<legis-type>A BILL</legis-type> 
<official-title>To require State and local law enforcement agencies to determine the immigration status of all individuals arrested by such agencies for a felony, to require such agencies to report to the Secretary of Homeland Security when they have arrested for a felony an alien unlawfully present in the United States, to require mandatory Federal detention of such individuals pending removal in cases where they are not otherwise detained, and for other purposes.</official-title>

<section id="HE52DF07DEB094257A7F848D15DCFA65E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Justice for the Newark College Students Act</short-title></quote>.</text></section>
<section id="H45D599955A294716A57325004954F856"><enum>2.</enum><header>Identification of aliens unlawfully present upon felony arrest</header>
<subsection id="H5AA39233B366428FB9B3E5F2B8DD5C33"><enum>(a)</enum><header>Availability of investigative resources</header><text display-inline="yes-display-inline">Section 236(d)(1) of the Immigration and Nationality Act (8 U.S.C. 1226(d)(1)) is amended—</text>
<paragraph id="H743CCD7E0D7D458B9E812737C71C2C88"><enum>(1)</enum><text>in the matter preceding subparagraph (A), by striking <quote>Attorney General</quote> and inserting <quote>Secretary of Homeland Security</quote>;</text></paragraph>
<paragraph id="H54EB6B4ECEF04F519B2DF06498EC9B86"><enum>(2)</enum><text>in subparagraph (A)—</text>
<subparagraph id="H1F2F0E0E03DF4CBF9FD47536BBD4DC09"><enum>(A)</enum><text>by strking <quote>the Service</quote> and inserting <quote>the Department of Homeland Security</quote>; and</text></subparagraph>
<subparagraph id="H5D45DDFEF1D8498B9665F18864900100"><enum>(B)</enum><text>by striking <quote>aggravated felonies</quote> and inserting <quote>a felony (under the law that is the basis of the arrest) or an aggravated felony (as defined in section 101(a)(43))</quote>; and</text></subparagraph>
<subparagraph id="H7130F598F3D249588890C10970461F65"><enum>(C)</enum><text>by striking <quote>aliens;</quote> and inserting <quote>aliens, and to determine whether such individuals are unlawfully present in the United States;</quote>; and</text></subparagraph></paragraph>
<paragraph id="HF74153507FBA4438AA00F920CFE35CDE"><enum>(3)</enum><text>in subparagraph (B)—</text>
<subparagraph id="H86650D8F10924828BBC2CB0DA2D6215"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>the Service</quote> and inserting <quote>the Department of Homeland Security</quote>; and</text></subparagraph>
<subparagraph display-inline="no-display-inline" id="H92A64AEDE263403899C99F82C81254A9"><enum>(B)</enum><text>by striking <quote>an aggravated felony;</quote> and inserting <quote>a felony (under the law that is the basis of the arrest) or an aggravated felony (as defined in section 101(a)(43));</quote> .</text></subparagraph></paragraph></subsection>
<subsection id="HAD67DD2FBE0A43F1825448943887D689"><enum>(b)</enum><header>Required use of investigative resources</header><text display-inline="yes-display-inline">Section 236(d) of the Immigration and Nationality Act (8 U.S.C. 1226(d)) is amended by adding at the end the following:</text>

<paragraph id="H9FFF7884E4C349F6992D7223538C7B1B" indent="up1"><enum>(4)</enum>
<subparagraph commented="no" display-inline="yes-display-inline" id="H73D5B898AE1741F9992F20929C857852"><enum>(A)</enum><text>A State or local law enforcement official who arrests an individual for a felony (under the law that is the basis of the arrest)—</text>
<clause id="H96BF8C78CDFC4F74A3CCD4D03662D258" indent="up1"><enum>(i)</enum><text>shall, through the investigative resources described in paragraph (d)(1)(A), determine whether the individual is an alien unlawfully present in the United States; and</text></clause>
<clause id="H0D4955A0F107406989E3827B1FE2CE7F" indent="up1"><enum>(ii)</enum><text>shall inform the court having jurisdiction over the felony case when the official has determined that the individual is such an alien.</text></clause></subparagraph>
<subparagraph id="HB6080CEDDF4F45949446A7CB76E27D07" indent="up1"><enum>(B)</enum><text>A court described in subparagraph (A)(ii) shall inform the Department of Homeland Security of the disposition of a felony case described in such subparagraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="HB778A8600B6B4F2B89C280FA95B098D1"><enum>3.</enum><header>Federal detention of unlawfully present aliens</header>
<subsection id="H7A202080F7F0488F8BF9BADC892EBC22"><enum>(a)</enum><header>Custody</header><text display-inline="yes-display-inline">Section 236(c)(1) of the Immigration and Nationality Act (8 U.S.C. 1226(c)(1)) is amended—</text>
<paragraph id="H0D6D8F878087410CA307E8668C36A928"><enum>(1)</enum><text>in subparagraph (C), by striking <quote>or</quote> at the end;</text></paragraph>
<paragraph id="HD2E541375BBB43AD9F88FCFFE89D3B35"><enum>(2)</enum><text>in subparagraph (D), by adding <quote>or</quote> at the end; and</text></paragraph>
<paragraph id="H738059B8BE95405594A06147406BEF5F"><enum>(3)</enum><text>by inserting after subparagraph (D) the following:</text>
<quoted-block display-inline="no-display-inline" id="HEBE8521EF21B47099F3900D94CCD0296" style="OLC">
<subparagraph id="H68CCD81D4B564C0DBD3B067902ADD695"><enum>(E)</enum><text display-inline="yes-display-inline">has been determined under subsection (d)(4)(A) to be an alien unlawfully present in the United States,</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H28E1B951BA9142EF816DFD5612D7F600"><enum>(b)</enum><header>Release</header><text>Section 236(c)(2) of the Immigration and Nationality Act (8 U.S.C. 1226(c)(2)) is amended by adding at the end <quote>Notwithstanding any other provision of this paragraph, an alien taken into custody under paragraph (1)(E) may not be released except in furtherance of the felony case described in subsection (d)(4)(B).</quote></text></subsection></section>
