<section commented="no" display-inline="no-display-inline" id="H533E84C9C58240F391A8E9B7E78DE621" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sangre de Cristo National Heritage Area Act </short-title></quote>.</text> </section>
<section commented="no" display-inline="no-display-inline" id="H8475A22781A34F75AD147BC51A9358F" section-type="subsequent-section"><enum>2.</enum><header>Findings and purposes</header> 
<subsection commented="no" display-inline="no-display-inline" id="H5602CF9A24DE4F4D9DC659AEE4FFE087"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H1DA4FF1E5A334AAB81F0E340AD422DAF"><enum>(1)</enum><text display-inline="yes-display-inline">the exceptional culture, the rich natural resources, the variety of recreational opportunities, and the unparalleled history of the San Luis Valley are of national significance and are deserving of recognition, conservation, interpretation, and continuing use;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HD261831D72B74E1CBF31DE4DE7D8C1C2"><enum>(2)</enum><text display-inline="yes-display-inline">the people of the San Luis Valley have, for centuries, found ways to cultivate and preserve their cultural and natural heritage;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HAD06EBB059444001BD4E36D53F28B9A5"><enum>(3)</enum><text display-inline="yes-display-inline">the efforts of the peoples of Conejos, Costilla, and Alamosa Counties to form the Sangre de Cristo National Heritage Area reinforce this tradition of stewardship;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H1F5CFA9D616D48A2004FC2BAC03E11E9"><enum>(4)</enum><text display-inline="yes-display-inline">the Sangre de Cristo National Heritage Area contains historic structures and land that were central to the development of the West, including Mexican land grants, the narrow gauge railroad now known as the <quote>Cumbres and Toltec Scenic Railroad</quote>, and Fort Garland;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H4CBE4487CC2E4C6AB64161F32D761782"><enum>(5)</enum><text display-inline="yes-display-inline">the Sangre de Cristo National Heritage Area is a nationally significant cradle of Hispano culture;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H3AED943E1DC24BAE835CAAA98D8DADF2"><enum>(6)</enum><text display-inline="yes-display-inline">the language, art, architecture, religion, tradition, and folklore of Native Americans, early Spanish colonists, and Mexican settlers of the Southwest are alive and thriving in the area, as exemplified in that—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H05EF9FD9BAA44F6AA5FC1C17E648EE8"><enum>(A)</enum><text display-inline="yes-display-inline">17th century Spanish is still spoken by about 35 percent of the population of the Sangre de Cristo region;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H708ACCCD973E463697DEB2A41872C800"><enum>(B)</enum><text display-inline="yes-display-inline">the towns of San Luis and Antonito, which are among the oldest settlements in Colorado—</text> 
<clause commented="no" display-inline="no-display-inline" id="HA9F3FB5E391A4F8488897DF88B8E4BEC"><enum>(i)</enum><text display-inline="yes-display-inline">still contain moradas, placitas, historic churches, murals, the first mercantile of the region, the first water right, and La Vega; and</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="H1E40EF6A02EE488AAF98BFE0A92BCFB"><enum>(ii)</enum><text display-inline="yes-display-inline">regularly host festivals and religious celebrations, including the centuries old procession of Los Hermanos Penitentes; and</text> </clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H23505361849E47778241EFBD9205BC75"><enum>(C)</enum><text display-inline="yes-display-inline">the Sangre de Cristo National Heritage Area, inhabited for over 11,000 years by native peoples, including the Ute, Navajo, Apache, Tiwa, Tewa, Comanche, Kiowa, and Arapaho, remains central to native cultures and is home to—</text> 
<clause commented="no" display-inline="no-display-inline" id="H9E93B6B70BE14458BBB95F9C2153FCB9"><enum>(i)</enum><text display-inline="yes-display-inline">Mount Blanca, or Sisnaajini, a sacred mountain for the Navajo and other peoples that marks the eastern boundary of their world; and</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="H51EC812F0B6B42EFB96190EA8EA38BB"><enum>(ii)</enum><text display-inline="yes-display-inline">petroglyphs and pictographs along the Rio Grande, telling the stories and cosmologies of early inhabitants; and</text> </clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HC6DBE38AACEC4FDCA6BDB7D334A8FE38"><enum>(7)</enum><text display-inline="yes-display-inline">the Sangre de Cristo National Heritage Area, flanked by the San Juan and the Sangre de Cristo Mountains, lies in one of the largest alpine valleys in North America and is home to an unparalleled combination of natural resources that are protected by the good stewardship of private