		<section id="H9A3AA76EFC1A447FA8C6A9F89D2FF580" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>New Automobile Voucher Act of
			 2009</short-title></quote>.</text>
		</section><section id="HABC9651C3A8D4E6180885AFD99D17C11"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H1654D2A13DC54BD7A9F712C81CF0A37B"><enum>(1)</enum><text>1
			 out of every 10 jobs in the United States, or about 13,000,000, is related to
			 automobiles.</text>
			</paragraph><paragraph id="H7A077834F73C4A3A87C02CD61F714A17"><enum>(2)</enum><text>The automotive
			 sector represents the largest manufacturing base in the United States and each
			 automobile assembly plant generates about 5 jobs among suppliers and the
			 surrounding community.</text>
			</paragraph><paragraph id="H6EB56BABB89E473F9B791D420ED77E2F"><enum>(3)</enum><text display-inline="yes-display-inline">Automobile parts manufacturers account for
			 4,500,000 private industry jobs, including nearly 2,000,000 indirect jobs in
			 industries ranging from steel and plastics to technical services.</text>
			</paragraph><paragraph id="H2B1435D407E04E6181E1BD9260FD3E39"><enum>(4)</enum><text>Automobile
			 dealerships employ 1,100,000 workers and account for 18 percent of all retail
			 sales in the United States.</text>
			</paragraph><paragraph id="H6D0B7844EBC7421D95FB9A8E3FD9AAEB"><enum>(5)</enum><text>In 2005,
			 16,900,000 new automobiles were sold in the United States, but in 2008, only
			 13,200,000 new automobiles were sold.</text>
			</paragraph><paragraph id="H91871481890842CBA04FBF52ED680E9C"><enum>(6)</enum><text>This loss of
			 3,700,000 new automobile sales, at an average price of $28,400, directly
			 removed $105,000,000,000 from the economy.</text>
			</paragraph><paragraph id="H8CF44E8ADD844928969E301FC9D7CB2B"><enum>(7)</enum><text>Economic
			 multiplier effects of between 3 and 7 percent mean that this decline of new
			 automobile sales translates into a $315,000,000,000 to $735,000,000,000 loss to
			 the economy of the United States.</text>
			</paragraph><paragraph id="H11CDFE9B2A5341558C5146C47817AC3C"><enum>(8)</enum><text display-inline="yes-display-inline">Only 1,345,885 vehicles were sold in the
			 United States during January and February of 2009, representing a 39 percent
			 decrease from January and February of 2008.</text>
			</paragraph><paragraph id="H742E855BCF594F859100E1AF50D6491F"><enum>(9)</enum><text>The best way to
			 help the United States automobile industry and manufacturing base recover is to
			 set a goal of selling 15,000,000 new automobiles in 2009 in order to restart
			 the United States economy.</text>
			</paragraph></section><section id="HA001731B2CBE4D67BA6DE28E6508E0EE"><enum>3.</enum><header>New Automobile
			 Voucher Program</header>
			<subsection id="H8D108926C31943ECAA7EB8EB1D9EA893"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Department of
			 the Treasury a program to be known as the <quote>New Automobile Voucher
			 Program</quote>, through which the Secretary shall—</text>
				<paragraph id="H9E1D8C6807004B90BB43514191136EA3"><enum>(1)</enum><text display-inline="yes-display-inline">authorize the issuance of a voucher,
			 subject to the specifications described in subsection (b), to a dealer for each
			 person or eligible fleet operator who purchases an eligible new automobile from
			 such dealer, which voucher shall be applied towards such purchase;</text>
				</paragraph><paragraph id="H9BEE505ED0124365B5DA618AFD215ED8"><enum>(2)</enum><text>allow any dealer
			 to participate in the Program if the dealer agrees to—</text>
					<subparagraph id="H01E5D29829B047D184BDEEE78710C82B"><enum>(A)</enum><text>apply a voucher
			 towards the purchase of an eligible new automobile as partial payment for each
			 eligible person or eligible fleet operator at the time of purchase; and</text>
					</subparagraph><subparagraph id="HAA28015CCE574B76B21209F657B90C7B"><enum>(B)</enum><text>comply with all
			 applicable requirements under this Act and regulations promulgated by the
			 Secretary to carry out this Act;</text>
					</subparagraph></paragraph><paragraph id="HE3D36E5CC2644E3F8D6620D0DFB1B8B3"><enum>(3)</enum><text>establish a
			 Web-based electronic system to process the vouchers at the point of
			 sale;</text>
				</paragraph><paragraph id="HDACBBFE4D69B49289D8F61BD5B42C165"><enum>(4)</enum><text>certify that the
			 Program is operational; and</text>
				</paragraph><paragraph id="HC051B6F10A584F0D82849D71AFFD160E"><enum>(5)</enum><text>make payments to
			 dealers for vouchers applied by such dealers under paragraph (2) in accordance
