and</text>
				</paragraph><paragraph id="HF9D6952BB0934C1C9D43D3C601999C24"><enum>(2)</enum><text>by striking
			 <quote>United States</quote> and inserting <quote>plaintiff</quote>.</text>
				</paragraph></subsection><subsection id="H5624901D19474D1CBC8477A1DE5367BD"><enum>(c)</enum><header>Notice of
			 Claims; void contracts, agreements, and conditions of employment</header><text display-inline="yes-display-inline">Section 3731 of title 31, United States
			 Code, is amended by adding at the end the following new subsections:</text>
				<quoted-block display-inline="no-display-inline" id="H2463AA5D17F64808A12896158C53000F" style="OLC">
					<subsection id="H8D74005D1E2442B18EEEE6B8F90E5AE0"><enum>(e)</enum><header>Notice of
				claims</header><text display-inline="yes-display-inline">In pleading an action
				brought under section 3730(b), a person shall not be required to identify
				specific claims that result from an alleged course of misconduct if the facts
				alleged in the complaint, if ultimately proven true, would provide a reasonable
				indication that one or more violations of section 3729 are likely to have
				occurred, and if the allegations in the pleading provide adequate notice of the
				specific nature of the alleged misconduct to permit the Government effectively
				to investigate and defendants fairly to defend the allegations made.</text>
					</subsection><subsection id="H4E47C07FF2AB433480493D9FE597CA4C"><enum>(f)</enum><header>Void contract,
				agreements, and conditions of employment</header>
						<paragraph id="H1857E7CD6E7A490992DE035FD99266DC"><enum>(1)</enum><header>In
				general</header><text>Any contract, private agreement, or private term or
				condition of employment that has the purpose or effect of limiting or
				circumventing the rights of a person to take otherwise lawful steps to
				initiate, prosecute, or support an action under section 3730, or to limit or
				circumvent the rights or remedies provided to persons bringing actions under
				section 3730(b) and other cooperating persons under section 3729 shall be void
				to the full extent of such purpose or effect.</text>
						</paragraph><paragraph id="HB6305D9118914A33A2F285D42581C6F8"><enum>(2)</enum><header>Exception</header><text>Paragraph
				(1) shall not preclude a contract or private agreement that is entered
				into—</text>
							<subparagraph id="H98C547A7681145B5804844BEF67FD543"><enum>(A)</enum><text>with the United
				States and a person bringing an action under section 3730(b) who would be
				affected by such contract or agreement specifically to settle claims of the
				United States and the person under section 3730; or</text>
							</subparagraph><subparagraph id="HF1460C72FC714182B743EC42243C54FD"><enum>(B)</enum><text>specifically to
				settle any discrimination claim under section 3730(h) of a person affected by
				such contract or
				agreement.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H20740C06BD6B45E985F21883CD40BEDC"><enum>(d)</enum><header>Conforming
			 amendments</header><text>Section 3731 of title 31, United States Code, is
			 amended—</text>
				<paragraph id="H14C16478B0234BC898BAC61F5BEFCC93"><enum>(1)</enum><text>in subsection (a),
			 by striking <quote>(a) A subpena</quote> and inserting <quote>(a)
			 <header-in-text level="subsection" style="OLC">Service of
			 Subpoenas</header-in-text>.—A subpoena</quote>; and</text>
				</paragraph><paragraph id="H4147275B3EF145C198B02BA46144AE9D"><enum>(2)</enum><text>in subsection (d),
			 by striking <quote>(d) Notwithstanding</quote> and inserting <quote>(d)
			 <header-in-text level="subsection" style="OLC">Estoppel</header-in-text>.—Notwithstanding</quote>.</text>
				</paragraph></subsection></section><section id="H102A69DD72154D7590C7A5120BF73465"><enum>5.</enum><header>False claims
			 jurisdiction</header><text display-inline="no-display-inline">Section 3732 of
			 title 31, United States Code, is amended by adding at the end the following new
			 subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H1893CC7ADC214032A45E5B50A0871720" style="OLC">
				<subsection id="H22E54AA111EE404384E57199AF90EAD2"><enum>(c)</enum><header>Service on state
				or local authorities</header><text display-inline="yes-display-inline">With
				respect to any State or local government that is named as a co-plaintiff with
				the United States in an action brought under subsection (b), a seal on the
				action ordered by the court under section 3730(b) shall not preclude the
				Government or the person bringing the action from serving the complaint, any
				other pleadings, or the written disclosure of substantially all material
				evidence and information possessed by the person bringing the action on the law
				enforcement authorities that are authorized under the law of that State or
				local government to investigate and prosecute such actions on behalf of such
				governments.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H108733EE039F41D9B99187FCC2AF45E0"><enum>6.</enum><header>Civil
			 Investigative Demands</header>
			<subsection id="HF288670BE6214B1E9404F2C6388902F4"><enum>(a)</enum><header>Civil
			 investigative demands</header><text>Section 3733(a) of title 31, United States
			 Code, is amended—</text>
				<paragraph id="H89454DAB3F31476691911D020993AE46"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="H782C31B882694A53B41E42AEF0619FDA"><enum>(A)</enum><text>in the matter
			 following subparagraph (D)—</text>
						<clause display-inline="no-display-inline" id="H522221D76F24434DAA7EA704EC00493A"><enum>(i)</enum><text>by striking
			 <quote>The Attorney General may not delegate</quote> and all that follows
			 through <quote>subsection.</quote>; and</text>
						</clause><clause id="H18CD9345400342D484A3819D7549094F"><enum>(ii)</enum><text>by
			 striking <quote>, the Deputy Attorney General, or an Assistant Attorney