landowners and by State and Federal landholdings, including—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H1874343A5E0D49F98DA233863FF47845"><enum>(A)</enum><text display-inline="yes-display-inline">the Great Sand Dunes National Park and Preserve;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H0967833B1721486FBD24871DDB19E3E"><enum>(B)</enum><text display-inline="yes-display-inline">the Great Sand Dunes Wilderness Area;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H7BE05193F94E46A6A98B19BFB1AB255B"><enum>(C)</enum><text display-inline="yes-display-inline">the Baca National Wildlife Refuge, the Monte Vista National Wildlife Refuge, and the Alamosa National Wildlife Refuge;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H1E3E0B43E2604A6493FDF165DFEF83C2"><enum>(D)</enum><text display-inline="yes-display-inline">the Rio Grande National Forest;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H792EA42D39BA45AFA3C51EEDA2E1D15"><enum>(E)</enum><text display-inline="yes-display-inline">the Sangre de Cristo Wilderness and the San Juan Wilderness;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HDAAA49C9558C49BB9FD2C3778B3282EE"><enum>(F)</enum><text display-inline="yes-display-inline">the Blanca Wetlands Complex, the Blanca Special Recreation Management Area, and the Rio Grande Special Recreation Area;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H0BAC0D6F6001414D95A35CB1BAF885D2"><enum>(G)</enum><text display-inline="yes-display-inline">the San Luis Lakes State Park; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H75D50A0EF7AD4228BA1EF59DDC69CDCC"><enum>(H)</enum><text display-inline="yes-display-inline">15 State Wildlife Areas, consisting of—</text> 
<clause commented="no" display-inline="no-display-inline" id="H28AC10B1074C40B49E70DF3674000054"><enum>(i)</enum><text display-inline="yes-display-inline">the Higel State Wildlife Area;</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="H15FD280A3E3C451296B95EE973C23347"><enum>(ii)</enum><text display-inline="yes-display-inline">the Playa Blanca State Wildlife Area;</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="H590407F8D6314CAB8CD03DEFDDAB5F8F"><enum>(iii)</enum><text display-inline="yes-display-inline">the San Luis Lakes State Wildlife Area;</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="H5F990BD1FBC048EC978EBF931FAA9CE1"><enum>(iv)</enum><text display-inline="yes-display-inline">the Conejos County Ponds State Wildlife Area;</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="HDB0EFD4D5C7B47F3BDF265B5A84C1549"><enum>(v)</enum><text display-inline="yes-display-inline">the Conejos River State Wildlife Area;</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="HE7C4D7B6067642849B3EEB45F3303348"><enum>(vi)</enum><text display-inline="yes-display-inline">the Hot Creek State Wildlife Area;</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="H4536AC35A41743049C1B5374338B6D00"><enum>(vii)</enum><text display-inline="yes-display-inline">the La Jara Reservoir State Wildlife Area;</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="H29C99C249AC54171A395FBF765FC56D9"><enum>(viii)</enum><text display-inline="yes-display-inline">the La Jara State Wildlife Area;</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="HB735EA36EBD24E588E83C8CD0700F612"><enum>(ix)</enum><text display-inline="yes-display-inline">the Poso State Wildlife Area;</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="HD4E93FE143C547999D52E472ADC018"><enum>(x)</enum><text display-inline="yes-display-inline">the Sego Springs State Wildlife Area;</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="H30951C77626948D6B71C84D9F6403CE0"><enum>(xi)</enum><text display-inline="yes-display-inline">the Terrace Reservoir State Wildlife Area;</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="H77AD0BF078234FB894D9D32EC2E2155E"><enum>(xii)</enum><text display-inline="yes-display-inline">the Trujillo Meadows State Wildlife Area;</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="H2ADE6430F13A4F7288EF006C2998A87F"><enum>(xiii)</enum><text display-inline="yes-display-inline">the Mountain Home Reservoir State Wildlife Area;</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="HB5B7342A178D40F4A7BAD65FEF9300B"><enum>(xiv)</enum><text display-inline="yes-display-inline">the Sanchez Reservoir State Wildlife Area; and</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="H0225AA67D2E5450E9C3E002BB5DA9838"><enum>(xv)</enum><text display-inline="yes-display-inline">the Smith Reservoir State Wildlife Area.