		<official-title>To amend the National Voter Registration Act of 1993 and
		  the Help America Vote Act of 2002 to promote the use of the Internet by State
		  and local election officials in carrying out voter registration activities, and
		  for other purposes.</official-title>

		<section id="H1213ED49148F4A8EB329DC5DC2B01CC0" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Voter Registration Modernization Act of
			 2009</short-title></quote>.</text>
		</section><section id="H464D9C27F32E4AE88C8DEBDF7418B5B8"><enum>2.</enum><header>Requiring
			 Availability of Internet for Voter Registration</header>
			<subsection id="HF980990E49AF4C729DBBA89A9F6EBCCA"><enum>(a)</enum><header>Requiring
			 Availability of Internet for Registration</header><text display-inline="yes-display-inline">The National Voter Registration Act of 1993
			 (42 U.S.C. 1973gg et seq.) is amended by inserting after section 7 the
			 following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H0E3AB9E076C34F6FB07117B9EB01D2B3" style="OLC">
					<section id="HEBD2B8996A254262AD58DA6E11545BCD"><enum>7A.</enum><header>Internet
				Registration</header>
						<subsection id="HAE788DF40D634FE2A694A60292AB5788"><enum>(a)</enum><header>Requiring
				Availability of Internet for Online Registration</header><text display-inline="yes-display-inline">Each State shall ensure that the following
				services are available to the public on the official public website of the
				appropriate election officials in the State:</text>
							<paragraph id="HCD0E1468F0EA40528875F7158F07D9D0"><enum>(1)</enum><text>Online access to,
				and distribution in electronic form of, mail voter registration application
				forms in accordance with paragraph (6).</text>
							</paragraph><paragraph id="HDE8218124D0E405B9400F727D858B5F3"><enum>(2)</enum><text>Online assistance
				to applicants in completing voter registration application forms.</text>
							</paragraph><paragraph id="H28390B787FC947BEB8E2B1CBC2FB29FA"><enum>(3)</enum><text>Online completion
				and submission by applicants of online versions of voter registration
				application forms.</text>
							</paragraph><paragraph id="H3A3C0D03A38F4B5FA8D409CDB447DBA1"><enum>(4)</enum><text>Online acceptance
				of completed voter registration application forms.</text>
							</paragraph></subsection><subsection id="H86DE24F83DE740CDA734BDF12AA366F1"><enum>(b)</enum><header>Provision of
				Services in Nonpartisan Manner</header><text>The services made available under
				subsection (a) shall be provided in a manner that ensures that—</text>
							<paragraph id="H90B322FF4B354EC1B9DF88E128983376"><enum>(1)</enum><text>no person shall
				seek to influence an applicant’s political preference or party
				registration;</text>
							</paragraph><paragraph id="H1C94059A314748FD9FF2D2E24C04ACC2"><enum>(2)</enum><text>there is no
				display on the website of any political preference or party allegiance;
				and</text>
							</paragraph><paragraph id="H67738E952A154F92A4D2ED9284DEB38C"><enum>(3)</enum><text>there is no
				statement or any other feature on the website the purpose or effect of which is
				to discourage the applicant from registering to vote.</text>
							</paragraph></subsection><subsection id="HD8B8F9A2585E4F83B0AA56920DA47C70"><enum>(c)</enum><header>Protection of
				Security of Information</header><text>In meeting the requirements of this
				section, the State shall establish appropriate technological security measures
				to prevent unauthorized access to information provided by individuals using the
				services made available under subsection (a).</text>
						</subsection><subsection id="H8BC8CD44028341D2A3847C5657FDD9F5"><enum>(d)</enum><header>Effective
				Date</header><text>The requirements of this section shall apply with respect to
				elections for Federal office occurring in 2016 and each succeeding
				year.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB526494E4FC5484392847C2B030C2AE2"><enum>(b)</enum><header>Conforming
			 Amendments</header>
				<paragraph id="HB01937DE154042A1A43E5057DD572258"><enum>(1)</enum><header>Timing of
			 registration</header><text>Section 8(a)(1) of such Act (42 U.S.C.