			 with the provisions of this section.</text>
				</paragraph></subsection><subsection id="H6DBF30EF3235431493696A534AC47DA4"><enum>(b)</enum><header>Program
			 specifications</header>
				<paragraph id="HBA33494B14644B2A8011F325D3E3C596"><enum>(1)</enum><header>Vouchers per
			 person</header><text display-inline="yes-display-inline">Not more than 1
			 voucher may be issued for any person, unless such person is an eligible fleet
			 operator.</text>
				</paragraph><paragraph id="HAFFF56577B2947C0B8058F9E627EC7E9"><enum>(2)</enum><header>Vouchers per
			 eligible new automobile</header><text>Not more than 1 voucher may be applied to
			 each eligible new automobile.</text>
				</paragraph><paragraph id="H6B52CD2B8D234CC0AC06EC86C0909CD4"><enum>(3)</enum><header>Offset</header><text>A
			 dealer—</text>
					<subparagraph id="HF7686AF3387C434C8FBA6D88FED29014"><enum>(A)</enum><text display-inline="yes-display-inline">shall credit the amount of the voucher
			 being applied toward the purchase of an eligible new automobile; and</text>
					</subparagraph><subparagraph id="H95022F06130E4E4F9DDC6E772E287480"><enum>(B)</enum><text display-inline="yes-display-inline">may not offset the amount of the voucher
			 against any other rebate or discount otherwise being offered by the dealer or
			 manufacturer.</text>
					</subparagraph></paragraph><paragraph id="HFF7CB16A2E144668926CA6ADBE945A09"><enum>(4)</enum><header>Combination with
			 other incentives permitted</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 the availability or use of a Federal or State tax incentive or a State-issued
			 voucher for the purchase of an eligible new automobile shall not limit the
			 value or issuance of a voucher under the Program for any eligible person or
			 eligible fleet operator.</text>
				</paragraph><paragraph id="HC43FD92D3A0340B1B94CE776254F20E7"><enum>(5)</enum><header>Voucher</header>
					<subparagraph id="H8AD86BFEB8984251825B701D02761C4E"><enum>(A)</enum><header>Paperless
			 voucher</header><text display-inline="yes-display-inline">Any voucher issued
			 under this section shall be issued electronically through a Web-based
			 electronic system.</text>
					</subparagraph><subparagraph id="HABA25B15636146ACB914676610CC590A"><enum>(B)</enum><header>Value of voucher
			 during the initial period</header><text>A voucher issued under the Program
			 during the initial period may be applied to offset the purchase price of an
			 eligible new automobile by $5,000.</text>
					</subparagraph><subparagraph id="H9C14F47A2D484E299B33D1F2618A1A5E"><enum>(C)</enum><header>Value of voucher
			 during the secondary period</header><text>A voucher issued under the Program
			 during the secondary period may be applied to offset the purchase price of an
			 eligible new automobile by $2,500.</text>
					</subparagraph></paragraph><paragraph id="HC3CC0FA4543F4C19B76B00A9E846F8EB"><enum>(6)</enum><header>Prompt
			 fulfillment of redemption requests required</header><text display-inline="yes-display-inline">The Secretary shall provide for the payment
			 of all vouchers submitted to the Secretary for redemption in accordance with
			 the provisions of this Act not later than 10 days after such submission, or
			 within such lesser period as the Secretary determines to be practicable.</text>
				</paragraph></subsection><subsection id="H5933D231D4E94D818B617E833DB585D3"><enum>(c)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 30 days after the date of
			 the enactment of this Act, the Secretary shall promulgate regulations to
			 implement the Program, including the enforcement of the penalties described in
			 section 4.</text>
			</subsection><subsection id="H99AC3BC248DA49C8B10F800BD0154E47"><enum>(d)</enum><header>Disclaimer</header><text display-inline="yes-display-inline">Nothing in this Act or any other provision
			 of law limits the authority of Congress or the Secretary to terminate or limit
			 the Program or the issuance of vouchers under the Program.</text>
			</subsection></section><section id="H52087CE0B79A44E59B30CEF4357FAF23"><enum>4.</enum><header>Penalties</header>
			<subsection id="H443EFA7CB0974151B4FFD6FB62C25DAD"><enum>(a)</enum><header>Violation</header><text display-inline="yes-display-inline">It shall be unlawful for any person to
			 commit any fraudulent act in connection with a voucher issued under the
			 Program.</text>
			</subsection><subsection id="H2A00461FECC24670844A8F5677DDDABB"><enum>(b)</enum><header>Penalties</header><text display-inline="yes-display-inline">Any person who commits a violation