</text> </clause></subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H0C4A55A1E18F4CEABD38F8AB8706A024"><enum>(b)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purpose of this Act is to establish the Heritage Area—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H88097D9F8E124DC6B38F50B281397416"><enum>(1)</enum><text display-inline="yes-display-inline">to carry out the national heritage area alternative as described in the document entitled <quote>Sangre de Cristo National Heritage Area Feasibility Study, 2005</quote>, dated November, 2005;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H721451730AD54C0EB56BEAF49C2A0F5"><enum>(2)</enum><text display-inline="yes-display-inline">to provide a management framework to foster a close working relationship with all levels of government, the private sector, and the local communities in the San Luis Valley to—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H780C64F09D0F492BBB63183522385937"><enum>(A)</enum><text display-inline="yes-display-inline">conserve the heritage of the region; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H131159043082454D80D36BE3A03595AF"><enum>(B)</enum><text display-inline="yes-display-inline">continue to pursue compatible economic opportunities; and</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H5ADF7AF86372406BA2C6CB19948284A7"><enum>(3)</enum><text display-inline="yes-display-inline">to assist communities, organizations, and citizens in the State of Colorado in identifying, preserving, interpreting, and developing the historical, cultural, scenic, and natural resources of the region for the educational and inspirational benefit of current and future generations.</text> </paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="HCF03F8389BE4473A859B7E3339EFF83B" section-type="subsequent-section"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H4A418171835C4A28A720F7E445515B09"><enum>(1)</enum><header>Heritage area</header><text display-inline="yes-display-inline">The term <quote>Heritage Area</quote> means the Sangre de Cristo National Heritage Area, established in section 4(a).</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H3EC072EC62B845DEA5D553911FDF2729"><enum>(2)</enum><header>Management entity</header><text display-inline="yes-display-inline">The term <quote>Management Entity</quote> means the management entity for the Heritage Area designated by section 4(d).</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HD29CB1DE72C9484193ED3E00FE9600AE"><enum>(3)</enum><header>Management plan</header><text display-inline="yes-display-inline">The term <quote>Management Plan</quote> means the management plan for the Heritage Area required section 6.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HFB04A17F4A2C4C0884AEDC3FF6F700FC"><enum>(4)</enum><header>Map</header><text display-inline="yes-display-inline">The term <quote>map</quote> means the map entitled <quote>Proposed Sangre De Cristo National Heritage Area</quote> and dated November 2005.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H3A48584F4D784BF9BA4F33CA03AAD3F8"><enum>(5)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the Secretary of the Interior.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H2D36AC1165BF4DDF928259A952A6F996"><enum>(6)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means the State of Colorado.</text> </paragraph></section>
<section commented="no" display-inline="no-display-inline" id="H8389B81C10934B5FAAD8CDF14E87BA85" section-type="subsequent-section"><enum>4.</enum><header>Sangre de cristo national heritage area</header> 
<subsection commented="no" display-inline="no-display-inline" id="HCA2FDEE8A78749DA92503D0006F157D8"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the State the Sangre de Cristo National Heritage Area.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="H6299CEC8B2544BE2823E6335F9BC10AB"><enum>(b)</enum><header>Boundaries</header><text display-inline="yes-display-inline">The Heritage Area shall consist of—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H6A2DEC69D5DC4871B34B2460E211104C"><enum>(1)</enum><text display-inline="yes-display-inline">the counties of Alamosa, Conejos, and Costilla; and</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H6D0D6D9E79A24DEEBEB9259BC11EFA61"><enum>(2)</enum><text display-inline="yes-display-inline">the Monte Vista National Wildlife Refuge, the Baca National Wildlife Refuge, the Great Sand Dunes National Park and Preserve, and other areas included in the map.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HF862DE64DD6345B3AF7594C7C59C7686"><enum>(c)</enum><header>Map</header><text display-inline="yes-display-inline">A map of the Heritage Area shall be—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H9EB98FC6E68A482BA3D99D049C8595DD"><enum>(1)</enum><text display-inline="yes-display-inline">included in the management plan; and</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H6E160820691342C3B900602400BF9382"><enum>(2)</enum><text display-inline="yes-display-inline">on file and available for public inspection in the appropriate offices of the National Park Service.