		<section display-inline="no-display-inline" id="H93E0EFB10C0D4D06987DBA5F214B2316" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Dam Rehabilitation and Repair Act of
			 2009</short-title></quote>.</text>
		</section><section id="H942E1B9C72244CBBA5987384A057A138"><enum>2.</enum><header>Rehabilitation
			 and repair of deficient dams</header>
			<subsection id="H41D40730FC45444FA33C9C494AB068E2"><enum>(a)</enum><header>Definitions</header><text>Section
			 2 of the National Dam Safety Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/467">33 U.S.C. 467</external-xref>) is amended—</text>
				<paragraph id="H2C13498D11204960B6D687B33DBC3634"><enum>(1)</enum><text>by striking
			 paragraph (3);</text>
				</paragraph><paragraph id="H17CD0D492BAF47E19116A996ECFD82AE"><enum>(2)</enum><text>by redesignating
			 paragraphs (1) and (2) as paragraphs (2) and (3), respectively;</text>
				</paragraph><paragraph id="HB82DF1B1228A4DCA86C4975E8DAEE70E"><enum>(3)</enum><text>by inserting
			 before paragraph (2) (as redesignated by paragraph (2) of this subsection) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H2A67C29E68DB4501945FE1EE16CE754E" style="OLC">
						<paragraph id="H027E97DF53A844E79002B7E906229541"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <quote>Administrator</quote> means
				the Administrator of the Federal Emergency Management
				Agency.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HEE009AACC0A04782AC661489A79BC5B1"><enum>(4)</enum><text>by redesignating
			 paragraphs (4), (5), (6), (7), (8), (9), (10), (11), (12), and (13) as
			 paragraphs (5), (6), (7), (8), (9), (10), (13), (14), (15), and (16),
			 respectively;</text>
				</paragraph><paragraph id="H1487F224E9614367BC040A767323BAD6"><enum>(5)</enum><text>by inserting after
			 paragraph (3) (as redesignated by paragraph (2) of this subsection) the
			 following:</text>
					<quoted-block id="H6B88FB756ADF41F2938B91647B916903">
						<paragraph id="HE14C789BC7C64D6AB06BF9DBCDAC2E15"><enum>(4)</enum><header>Deficient
				dam</header><text>The term <term>deficient dam</term> means a dam that the
				State within the boundaries of which the dam is located determines—</text>
							<subparagraph id="H3860564152764675AB79A8CBC92C93FA"><enum>(A)</enum><text>fails to meet
				minimum dam safety standards of the State; and</text>
							</subparagraph><subparagraph id="H8D7410EDDB3A4266B5B6F86D9BA6B3B7"><enum>(B)</enum><text>poses an
				unacceptable risk to the public.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HB47C9C14EF004F04965C724C7D346197"><enum>(6)</enum><text>by inserting after
			 paragraph (10) (as redesignated by paragraph (4) of this subsection) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="H9A0F0C4712DD46E181423E2E31462845" style="OLC">
						<paragraph commented="no" id="HE6AEA180B2184746B2E95AB1A1566B75"><enum>(11)</enum><header>Publicly-owned
				dam</header>
							<subparagraph commented="no" id="HCCB44961833A4DE984187907BB39DE3F"><enum>(A)</enum><header>In
				general</header><text>The term <term>publicly-owned dam</term> means a dam that
				is owned by 1 or more State agencies or governments, local governments, or
				municipal governments.</text>
							</subparagraph><subparagraph commented="no" id="H6FB0964E570C40E985D0CD75A4880BF8"><enum>(B)</enum><header>Inclusions</header><text>The
				term <term>publicly-owned dam</term> includes a dam owned by a nonprofit
				organization that—</text>
								<clause commented="no" id="HEE5EF9B12CA441D784A2D4CBC24352F4"><enum>(i)</enum><text>is established by
				1 or more State, local, or municipal governments; and</text>
								</clause><clause commented="no" id="H4EC615EFA74B4A8586D7CBFA2639BDA3"><enum>(ii)</enum><text>provides public
				benefits, such as—</text>
									<subclause commented="no" id="HB276915FCC854055AE72D3CF0E864B46"><enum>(I)</enum><text>local flood
				control districts;</text>
									</subclause><subclause commented="no" id="HB3BA2864C560474685B2D28CA1DDAD81"><enum>(II)</enum><text>regional public
				water utilities; and</text>
									</subclause><subclause commented="no" id="H5079344FDD164ACEAA5F8BF463C7D0DB"><enum>(III)</enum><text>local irrigation
				districts.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="HC69364BB46B642908E8824836B86704B"><enum>(12)</enum><header>Rehabilitation</header><text>The
				term <term>rehabilitation</term> means the repair, replacement, reconstruction,
				or removal of a dam that is carried out to meet applicable State dam safety and
				security
				standards.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HDFD7A4FC713E4158A48796E9855CA4F6"><enum>(b)</enum><header>Program for
			 rehabilitation and repair of deficient dams</header><text>The National Dam
			 Safety Program Act is amended by inserting after section 8 (<external-xref legal-doc="usc" parsable-cite="usc/33/467f">33 U.S.C. 467f</external-xref>) the
