<section id="H1E8F68EBC8F84DC38869F4FB200B1A3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Smart Planning for Smart Growth Act of 2009</short-title></quote>.</text></section> 
<section id="H3A86256D5B384A70B615E9EC24E3FE35"><enum>2.</enum><header>Greenhouse Gas Emissions Reductions through Transportation Efficiency</header><text display-inline="no-display-inline">Title I of the Clean Air Act is amended by inserting after section 179B (42 U.S.C. 7509a) the following:</text>

<section id="HEA5C4214652D41CE00C8F0A31C41C46B"><enum>179C.</enum><header>Greenhouse Gas Emissions Reductions through Transportation Efficiency</header> 
<subsection id="HC788D33E481544B5AF1BECC7B4FE751C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Each State shall—</text> 
<paragraph id="H151EFDEBF74A4DF2828DB886B640837D"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 3 years after the date of the enactment of this section, submit to the Administrator goals for transportation-related greenhouse gas emissions reductions; and</text></paragraph> 
<paragraph id="HEE1F93B1711D44B8B59C2F173432C0A5"><enum>(2)</enum><text display-inline="yes-display-inline">as part of each transportation plan or transportation improvement plan developed under title 23 or title 49, United States Code, ensure that a plan to achieve such goals, or an updated version of such a plan, is submitted to the Administrator and to the Secretary of Transportation (in this section referred to as the <quote>Secretary</quote>) by each metropolitan planning organization in the State for an area with a population exceeding 200,000.</text> </paragraph></subsection> 
<subsection id="H668DA176A8414C7A006CFDF328BBEBE2"><enum>(b)</enum><header>Models and methodologies</header> 
<paragraph id="HA53A058FF18E4D8F8B96FBEB007312AD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall promulgate regulations to establish standardized models and methodologies for use in developing goals, plans, and strategies under this section. Such regulations may approve or improve existing models and methodologies.</text></paragraph> 
<paragraph id="H0648C2FE11A346C9A9BE7E6C47F30069"><enum>(2)</enum><header>Timing</header><text>The Administrator shall—</text> 
<subparagraph id="H8910FAD96171489486724D5E43BA7BE8"><enum>(A)</enum><text>publish proposed regulations under paragraph (1) not later than 1 year after the date of the enactment of this section; and</text></subparagraph> 
<subparagraph id="H76E0DC9A56D8473CB09890006881CDAD"><enum>(B)</enum><text>promulgate final regulations under paragraph (1) not later than 2 years after such date of enactment.</text></subparagraph></paragraph></subsection> 
<subsection id="HB2651DCEAD534E42BB7D875E4BC7B8D"><enum>(c)</enum><header>Greenhouse gas reduction goals</header> 
<paragraph id="H32A4007E9D024ADC989C078F7DFDDC2E" display-inline="no-display-inline"><enum>(1)</enum><header>Consultation</header><text>Each State shall develop the goals referred to in subsection (a)(1)—</text> 
<subparagraph id="H6549D49FE1A9479BBE004B36AEDD1263"><enum>(A)</enum><text display-inline="yes-display-inline">in concurrence with State agencies responsible for air quality and transportation;</text></subparagraph> 
<subparagraph id="H78489482636749BCA5E2E37DEDCA6F3F"><enum>(B)</enum><text>in consultation with each metropolitan planning organization for an area in the State with a population exceeding 200,000 and applicable local air quality and transportation agencies; and</text></subparagraph> 
<subparagraph id="HBE2E5335A1CD4B428BDA95DE21B4F0CE"><enum>(C)</enum><text display-inline="yes-display-inline">with public involvement, including public comment periods and meetings.</text></subparagraph></paragraph> 
<paragraph id="HE839D501FEEB4CB4A507F4AD6BC9A424"><enum>(2)</enum><header>Period</header><text display-inline="yes-display-inline">The goals referred to in subsection (a)(1) shall be for 10- and 20-year periods.</text></paragraph> 
