		<official-title>To amend title 10, United States Code, to ensure that
		  commissioned officers who serve in a reserve component of the Armed Forces are
		  able to retire in the highest grade in which they have successfully
		  served.</official-title>

		<section id="H7BE20F87004B4503BC3BE9F700665256" section-type="section-one"><enum>1.</enum><header>Election to receive retired
			 pay for non-regular service upon retirement for service in an active reserve
			 status performed after attaining eligibility for regular retirement</header>
			<subsection id="H8228146FEC9C432382644FCDCC00847C"><enum>(a)</enum><header>Election
			 authority; requirements</header><text display-inline="yes-display-inline">Subsection (a) of section 12741 of title
			 10, United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HE28CB1C988D8431F9DEFD89FFE9FA9EB" style="OLC">
					<subsection id="HE7A5FBD91F6449388EF5155444443268"><enum>(a)</enum><header>Authority To
				elect To receive reserve retired pay</header><paragraph commented="no" display-inline="yes-display-inline" id="H023E06A427784B68B56FC97361C7E79F"><enum>(1)</enum><text display-inline="yes-display-inline">Notwithstanding the requirement in
				paragraph (4) of section 12731(a) of this title that a person may not receive
				retired pay under this chapter when the person is entitled, under any other
				provision of law, to retired pay or retainer pay, a person may elect to receive
				retired pay under this chapter, instead of receiving retired or retainer pay
				under chapter 65, 367, 571, or 867 of this title, if the person—</text>
							<subparagraph id="HA95BFE7277E14A8498AC1EB367497300" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">satisfies the requirements specified in
				paragraphs (1) and (2) of such section for entitlement to retired pay under
				this chapter;</text>
							</subparagraph><subparagraph id="HADA436B0BE59437FA87F29C70DBD36D" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">served in an active status in the Selected
				Reserve of the Ready Reserve after becoming eligible for retirement under
				chapter 65, 367, 571, or 867 of this title (without regard to whether the
				person actually retired or received retired or retainer pay under one of those
				chapters); and</text>
							</subparagraph><subparagraph id="H8ACCEFD24FFA466E8C3564B729249791" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">completed not less than two years of
				satisfactory service (as determined by the Secretary concerned) in such active
				status (excluding any period of active service).</text>
							</subparagraph></paragraph><paragraph id="HD6BF9F6125CD41D19149B369156E7DA6" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary concerned may reduce the
				minimum two-year service requirement specified in paragraph (1)(C) in the case
				of a person who—</text>
							<subparagraph id="H69334766809E4BFDAF9FFFB5CD449EF"><enum>(A)</enum><text display-inline="yes-display-inline">completed at least six months of service in
				a position of adjutant general required under section 314 of title 32 or in a
				position of assistant adjutant general subordinate to such a position of
				adjutant general; and</text>
							</subparagraph><subparagraph id="H172BDB5065C7419C80D77F166555797D"><enum>(B)</enum><text>failed to complete the minimum years
				of service solely because the appointment of the person to such position was
				terminated or vacated as described in section 324(b) of title
				32.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8CEC9669281C4845B7CBAD3B83BC74C"><enum>(b)</enum><header>Actions To
			 effectuate election</header><text>Subsection (b) of such section is amended by
			 striking paragraph (1) and inserting the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H27FC6D45BEA74463B34B70B244480952" style="OLC">
					<paragraph id="HF16F677676EF47058629B018FEE1E7AB"><enum>(1)</enum><text display-inline="yes-display-inline">terminate the eligibility of the person to
				retire under chapter 65, 367, 571, or 867 of this title, if the person is not
				already retired under one of those chapters, and terminate entitlement of the
				person to retired or retainer pay under one of those chapters, if the person
				was already receiving retired or retainer pay under one of those chapters;
				and</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2AE283B8B88B42B5AFB602190796F000"><enum>(c)</enum><header>Conforming
			 amendment To reflect new variable age requirement for
			 retirement</header><text>Subsection (d) of such section is amended—</text>
				<paragraph id="H8827DAD2D1F34119AC159B9229F09476"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>attains 60 years of age</quote> and inserting <quote>attains
			 the eligibility age applicable to the person under section 12731(f) of this
			 title</quote>; and</text>
				</paragraph><paragraph id="HAE5BE6F8D9E64741BCB0AEAFF0021B7"><enum>(2)</enum><text>in
			 paragraph (2)(A), by striking <quote>attains 60 years of age</quote> and
			 inserting <quote>attains the eligibility age applicable to the person under
			 such section</quote>.</text>
				</paragraph></subsection><subsection id="HF7E4B6001B19432A8D83F498DC3B8B5"><enum>(d)</enum><header>Clerical
			 amendments</header>
				<paragraph id="H13932C6577004463958D6E45B59E079D"><enum>(1)</enum><header>Section
			 heading</header><text display-inline="yes-display-inline">The heading for
			 section 12741 of such title is amended to read as follows:</text>

			 sections</header><text>The table of sections at the beginning of chapter 1223
			 of such title is amended by striking the item relating to section 12741 and
			 inserting the following new item:</text>