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H42275CE60E714A4AAC6E6875E1810611"><enum>(d)</enum><header>Management entity</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H7593993960CF4314BC478737AD464EAC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The management entity for the Heritage Area shall be the Sangre de Cristo National Heritage Area Board of Directors.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H0AB6C8CB33CB485DB7E4DE19F3305565"><enum>(2)</enum><header>Membership requirements</header><text display-inline="yes-display-inline">Members of the Board shall include representatives from a broad cross-section of the individuals, agencies, organizations, and governments that were involved in the planning and development of the Heritage Area before the date of enactment of this Act.</text> </paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="HF888E6E0F9AD4C769B90CF173A584E9" section-type="subsequent-section"><enum>5.</enum><header>Administration</header> 
<subsection commented="no" display-inline="no-display-inline" id="H32A1FBDE2DD24550B7B300172F6752D3"><enum>(a)</enum><header>Authorities</header><text display-inline="yes-display-inline">For purposes of carrying out the management plan, the Secretary, acting through the management entity, may use amounts made available under this Act to—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H9ECAA75E71F64AF5957D6EBDB8CCC837"><enum>(1)</enum><text display-inline="yes-display-inline">make grants to the State or a political subdivision of the State, nonprofit organizations, and other persons;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H709BC85A3046499FA5F051E9AC052FB6"><enum>(2)</enum><text display-inline="yes-display-inline">enter into cooperative agreements with, or provide technical assistance to, the State or a political subdivision of the State, nonprofit organizations, and other interested parties;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HD5505AF42FF84B33BCEB03FAC276E32"><enum>(3)</enum><text display-inline="yes-display-inline">hire and compensate staff, which shall include individuals with expertise in natural, cultural, and historical resources protection, and heritage programming;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H552EB857C0914FA080C945EAF55294FF"><enum>(4)</enum><text display-inline="yes-display-inline">obtain money or services from any source including any that are provided under any other Federal law or program;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H9B4678EF827449D19200BCC9F2DFD4C"><enum>(5)</enum><text display-inline="yes-display-inline">contract for goods or services; and</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H954178855DFE4ECE9B571D8EC16251C5"><enum>(6)</enum><text display-inline="yes-display-inline">undertake to be a catalyst for any other activity that furthers the Heritage Area and is consistent with the approved management plan.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H7837C68F214440BBBD0043413F2B7DAD"><enum>(b)</enum><header>Duties</header><text display-inline="yes-display-inline">The management entity shall—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H26C1E2A81FA444638E27298F56696940"><enum>(1)</enum><text display-inline="yes-display-inline">in accordance with section 6, prepare and submit a management plan for the Heritage Area to the Secretary;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H646B3C7D6B854A3EB782C8B0D0003571"><enum>(2)</enum><text display-inline="yes-display-inline">assist units of local government, regional planning organizations, and nonprofit organizations in carrying out the approved management plan by—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HFBAAC3058BB54CD3AA0082AE10AD6DE3"><enum>(A)</enum><text display-inline="yes-display-inline">carrying out programs and projects that recognize, protect, and enhance important resource values in the Heritage Area;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H96CCD06F0E594CD8BE4E35C32E5E3716"><enum>(B)</enum><text display-inline="yes-display-inline">establishing and maintaining interpretive exhibits and programs in the Heritage Area;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H79CD035F76394FA5BA42064BDAED0400"><enum>(C)</enum><text display-inline="yes-display-inline">developing recreational and educational opportunities in the Heritage Area;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H8EAD9B4F56214D088F82C4BBA7CE91F2"><enum>(D)</enum><text display-inline="yes-display-inline">increasing public awareness of, and appreciation for, natural, historical, scenic, and cultural resources of the Heritage Area;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H282821298A5A48399F5C778B7B607027"><enum>(E)</enum><text display-inline="yes-display-inline">protecting and restoring historic sites and buildings in the Heritage Area that are consistent with Heritage Area themes;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H831EEBAB26C648EAA654C900A0D068E5"><enum>(F)</enum><text display-inline="yes-display-inline">ensuring that clear, consistent, and