<official-title>To amend the Internal Revenue Code of 1986 to encourage the purchase of residential property by providing an exclusion from tax on certain gains.</official-title>

<section id="H44DD5065C94E4973ACA7B969E321AB73" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Investment Property Opportunity Act of 2009</short-title></quote>. </text></section> 
<section id="HD43F302C3031445AB111BEAF6305375A"><enum>2.</enum><header>Exclusion of certain capital gains on residential property</header> 
<subsection id="H5BC51C14D398405A87ED9F163CF161E6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part III of subchapter B of chapter 1 of the Internal Revenue Code of 1986 is amended by inserting after section 139C the following new section:</text>

<section id="H205AD31319444128966ADAEC96F3813E"><enum>139D.</enum><header>Capital gains on certain residential property</header> 
<subsection id="H9F2362763D0C4C2CB0AC30C9AA13D8B9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Gross income shall not include gain from the sale of real property consisting predominantly of residential property if—</text> 
<paragraph id="H5B0B83F888784F9EBFBC5EA1CBA11250"><enum>(1)</enum><text>such property is located in a distressed housing area,</text></paragraph> 
<paragraph id="HF63341CF2DCC4EA3912F22167EA478F4"><enum>(2)</enum><text>such property is acquired by purchase (as defined in section 179(d)(2)) during the 18-month period beginning on the date of the enactment of this section, and</text></paragraph> 
<paragraph id="H53D9513FF0474563AC802AD05EA458AA"><enum>(3)</enum><text>such property is held for more than 3 years.</text></paragraph></subsection> 
<subsection id="H169F191BEF8B47CBB06122A1EB5B46F8"><enum>(b)</enum><header>Distressed housing area</header><text>For purposes of this section, the term <quote>distressed housing area</quote> means any county which is designated by the Secretary as having, with respect to residential housing located in such county—</text> 
<paragraph id="H992FFD21C14C47819261D5B64CAC54A5"><enum>(1)</enum><text>a mortgage foreclosure rate during 2008 which was 110 percent or more of the national average of such rate,</text></paragraph> 
<paragraph id="H4E902EA74D6E4BD8B6AF6B00B3466147"><enum>(2)</enum><text>a decline during 2008 in the average fair market value of such housing of at least 20 percent, or</text></paragraph> 
<paragraph id="H06508BB643BC4821B79EB838A0434A1D"><enum>(3)</enum><text>more than 50 percent of the loans which are secured by such housing as having a loan to value ratio of greater than 80 percent (determined as of the end of 2008).</text></paragraph></subsection> 
<subsection id="HB9F1C51095AA48CF93DB4047DDDF2219"><enum>(c)</enum><header>Exception for sales between related persons</header> 
<paragraph id="HA233CA992543468A9341B7AA4E04711D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subsection (a) shall not apply to any sale between related persons.</text></paragraph> 
<paragraph id="H8B379898DD684040935B6BE1E6081451"><enum>(2)</enum><header>Related persons</header><text>For purposes of this subsection, a person shall be treated as related to another person if the relationship between such persons would result in a disallowance of losses under section 267 or 707(b).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H30A83173F4004F269161D8DA0C56EF73"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for part III of subchapter B of chapter 1 of such Code is amended by inserting after the item relating to section 139C the following new item:</text>

<subsection id="H27D23A7CC692474384E796009EB97235"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to property purchased after the date of the enactment of this section.</text></subsection></section>