<paragraph id="H8A0A58DCC6B94050AB90AE8926451BCF" commented="no"><enum>(3)</enum><header>Targets; designated year</header><text display-inline="yes-display-inline">The goals referred to in subsection (a)(1) shall establish targets to reduce mobile source greenhouse gas emissions in the covered area from levels projected under a business-as-usual scenario. The targets shall be designed to ensure that the levels of such emissions stabilize and decrease after a designated year. The State shall consider designating 2010 as such designated year.</text></paragraph> 
<paragraph id="HEE1EFC90DDD14787A275E6802F4100D1"><enum>(4)</enum><header>Covered area</header><text display-inline="yes-display-inline">The goals referred to in subsection (a)(1) shall be established—</text> 
<subparagraph id="HFF095522E0A048C5B612C89F77577B67"><enum>(A)</enum><text>on a statewide basis; and</text></subparagraph> 
<subparagraph id="H10C01C2FAD324CCFA7B2792F1F72D08D"><enum>(B)</enum><text>for each metropolitan planning organization in the State for an area with a population exceeding 200,000.</text></subparagraph></paragraph>
<paragraph id="H2723BD1C3BC34741A899FDD7779B8A73"><enum>(5)</enum><header>Revised goals</header><text display-inline="yes-display-inline">Every 4 years, each State shall update and revise, as appropriate, the goals referred to in subsection (a)(1).</text></paragraph> </subsection> 
<subsection id="HEE734C4D36254A2AADC65C49BF054E16"><enum>(d)</enum><header>Planning</header><text>A plan referred to in subsection (a)(2) shall—</text> 
<paragraph id="H393819874FAC462992AF49A7F59C2900"><enum>(1)</enum><text>be based upon the models and methodologies established by the Administrator under subsection (b);</text></paragraph> 
<paragraph id="H1E0C7DC38D094AA7982088DBDC4D306C" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">address mobile sources, economic development, and scenario analysis; and</text></paragraph> 
<paragraph id="H4A7D75A4122B4FFC824BE2CA73183DE8" commented="no"><enum>(3)</enum><text>be developed—</text> 
<subparagraph id="H42015790EC4E48B1A456D2B727006DAB" commented="no"><enum>(A)</enum><text>with public involvement, including public comment periods and meetings;</text></subparagraph> 
<subparagraph id="H55C6F145608047060000B1A2FA54CEE4" commented="no"><enum>(B)</enum><text>with regional coordination, including with respect to—</text> 
<clause id="HF6DEF0ECBC4E47548358AAFFDAE75D77" commented="no"><enum>(i)</enum><text>metropolitan planning organizations;</text></clause> 
<clause id="H5DD33FE1298042A98F7EF68350AD65DD" commented="no"><enum>(ii)</enum><text>the localities comprising the metropolitan planning organization;</text></clause> 
<clause id="HA9DDDE07177D4446BE83A595ADC826AE" commented="no"><enum>(iii)</enum><text>the State in which the metropolitan planning organization is located; and</text></clause> 
<clause id="H193CA9DEBB084B46825B5528006D0084" commented="no"><enum>(iv)</enum><text>air quality and transportation agencies for the State and region involved; and</text></clause></subparagraph> 
<subparagraph id="HDF73351559F14CBDB9114F8807A06648" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">in consultation with the State and local housing, public health, economic development, land use, environment, and public transportation agencies.</text></subparagraph></paragraph></subsection> 
<subsection id="H44662756E2834FEB9655BB90427BD0BA" commented="no"><enum>(e)</enum><header>Strategies</header><text>In developing goals under subsection (a)(1) and a plan under subsection (a)(2), the State or metropolitan planning organization, as applicable, shall consider transportation and land use planning strategies to reduce greenhouse gas emissions, including the following:</text> 
<paragraph id="H62E88A67B56242A3B55BF9012D5040C8" commented="no"><enum>(1)</enum><text>Efforts to increase public transportation, including commuter rail service and ridership, by adding at a minimum—</text> 
<subparagraph id="H0B9A3F562A314B9DBC00DDC21E704B62" commented="no"><enum>(A)</enum><text>new public transportation systems, including new commuter rail systems;</text></subparagraph> 
<subparagraph id="H9FFE57EA54634F61A761F3386D4EFF24" commented="no"><enum>(B)</enum><text>employer-based subsidies; and</text></subparagraph> 
<subparagraph id="H66BA8710B0A249B3B36D558983FBDF87" commented="no"><enum>(C)</enum><text>cleaner locomotive technologies.</text></subparagraph></paragraph> 