appropriate signs identifying points of public access, and sites of interest are posted throughout the Heritage Area; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HB055331A472D4D4B9989A1F99E1D6BBB"><enum>(G)</enum><text display-inline="yes-display-inline">promoting a wide range of partnerships among governments, organizations, and individuals to further the Heritage Area;</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H9E1666F3AEF34CAC9073ABC000D6E163"><enum>(3)</enum><text display-inline="yes-display-inline">consider the interests of diverse units of government, businesses, organizations, and individuals in the Heritage Area in the preparation and implementation of the management plan;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H9E17437D0FA044E599E16795D5E3CE39"><enum>(4)</enum><text display-inline="yes-display-inline">conduct meetings open to the public at least semiannually regarding the development and implementation of the management plan;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HBFB5B9FDC6FB4E96A58449D75D39053E"><enum>(5)</enum><text display-inline="yes-display-inline">for any year that Federal funds have been received under this Act—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HFB0417C511B640FEBBE3BC2F417CCCA"><enum>(A)</enum><text display-inline="yes-display-inline">submit an annual report to the Secretary that describes the activities, expenses, and income of the management entity (including grants to any other entities during the year that the report is made);</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HD351F3E1A7C44C4C95AB24841CD1F48"><enum>(B)</enum><text display-inline="yes-display-inline">make available to the Secretary for audit all records relating to the expenditure of the funds and any matching funds; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HA63C3E3B741842A6A97700EA5E1EC9A8"><enum>(C)</enum><text display-inline="yes-display-inline">require, with respect to all agreements authorizing expenditure of Federal funds by other organizations, that the organizations receiving the funds make available to the Secretary for audit all records concerning the expenditure of the funds; and</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H7A13D95B55B34CFFB9ADAA1CBEFCB4AF"><enum>(6)</enum><text display-inline="yes-display-inline">encourage by appropriate means economic viability that is consistent with the Heritage Area.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HBC612148B5174D0CB0F9A75B099BBDA8"><enum>(c)</enum><header>Prohibition on the Acquisition of Real Property</header><text display-inline="yes-display-inline">The management entity shall not use Federal funds made available under this Act to acquire real property or any interest in real property.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="HDF50BA02D7A34D8F9062EF144164C878"><enum>(d)</enum><header>Cost-sharing requirement</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H5D65B3B0F0AD42ADB7EDFCD8FD9B1427"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), the Federal share of the cost of any activity carried out using any assistance made available under this Act shall be 50 percent.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H26096A09645241CBB20723783C5896C"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">During the period before the management entity completes the management plan under section 6, the Federal share of the cost of any activity described in paragraph 1 may be 100 percent.</text> </paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="H2733B3A6896E420A9425B179B86DA230" section-type="subsequent-section"><enum>6.</enum><header>Management plan</header> 
<subsection commented="no" display-inline="no-display-inline" id="H70BC71E90BFA4EEEA069DA9E38003B00"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this Act, the management entity shall submit to the Secretary for approval a proposed management plan for the Heritage Area.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="H679FD8431B7147449EDCFF3E095E009E"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">The management plan shall—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H4B2554F0C7B14ED0BE92043B5B89FD84"><enum>(1)</enum><text display-inline="yes-display-inline">incorporate an integrated and cooperative approach for the protection, enhancement, and interpretation of the natural, cultural, historic, scenic, and recreational resources of the Heritage Area;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H24621F982C824CC1871EF87FB5E6CD16"><enum>(2)</enum><text display-inline="yes-display-inline">take into consideration State and local plans;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H730DB36851AC4DD6B8796B6594C067B4"><enum>(3)</enum><text display-inline="yes-display-inline">include—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HB8E524AE3C6544989600CFF3A3299C00"><enum>(A)</enum><text display-inline="yes-display-inline">an inventory of—</text> 
