			 references</header>
			<subsection id="HB2B83C810D8A4843895465A8515C0192"><enum>(a)</enum><header>Short
			 title</header><text display-inline="yes-display-inline">This Act may be cited
			 as the <quote><short-title>Frank Melville Supportive
			 Housing Investment Act of 2009</short-title></quote>.</text>
			</subsection><subsection id="HC7A4F56751EB4FB1B680F1243F762000"><enum>(b)</enum><header>References</header><text>Except
			 as otherwise expressly provided, wherever in this Act an amendment or repeal is
			 expressed in terms of an amendment to, or repeal of, section 811 or any other
			 provision of section 811, the reference shall be considered to be made to
			 section 811 of the Cranston-Gonzalez National Affordable Housing Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/8013">42 U.S.C.
			 8013</external-xref>).</text>
			</subsection></section><section id="HED9FEF25B8A841AAB6BCB2482B272800" section-type="subsequent-section"><enum>2.</enum><header>Tenant-based rental
			 assistance through certificate fund</header>
			<subsection id="H1D608241413245F9AAF88E218C6DAC5C"><enum>(a)</enum><header>Termination of
			 mainstream tenant-based rental assistance program</header><text display-inline="yes-display-inline">Section 811 is amended—</text>
				<paragraph id="H7503B338B5B44655A0EBD302A1DFBE1C"><enum>(1)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="H045F4F3C1E664743BD6285D515B0C71D"><enum>(A)</enum><text>by striking the
			 first subsection designation and all that follows through the end of
			 subparagraph (B) of paragraph (2) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="HF31F7056B1A3470E861FADFA2FAAF4E2" style="OLC">
							<subsection id="HC6954715E2E647129F950031221DEC4C"><enum>(b)</enum><header>Authority To
				provide assistance</header><text display-inline="yes-display-inline">The
				Secretary is authorized to provide assistance to private nonprofit
				organizations to expand the supply of supportive housing for persons with
				disabilities, which shall be provided as—</text>
								<paragraph id="H36AD14B16EA945EAB5A7D9ACCB89DC25"><enum>(1)</enum><text>capital advances
				in accordance with subsection (d)(1); and</text>
								</paragraph><paragraph id="HA4293B75B5754CE49FA1BFB835B993F7"><enum>(2)</enum><text>contracts for
				project rental assistance in accordance with subsection
				(d)(2).</text>
								</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H8745520600144205A9C651DC75A73CE2"><enum>(B)</enum><text>by striking
			 <quote>assistance under this paragraph</quote> and inserting <quote>Assistance
			 under this subsection</quote>;</text>
					</subparagraph></paragraph><paragraph id="H0A393D5771344359922EA6DAD967E383"><enum>(2)</enum><text>in subsection (d),
			 by striking paragraph (4); and</text>
				</paragraph><paragraph id="H1FC565866BCF4A33B3D3CA3CAD6453AC"><enum>(3)</enum><text>in subsection (l),
			 by striking paragraph (1).</text>
				</paragraph></subsection><subsection id="H00B0B656C7874B4FA83B3829E9674F57"><enum>(b)</enum><header>Renewal through
			 section 8</header><text>Section 811 is amended by adding at the end the
			 following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HCD524FBB23F9415684D900D73C363908" style="OLC">
					<subsection id="H224F6A0F800740308801B91E7FC06667"><enum>(p)</enum><header>Authorization of
				appropriations for section 8 assistance</header>
						<paragraph id="H7A4D7B86BD4E46E2869BCD0F85C1B63"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">There is authorized
				to be appropriated for tenant-based rental assistance under section 8(o) of the
				United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C.
				1437f(o)</external-xref>) for persons with disabilities in fiscal year 2010 the
				amount necessary to provide a number of incremental vouchers under such section
				that is equal to the number of vouchers provided in fiscal year 2009 under the
				tenant-based rental assistance program under subsection (d)(4) of this section
				(as in effect before the date of the enactment of the
				<short-title>Frank Melville Supportive Housing Investment
				Act of 2009</short-title>).</text>
						</paragraph><paragraph id="H641E34305A0B4050AB9119B41D9E89EC"><enum>(2)</enum><header>Requirements
				upon turnover</header><text>The Secretary shall develop and issue, to public
				housing agencies that receive voucher assistance made available under this
				subsection and to public housing agencies that received voucher assistance
				under section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C.