			 1973gg–6(a)(1)) is amended—</text>
					<subparagraph id="HAFBB1D5589F64F4F872E5E780C4AFC89"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (C);</text>
					</subparagraph><subparagraph id="H9A6ED0557C3A4D9D89D5733B31F2A349"><enum>(B)</enum><text>by redesignating
			 subparagraph (D) as subparagraph (E); and</text>
					</subparagraph><subparagraph id="H6FDFF331650C4074B9B40D36BBED8B12"><enum>(C)</enum><text>by inserting after
			 subparagraph (C) the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="H7C4196D3ACDA4134B45498982A47E453" style="OLC">
							<subparagraph id="H485C7C88604B4A688322AF51EEFED248"><enum>(D)</enum><text display-inline="yes-display-inline">in the case of online registration through
				the official public website of an election official under section 7A, if the
				valid voter registration form is submitted online not later than the lesser of
				15 days, or the period provided by State law, before the date of the election;
				and</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H5150C2AA589545F0885BC590DC1E18D8"><enum>(2)</enum><header>Informing
			 applicants of eligibility requirements and penalties</header><text>Section
			 8(a)(5) of such Act (42 U.S.C. 1973gg–6(a)(5)) is amended by striking
			 <quote>and 7</quote> and inserting <quote>7, and 7A</quote>.</text>
				</paragraph></subsection></section><section id="H1079D024672E40BD83D3996D604D8F95"><enum>3.</enum><header>Use of Internet
			 to Update Registration Information</header>
			<subsection id="HE936B38D007A49CFBE2216C4E642EF8F"><enum>(a)</enum><header>Updates to
			 Information Contained on Computerized Statewide Voter Registration
			 List</header>
				<paragraph id="HB7BDC52725724F63A3F79E7B49237FE0"><enum>(1)</enum><header>In
			 general</header><text>Section 303(a) of the Help America Vote Act of 2002 (42
			 U.S.C. 15483(a)) is amended by adding at the end the following new
			 paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H8CA68EEB8F7C4965AD4AAE8210F4269B" style="OLC">
						<paragraph id="HADA837713F0D432E9E58BD1C6C90CAA7"><enum>(6)</enum><header>Use of Internet
				by registered voters to update information</header>
							<subparagraph id="HA3DA7478662741E48F8C213A0215EC7B"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The appropriate State
				or local election official shall ensure that any legally registered voter to
				whom a unique identifier has been assigned under the computerized list may
				update the voter’s registration information, including the voter’s address and
				electronic mail address, online through the official public website of the
				election official responsible for the maintenance of the list, at any time as
				well as at any location at which under State law the voter may update the
				information in person.</text>
							</subparagraph><subparagraph id="HDAB3FEDD459F4D5DA0B04D5B35D0B80C"><enum>(B)</enum><header>Processing of
				updated information by election officials</header><text>If a registered voter
				updates registration information under subparagraph (A), the appropriate State
				or local election official shall—</text>
								<clause id="HFD916F27FA8F493A95D7A77B6BF424EA"><enum>(i)</enum><text>revise any
				information on the computerized list to reflect the update made by the voter;
				and</text>
								</clause><clause id="H8AEDA88145BF4DF2861A3A3F3691A7F8"><enum>(ii)</enum><text>if requested by
				the voter, confirm the receipt of the update by electronic mail sent to the
				voter.</text>
								</clause></subparagraph><subparagraph id="H1E72C1D538B74946AF885BD94555FA07"><enum>(C)</enum><header>Prevention of
				unauthorized revisions and fraud</header><text>In meeting the requirements of
				this paragraph, the appropriate State or local election official shall
				establish appropriate technological security measures to prevent unauthorized
				persons from updating a registered voter’s registration information and to
				prevent the entry of fraudulent data.</text>
							</subparagraph><subparagraph id="H2C156B0D30A14CA1848FBDE5CA229FF0"><enum>(D)</enum><header>Effective
				date</header><text>This paragraph shall take effect on January 1,
				2012.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H4DE9D496D92F4AE29509DFEC82D99CB2"><enum>(2)</enum><header>Conforming
			 amendment relating to effective date</header><text>Section 303(d)(1)(A) of such
			 Act (42 U.S.C. 15483(d)(1)(A)) is amended by striking <quote>subparagraph
			 (B)</quote> and inserting <quote>subparagraph (B) and subsection
			 (a)(6)</quote>.</text>
				</paragraph></subsection><subsection id="H73F23E01B6004A7191C62587D8742AAE"><enum>(b)</enum><header>Effect on Voter