<clause commented="no" display-inline="no-display-inline" id="H25363AE0980E4E3A9275E2DF4ADA5A0"><enum>(i)</enum><text display-inline="yes-display-inline">the resources located in the core area described in section 4(b); and</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="H2E4399AC27C84019AA7667A433355B7B"><enum>(ii)</enum><text display-inline="yes-display-inline">any other property in the core area that—</text> 
<subclause commented="no" display-inline="no-display-inline" id="H94C9559AA5954A5C91F145216CCECF27"><enum>(I)</enum><text display-inline="yes-display-inline">is related to the themes of the Heritage Area; and</text> </subclause>
<subclause commented="no" display-inline="no-display-inline" id="H75DA714EA4AD47608C05476807C69C29"><enum>(II)</enum><text display-inline="yes-display-inline">should be preserved, restored, managed, or maintained because of the significance of the property;</text> </subclause></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HAC9523A3A7954824A8911911611B85F2"><enum>(B)</enum><text display-inline="yes-display-inline">comprehensive policies, strategies and recommendations for conservation, funding, management, and development of the Heritage Area;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HE826C088BA8D470BB6FC7C9ED829FEA"><enum>(C)</enum><text display-inline="yes-display-inline">a description of actions that governments, private organizations, and individuals have agreed to take to protect the natural, historical and cultural resources of the Heritage Area;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H710C13D183454E239DB481E6F87782D0"><enum>(D)</enum><text display-inline="yes-display-inline">a program of implementation for the management plan by the management entity that includes a description of—</text> 
<clause commented="no" display-inline="no-display-inline" id="HB3A0F64C1FF64EA3A6DE5571CA6E5576"><enum>(i)</enum><text display-inline="yes-display-inline">actions to facilitate ongoing collaboration among partners to—</text> 
<subclause commented="no" display-inline="no-display-inline" id="HB0D69A84F4444CACAEFC75A3515B41A5"><enum>(I)</enum><text display-inline="yes-display-inline">promote plans for resource protection, restoration, and construction; and</text> </subclause>
<subclause commented="no" display-inline="no-display-inline" id="HA7EFAEA041C241F89EE9A222588706FB"><enum>(II)</enum><text display-inline="yes-display-inline">specific commitments for implementation that have been made by the management entity or any government, organization, or individual for the first 5 years of operation;</text> </subclause></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H047A5C63A5CC4DAB83F203D5237E1409"><enum>(E)</enum><text display-inline="yes-display-inline">the identification of sources of funding for carrying out the management plan;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HAE82447B9B934AC786EAF0F83900E7D3"><enum>(F)</enum><text display-inline="yes-display-inline">analysis and recommendations for means by which local, State, and Federal programs, including the role of the National Park Service in the Heritage Area, may best be coordinated to carry out this Act; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H4999622C84324C269C00683E909501CD"><enum>(G)</enum><text display-inline="yes-display-inline">an interpretive plan for the Heritage Area; and</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H4ED68A17B11F421B8C1CD4E7FD5B9FDD"><enum>(4)</enum><text display-inline="yes-display-inline">recommend policies and strategies for resource management that consider and detail the application of appropriate land and water management techniques, including the development of intergovernmental and interagency cooperative agreements to protect the natural, historical, cultural, educational, scenic, and recreational resources of the Heritage Area.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HAADFC02EA9B94030B3259EF7F900B8F"><enum>(c)</enum><header>Deadline</header><text display-inline="yes-display-inline">If a proposed management plan is not submitted to the Secretary by the date that is 3 years after the date of enactment of this Act, the management entity shall be ineligible to receive additional funding under this Act until the date that the Secretary receives and approves the management plan.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="HCC9360757F8A4AD7BD3EBF6B7F26B32B"><enum>(d)</enum><header>Approval or disapproval of management plan</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H89152A25F8CA4DB9858E22CE5CA085FB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of receipt of the management plan under subsection (a), the Secretary, in consultation with the State, shall approve or disapprove the management plan.