				1437f(o)</external-xref>) for non-elderly disabled families pursuant to
				appropriation Acts for fiscal years 1997 through 2002 or any other subsequent
				appropriations for incremental vouchers for non-elderly disabled families,
				guidance to ensure that, to the maximum extent possible, such vouchers continue
				to be provided upon turnover to qualified persons with disabilities or to
				qualified non-elderly disabled families,
				respectively.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HFBB99459EEDD445BAE8C5B65F33798BF"><enum>3.</enum><header>Modernized
			 capital advance program</header>
			<subsection id="H6FA41099524D4AC0948BC8E252A6FC01"><enum>(a)</enum><header>Project rental
			 assistance contracts</header><text>Section 811 is amended—</text>
				<paragraph id="H351A8CE3C10D40DC95E8FF06A8978CC"><enum>(1)</enum><text>in
			 subsection (d)(2)—</text>
					<subparagraph id="HC832645067FF46D9BDC700C254B4AFF9"><enum>(A)</enum><text>by inserting
			 <quote>(A) <header-in-text level="subparagraph" style="OLC">Initial project
			 rental assistance contract</header-in-text>.—</quote> after
			 <quote><header-in-text level="paragraph" style="OLC">Project rental
			 assistance</header-in-text>.—</quote>;</text>
					</subparagraph><subparagraph id="H283CB5B032B34504AF8D5DE4EB2B30A8"><enum>(B)</enum><text>in the first
			 sentence, by inserting after <quote>shall</quote> the following: <quote>comply
			 with subsection (e)(2) and shall</quote>;</text>
					</subparagraph><subparagraph id="H3282A27DE75048E5A72E00653953DD35"><enum>(C)</enum><text>by striking
			 <quote>annual contract amount</quote> each place such term appears and
			 inserting <quote>amount provided under the contract for each year covered by
			 the contract</quote>; and</text>
					</subparagraph><subparagraph id="HFA3480BF3F19411F9FDA064468F91B00"><enum>(D)</enum><text>by adding at the
			 end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="H0984A2338009429DB34900C5D31338A7" style="OLC">
							<subparagraph id="H4C06F48BA97B4EBE966FFC37EC3BBAC6" indent="up1"><enum>(B)</enum><header>Renewal of and increases in contract
				amounts</header>
								<clause id="HD3D6EDF94FFC4C96B75312BDBFCB1371"><enum>(i)</enum><header>Expiration of contract
				term</header><text display-inline="yes-display-inline">Upon the expiration of
				each contract term, subject to the availability of amounts made available in
				appropriation Acts, the Secretary shall adjust the annual contract amount to
				provide for reasonable project costs, and any increases, including adequate
				reserves and service coordinators, except that any contract amounts not used by
				a project during a contract term shall not be available for such adjustments
				upon renewal.</text>
								</clause><clause id="H719D8224E1604FA7B9535510A82FC136"><enum>(ii)</enum><header>Emergency
				situations</header><text display-inline="yes-display-inline">In the event of
				emergency situations that are outside the control of the owner, the Secretary
				shall increase the annual contract amount, subject to reasonable review and
				limitations as the Secretary shall
				provide.</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H6AE2BDD62CFC4A5B91D50AC79E5D1F"><enum>(2)</enum><text>in
			 subsection (e)(2)—</text>
					<subparagraph commented="no" id="H252B128F694C42BB95DC71A00027F00"><enum>(A)</enum><text>in the first
			 sentence, by inserting before the period at the end the following: <quote>,
			 except that, in the case of the sponsor of a project assisted with any
			 low-income housing tax credit pursuant to
			 <external-xref legal-doc="usc" parsable-cite="usc/26/42">section
			 42</external-xref> of the Internal Revenue Code of 1986 or with any tax-exempt
			 housing bonds, the contract shall have an initial term of not less than 360
			 months and shall provide funding for a term of 60 months</quote>; and</text>
					</subparagraph><subparagraph id="HFE9EEB1FF4414F42BF7F7CE4942592A2"><enum>(B)</enum><text>by striking
			 <quote>extend any expiring contract</quote> and insert <quote>upon expiration
			 of a contract (or any renewed contract), renew such contract</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="HEDAD9453D1AF4E72A4BF77510037505D"><enum>(b)</enum><header>Program
			 requirements</header><text>Section 811 is amended—</text>
				<paragraph id="H62BC49B7CA42481988C804E4DAF75EF"><enum>(1)</enum><text>in
			 subsection (e)—</text>
					<subparagraph id="H378900D2F06344F7B9667394C63EC4EF"><enum>(A)</enum><text>by striking the
			 subsection heading and inserting the following: <quote><header-in-text level="subsection" style="OLC">Program
			 requirements</header-in-text></quote>;</text>
					</subparagraph><subparagraph id="HDBF1AEB8466342C5BDF2B467F39F9E79"><enum>(B)</enum><text>by striking
			 paragraph (1) and inserting the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="HA01A3A34976B4E869100D45E2275EE92" style="OLC">
							<paragraph id="H3670E2CDB38840A287C84FBD82EC260"><enum>(1)</enum><header>Use
				Restrictions</header>
								<subparagraph id="HD9682AE318424088B3B3D0C7DE4AC92"><enum>(A)</enum><header>Term</header><text display-inline="yes-display-inline">Any project for which a capital advance is
				provided under subsection (d)(1) shall be operated for not less than 40 years
				as supportive housing for persons with disabilities, in accordance with the
				application for the project approved by the Secretary and shall, during such
				period, be made available for occupancy only by very low-income persons with
