<official-title display="yes">To amend the Public Health Service Act to provide liability protections for volunteer practitioners at health centers under section 330 of such Act.</official-title>

<section id="HBAE844FA10D74D5AB4D6E4578AC2688C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Family Health Care Accessibility Act of 2010</short-title></quote>. </text></section> 
<section id="H152A162D46594C1689BDA5990164C79A" section-type="subsequent-section"><enum>2.</enum><header>Liability protections for health professional volunteers at community health centers</header><text display-inline="no-display-inline"> Section 224 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/233">42 U.S.C. 233</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H71A33CD83EB24E7A87A4DA9FB109E28E" display-inline="no-display-inline"> 
<subsection id="HD865681919F4453A9158DF30ED9D9AED"><enum>(q)</enum> 
<paragraph display-inline="yes-display-inline" id="H646982F579EC45E7A6E4D1E933DCFB92"><enum>(1)</enum><text>For purposes of this section, a health professional volunteer at an entity described in subsection (g)(4) shall, in providing a health professional service eligible for funding under section 330 to an individual, be deemed to be an employee of the Public Health Service for a calendar year that begins during a fiscal year for which a transfer was made under paragraph (4)(C). The preceding sentence is subject to the provisions of this subsection.</text></paragraph> 
<paragraph id="HC65A57D34CA24436821AE1597B53B363" indent="up1"><enum>(2)</enum><text>In providing a health service to an individual, a health care practitioner shall for purposes of this subsection be considered to be a health professional volunteer at an entity described in subsection (g)(4) if the following conditions are met:</text> 
<subparagraph id="H6C1B8E90662E465C9ED909C8CF2F561F"><enum>(A)</enum><text>The service is provided to the individual at the facilities of an entity described in subsection (g)(4), or through offsite programs or events carried out by the entity.</text></subparagraph> 
<subparagraph id="H844FC86E34F64B95AACA4279140ACA86"><enum>(B)</enum><text>The entity is sponsoring the health care practitioner pursuant to paragraph (3)(B).</text></subparagraph> 
<subparagraph id="H7BB9D84C8CD7462A92F09F7B7507A95F"><enum>(C)</enum><text display-inline="yes-display-inline">The health care practitioner does not receive any compensation for the service from the individual or from any third-party payer (including reimbursement under any insurance policy or health plan, or under any Federal or State health benefits program), except that the health care practitioner may receive repayment from the entity described in subsection (g)(4) for reasonable expenses incurred by the health care practitioner in the provision of the service to the individual. </text></subparagraph> 
<subparagraph id="H0AF28C235DB545B8B41EA04CDE362E01" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">Before the service is provided, the health care practitioner or the entity described in subsection (g)(4) posts a clear and conspicuous notice at the site where the service is provided of the extent to which the legal liability of the health care practitioner is limited pursuant to this subsection.</text></subparagraph> 
<subparagraph id="H263759FE7BA5408FB9A614626BC64741"><enum>(E)</enum><text>At the time the service is provided, the health care practitioner is licensed or certified in accordance with applicable law regarding the provision of the service.</text></subparagraph></paragraph> 
<paragraph id="HD0867BE4CB0E408B9A3F03C10E72187C" indent="up1"><enum>(3)</enum><text>Subsection (g) (other than paragraphs (3) and (5)) and subsections (h), (i), and (l) apply to a health care practitioner for purposes of this subsection to the same extent and in the same manner as such subsections apply to an officer, governing board member, employee, or contractor of an entity described in subsection (g)(4), subject to paragraph (4) and subject to the following:</text> 
<subparagraph id="H67F85BDEEDD54742833E7ABBDE76520F"><enum>(A)</enum><text>The first sentence of paragraph (1) applies in lieu of the first sentence of subsection (g)(1)(A).</text></subparagraph> 