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H7AE291175AA74FE500DA00ED39FB9D43"><enum>(2)</enum><header>Criteria for approval</header><text display-inline="yes-display-inline">In determining whether to approve the management plan, the Secretary shall consider whether—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H2686F11C01F84473B7C78F7614B82173"><enum>(A)</enum><text display-inline="yes-display-inline">the management entity is representative of the diverse interests of the Heritage Area, including governments, natural and historic resource protection organizations, educational institutions, businesses, and recreational organizations;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HEAC3EDE23B964BF384BD00622F4E9300"><enum>(B)</enum><text display-inline="yes-display-inline">the management entity has afforded adequate opportunity, including public hearings, for public and governmental involvement in the preparation of the management plan; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H035D770D6A6041D69D558F00459046FF"><enum>(C)</enum><text display-inline="yes-display-inline">the resource protection and interpretation strategies contained in the management plan, if implemented, would adequately protect the natural, historical, and cultural resources of the Heritage Area.</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H8659A75B1D704A61A0B38B9DA571B17C"><enum>(3)</enum><header>Action following disapproval</header><text display-inline="yes-display-inline">If the Secretary disapproves the management plan under paragraph (1), the Secretary shall—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H38C87121DA1A4282A6F5C2ADCE9F3105"><enum>(A)</enum><text display-inline="yes-display-inline">advise the management entity in writing of the reasons for the disapproval;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H69B7B445025B4F309D1476CC7985D129"><enum>(B)</enum><text display-inline="yes-display-inline">make recommendations for revisions to the management plan; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H764E9EBE2F5948B98C8109F7B277C703"><enum>(C)</enum><text display-inline="yes-display-inline">not later than 60 days after the receipt of any proposed revision of the management plan from the management entity, approve or disapprove the proposed revision.</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H3625BE05B18444B5B7AA3B202B6245F3"><enum>(4)</enum><header>Amendments</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="H8BA83C8249AC411893DFBB232B00695F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall approve or disapprove each amendment to the management plan that the Secretary determines make a substantial change to the management plan.</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HA236B8F641E04959B495AFA44BA2E309"><enum>(B)</enum><header>Use of funds</header><text display-inline="yes-display-inline">The management entity shall not use Federal funds authorized by this Act to carry out any amendments to the management plan until the Secretary has approved the amendments.</text> </subparagraph></paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="H40F7B7358DA7475B8603191B522FEC4C" section-type="subsequent-section"><enum>7.</enum><header>Duties of other federal agencies</header><text display-inline="no-display-inline">Any Federal agency conducting or supporting an activity that directly affects the Heritage Area shall—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H7811F4AFC81442DAA19CA256D9D43661"><enum>(1)</enum><text display-inline="yes-display-inline">consult with the Secretary and the management entity regarding the activity;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H065B4B663920473687877508C20030F"><enum>(2)</enum><text display-inline="yes-display-inline">cooperate with the Secretary and the management entity in carrying out the duties of the Federal agency under this Act;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H47D029E5692449FB842724A54FB99CA7"><enum>(3)</enum><text display-inline="yes-display-inline">to the maximum extent practicable, coordinate the activity with carrying out those duties; and</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H7791ED1D185C465BA07E88003DA8AEF6"><enum>(4)</enum><text display-inline="yes-display-inline">to the maximum extent practicable, conduct the activity in a manner that the management entity determines will not have an adverse effect on the Heritage Area.</text> </paragraph></section>
<section commented="no" display-inline="no-display-inline" id="HB40CF0FA1B8A4C8997F0B1BDBAA8F3C" section-type="subsequent-section"><enum>8.</enum><header>Private property protection</header> 