			 following:</text>

					<section id="H69AFA39C0CA34B0391AC79405AB7C9DA"><enum>8A.</enum><header>Rehabilitation
				and repair of deficient dams</header>
						<subsection id="H1EEA913305424569890E1EF07E88031F"><enum>(a)</enum><header>Establishment of
				program</header><text>The Administrator shall establish, within FEMA, a program
				to provide grant assistance to States for use in rehabilitation of deficient
				dams that are publicly-owned dams.</text>
						</subsection><subsection id="HA4E447C10D4E47ED9C9D5D2A841A4159"><enum>(b)</enum><header>Award of
				grants</header>
							<paragraph id="HE5D62EE435324FB2B2E7FEFA95F941B6"><enum>(1)</enum><header>Application</header>
								<subparagraph id="H7ED22D7B3A1D4BBD99E244064C327FAF"><enum>(A)</enum><header>In
				general</header><text>A State interested in receiving a grant under this
				section may submit to the Administrator an application for the grant.</text>
								</subparagraph><subparagraph id="H63CB5B31279F4E5096743D770337E759"><enum>(B)</enum><header>Requirements</header><text>An
				application submitted to the Administrator under this section shall be
				submitted at such time, be in such form, and contain such information as the
				Administrator may prescribe by regulation.</text>
								</subparagraph></paragraph><paragraph id="H26F3897F9AF048749F6C8E94B9473E72"><enum>(2)</enum><header>Grant</header>
								<subparagraph id="H263163DF5D904F1AB3B8975C97F10229"><enum>(A)</enum><header>In
				general</header><text>The Administrator may make a grant in accordance with
				this section for rehabilitation of a deficient dam to a State that submits an
				application for the grant in accordance with the regulations prescribed by the
				Administrator.</text>
								</subparagraph><subparagraph id="HE94424C2C42142D0A3C42ED6DC8BD9B4"><enum>(B)</enum><header>Project grant
				agreement</header><text>The Administrator shall enter into a project grant
				agreement with the State to establish the terms of the grant and the project,
				including the amount of the grant.</text>
								</subparagraph></paragraph><paragraph id="H79730A2247AA4E00B6EBBE2957788EF1"><enum>(3)</enum><header>Applicability of
				requirements</header><text display-inline="yes-display-inline">The
				Administrator shall require a State receiving a grant under this section to
				comply with requirements applicable to contributions of Federal funds under
				section 611(j)(9) of the Robert T. Stafford Disaster Relief and Emergency
				Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5196">42
				U.S.C. 5196(j)(9)</external-xref>), as in effect on the date of enactment of
				this section, in carrying out a project funded using amounts from the
				grant.</text>
							</paragraph></subsection><subsection id="HB79CB19E1E5D46C8AF4264B9E9C8A80F"><enum>(c)</enum><header>Priority
				system</header><text>The Administrator, in consultation with the Board, shall
				develop a risk-based priority system for use in identifying deficient dams for
				which grants may be made under this section.</text>
						</subsection><subsection id="HFBEA1B6F92DA4D9B84ACF3CBECA0FCCE"><enum>(d)</enum><header>Allocation of
				funds</header><text>The total amount of funds appropriated pursuant to
				subsection (h)(1) for a fiscal year shall be allocated for making grants under
				this section to States applying for the grants for that fiscal year as
				follows:</text>
							<paragraph id="HA62BED1507EB4E3FB91048316D529A34"><enum>(1)</enum><text><fraction>1/3</fraction>
				divided equally among applying States.</text>
							</paragraph><paragraph id="HD6B9F65F567A435EA49E62636405284D"><enum>(2)</enum><text><fraction>2/3</fraction>
				divided among applying States based on the proportion that—</text>
								<subparagraph id="HE8813A946D51400882F56E682FCB2699"><enum>(A)</enum><text>the number of
				non-Federal publicly-owned dams that the Secretary of the Army identifies in
				the national inventory of dams maintained under section 6 as constituting a
				danger to human health and that are located within the boundaries of the State;
				bears to</text>
								</subparagraph><subparagraph id="H8C2A4B86520E4DCDABB23B7FB048BD0D"><enum>(B)</enum><text>the number of
				non-Federal publicly-owned dams that are so identified and that are located
				within the boundaries of all applying States.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" id="H94EEF24735EB448A87AB42379749AAF7"><enum>(e)</enum><header>Use of
				funds</header><text display-inline="yes-display-inline">None of the funds
				provided in the form of a grant or otherwise made available under this section
				shall be used—</text>
							<paragraph commented="no" id="H492BC71B7884401B9D2694C5E209860A"><enum>(1)</enum><text>to rehabilitate a
				Federal dam;</text>
