		<section id="H20C46FF7F97D4D69A77D1C6B0DA2A510" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Mail Network Protection Act of
			 2009</short-title></quote>.</text>
		</section><section id="HC48E35735C224425B2892E8D91EA8EFB"><enum>2.</enum><header>Mail network
			 protection</header><text display-inline="no-display-inline">Section 404 of
			 title 39, United States Code, is amended—</text>
			<paragraph id="H13274E59796E474981D424051EF1A6D3"><enum>(1)</enum><text>by redesignating
			 subsections (d) and (e) as subsections (e) and (f), respectively; and</text>
			</paragraph><paragraph id="H96DA9815E7274AC98E65203061215B6B"><enum>(2)</enum><text>by inserting after
			 subsection (c) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HB45A35058AA447629536D75FA9E5BD1F" style="USC">
					<subsection id="H54DE7A865F734E09BCF5F21DB04ED862"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H16345F0591934EF49D6586065D65F5BC"><enum>(1)</enum><text>The Postal Service may
				not enter into any contract described in paragraph (2) without first satisfying
				the requirements of paragraph (3).</text>
						</paragraph><paragraph commented="no" id="H952E9505B9B74B9CB3026D39DFAAE87D" indent="up1"><enum>(2)</enum><text>A contract described in this
				paragraph is any contract which—</text>
							<subparagraph id="H0384C85CEDE64153BBC8F29FFBF0FDDD"><enum>(A)</enum><text>provides for mail processing, mail
				handling, or surface transportation of mail; and</text>
							</subparagraph><subparagraph id="HE10C1091D7B848B299ED34F65BED55CC"><enum>(B)</enum><text>involves work—</text>
								<clause id="H96592742917B4AA6A015D346A60597D6"><enum>(i)</enum><text>that would otherwise be performed,
				in whole or in part, by career postal employees within a recognized bargaining
				unit; and</text>
								</clause><clause id="H06315AE4448A44F8A0EC501D95AAE035"><enum>(ii)</enum><text>the performance of which would,
				during any 12-month period—</text>
									<subclause id="H3F4C39BE57B4430FAC692EDFCFD1BCE5"><enum>(I)</enum><text>cost the Postal Service $5,000,000 or
				more under the proposed contract; or</text>
									</subclause><subclause id="HBCD3BAFDDADC41F3A463564827FD814F"><enum>(II)</enum><text>involve at least 50 workyears of
				work.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="H5A83081B402F42F0B6B997A862B42DC5" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H8FDB891679C94FF9AE623E931B7A647F"><enum>(A)</enum><text>Before entering into a
				contract described in paragraph (2), the Postal Service shall first notify the
				exclusive representative of the bargaining unit described in paragraph
				(2)(B)(i) (or each such unit) of its intent and, if requested, shall meet and
				bargain with the exclusive representative (or representatives), in accordance
				with the provisions of chapter 12 relating to collective bargaining, with
				respect to the proposed contract.</text>
							</subparagraph><subparagraph id="HE28A18C0D203459E8428798ED4EC32B5" indent="up1"><enum>(B)</enum><text>If no agreement is reached within 60
				days after collective bargaining commences, either party may invoke the dispute
				resolution procedures set forth in subsection (c) of section 1207, which
				subsection shall thereupon apply in accordance with its terms.</text>
							</subparagraph></paragraph><paragraph id="HB419D79209224E5AA609720E070E9EA9" indent="up1"><enum>(4)</enum><text>Any contract described in paragraph
				(2) which is not entered into in accordance with the requirements of paragraph
				(3) shall be void ab
				initio.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H3B29D9F999604D83AE3C97B78029124D"><enum>3.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall apply with respect to any contract entered into on or after the
			 date of the enactment of this Act.</text>