				disabilities.</text>
								</subparagraph><subparagraph id="HF8308779326545D19297BE093CC48054"><enum>(B)</enum><header>Conversion</header><text display-inline="yes-display-inline">If the owner of a project requests the use
				of the project for the direct benefit of very low-income persons with
				disabilities and, pursuant to such request the Secretary determines that a
				project is no longer needed for use as supportive housing for persons with
				disabilities, the Secretary may approve the request and authorize the owner to
				convert the project to such use.</text>
								</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="HFA1DBDAB1C0943A487EA006DA8E19CEE"><enum>(C)</enum><text>by adding at the
			 end the following new paragraphs:</text>
						<quoted-block display-inline="no-display-inline" id="HD0BE67F3089F48EBB0D0157845A0D9E" style="OLC">
							<paragraph id="H56FB7163647442B593C028F0642FEBD"><enum>(3)</enum><header>Limitation on use
				of funds</header><text>No assistance received under this section (or any State
				or local government funds used to supplement such assistance) may be used to
				replace other State or local funds previously used, or designated for use, to
				assist persons with disabilities.</text>
							</paragraph><paragraph commented="no" id="HBF66838AE45F46D881405C579FA81371"><enum>(4)</enum><header>Multifamily
				projects</header>
								<subparagraph id="HC565105E578D44D8B1A6117F6926ED47"><enum>(A)</enum><header>Limitation</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), of
				the total number of dwelling units in any multifamily housing project
				(including any condominium or cooperative housing project) containing any unit
				for which assistance is provided from a capital grant under subsection (d)(1)
				made after the date of the enactment of the <short-title>Frank Melville Supportive Housing Investment Act of
				2009</short-title>, the aggregate number that are used for persons with
				disabilities, including supportive housing for persons with disabilities, or to
				which any occupancy preference for persons with disabilities applies, may not
				exceed 25 percent of such total.</text>
								</subparagraph><subparagraph id="H37317E0550154DCE00CB64D000D510CA"><enum>(B)</enum><header>Exception</header><text>Subparagraph
				(A) shall not apply in the case of any project that is a group home or
				independent living facility.</text>
								</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HEE29A06808414DB5A5E23C43DEEABD19"><enum>(2)</enum><text>in subsection (l),
			 by striking paragraph (4).</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="HF5D269C9FA9F4BEAB2B1E898B92427E7"><enum>(c)</enum><header>Delegated
			 processing</header><text>Subsection (g) of section 811 (<external-xref legal-doc="usc" parsable-cite="usc/42/8013">42 U.S.C. 8013(g)</external-xref>)
			 is amended—</text>
				<paragraph id="H8F0AD30D5C3A420FAF3ED1F2396E62E1"><enum>(1)</enum><text>by striking
			 <quote><header-in-text level="subsection" style="OLC">Selection
			 criteria</header-in-text>.—</quote> and inserting <quote><header-in-text level="subsection" style="OLC">Selection criteria and
			 processing</header-in-text>.—(1) <header-in-text level="paragraph" style="OLC">Selection criteria</header-in-text>.—</quote>;</text>
				</paragraph><paragraph display-inline="no-display-inline" id="HDFCF79C6E23243368E12A9BA00F042A2"><enum>(2)</enum><text>by redesignating
			 paragraphs (1), (2), (3), (4), (5), (6), and (7) as subparagraphs (A), (B),
			 (C), (D), (E), (G), and (H), respectively;</text>
				</paragraph><paragraph id="H0C4D0C5D77484628A500D6B929AEA27F"><enum>(3)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block id="HACCF8C70FDBB4976B432159BD1AB403B" style="OLC">
						<paragraph id="H4FFDAD842DC5404EA03F2FA9895C68D7" indent="up1"><enum>(2)</enum><header>Delegated processing</header>
							<subparagraph id="HD379DDC4FA8A4A5CB1C0976F4E86C426"><enum>(A)</enum><text display-inline="yes-display-inline">In
				issuing a capital advance under subsection (d)(1) for any multifamily project
				(but not including any project that is a group home or independent living
				facility) for which financing for the purposes described in the last sentence
				of subsection (b) is provided by a combination of the capital advance and
				sources other than this section, within 30 days of award of the capital
				advance, the Secretary shall delegate review and processing of such projects to
				a State or local housing agency that—</text>
								<clause id="H6AB29EB408DA4167B1CF21436C41E411"><enum>(i)</enum><text>is in geographic proximity to the
				property;</text>
								</clause><clause id="H4AF2985732A94BE2B9EFBE5300221DD4"><enum>(ii)</enum><text>has demonstrated experience in and
				capacity for underwriting multifamily housing loans that provide housing and
				supportive services;</text>
								</clause><clause id="H6ADBC1021B954751B66C169622D6E075"><enum>(iii)</enum><text>may or may not be providing
				low-income housing tax credits in combination with the capital advance under
				this section; and</text>
								</clause><clause id="H5877B06FE859464087CDD11868B3F091"><enum>(iv)</enum><text>agrees to issue a firm commitment
				within 12 months of delegation.</text>
								</clause></subparagraph><subparagraph display-inline="no-display-inline" id="H1A49FA3D780E405FAA1B82CF0197623"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary shall retain the authority to
				process capital advances in cases in which no State or local housing agency has