			 described in subsection (a) shall be liable to the United States Government for
			 a civil penalty of not more than $10,000 for each violation.</text>
			</subsection></section><section id="H75F0AD7A6C7C4C2CA29A99212A3D1453"><enum>5.</enum><header>Report</header><text display-inline="no-display-inline">The Secretary shall submit a report to the
			 Congress every 6 months that specifies, for the most recent 6-month period, the
			 number of vouchers that have been used under the Program.</text>
		</section><section id="H2440D98D2E1841A59385744653E4013E"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HFB6F41F440B04F0A93ABAF3D3B4C2D95"><enum>(1)</enum><header>Automobile</header><text>The
			 term <term>automobile</term> has the meaning given such term in section
			 32901(a) of title 49, United States Code.</text>
			</paragraph><paragraph id="HBE217ED6660A481CBC9843A447B5C63A"><enum>(2)</enum><header>Dealer</header><text display-inline="yes-display-inline">The term <term>dealer</term> means a person
			 residing in a State that is engaged in the sale of new automobiles as of the
			 date of introduction of this Act to the first person or eligible fleet operator
			 that is the ultimate purchaser.</text>
			</paragraph><paragraph id="H80720243E4C644F0B55F7276B78D556D"><enum>(3)</enum><header>Eligible fleet
			 operator</header><text display-inline="yes-display-inline">The term
			 <term>eligible fleet operator</term> means the operator of a fleet of
			 automobiles that is owned by a partnership, corporation, association, or public
			 or private organization.</text>
			</paragraph><paragraph id="HACFD97B291D948909026783F4D94ADB7"><enum>(4)</enum><header>Initial
			 period</header><text>The term <term>initial period</term> means the first 6
			 months of the Program, beginning from the date the Secretary certifies the
			 Program is operational.</text>
			</paragraph><paragraph id="HBAE15A73F5B84106AD82A737C6F37F2F"><enum>(5)</enum><header>New
			 automobile</header><text display-inline="yes-display-inline">The term <term>new
			 automobile</term> means an automobile for which a manufacturer, distributor, or
			 dealer has never transferred the equitable or legal title of such automobile to
			 an ultimate purchaser.</text>
			</paragraph><paragraph id="H5084BD303B3A4B02AC7AA671C3660C90"><enum>(6)</enum><header>Eligible new
			 automobile</header><text>The term <term>eligible new automobile</term> means a
			 new automobile whose purchase price is less than $50,000.</text>
			</paragraph><paragraph id="H788EE6B77A0D49EBAFAD302AE9E29AA5"><enum>(7)</enum><header>Person</header><text display-inline="yes-display-inline">The term <term>person</term> has the
			 meaning given such term in section 551 of title 5, United States Code.</text>
			</paragraph><paragraph id="H8206F73CFA7940A7B927C7A3E9F464A8"><enum>(8)</enum><header>Program</header><text>The
			 term <term>Program</term> means the New Automobile Voucher Program established
			 under section 3.</text>
			</paragraph><paragraph id="H80E4A5B9067E4335806F8058EF99DDB0"><enum>(9)</enum><header>Secondary
			 period</header><text>The term <term>secondary period</term> means the time
			 period beginning the day after the initial period has expired and ending
			 December 31, 2010.</text>
			</paragraph><paragraph id="H3174B16432874CD193AA13BB48ED1DE4"><enum>(10)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Treasury.</text>
			</paragraph><paragraph id="HBC1B8DC3FAC54C979438C6DD7EC93480"><enum>(11)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means a State
			 of the United States, the District of Columbia, Puerto Rico, the Northern
			 Mariana Islands, Guam, American Samoa, and the Virgin Islands.</text>
			</paragraph><paragraph id="HC9A14FCAAA1E43588C4AB24549BD201E"><enum>(12)</enum><header>Ultimate
			 purchaser</header><text>The term <term>ultimate purchaser</term> means, with
			 respect to a new automobile, the first person who purchases such automobile for
			 purposes other than resale.</text>
			</paragraph><paragraph id="H4C5787A88AF643D39ECD7F084ED69D05"><enum>(13)</enum><header>Voucher</header><text>The
			 term <term>voucher</term> means a voucher issued to a person who is purchasing
			 an eligible new automobile pursuant to the provisions of this Act.</text>
			</paragraph></section><section id="HF27DBCDDB6B94387B3BC3B66239207FD"><enum>7.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated to the Secretary $75,000,000,000 to carry out
			 this Act. Of the amount appropriated under this Act, the Secretary shall
			 obligate no more than $50,000,000 to cover administrative costs for the
			 Program.</text>
