<official-title>To amend the Immigration and Nationality Act to establish a right for an alien to file a motion to reopen a case in removal proceedings if the alien can demonstrate that counsel or a certified representative provided deficient performance.</official-title>

<section id="HEB59BEDA64DF48A6B1AF846D00067E57" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Access to Justice Act</short-title></quote>.</text> </section>
<section id="HBD5DB21C06E5488C9CB614F5E8EB9244"><enum>2.</enum><header>Establishing a right for an alien to reopen a case in removal proceedings if the alien can demonstrate that counsel or a certified representative provided deficient performance</header><text display-inline="no-display-inline">Section 240(c)(7) of the Immigration and Nationality Act (8 U.S.C. 1229a(c)(7)) is amended as follows:</text> 
<paragraph id="HD1DFFA70BD8046F2868FF1D535BB6B82"><enum>(1)</enum><text display-inline="yes-display-inline">In subparagraph (A), by adding at the end the following new sentence: <quote>A motion to reopen proceedings may be filed under this section by an alien on the grounds that counsel or a certified representative provided deficient performance.</quote>.</text> </paragraph>
<paragraph id="H952F179B278B485AA2668E00DC73256"><enum>(2)</enum><text>By striking subparagraph (B) and inserting the following:</text>

<subparagraph id="HBE58D9FD3EED4E59A28151473BE7F5A6"><enum>(B)</enum><header>Contents</header> 
<clause id="HFDA5A92F6852424FBEDE7E41FE35FF0"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The motion to reopen shall state the new facts that will be proven at a hearing to be held if the motion is granted, and shall be supported by affidavits or other evidentiary material.</text> </clause>
<clause id="H03FA5293783E416A85B5A20057D8E9A0"><enum>(ii)</enum><header>Special rule for deficient performance of counsel</header><text display-inline="yes-display-inline">A motion to reopen on the grounds that counsel or a certified representative provided deficient performance shall contain a sworn declaration describing the deficient performance in detail and stating what defense to removability or relief or protection from removal the alien would have been likely to obtain absent the deficient performance.</text> </clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph>
<paragraph id="H867941B65F1B45649BB1E246EC523B93"><enum>(3)</enum><text display-inline="yes-display-inline">In subparagraph (C), by adding at the end the following:</text>

<clause id="H4106B91D9F84484EACE0BA363C54F26"><enum>(v)</enum><header>Deficient performance of counsel</header><text display-inline="yes-display-inline">There is no time limit on the filing of a motion to reopen on the grounds that counsel or a certified representative provided deficient performance if the alien demonstrates that the alien exercised due diligence in discovering and seeking to cure counsel’s alleged deficient performance.</text> </clause><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>
<section id="HE18232040BBD416F9BB8D8F57B90B0C"><enum>3.</enum><header>Regulations</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Attorney General shall issue regulations to carry out the amendments made by this Act.</text> </section>
<section id="id2CED4A1F6E34497E9683F0521657BC57"><enum>4.</enum><header>Effective Date</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect as if enacted on January 6, 2009.</text> </section>