				applied to provide delegated processing pursuant to this paragraph or no such
				agency has entered into an agreement with the Secretary to serve as a delegated
				processing agency.</text>
							</subparagraph><subparagraph id="H86F776678FE748B9BA3D42DBDAADA3CC"><enum>(C)</enum><text display-inline="yes-display-inline">An
				agency to which review and processing is delegated pursuant to subparagraph (A)
				may assess a reasonable fee which shall be included in the capital advance
				amounts and may recommend project rental assistance amounts in excess of those
				initially awarded by the Secretary. The Secretary shall develop a schedule for
				reasonable fees under this subparagraph to be paid to delegated processing
				agencies, which shall take into consideration any other fees to be paid to the
				agency for other funding provided to the project by the agency, including
				bonds, tax credits, and other gap funding.</text>
							</subparagraph><subparagraph id="H74AD93448AD448869B2B00663B47327D"><enum>(D)</enum><text>Under such delegated system, the
				Secretary shall retain the authority to approve rents and development costs and
				to execute a capital advance within 60 days of receipt of the commitment from
				the State or local agency. The Secretary shall provide to such agency and the
				project sponsor, in writing, the reasons for any reduction in capital advance
				amounts or project rental assistance and such reductions shall be subject to
				appeal.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H2857231A559C45C3B0BFA5964122A94"><enum>(d)</enum><header>Leveraging other
			 resources</header><text>Paragraph (1) of section 811(g) (as so designated by
			 subsection (c)(1) of this section) is amended by inserting after subparagraph
			 (E) (as so redesignated by subsection (c)(2) of this section) the following new
			 subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H018C0F8E995247E9A729E9E573D69088" style="OLC">
					<subparagraph id="H583DE791F4A74EF3AC33D2AF766E4F34"><enum>(F)</enum><text>the extent to
				which the per-unit cost of units to be assisted under this section will be
				supplemented with resources from other public and private
				sources;</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC9F5B4F10A314CF1B9EBCBF0275CA96"><enum>(e)</enum><header>Tenant
			 protections and eligibility for occupancy</header><text>Section 811 is amended
			 by striking subsection (i) and inserting the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H24FDB80D6E9A4CC498537767A1FE89E" style="OLC">
					<subsection id="HE7A575BA1E984AD08FE70296DC1F4B48"><enum>(i)</enum><header>Admission and
				occupancy</header>
						<paragraph id="H6AC9580C274A4B36B281F704025B1285"><enum>(1)</enum><header>Tenant
				selection</header>
							<subparagraph id="HD818883BB7FF483382B02F1B6BB5A0D1"><enum>(A)</enum><header>Procedures</header><text display-inline="yes-display-inline">An owner shall adopt written tenant
				selection procedures that are satisfactory to the Secretary as (i) consistent
				with the purpose of improving housing opportunities for very low-income persons
				with disabilities; and (ii) reasonably related to program eligibility and an
				applicant's ability to perform the obligations of the lease. Owners shall
				promptly notify in writing any rejected applicant of the grounds for any
				rejection.</text>
							</subparagraph><subparagraph id="H9864E5509D8C4D0E971E6245BED565EB"><enum>(B)</enum><header>Requirement for
				occupancy</header><text>Occupancy in dwelling units provided assistance under
				this section shall be available only to persons with disabilities and
				households that include at least one person with a disability.</text>
							</subparagraph><subparagraph id="H25D69756166A410BB0BFCC9FAFCE9F75"><enum>(C)</enum><header>Availability</header><text>Except
				only as provided in subparagraph (D), occupancy in dwelling units in housing
				provided with assistance under this section shall be available to all persons
				with disabilities eligible for such occupancy without regard to the particular
				disability involved.</text>
							</subparagraph><subparagraph id="H648C73D2208547A5863FA744047D5922"><enum>(D)</enum><header>Limitation on
				occupancy</header><text>Notwithstanding any other provision of law, the owner
				of housing developed under this section may, with the approval of the
				Secretary, limit occupancy within the housing to persons with disabilities who
				can benefit from the supportive services offered in connection with the
				housing.</text>
							</subparagraph></paragraph><paragraph id="H6A5FF353FBC34B3485DFAE8E2700953B"><enum>(2)</enum><header>Tenant
				protections</header>
							<subparagraph id="H354C9926ADC24CB39B71633BCE55CD83"><enum>(A)</enum><header>Lease</header><text display-inline="yes-display-inline">The lease between a tenant and an owner of
				housing assisted under this section shall be for not less than one year, and
				shall contain such terms and conditions as the Secretary shall determine to be
				appropriate.</text>
							</subparagraph><subparagraph id="H5B63A2F592D843AF827617FCA4A06628"><enum>(B)</enum><header>Termination of
				tenancy</header><text display-inline="yes-display-inline">An owner may not
				terminate the tenancy or refuse to renew the lease of a tenant of a rental
				dwelling unit assisted under this section except—</text>
								<clause id="H489852862E45492D943ED310CBDBB44B"><enum>(i)</enum><text>for serious or