			 Removal Program Under National Voter Registration Act of 1993</header>
				<paragraph id="H2F46922D3B594B2E96C3C23D0E99C6AA"><enum>(1)</enum><header>Use of online
			 update to confirm change of residence</header><text display-inline="yes-display-inline">Section 8(d)(1)(A) of the National Voter
			 Registration Act of 1993 (42 U.S.C. 1973gg–6(d)(1)(A)) is amended by inserting
			 after <quote>in writing</quote> the following: <quote>or by updating
			 information on the computerized Statewide voter registration list using the
			 online method provided under section 303(a)(6) of the Help America Vote Act of
			 2002</quote>.</text>
				</paragraph><paragraph id="HECF19949D2DD45498451DE31239E3D62"><enum>(2)</enum><header>Prohibiting
			 removal of registered voters included on computerized list for failure to vote
			 or appear to vote</header><text>Section 8 of such Act (42 U.S.C. 1973gg–6) is
			 amended—</text>
					<subparagraph id="HFE0960346C784A379BD61B9B7921061C"><enum>(A)</enum><text>in subsection
			 (b)(2), by inserting after <quote>eligible voters</quote> the following:
			 <quote>(other than an individual to whom a unique identifier has been assigned
			 under the computerized Statewide voter registration list under section 303(a)
			 of the Help America Vote Act of 2002)</quote>; and</text>
					</subparagraph><subparagraph id="H5B4344F77B644BE792228B4786274082"><enum>(B)</enum><text>in subsection
			 (d)(1)(B)(i), by striking <quote>has failed</quote> and inserting the
			 following: <quote>in the case of a registrant to whom a unique identifier has
			 not been assigned under the computerized Statewide voter registration list
			 under section 303(a) of the Help America Vote Act of 2002, has
			 failed</quote>.</text>
					</subparagraph></paragraph><paragraph id="H11822321C0624846991E6306A3E73E0E"><enum>(3)</enum><header>Conforming
			 amendment relating to procedures to ensure ability to vote following failure to
			 notify registrar of change of address</header><text>Section 8(e) of such Act
			 (42 U.S.C. 1973gg–6(e)) is amended in the heading by striking
			 <quote><header-in-text level="subsection" style="OLC">Failure to Return
			 Card</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Failure to Notify Registrar of Change of
			 Address</header-in-text></quote>.</text>
				</paragraph><paragraph id="H841FDC2868DF482C8406D72CDBF48336"><enum>(4)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this subsection shall take effect on January 1, 2012.</text>
				</paragraph></subsection></section><section id="H970163A0E9BF46F29BF3701439DED852"><enum>4.</enum><header>Provision of
			 Election Information by Electronic Mail to Individuals Registered to
			 Voter</header>
			<subsection id="H1F90FC0F97D24F19A25880ECA6934296"><enum>(a)</enum><header>Including Option
			 on Voter Registration Form To Provide E–Mail Address and Receive
			 Information</header>
				<paragraph id="H265DC6CD29F54D19980EF29E684D1333"><enum>(1)</enum><header>In
			 general</header><text>Section 9(b) of the National Voter Registration Act of
			 1993 (42 U.S.C. 1973gg–7(b)) is amended—</text>
					<subparagraph id="HFB01BCE7987840E08E74BD4DC8314450"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (3);</text>
					</subparagraph><subparagraph id="H98B9B601A672457ABE53E82106828F19"><enum>(B)</enum><text>by striking the
			 period at the end of paragraph (4) and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="H9D2DBAC95B664130991564085F14CD5F"><enum>(C)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="HD8B7D2674E01415EBE54DC452F05BD1C" style="OLC">
							<paragraph id="H20C8294E77DE49278F34F94086F15AD1"><enum>(5)</enum><text display-inline="yes-display-inline">shall include a space for the applicant to
				provide an electronic mail address, together with a statement that, unless the
				applicant requests otherwise, the applicant shall (if eligible to register to
				vote) receive voter registration and voting information from the appropriate
				State or local election official through electronic mail sent to that
				address.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HC30A2CB432FC4AA09FA87EA56AF95F4B"><enum>(2)</enum><header>Effective
			 date</header><text>The amendments made by paragraph (1) shall take effect
			 January 1, 2012.</text>
				</paragraph></subsection><subsection id="HC914F4AB80F74A798611862073DE7E26"><enum>(b)</enum><header>Requiring
			 Provision of Information by Election Officials</header><text display-inline="yes-display-inline">Section 302(b) of the Help America Vote Act
			 of 2002 (42 U.S.C. 15482(b)) is amended by adding at the end the following new