							</paragraph><paragraph commented="no" id="H9FD7BF2D3BE1411F9E16AA374D14C3B8"><enum>(2)</enum><text>to perform routine
				operation or maintenance of a dam;</text>
							</paragraph><paragraph commented="no" id="H695C4FF96D9547079A5238915E461ACB"><enum>(3)</enum><text>to modify a dam to
				produce hydroelectric power;</text>
							</paragraph><paragraph commented="no" id="HFA41A04C79204AE996AE0A8F0DF876B0"><enum>(4)</enum><text>to increase water
				supply storage capacity; or</text>
							</paragraph><paragraph commented="no" id="HA94434F2EC8341269753795FB9CFDEA7"><enum>(5)</enum><text>to make any other
				modification to a dam that does not also improve the safety of the dam.</text>
							</paragraph></subsection><subsection id="H7FE2F17615784BE5BCF4B96FB6357C66"><enum>(f)</enum><header>Cost
				sharing</header><text>The Federal share of the cost of rehabilitation of a
				deficient dam for which a grant is made under this section may not exceed 65
				percent of the cost of the rehabilitation.</text>
						</subsection><subsection id="H430947E06A564A1C9A898DB39F5A4E35"><enum>(g)</enum><header>Contractual
				requirements</header>
							<paragraph id="HBF40D82976974D51B06A6209DFA1B818"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), as a condition on the receipt
				of a grant under this section, a State that receives the grant shall require
				that each contract and subcontract for program management, construction
				management, planning studies, feasibility studies, architectural services,
				preliminary engineering, design, engineering, surveying, mapping, and related
				services entered into using funds from the grant be awarded in the same manner
				as a contract for architectural and engineering services is awarded
				under—</text>
								<subparagraph id="HD29B318ED953496D8BC5ED90B87452F7"><enum>(A)</enum><text>chapter 11 of
				title 40, United States Code; or</text>
								</subparagraph><subparagraph id="H4EE9F08881F147A18AE0F7B41031A653"><enum>(B)</enum><text>an equivalent
				qualifications-based requirement prescribed by the State.</text>
								</subparagraph></paragraph><paragraph id="H626834CE98384482ACD467B83F446729"><enum>(2)</enum><header>No proprietary
				interest</header><text>A contract awarded in accordance with paragraph (1)
				shall not be considered to confer a proprietary interest upon the United
				States.</text>
							</paragraph></subsection><subsection id="HC2D894A7E4B04354879522C3D350CE23"><enum>(h)</enum><header>Authorization of
				appropriations</header>
							<paragraph id="HAE708941800D4B2E9884074547A5AD02"><enum>(1)</enum><header>In
				general</header><text>There are authorized to be appropriated to carry out this
				section—</text>
								<subparagraph id="H0361406358504F24817FE368427AF323"><enum>(A)</enum><text>$10,000,000 for
				fiscal year 2010;</text>
								</subparagraph><subparagraph id="HCE6CB97178384386B9DC6F742CF56E33"><enum>(B)</enum><text>$15,000,000 for
				fiscal year 2011;</text>
								</subparagraph><subparagraph id="H234C940A0D1F48678C912103559DC9D1"><enum>(C)</enum><text>$25,000,000 for
				fiscal year 2012;</text>
								</subparagraph><subparagraph id="H82C3B23A99F241DC96542E82A4E5CF41"><enum>(D)</enum><text>$50,000,000 for
				fiscal year 2013; and</text>
								</subparagraph><subparagraph id="HCB054F8C06F34D2C8686C4E8F20354E4"><enum>(E)</enum><text>$100,000,000 for
				fiscal year 2014.</text>
								</subparagraph></paragraph><paragraph id="H46296F0C038E4B6CAF1DDB6E57900AF8"><enum>(2)</enum><header>Staff</header><text>There
				is authorized to be appropriated to provide for the employment of such
				additional staff of FEMA as are necessary to carry out this section $400,000
				for each of fiscal years 2010 through 2014.</text>
							</paragraph><paragraph id="H60D2F4F0D5B6483285FDD18E479A6AE4"><enum>(3)</enum><header>Period of
				availability</header><text>Amounts made available under this section shall
				remain available until
				expended.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HE79F6E8ED8164C29AAE20FDEF8413E4F"><enum>3.</enum><header>Rulemaking</header>
			<subsection id="H85380FB2DBA34A7C938F68ED63B4CDC0"><enum>(a)</enum><header>Proposed
			 rulemaking</header><text>Not later than 90 days after the date of enactment of
			 this Act, the Administrator of the Federal Emergency Management Agency shall
			 issue a notice of proposed rulemaking regarding the amendments made by section
			 2 to the National Dam Safety Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/467">33 U.S.C. 467 et seq.</external-xref>).</text>
			</subsection><subsection id="H20DCDDC3506849D8907D5954F39D8BA0"><enum>(b)</enum><header>Final
			 rule</header><text>Not later than 120 days after the date of enactment of this
			 Act, the Administrator of the Federal Emergency Management Agency shall
			 promulgate a final rule regarding the amendments described in subsection
			 (a).</text>