				repeated violation of the terms and conditions of the lease, for violation of
				applicable Federal, State, or local law, or for other good cause; and</text>
								</clause><clause id="HD906B4627EB3442797D739A9F262456F"><enum>(ii)</enum><text>by providing the
				tenant, not less than 30 days before such termination or refusal to renew, with
				written notice specifying the grounds for such action.</text>
								</clause></subparagraph><subparagraph id="HF4EEED2E1FF941EE908CD843D89D6836"><enum>(C)</enum><header>Voluntary
				participation in services</header><text display-inline="yes-display-inline">A
				supportive service plan for housing assisted under this section shall permit
				each resident to take responsibility for choosing and acquiring their own
				services, to receive any supportive services made available directly or
				indirectly by the owner of such housing, or to not receive any supportive
				services.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H404645AB3DDE4561AF114FBF83E479BE"><enum>(f)</enum><header>Development cost
			 limitations</header><text>Subsection (h) of section 811 is amended—</text>
				<paragraph id="HEFE27226E954475F8D8CAED4D7E3683D"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="HC71CDEA2214F4FE3B861AF29714F2EE4"><enum>(A)</enum><text>by striking the
			 paragraph heading and inserting <quote><header-in-text level="paragraph" style="OLC">Group homes</header-in-text></quote>;</text>
					</subparagraph><subparagraph id="H51FE23E8CEC94EA0AE00C0CC00E7ACA8"><enum>(B)</enum><text>in the first
			 sentence, by striking <quote>various types and sizes</quote> and inserting
			 <quote>group homes</quote>;</text>
					</subparagraph><subparagraph id="H102E4C36256A484684AE4BBFDF1507A2"><enum>(C)</enum><text>by striking
			 subparagraph (E); and</text>
					</subparagraph><subparagraph id="HDF6B7A54456E4B439766F6D1F426900"><enum>(D)</enum><text>by redesignating
			 subparagraphs (F) and (G) as subparagraphs (E) and (F), respectively;</text>
					</subparagraph></paragraph><paragraph id="H279A82BE28BE498A965D9798E26EB735"><enum>(2)</enum><text>in paragraph (3),
			 by inserting <quote>established pursuant to paragraph (1)</quote> after
			 <quote>cost limitation</quote>; and</text>

				HOME program cost limitations</header>
							<subparagraph id="HB13046708B7341D2A768C26E3FFD8493"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The provisions of
				section 212(e) of this Act and the cost limits established by the Secretary
				pursuant to such section with respect to the amount of funds under subtitle A
				of title II of this Act that may be invested on a per unit basis, shall apply
				to supportive housing assisted with a capital advance under subsection (d)(1)
				and the amount of funds under such subsection that may be invested on a per
				unit basis.</text>
							</subparagraph><subparagraph id="H3EE45A1E4A3943BD9E72993E596BB356"><enum>(B)</enum><header>Waivers</header><text>The
				Secretary shall provide for waiver of the cost limits applicable pursuant to
				subparagraph (A)—</text>
								<clause id="HDF8069728ECC4AB4AAD8B30DD76A3"><enum>(i)</enum><text>in
				the cases in which the cost limits established pursuant to section 212(e) of
				this Act may be waived; and</text>
								</clause><clause id="HA2F5C75337ED4E73002943DF5600A7FC"><enum>(ii)</enum><text>to provide
				for—</text>
									<subclause id="H412D67F4B5C94DF993DFF69857942F06"><enum>(I)</enum><text display-inline="yes-display-inline">the cost of special design features to make
				the housing accessible to persons with disabilities;</text>
									</subclause><subclause id="H4215A35D9E1847A2A98E1F0012D220DB"><enum>(II)</enum><text>the cost of
				special design features necessary to make individual dwelling units meet the
				special needs of persons with disabilities; and</text>
									</subclause><subclause id="HB1E796BAAB4B4C308C9F82CFC2F39226"><enum>(III)</enum><text>the cost of
				providing the housing in a location that is accessible to public transportation
				and community organizations that provide supportive services to persons with
				disabilities.</text>
									</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" id="H0B8F861B893D4025003F72414D499447"><enum>(g)</enum><header>Repeal of
			 authority To waive size limitations</header><text>Subsection (k) of section 811
			 is amended—</text>
				<paragraph commented="no" id="H9D62DD0DF3294F80A9B5E29656B8C555"><enum>(1)</enum><text>in paragraph (1),
			 by striking the second sentence; and</text>
				</paragraph><paragraph commented="no" id="H0ACDAF8FD46C41CCACBA620034EEC1F8"><enum>(2)</enum><text>in paragraph (4),
			 by striking <quote>(or such higher number of persons</quote> and all that
			 follows through <quote>subsection (h)(6))</quote>.</text>
				</paragraph></subsection><subsection id="H4383D029EF7E4773ABCB08ECA238562"><enum>(h)</enum><header>Minimum
			 allocation for multifamily projects</header><text>Subsection (l) of section
			 811, as amended by the preceding provisions of this Act, is further amended by
			 inserting before paragraph (2) the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HF61DB4933D0C46839E85B5E800D14E3E" style="OLC">
					<paragraph id="H7FA2A6343FAF4FE58584D57C4F2D0119"><enum>(1)</enum><header>Minimum
				allocation for multifamily projects</header><text display-inline="yes-display-inline">The Secretary shall establish a minimum
				percentage of the amount made available for each fiscal year for capital
				advances under subsection (d)(1) that shall be used for multifamily projects