<paragraph id="H686F33AB4B234D9C9EC8D8367A4358F" commented="no"><enum>(2)</enum><text>Updates to zoning and other land use regulations and plans to support development that—</text> 
<subparagraph id="HC55E16C5EAC3456BA5198E09816DE8C5" commented="no"><enum>(A)</enum><text>coordinates transportation and land use planning;</text></subparagraph> 
<subparagraph id="HFC75D614F5C4408A9C15442E1F4DF3EC" commented="no"><enum>(B)</enum><text>focuses future growth close to existing and planned job centers and public facilities;</text></subparagraph> 
<subparagraph id="H201C01B568134B4CBF05291FCD059B15" commented="no"><enum>(C)</enum><text>uses existing infrastructure;</text></subparagraph> 
<subparagraph id="H5A5F68A2D17346F3ADD145855864CBE" commented="no"><enum>(D)</enum><text>promotes walking, bicycling, and public transportation use; and</text></subparagraph> 
<subparagraph id="H336612D33F874D499BD9A5DCD0AF0000" commented="no"><enum>(E)</enum><text>mixes land uses such as housing, retail, and schools.</text></subparagraph></paragraph> 
<paragraph id="H25EFAA637E8B4FFF95F299B67EA521B5"><enum>(3)</enum><text display-inline="yes-display-inline">Implementation of a policy (referred to as a <quote>complete streets policy</quote>) that—</text> 
<subparagraph id="H14E478AD7D194F958F313B0620224037"><enum>(A)</enum><text>ensures adequate accommodation of all users of transportation systems, including pedestrians, bicyclists, public transportation users, motorists, children, the elderly, and individuals with disabilities; and</text></subparagraph> 
<subparagraph id="H1EF2A728A2A2474B947E8C3712005FAA"><enum>(B)</enum><text>adequately addresses the safety and convenience of all users of the transportation system.</text></subparagraph></paragraph> 
<paragraph id="H8ED28C50E3BA451AA300C4FB88E30874" commented="no"><enum>(4)</enum><text>Construction of bicycle and pedestrian infrastructure facilities.</text></paragraph> 
<paragraph id="HDC588FFF7AAC4914816182D726A186C3" commented="no"><enum>(5)</enum><text>Projects to promote telecommuting, flexible work schedules, or satellite work centers.</text></paragraph> 
<paragraph id="HF58CB999C9684B7880FC4E1B9BCC4000" commented="no"><enum>(6)</enum><text>Pricing measures such as congestion pricing.</text></paragraph> 
<paragraph id="H8DB0DC41AC0441B59664FE2379CCF620" commented="no"><enum>(7)</enum><text>Intermodal freight system strategies, including enhanced rail services, short sea shipping, and other strategies.</text></paragraph> 
<paragraph id="HC21E00EF98A84C57B8CB2741CA1382E" commented="no"><enum>(8)</enum><text>Parking policies.</text></paragraph> 
<paragraph id="HDC0F82329C1B4FA28F6E65563D551674" commented="no"><enum>(9)</enum><text>Travel demand management projects.</text></paragraph> 
<paragraph id="H0F2B2601201F4BE4823346A8E5D27E6D" commented="no"><enum>(10)</enum><text>Restriction of the use of certain roads, or lanes, by vehicles other than passenger buses and high-occupancy vehicles.</text></paragraph> 
<paragraph id="H74DCF3AF57694B33BF6032B5E272F8FE" commented="no"><enum>(11)</enum><text>Reduction of vehicle idling, including idling associated with freight management, construction, transportation, and commuter operations.</text></paragraph> 
<paragraph id="H540EC1849B0644A1832114CA3C69006E" commented="no"><enum>(12)</enum><text>Policies to encourage the use of retrofit technologies and early replacement of vehicles, engines and equipment to reduce greenhouse gas emissions from existing mobile sources.</text></paragraph> 
<paragraph id="H75A469E0EB27405B8C84A960FA62C928" commented="no"><enum>(13)</enum><text>Other projects that the Administrator finds reduce greenhouse gas emissions from mobile sources.</text></paragraph></subsection> 
<subsection id="H07B34721766949158BC6535D2D340055"><enum>(f)</enum><header>Public Availability</header><text>The Administrator shall publish, including by posting on the Environmental Protection Agency’s website—</text> 
<paragraph id="HFB23DD02B1FF4F0E874F9882F669453D"><enum>(1)</enum><text>the goals and plans submitted under subsection (a); and</text></paragraph> 