<subparagraph id="H637EA49DBE7940D8AC0FB20EAF5DFD97"><enum>(B)</enum><text display-inline="yes-display-inline">With respect to an entity described in subsection (g)(4), a health care practitioner is not a health professional volunteer at such entity unless the entity sponsors the health care practitioner. For purposes of this subsection, the entity shall be considered to be sponsoring the health care practitioner if—</text> 
<clause id="HC294B1C8A7384200BDF53E75638AE74C"><enum>(i)</enum><text>with respect to the health care practitioner, the entity submits to the Secretary an application meeting the requirements of subsection (g)(1)(D); and</text></clause> 
<clause id="HE5DBADEB54C54E88BF611155C4F5D8CF"><enum>(ii)</enum><text>the Secretary, pursuant to subsection (g)(1)(E), determines that the health care practitioner is deemed to be an employee of the Public Health Service.</text></clause></subparagraph> 
<subparagraph id="HB228FE5350A24C238C2452D5BF367981"><enum>(C)</enum><text display-inline="yes-display-inline">In the case of a health care practitioner who is determined by the Secretary pursuant to subsection (g)(1)(E) to be a health professional volunteer at such entity, this subsection applies to the health care practitioner (with respect to services performed on behalf of the entity sponsoring the health care practitioner pursuant to subparagraph (B)) for any cause of action arising from an act or omission of the health care practitioner occurring on or after the date on which the Secretary makes such determination.</text></subparagraph> 
<subparagraph id="H84AED69AEAC547DFA4A9AE85E4E9AD90"><enum>(D)</enum><text display-inline="yes-display-inline">Subsection (g)(1)(F) applies to a health care practitioner for purposes of this subsection only to the extent that, in providing health services to an individual, each of the conditions specified in paragraph (2) is met.</text></subparagraph></paragraph> 
<paragraph id="HAF84B277BD09431483497CEC481B95C9" indent="up1"><enum>(4)</enum> 
<subparagraph id="H3FA2415F42EB4CA7A43073B0705FA300" display-inline="yes-display-inline" commented="no"><enum>(A)</enum><text>Amounts in the fund established under subsection (k)(2) shall be available for transfer under subparagraph (C) for purposes of carrying out this subsection.</text></subparagraph> 
<subparagraph id="H1492BF5B41014754B3889257D99D5C13" indent="up1" commented="no"><enum>(B)</enum><text>Not later May 1 of each fiscal year, the Attorney General, in consultation with the Secretary, shall submit to the Congress a report providing an estimate of the amount of claims (together with related fees and expenses of witnesses) that, by reason of the acts or omissions of health professional volunteers, will be paid pursuant to this section during the calendar year that begins in the following fiscal year. Subsection (k)(1)(B) applies to the estimate under the preceding sentence regarding health professional volunteers to the same extent and in the same manner as such subsection applies to the estimate under such subsection regarding officers, governing board members, employees, and contractors of entities described in subsection (g)(4).</text></subparagraph> 
<subparagraph id="H9521A902C9CA4CC4B2DBFDD495580214" indent="up1" commented="no"><enum>(C)</enum><text>Not later than December 31 of each fiscal year, the Secretary shall transfer from the fund under subsection (k)(2) to the appropriate accounts in the Treasury an amount equal to the estimate made under subparagraph (B) for the calendar year beginning in such fiscal year, subject to the extent of amounts in the fund.</text></subparagraph></paragraph> 
<paragraph id="H84FA07FE85F640078EE5B0342951501E" indent="up1"><enum>(5)</enum> 
<subparagraph display-inline="yes-display-inline" id="H90F4F68498974C40ABBAE392CEA46881" commented="no"><enum>(A)</enum><text>This subsection takes effect on October 1, 2011, except as provided in subparagraph (B).</text></subparagraph> 
<subparagraph id="HF50C1C351B7F48D79086BF7369289177" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Effective on the date of the enactment of this subsection—</text> 
<clause id="HF9FC3C316DB8423D93A6771A285001EC"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary may issue regulations for carrying out this subsection, and the Secretary may accept and consider applications submitted pursuant to paragraph (3)(B); and<pagebreak/></text></clause> 
<clause id="H955ABD515DD04B27B846DB77E8056BCD"><enum>(ii)</enum><text display-inline="yes-display-inline">reports under paragraph (4)(B) may be submitted to the Congress.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