				subject to subsection
				(e)(4).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H0AF144355F08447EB225E812ED1EEF38"><enum>4.</enum><header>Project rental
			 assistance competitive demonstration program</header><text display-inline="no-display-inline">Section 811, as amended by the preceding
			 provisions of this Act, is further amended—</text>
			<paragraph id="H3FF7888127D649B8BED797604234E486"><enum>(1)</enum><text>by redesignating
			 subsections (k) through (n) as subsections (l) through (o), respectively;
			 and</text>
			</paragraph><paragraph id="H4CDF2609BBD54A22A2A8AF44F51B8052"><enum>(2)</enum><text>by inserting after
			 subsection (j) the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HCBADF2668F644F18884E1DD801B624BC" style="OLC">
					<subsection id="H7A08F53DAF81424C9C65CAD62B6EDA00"><enum>(k)</enum><header>Project rental
				assistance-only competitive demonstration program</header>
						<paragraph id="HC9B95DE041734CF1A44421FAEF59BFB"><enum>(1)</enum><header>Authority</header><text display-inline="yes-display-inline">The Secretary shall carry out a
				demonstration program under this subsection to expand the supply of supportive
				housing for non-elderly adults with disabilities, under which the Secretary
				shall make funds available for project rental assistance pursuant to paragraph
				(2) for eligible projects under paragraph (3). The Secretary shall provide for
				State housing finance agencies and other appropriate entities to apply to the
				Secretary for such project rental assistance funds, which shall be made
				available by such agencies and entities for dwelling units in eligible projects
				based upon criteria established by the Secretary for the demonstration program
				under this subsection. The Secretary may not require any State housing finance
				agency or other entity applying for project rental assistance funds under the
				demonstration program to identify in such application the eligible projects for
				which such funds will be used, and shall allow such agencies and applicants to
				subsequently identify such eligible projects pursuant to the making of
				commitments described in paragraph (3)(B).</text>
						</paragraph><paragraph id="H3ABF5A31805F4C108EB81B5E4E51C241"><enum>(2)</enum><header>Project rental
				assistance</header>
							<subparagraph id="HD39361A7831741A9A33DCD8FEE8B51E3"><enum>(A)</enum><header>Contract
				terms</header><text display-inline="yes-display-inline">Project rental
				assistance under the demonstration program under this subsection shall be
				provided—</text>
								<clause id="H6D764FD9276143D8B116CF085025DC27"><enum>(i)</enum><text>in
				accordance with subsection (d)(2); and</text>
								</clause><clause id="HAE1351F054B0428CAEAC9DC749E9997D"><enum>(ii)</enum><text>under a contract
				having an initial term of not less than 180 months that provides funding for a
				term 60 months, which funding shall be renewed upon expiration, subject to the
				availability of sufficient amounts in appropriation Acts.</text>
								</clause></subparagraph><subparagraph id="H95E33AB292524DC0AB92142B927108B9"><enum>(B)</enum><header>Limitation on
				units assisted</header><text display-inline="yes-display-inline">Of the total
				number of dwelling units in any multifamily housing project containing any unit
				for which project rental assistance under the demonstration program under this
				subsection is provided, the aggregate number that are provided such project
				rental assistance, that are used for supportive housing for persons with
				disabilities, or to which any occupancy preference for persons with
				disabilities applies, may not exceed 25 percent of such total.</text>
							</subparagraph><subparagraph id="H05C1B2D8EA08401FB8FA6755908DBA23"><enum>(C)</enum><header>Prohibition of
				capital advances</header><text>The Secretary may not provide a capital advance
				under subsection (d)(1) for any project for which assistance is provided under
				the demonstration program.</text>
							</subparagraph><subparagraph id="H7629C3C1CE4B4AA3965161A59AD7784"><enum>(D)</enum><header>Eligible
				population</header><text display-inline="yes-display-inline">Project rental
				assistance under the demonstration program under this subsection may be
				provided only for dwelling units for extremely low-income persons with
				disabilities and extremely low-income households that include at least one
				person with a disability.</text>
							</subparagraph></paragraph><paragraph id="HB667343553AB4B11B9C00FFFB7DFBD9"><enum>(3)</enum><header>Eligible
				projects</header><text display-inline="yes-display-inline">An eligible project
				under this paragraph is a new or existing multifamily housing project for
				which—</text>
							<subparagraph id="HCFAB761F284C441BB6856737DA17A263"><enum>(A)</enum><text>the development
				costs are paid with resources from other public or private sources; and</text>
							</subparagraph><subparagraph id="H51BA9BBA490A44C9BEA897F55259E1B3"><enum>(B)</enum><text>a commitment has
				been made—</text>
								<clause id="H4BDF79A45EE240878011B224A162B1E8"><enum>(i)</enum><text>by
				the applicable State agency responsible for allocation of low-income housing
				tax credits under <external-xref legal-doc="usc" parsable-cite="usc/26/42">section 42</external-xref> of the Internal Revenue
				Code of 1986, for an allocation of such credits;</text>
								</clause><clause id="HB6F5BD3D4BA24FA89E00C91F5FC0BF6B"><enum>(ii)</enum><text>by the applicable