				</paragraph></subsection><subsection commented="no" id="H948792935368411C89D24D11584ED979"><enum>(e)</enum><header>Retroactive
			 applicability</header><text>The amendments made by this section shall take
			 effect as of January 1, 2008.</text>
			</subsection></section><section id="H508759E5D1924F7EA769C081975498CD" section-type="subsequent-section"><enum>2.</enum><header>Recomputation of
			 retired pay and adjustment of retired grade of Reserve retirees to reflect
			 service after retirement</header>
			<subsection id="HA2A87F9971D44837B1AFAD8BBF4E81E0"><enum>(a)</enum><header>Recomputation of
			 retired pay</header><text display-inline="yes-display-inline">Section 12739 of
			 title 10, United States Code, is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HB293CA76267C40CCB2170879D010DC4D" style="OLC">
					<subsection id="HCCAC6F790184407B981200D1C3CFDBB6"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H539AF5A81A0B40B78208EC16A161004C"><enum>(1)</enum><text display-inline="yes-display-inline">If a member of the Retired Reserve is
				recalled to an active status in the Selected Reserve of the Ready Reserve under
				section 10145(d) of this title and completes not less than two years of service
				in such active status, the member is entitled to the recomputation under this
				section of the retired pay of the member.</text>
						</paragraph><paragraph id="H79FF95C86EED4FA0AE50773E75B55E8" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary concerned may reduce the
				two-year service requirement specified in paragraph (1) in the case of a member
				who—</text>
							<subparagraph id="H349F1C93382049A69830B1ACEFCBA8F9"><enum>(A)</enum><text>is recalled to serve in a position of
				adjutant general required under section 314 of title 32 or in a position of
				assistant adjutant general subordinate to such a position of adjutant
				general;</text>
							</subparagraph><subparagraph id="H851B88C66A8F442D9B06072C85B448AC"><enum>(B)</enum><text>completes at least six months of
				service in such position; and</text>
							</subparagraph><subparagraph id="H7C089DE7FDD842EC986E00DDAE1F919B"><enum>(C)</enum><text>fails to complete the minimum two
				years of service solely because the appointment of the member to such position
				is terminated or vacated as described in section 324(b) of title
				32.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H75903D37B3BF4EB1844B90C55435A9F4"><enum>(b)</enum><header>Adjustment of
			 retired grade</header><text display-inline="yes-display-inline">Section 12771
			 of such title is amended—</text>
				<paragraph id="HE19D711622944C22AEC2F4A5A2890097"><enum>(1)</enum><text>by striking
			 <quote>Unless</quote> and inserting <quote>(a)
			 <header-in-text level="subsection" style="OLC">Grade on
			 transfer</header-in-text>.—Unless</quote>; and</text>
				</paragraph><paragraph id="HF2216431A2D04C7BA52F91A9FC4EC75F"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H570C7B2B41DE4679AAC07F33DA6BA398" style="OLC">
						<subsection id="H6FFD3F8520614128A4A4ABF3ADFFD4B"><enum>(b)</enum><header>Effect of
				subsequent recall to active status</header><paragraph commented="no" display-inline="yes-display-inline" id="HAD5E231A9A754A5E8628499C00F5DCD7"><enum>(1)</enum><text display-inline="yes-display-inline">If a member of the Retired Reserve who is a
				commissioned officer is recalled to an active status in the Selected Reserve of
				the Ready Reserve under section 10145(d) of this title and completes not less
				than two years of service in such active status, the member is entitled to an
				adjustment in the retired grade of the member in the manner provided in section
				1370(d) of this title.</text>
							</paragraph><paragraph id="HB11D32D2F7754711AC81E2BE411213C" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary concerned may reduce the
				two-year service requirement specified in paragraph (1) in the case of a member
				who—</text>
								<subparagraph id="HCDBF12A809354F648CF9531341903200"><enum>(A)</enum><text>is recalled to serve in a position of
				adjutant general required under section 314 of title 32 or in a position of
				assistant adjutant general subordinate to such a position of adjutant
				general;</text>
								</subparagraph><subparagraph id="HACBD696137754B1FA63F1F7F83318F7B"><enum>(B)</enum><text>completes at least six months of
				service in such position; and</text>
								</subparagraph><subparagraph id="H4DAA5046B51C4002A6739946E0E1C000"><enum>(C)</enum><text>fails to complete the minimum two
				years of service solely because the appointment of the member to such position
				is terminated or vacated as described in section 324(b) of title
				32.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H96C089EFE91E476500008C16E3BFDEDC"><enum>(c)</enum><header>Retroactive
			 applicability</header><text>The amendments made by this section shall take
			 effect as of January 1, 2008.</text>