<paragraph id="HEC06EC36482D42C9868251FC81D46C39"><enum>(2)</enum><text>for each plan submitted under subsection (a)(2), an analysis of the anticipated effects of the plan on greenhouse gas emissions and oil consumption.</text></paragraph></subsection> 
<subsection id="HF567D0F9A39844FB0098EF79180004F5" commented="no"><enum>(g)</enum><header>Enforcement</header><text>If the Administrator finds that a State has failed to submit goals under subsection (a)(1), or to ensure the submission of a plan under subsection (a)(2), for any area in the State (irrespective of whether the area is a nonattainment area), the Administrator may impose a prohibition in accordance with section 179(b)(1) applicable to the area. The Administrator may not impose a prohibition under the preceding sentence, and no action may be brought by the Administrator or any other entity alleging a violation of this section, based on the content or adequacy of a goal or plan submitted under subsection (a)(1) or (a)(2).</text></subsection> 
<subsection id="HFA7192793AA44592BE1119C48E7CBCCD"><enum>(h)</enum><header>Competitive Grants</header> 
<paragraph id="HF4425C593C8D4982009595E9835759CE"><enum>(1)</enum><header>Grants</header><text>The Administrator, in consultation with the Secretary of Transportation, may award grants on a competitive basis to metropolitan planning organizations to develop or implement plans submitted under subsection (a)(2) or elements thereof.</text></paragraph> 
<paragraph id="HB9FA7A5523B64F01B958637500FAC356"><enum>(2)</enum><header>Priority</header><text>In making grants under paragraph (1), the Administrator shall give priority to applicants based upon—</text> 
<subparagraph id="H66319AB62059497DBD678FC554A05F82"><enum>(A)</enum><text>the amount of greenhouse gas emissions to be reduced on a total or per capita basis, as determined by the Administrator in consultation with the Secretary of Transportation; and</text></subparagraph> 
<subparagraph id="H91B79F349990403E84B6285842CFEB29"><enum>(B)</enum><text>such other factors as the Administrator determines appropriate.</text></subparagraph></paragraph> 
<paragraph id="HEB93AEC45EDB4F2FAAC09171A40740E0"><enum>(3)</enum><header>Authorization of appropriations</header><text>To carry out this subsection, there are authorized to be appropriated such sums as may be necessary.</text></paragraph></subsection> 
<subsection id="H277CDFFCA96846BF811B02EEA6DC2847"><enum>(i)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HFF3F420C34E745DFBCB44B1EDD51FEE7"><enum>(1)</enum><text>The term <term>metropolitan planning organization</term> means a metropolitan planning organization, as such term is used in section 176 of the Clean Air Act.</text></paragraph> 
<paragraph id="H42D8F8065F7942E4AF66C132F900008C"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>scenario analysis</term> means an analysis that is conducted by identifying different trends and making projections based on those trends to develop a range of scenarios and estimates of how each scenario could improve access to goods and services, including access to employment, education, and health care (especially for elderly and economically disadvantaged communities), and could affect rates of—</text> 
<subparagraph id="HDE7D510EC0394D94B02421D2464D0017"><enum>(A)</enum><text>vehicle miles traveled;</text></subparagraph> 
<subparagraph id="H3D1195E338974DFC0094EEC1E42373A3"><enum>(B)</enum><text>use of mobile source fuel by type, including electricity; and</text></subparagraph> 
<subparagraph id="H7EBE1015D03748ACAA674090655D31EF"><enum>(C)</enum><text>greenhouse gas emissions from the mobile source sector.</text></subparagraph></paragraph></subsection> 
<subsection id="H514E453A8AE54A7394FFB3D9A6981DE2"><enum>(j)</enum><header>Land use authority</header><text display-inline="yes-display-inline">Nothing in this section may be construed to—</text> 
<paragraph id="H38A3200FA9194BB9A80083A652858C49"><enum>(1)</enum><text>infringe upon the existing authority of State or local governments to plan or control land use, or</text></paragraph> 
<paragraph id="HB317D563E0C1410DB258004742EBFEE0"><enum>(2)</enum><text>provide or transfer authority over land use to any other entity.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