				participating jurisdiction that receives assistance under the HOME Investment
				Partnership Act, for assistance from such jurisdiction; or</text>
								</clause><clause id="HC8EF3BE07E3A42FBBCBBBB0B6CAB974"><enum>(iii)</enum><text>by any Federal
				agency or any State or local government, for funding for the project from funds
				from any other sources.</text>
								</clause></subparagraph></paragraph><paragraph id="HE090479B5F36465FAB4CCC3D8CC33AC"><enum>(4)</enum><header>State agency
				involvement</header><text display-inline="yes-display-inline">Assistance under
				the demonstration may be provided only for projects for which the applicable
				State agency responsible for health and human services programs, and the
				applicable State agency designated to administer or supervise the
				administration of the State plan for medical assistance under title XIX of the
				Social Security Act, have entered into such agreements as the Secretary
				considers appropriate—</text>
							<subparagraph id="H3E9B1DA53E44443B92EE56BA9C9E6837"><enum>(A)</enum><text>to identify the
				target populations to be served by the project;</text>
							</subparagraph><subparagraph id="H601312CFDD904BE8AFEF641757B9AEE6"><enum>(B)</enum><text>to set forth
				methods for outreach and referral; and</text>
							</subparagraph><subparagraph id="H73007C6534D942AF9800F38526363EA"><enum>(C)</enum><text>to make available
				appropriate services for tenants of the project.</text>
							</subparagraph></paragraph><paragraph id="HCC8C71B8DFB14C37B03400BC08D46EE"><enum>(5)</enum><header>Use
				requirements</header><text>In the case of any project for which project rental
				assistance is provided under the demonstration program under this subsection,
				the dwelling units assisted pursuant to paragraph (2) shall be operated for not
				less than 30 years as supportive housing for persons with disabilities, in
				accordance with the application for the project approved by the Secretary, and
				such dwelling units shall, during such period, be made available for occupancy
				only by persons and households described in paragraph (2)(D).</text>
						</paragraph><paragraph id="HD9BA5D008E26443BB47F70179399234D"><enum>(6)</enum><header>Report</header><text>Upon
				the expiration of the 5-year period beginning on the date of the enactment of
				the <short-title>Frank Melville Supportive Housing
				Investment Act of 2009</short-title>, the Secretary shall submit to the
				Congress a report describing the demonstration program under this subsection,
				analyzing the effectiveness of the program, including the effectiveness of the
				program compared to the program for capital advances in accordance with
				subsection (d)(1) (as in effect pursuant to the amendments made by such Act),
				and making recommendations regarding future models for assistance under this
				section based upon the experiences under the
				program.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H1A33889785A542E78C59F85E48B5BB52"><enum>5.</enum><header>Technical
			 corrections</header><text display-inline="no-display-inline">Section 811 is
			 amended—</text>

				disabilities</term> means a person who is 18 years of age or older and less
				than 62 years of age, who—</text>
								<clause id="H353EF1B6BE8D4219BF7C27BCC5DB5F49" indent="up1"><enum>(i)</enum><text>has a disability as defined in
				section 223 of the Social Security Act;</text>
								</clause><clause id="H7AEACECA26FD4F1294DF0798D235BD1" indent="up1"><enum>(ii)</enum><text>is determined, pursuant to
				regulations issued by the Secretary, to have a physical, mental, or emotional
				impairment which—</text>
									<subclause id="H801073F4555E4E42B9D6A0084DF33F19"><enum>(I)</enum><text>is expected to be of long-continued and
				indefinite duration;</text>
									</subclause><subclause id="H936DDD66F7CE49AD9B8B6C7901E520D1"><enum>(II)</enum><text>substantially impedes his or her ability
				to live independently; and</text>
									</subclause><subclause id="H2B698164FA4D4580B0C0989C1BAE43B4"><enum>(III)</enum><text>is of such a nature that such ability
				could be improved by more suitable housing conditions; or</text>
									</subclause></clause><clause id="HDC879A4A87D445CD8BA755225FA9E424" indent="up1"><enum>(iii)</enum><text>has a developmental disability as
				defined in section 102 of the Developmental Disabilities Assistance and Bill of
				Rights Act of 2000.</text>
								</clause></subparagraph><subparagraph id="H3C85F8A51A0B4AE1B3E67E4835E2B8DE" indent="up1"><enum>(B)</enum><text>Such term shall not exclude persons
				who have the disease of acquired immunodeficiency syndrome or any conditions
				arising from the etiologic agent for acquired immunodeficiency syndrome.
				Notwithstanding any other provision of law, no individual shall be considered a
				person with disabilities, for purposes of eligibility for low-income housing
				under this title, solely on the basis of any drug or alcohol dependence. The
				Secretary shall consult with other appropriate Federal agencies to implement
				the preceding sentence.</text>
							</subparagraph><subparagraph id="HEC8D14F8DF4F4E758B4FA2204E171BEE" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">The Secretary shall prescribe such
				regulations as may be necessary to prevent abuses in determining, under the
				definitions contained in this paragraph, the eligibility of families and
				persons for admission to and occupancy of housing assisted under this section.
