		  treatment of autism under TRICARE.</official-title>

		<section id="HE235F3450D364D7C97BFE62939C7A41A" section-type="section-one"><enum>1.</enum><header>Treatment of autism under
			 TRICARE</header>
			<subsection id="H15AB1C892C9048DABA246E10D1A94942"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1077 of title
			 10, United States Code, is amended—</text>
				<paragraph id="H1EDD57CB3DC84464B9459B61EBBA650A"><enum>(1)</enum><text>in subsection (a),
			 by adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H3C58DED873DA4CE18F342CDF38D6F64D" style="USC">
						<paragraph id="HAB34F89CB53842A8822BB6BAE28CE9E1"><enum>(18)</enum><text display-inline="yes-display-inline">In accordance with subsection (g),
				treatment of autism spectrum disorders.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H4D0473944D5649C3A236553DB36479E9"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H03D8FDC530204A9A830749A68FD47FA0" style="USC">
						<subsection id="H76C894C136B942BABF8AE6B5F94CA067"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HB0A2D226D1B643B88B8C847B2B4F6B4B"><enum>(1)</enum><text display-inline="yes-display-inline">For purposes of subsection (a)(18),
				treatment of autism spectrum disorders shall be provided if a health care
				professional determines that the treatment is medically necessary. Such
				treatment shall include the following:</text>
								<subparagraph id="H35230BAE265847019D30F25207E24DF6" indent="up1"><enum>(A)</enum><text>Habilitative or rehabilitative
				care.</text>
								</subparagraph><subparagraph id="H6B04A048AF6449C69EFECC6410D04782" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Pharmaceutical agents.</text>
								</subparagraph><subparagraph id="H1D07CD0FA9E648179C8B31D3FEE8E064" indent="up1"><enum>(C)</enum><text>Psychiatric care.</text>
								</subparagraph><subparagraph id="HB404C5754EBB4153A483425BFC583F2B" indent="up1"><enum>(D)</enum><text>Psychological care.</text>
								</subparagraph><subparagraph id="HAA709C094AB7442281A7223873B79AF7" indent="up1"><enum>(E)</enum><text>Speech therapy.</text>
								</subparagraph><subparagraph id="HA42E002A063746C69C2B17B10A9AF7D6" indent="up1"><enum>(F)</enum><text>Occupational therapy.</text>
								</subparagraph><subparagraph id="H40A8CF2282E74AEB9762D273FC93178A" indent="up1"><enum>(G)</enum><text>Physical therapy.</text>
								</subparagraph><subparagraph id="H57AC19A5063742308DD2D5CFACB36410" indent="up1"><enum>(H)</enum><text display-inline="yes-display-inline">Group therapy, if a health care
				professional determines it necessary to develop, maintain, or restore the
				skills of the beneficiary.</text>
								</subparagraph><subparagraph id="HE28D61B05D904150A41DDA92D28FDC6D" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">Any other care or treatment that a health
				care professional determines medically necessary.</text>
								</subparagraph></paragraph><paragraph id="HA89BF5E2C06747D38136965233E5BEB6" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Beneficiaries under the age of five who
				have developmental delays and are considered at-risk for autism may not be
				denied access to treatment described by paragraph (1) if a health care
				professional determines that the treatment is medically necessary.</text>
							</paragraph><paragraph id="HF66F11C63ADE46C79964F9467867D609" indent="up1"><enum>(3)</enum><text>The Secretary may not consider the
				use of applied behavior analysis or other structured behavior programs under
				this section to be special education for purposes of section 1079(a)(9) of this
				title.</text>
							</paragraph><paragraph id="H5E56FF5E22FC46209D79C06D86031763" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">In carrying out this subsection, the
				Secretary shall ensure that—</text>
								<subparagraph id="H767D16D0436A4E0AACFD626ECE9723A4"><enum>(A)</enum><text display-inline="yes-display-inline">a
				person who is authorized to provide applied behavior analysis or other
				structured behavior programs is licensed or certified by a State, the Behavior
				Analyst Certification Board, or other accredited national certification board;
				and</text>
								</subparagraph><subparagraph commented="no" id="H73E3A2E771DA4AC79C5EB5708556F68D"><enum>(B)</enum><text display-inline="yes-display-inline">if
				applied behavior analysis or other structured behavior program is provided by
				an employee or contractor of a person authorized to provide such treatment, the
				employee or contractor shall meet minimum qualifications, training, and
				supervision requirements consistent with business best practices in the field
				of behavior analysis and autism services.</text>
								</subparagraph></paragraph><paragraph id="H3DDDA7DB05CF4E7F97D7416317970FF7" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">In this section:</text>
								<subparagraph id="HB4F9C7920F3D4B3399F87FED4850D0B4"><enum>(A)</enum><text>The term <term>autism spectrum
				disorders</term> includes autistic disorder, Asperger’s syndrome, and any of
				the pervasive developmental disorders as defined by the most recent edition of
				the Diagnostic and Statistical Manual of Mental Disorders.</text>
								</subparagraph><subparagraph id="H7DF39794C3134A8DAF4590FB773EF977"><enum>(B)</enum><text>The term <term>habilitative and
				rehabilitative care</term> includes—</text>
									<clause id="H9642A6A2E5514A028EE0A63EA28E97FC"><enum>(i)</enum><text>professional counseling;</text>
									</clause><clause id="H2A37E338A3A449F3ACEC3E8CF3DFA7E6"><enum>(ii)</enum><text>guidance service;</text>
									</clause><clause id="H6B922E1FA5A64FF0AFF67AA0EBDB4DFF"><enum>(iii)</enum><text>treatment programs, including not
				more than 40 hours per week of applied behavior analysis; and</text>
									</clause><clause id="H6CF6287215FD4BA7B9FBBBF80A50897F"><enum>(iv)</enum><text display-inline="yes-display-inline">other structured behavior programs that a
				health care professional determines necessary to develop, improve, maintain, or
				restore the functions of the beneficiary.</text>
									</clause></subparagraph><subparagraph id="HF357FE2B4961402BB715C0E8ECDA9C54"><enum>(C)</enum><text>The term <term>health care
				professional</term> has the meaning given that term in section 1094(e)(2) of
				this
				title.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" id="H2101A76ED0494A8E929A283F6A93C675"><enum>(b)</enum><header>Regulations</header><text>Not
			 later than 180 days after the enactment of this Act, the Secretary of Defense
			 shall prescribe such regulations as may be necessary to carry out section
			 1077(a)(18) of title 10, United States Code, as added by subsection (a).</text>