<subsection commented="no" display-inline="no-display-inline" id="HD4956C5DA20A4C3CB807FCE93E9D4D4D"><enum>(a)</enum><header>Access to private property</header><text display-inline="yes-display-inline">Nothing in this Act—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H2945558F492B45B9854374CEC354175E"><enum>(1)</enum><text display-inline="yes-display-inline">requires any private property owner to allow public access (including Federal, State, or local government access) to the private property; or</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H8679542C4EAE414B9D287DB7EF1793AD"><enum>(2)</enum><text display-inline="yes-display-inline">modifies any provision of Federal, State, or local law with regard to public access to or use of private property.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HC53D3B0349E64BA7AB98F881EF8857D7"><enum>(b)</enum><header>Liability</header><text display-inline="yes-display-inline">Designation of the Heritage Area shall not impose any liability on, or to have any effect on any liability under any other law on, any private property owner with respect to any person injured on the private property.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="H31AF5AEA0EB74D4989A06D6F6663782C"><enum>(c)</enum><header>Recognition of authority To control land use</header><text display-inline="yes-display-inline">Nothing in this Act modifies the authority of the Federal Government or State or local governments to regulate land use.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="HE957A1AA26CB44EFA6511D9494C1FA0"><enum>(d)</enum><header>Participation of private property owners in heritage area</header><text display-inline="yes-display-inline">Nothing in this Act requires the owner of any private property located within the boundaries of the Heritage Area to participate in or be associated with the Heritage Area.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="HF17741D4BCDD4275B8B7C208341919FE"><enum>(e)</enum><header>Effect of establishment</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H832222E47F0147DFAFF027F4D7556500"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The boundaries designated for the Heritage Area shall constitute the area within which Federal funds made available to carry out this Act may be expended.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H1A7EC994CF764FEA84C369296CFF823E"><enum>(2)</enum><header>Regulatory authority</header><text display-inline="yes-display-inline">The establishment of the Heritage Area and the boundaries of the Heritage Area shall not provide any regulatory authority that would not otherwise apply to govern land use within the Heritage Area or the viewshed of the Heritage Area by the Secretary, the National Park Service, or the management entity.</text> </paragraph></subsection></section>
<section id="H7929101A2F054961B7486200E6F7D2E"><enum>9.</enum><header>Water rights</header> 
<subsection id="H4271C6A65907437E93223B666571B4D4"><enum>(a)</enum><header>Statement of policy</header><text>Nothing in this Act is meant to modify the Rio Grande Natural Area Act.</text> </subsection>
<subsection id="H79D547F5828C420D9FB354EE1BB6F76"><enum>(b)</enum><header>Applicability</header><text>Nothing in this Act—</text> 
<paragraph id="H389B0243DFE6453F00E0086B1D998484"><enum>(1)</enum><text>amends, modifies, or is in conflict with the Act of May 31, 1939 (53 Stat. 785, chapter 155);</text> </paragraph>
<paragraph id="HE9B373CAE5CF41079026CD31CE167D1B"><enum>(2)</enum><text>authorizes the regulation of private land in the Heritage Area;</text> </paragraph>
<paragraph id="H9231F2ED64324709ADAA628FB3F24E65"><enum>(3)</enum><text>authorizes the imposition of any mandatory streamflow requirements;</text> </paragraph>
<paragraph id="HE2861E45986A4951000042145C68461D"><enum>(4)</enum><text>creates an express or implied Federal reserved water right;</text> </paragraph>
<paragraph id="H150A5DC8D38642289ED811EB4D4553D2"><enum>(5)</enum><text>imposes any Federal water quality standard within or upstream of the Heritage Area that is more restrictive than would be applicable had the Heritage Area not been established; or</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HD187A895BEEB4A53A36B2751BFBC83C8"><enum>(6)</enum><text>prevents the State of Colorado from acquiring an instream flow through the Heritage Area under the terms, conditions, and limitations of State law to assist in protecting the natural environment to the extent and for the purposes authorized by State law.</text> </paragraph></subsection></section>
<section commented="no" display-inline="no-display-inline" id="H13E9B6F53B1D4CEE84C1AF9D004277AC" section-type="subsequent-section"><enum>10.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out this Act $10,000,000, of which not more than $1,000,000 may be made available for any fiscal year.</text> </section>
<section commented="no" display-inline="no-display-inline" id="HF6ECF29402B2473BBAA811A6B3DA25AA" section-type="subsequent-section"><enum>11.</enum><header>Termination of authority</header><text display-inline="no-display-inline">The authority of the Secretary to provide assistance under this Act terminates on the date that is 15 years after the date that funds are first made available to carry out this Act.</text> </section>