				Notwithstanding the preceding provisions of this paragraph, the term
				<term>person with disabilities</term> includes two or more persons with
				disabilities living together, one or more such persons living with another
				person who is determined (under regulations prescribed by the Secretary) to be
				important to their care or well-being, and the surviving member or members of
				any household described in subparagraph (A) who were living, in a unit assisted
				under this section, with the deceased member of the household at the time of
				his or her
				death.</text>
							</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="H26E59BEB5ECD41CBAF62F6314F2CBA1B"><enum>(C)</enum><text>by striking
			 paragraph (3) and inserting the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HE9CFB509A189464AA17F8ECA281CD68B" style="OLC">
						<paragraph id="HE87C68C39E7048B58E3FBCBF59AA7538"><enum>(3)</enum><text>The term
				<term>supportive housing for persons with disabilities</term> means dwelling
				units that—</text>
							<subparagraph id="HAE553F5456FB4FF9AD027400239C3B54"><enum>(A)</enum><text>are designed to
				meet the permanent housing needs of very low-income persons with disabilities;
				and</text>
							</subparagraph><subparagraph id="H03310F2F28414120BEAE6FB2894D932"><enum>(B)</enum><text>are located in
				housing that make available supportive services that address the individual
				health, mental health, or other needs of such
				persons.</text>
							</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph commented="no" id="H9DD431487EAD4A2083F6876E675472F3"><enum>(D)</enum><text>in paragraph (5),
			 by striking <quote>a project for</quote>; and</text>

			 appropriations</header><text display-inline="no-display-inline">Subsection (n)
			 of section 811 (as so redesignated by section 4(1) of this Act) is amended to
			 read as follows:</text>

				<subsection id="H6DBCD154CA054A97BA2F88DFD2515F17"><enum>(n)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated for each of
				fiscal years 2010 through 2014 the following amounts:</text>
					<paragraph id="H2DC7ECA13C67499AA4FCDF507BB625C"><enum>(1)</enum><header>Capital
				advance/PRAC program</header><text display-inline="yes-display-inline">For
				providing assistance pursuant to subsection (b), such sums as may be
				necessary.</text>
					</paragraph><paragraph id="HADCBE3022E70442BBAEECFB52559843"><enum>(2)</enum><header>Demonstration
				program</header><text display-inline="yes-display-inline">For carrying out the
				demonstration program under subsection (k), such sums as may be necessary to
				provide 2,500 incremental dwelling units under such program in each of fiscal
				years 2010 and 2011 and 5,000 incremental dwelling units under such program in
				each of fiscal years 2012, 2013, and
				2014.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HE6EA3C9F967F442DA8296703DEA776C1"><enum>7.</enum><header>New regulations
			 and program guidance</header><text display-inline="no-display-inline">Not later
			 than the expiration of the 180-day period beginning on the date of the
			 enactment of this Act, the Secretary of Housing and Urban Development shall
			 issue new regulations and guidance for the program under section 811 of the
			 Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8013">42 U.S.C. 8013</external-xref>) for
			 supportive housing for persons with disabilities to carry out such program in
			 accordance with the amendments made by this Act.</text>
		</section><section id="H36245F714E7B4E60944B67E13BC41C56"><enum>8.</enum><header>GAO
			 study</header><text display-inline="no-display-inline">The Comptroller General
			 of the United States shall conduct a study of the supportive housing for
			 persons with disabilities program under section 811 of the Cranston-Gonzalez
			 National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8013">42 U.S.C. 8013</external-xref>) to determine the
			 adequacy and effectiveness of such program in assisting households of persons
			 with disabilities. Such study shall determine—</text>
			<paragraph id="H5107A24A91BB46C3A62708A5CD4D494C"><enum>(1)</enum><text display-inline="yes-display-inline">the total number of households assisted
			 under such program;</text>
			</paragraph><paragraph id="HFD7EA0EAEEAF4D64A838C29E524F8324"><enum>(2)</enum><text>the extent to
			 which households assisted under other programs of the Department of Housing and
			 Urban Development that provide rental assistance or rental housing would be
			 eligible to receive assistance under such section 811 program; and</text>
			</paragraph><paragraph id="H56581B9D2ECB4861ADB52F8D615BE7B5"><enum>(3)</enum><text>the extent to
			 which households described in paragraph (2) who are eligible for, but not
			 receiving, assistance under such section 811 program are receiving supportive
			 services from, or assisted by, the Department of Housing and Urban Development
			 other than through the section 811 program (including under the Resident
			 Opportunity and Self-Sufficiency program) or from other sources.</text>
			</paragraph><continuation-text continuation-text-level="section">Upon the
			 completion of the study required under this section, the Comptroller General
			 shall submit a report to the Congress setting forth the findings and
			 conclusions of the study.</continuation-text></section></legis-body>