			 paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H088BC92C0B324F00A4B392D6C484C2BC" style="OLC">
					<paragraph id="H50151FD820FA4E28B13379C047E747EC"><enum>(3)</enum><header>Provision of
				other information by electronic mail</header><text display-inline="yes-display-inline">If an individual who is a registered voter
				has provided the State or local election official with an electronic mail
				address for the purpose of receiving voter registration and voting information
				(as described in section 9(b)(5) of the National Voter Registration Act of
				1993), the appropriate State or local election official shall provide the
				individual with the following information through electronic mail not later
				than 7 days before the date of the election involved:</text>
						<subparagraph id="HED46590D8C0D44A59480E652E174B2EE"><enum>(A)</enum><text>The name and
				address of the polling place at which the individual is assigned to vote in the
				election.</text>
						</subparagraph><subparagraph id="H807ACD6C8DE841DD97D12C8216C79D5A"><enum>(B)</enum><text>The hours of
				operation for the polling place.</text>
						</subparagraph><subparagraph id="H934A614A3C8E4B3D81C87EC95832A59B"><enum>(C)</enum><text>A description of
				any identification or other information the individual may be required to bring
				to the polling
				place.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HB40B86C149E94358A5DFF9FCF6386A94"><enum>5.</enum><header>Clarification of
			 Requirement to Register Applicants Providing Necessary Information to Show
			 Eligibility to Vote</header><text display-inline="no-display-inline">Section 8
			 of the National Voter Registration Act of 1993 (42 U.S.C. 1973gg–6) is amended
			 by adding at the end the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H25F32FA22712403A8BE1DF79FD8D625B" style="OLC">
				<subsection id="H4A7517F64564478AAD78D8082D4349A8"><enum>(k)</enum><header>Requirement for
				State To Register Applicants Providing Necessary Information To Show
				Eligibility To Vote</header><text display-inline="yes-display-inline">For
				purposes meeting the requirement of subsection (a)(1) that an eligible
				applicant is registered to vote in an election for Federal office within the
				deadlines required under such subsection, the State shall consider an applicant
				to have provided a <quote>valid voter registration form</quote> if the
				applicant has provided the appropriate State or local election official with
				all of the information necessary to demonstrate that the applicant is eligible
				to vote in elections for Federal office in the State or local jurisdiction
				involved.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HBE44BB5E62EC45CA89BE3167F677FF03"><enum>6.</enum><header>Availability of
			 Requirements Payments Under HAVA to Cover Costs of Compliance With New NVRA
			 Requirements</header>
			<subsection id="HB0E45150A29C4BE3B0B6CC4461C63E22"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">Section 251(b) of the
			 Help America Vote Act of 2002 (42 U.S.C. 15401(b)) is amended—</text>
				<paragraph id="H66571DD736544305A91F4C78537FBBEF"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>paragraph (2)</quote> and inserting <quote>paragraphs (2)
			 and (3)</quote>;</text>
				</paragraph><paragraph id="H166244C4BCFD40439800FF87F82C6EE1"><enum>(2)</enum><text>by redesignating
			 paragraph (2) as paragraph (3); and</text>
				</paragraph><paragraph id="H718649B39B8046ECAD377E7C4F3EC080"><enum>(3)</enum><text>by inserting after
			 paragraph (2) the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HF0B08B95D73E4748A2EE125EBD4FF1B3" style="OLC">
						<paragraph id="HA7D0AA92AB33435295F2B64E563D9A23"><enum>(2)</enum><header>Certain voter
				registration activities</header><text display-inline="yes-display-inline">A
				State may use a requirements payment to carry out the requirements of the
				National Voter Registration Act of 1993 which are imposed pursuant to the
				amendments made to such Act by the Voter Registration Modernization Act of
				2009.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H09BEE2F4B5BC416B9C119CCA55B30733"><enum>(b)</enum><header>Conforming
			 Amendment</header><text>Section 254(a)(1) of such Act (42 U.S.C. 15404(a)(1))
			 is amended by striking <quote>section 251(a)(2)</quote> and inserting
			 <quote>section 251(b)(3)</quote>.</text>
			</subsection><subsection id="HE6C0AEB2907A4E6BAFC0881BDB8D32AE"><enum>(c)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall apply with respect
			 to fiscal year 2010 and each succeeding fiscal year.</text>