			 <quote>Any information obtained by the Attorney General under this section may
			 be shared with any a person bringing an action under section 3730(b) if the
			 Attorney General determines that it is necessary as part of any false claims
			 law investigation.</quote>; and</text>
					</subparagraph></paragraph><paragraph id="HD0E52A9ADA384D9E85FF837EF5C572CC"><enum>(2)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="HAE8AD5BD7F9C4FBE8BBC37E4FBEF4991"><enum>(A)</enum><text>in subparagraph
			 (F), by striking <quote>or an Assistant Attorney General designated by the
			 Attorney General</quote>; and</text>
					</subparagraph><subparagraph id="HB011A67547874567A6E3DE2BA0F92468"><enum>(B)</enum><text>in subparagraph
			 (G), by striking the second sentence.</text>
					</subparagraph></paragraph></subsection><subsection id="HCD3FAC6DD22C44ED983936838B777D0F"><enum>(b)</enum><header>Procedures</header>

			 3733(h)(6) of title 31, United States Code, is amended by striking <quote>, the

				</paragraph><paragraph id="H0BAF9931EA9641959467913AE22476D8"><enum>(2)</enum><header>Custodians</header><text>Section
			 3733(i)(3) of title 31, United States Code, is amended to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="H22A1529B1ED74000A24C30E212C82775" style="OLC">
						<paragraph id="H4885A8B345564A15AD0FD2EACF0B1C89"><enum></enum><header>(3) Use of
				material, answers, or transcripts in false claims actions and other
				proceedings</header><text>Whenever any attorney of the Department of Justice
				has been designated to handle any false claims law investigation or proceeding,
				or any other administrative, civil, or criminal investigation, case, or
				proceeding, the custodian of any documentary material, answers to
				interrogatories, or transcripts of oral testimony received under this section
				may deliver to such attorney such material, answers, or transcripts for
				official use in connection with any such investigation, case, or proceeding as
				such attorney determines to be required. Upon the completion of any such
				investigation, case, or proceeding, such attorney shall return to the custodian
				any such material, answers, or transcripts so delivered that have not passed
				into the control of a court, grand jury, or agency through introduction into
				the record of such case or
				proceeding.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H4D01129F3AC145B6A192EB251267FA43"><enum>(c)</enum><header>Definitions</header><text>Section
			 3733(l) of title 31, United States Code, is amended—</text>
				<paragraph id="H905CDA46860C46B9886AB971EF1709A9"><enum>(1)</enum><text>in paragraph (6),
			 by striking <quote>and</quote> after the semicolon;</text>
				</paragraph><paragraph id="HEEC88D79BBCA4DD2817B0C47A5E796A6"><enum>(2)</enum><text>in paragraph (7),
			 by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="H1AC6411109764BFE9BBAF64C34760557"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H275D9103427F4A3C8A11E0E5FD570807" style="OLC">
						<paragraph id="H1D7D91BA5F23484192F0DC7938E210F0"><enum>(8)</enum><text>the term
				<term>official use</term> means all lawful, reasonable uses in furtherance of
				an investigation, case, or proceeding, such as disclosures in connection with
				interviews of fact witnesses, settlement discussions, coordination of an
				investigation with a State Medicaid Fraud Control Unit or other government
				personnel, consultation with experts, and use in court pleadings and
				hearings.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H7DEAD79978704D79AFCD7C9D71C59EDD"><enum>(d)</enum><header>Delegation of
			 authority</header><text>Section 3733 of title 31, United States Code, is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H0BF2A373FB4E4DBEBAC463CA297B0451" style="OLC">
					<subsection id="HAF07C86C2D874430863FE1E8766644FF"><enum>(m)</enum><header>Delegation</header><text display-inline="yes-display-inline">The Attorney General may delegate any
				authority that the Attorney General has under this
				section.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HBD1D0B5DB28A434181125A5FD48C53DB"><enum>7.</enum><header>Effective
			 date</header>
			<subsection id="H6354191C108940B4927E61D567B1ADA3"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The amendments made
			 by this Act shall take effect on the date of the enactment of this Act and,
			 except as provided in subsection (b), shall apply to any case pending on, or
			 filed on or after, that date.</text>
			</subsection><subsection id="HE5C6EA8267FD442184C101DD5DC8CAAD"><enum>(b)</enum><header>Exceptions</header><text>The
			 following provisions of title 31, United States Code, as amended by this Act,
			 shall apply only to cases filed on or after the date of the enactment of this
			 Act:</text>
				<paragraph id="H4352CA4499174105811106B864EF10BF"><enum>(1)</enum><text display-inline="yes-display-inline">Section 3729(a)(1)(C)(i), relating to the
			 failure to comply with a statutory or contractual obligation to disclose an
			 overpayment.</text>
				</paragraph><paragraph id="H33098A6162F94BD3872E7627B95661C5"><enum>(2)</enum><text>Section 3730(h),
			 to the extent such section applies to discrimination against a person because
			 of lawful acts done by others associated with that person.</text>
				</paragraph><paragraph id="H1837877ECAF2422CB87B63193729948F"><enum>(3)</enum><text>Section
			 3731(b)(1).</text>
