<official-title>To amend the Internal Revenue Code of 1986 to permit hardship loans from certain individual retirement plans.</official-title>

<section id="H9AE5573E15BB4408A2DBAED01D45332E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>IRA Assistance Act of 2009</short-title></quote>. </text></section> 
<section id="H3CFA5DA27DFA4C4DA1D8144D1ED5D18C"><enum>2.</enum><header>Hardship loans from certain individual retirement plans</header> 
<subsection id="H66D3F9D1A34A47E48F47A41EEF83972"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Paragraph (2) of section 72(t) of the Internal Revenue Code of 1986 is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="HB815FC728194402599CC98ED9F141FA1"><enum>(H)</enum><header>Hardship loans from certain individual retirement plans</header> 
<clause id="H400EF885A18A4A69927C79EB711689B1"><enum>(i)</enum><header>In general</header><text>Any qualified hardship loan.</text></clause> 
<clause id="H5F3D16CBB8164907B507810096273599"><enum>(ii)</enum><header>Qualified hardship loan</header><text display-inline="yes-display-inline">For purposes of this subparagraph, the term <quote>qualified hardship loan</quote> means any distribution to an individual from a qualified individual retirement plan of such individual upon hardship of such individual (within the meaning of section 401(k)(2)(B)(i)(IV)) if one or more contributions to a qualified individual retirement plan of such individual in an aggregate amount equal to such distribution are made during the 5-year period beginning on the date of such distribution.</text></clause> 
<clause id="H13BF4418C63240E893C01308D4F48B65"><enum>(iii)</enum><header>Qualified individual retirement plan</header><text>For purposes of this subparagraph, the term <quote>qualified individual retirement plan</quote> means an individual retirement plan other than a Roth IRA.</text></clause> 
<clause id="H15472D697A5A47F086E83E5C6FA19F53"><enum>(iv)</enum><header>Limitation on amount of loan</header><text>Such term shall not include any loan unless the amount of such loan (when added to the outstanding balance of all other hardship loans from Qualified individual retirement plans of such individual) does not exceed $50,000.</text></clause> 
<clause id="H5F5AEA2BE3884602B1229C109E2EA2CA"><enum>(v)</enum><header>Treatment of recontributions</header><text display-inline="yes-display-inline">In the case of any contribution to a qualified individual retirement plan taken into account under clause (ii)—</text> 
<subclause id="HAE95416D198C4582BA15F373F45365EB"><enum>(I)</enum><text>the dollar limitations otherwise applicable to contributions to qualified individual retirement plans shall not apply to such contribution, and</text></subclause> 
<subclause id="HA4996310173B4852A43CCE4658159391"><enum>(II)</enum><text>no deduction shall be allowed for such contribution.</text></subclause></clause> 
<clause id="H30C9CF0FF3E0427B97731926899B37A3"><enum>(vi)</enum><header>Failure to repay</header><text>In the case of a failure to make the aggregate amount of contributions described in clause (ii) during the 5-year period described therein, the penalty determined under paragraph (1) shall be imposed for the taxable year in which such 5-year period ends in lieu of the taxable year in which the distribution was made.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H96AFFB0BF7B645EDA3CC13E53824B7EC"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to distributions made after the 6-month period beginning on the date of the enactment of this Act.</text></subsection></section>
