		<official-title>To require that amounts of assistance provided to
		  financial institutions under the Troubled Asset Relief Program of the Secretary
		  of the Treasury that are returned be used only for assistance for homeowners in
		  accordance with the Making Home Affordable Program of the
		  Secretary.</official-title>

		<section id="H69978ABC3CC54FF3AF0780EFA4CB5F38" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Helping Homeowners in Distressed
			 Communities Act of 2009</short-title></quote>.</text>
		</section><section id="H617AFD64905C4082887C5386C467F5E9"><enum>2.</enum><header>Limitation on use
			 of returned amounts</header><text display-inline="no-display-inline">Section
			 109 of the Emergency Economic Stabilization Act of 2008 is amended by adding at
			 the end the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H1BCCB9EF7D204F09915D34B7AD8CC5E4" style="OLC">
				<subsection id="HD6E865EF0D5D485983B33B5C3F27B226"><enum>(d)</enum><header>Use of returned
				amounts for homeowner assistance</header>
					<paragraph id="H75F62F8F153C4F3F836453A908C9DE2E"><enum>(1)</enum><header>Limitation on
				use</header><text display-inline="yes-display-inline">Notwithstanding any other
				provision of this title or any other law, the Secretary may not use any amounts
				of assistance provided under this title to or for any financial institution
				that, prior to any use of such amounts, are voluntarily returned to the
				Secretary, except that such amounts may be used, as provided under this title,
				to refinance and modify mortgages of homeowners in accordance with the Making
				Home Affordable Program established by the Secretary.</text>
					</paragraph><paragraph id="HFB1A95888B2246ABA36AEB53A724660E"><enum>(2)</enum><header>Allocation</header><text>Any
				returned amounts used in accordance with paragraph (1) shall be allocated for
				such use only for areas disproportionately affected by home mortgage
				foreclosures, as determined by the
				Secretary.</text>
