<section commented="no" display-inline="no-display-inline" id="HF1A009EB8C674548A20A51201811622D" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Patient-Focused Critical Care Enhancement Act</short-title></quote>.</text></section> 
<section commented="no" display-inline="no-display-inline" id="HCDD21774ADC2492B884E9D452E45F663" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to optimize the delivery of critical care medicine and expand the critical care workforce.</text></section> 
<section commented="no" display-inline="no-display-inline" id="H4460F00215294AFBB28AFF05D23598E9" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Based on the Health Resources and Services Administration’s May 2006 Report to Congress, The Critical Care Workforce: A Study of the Supply and Demand for Critical Care Physicians, the Congress makes the following findings:</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HAC12209503B1482DB57039958A0CD0AE"><enum>(1)</enum><text display-inline="yes-display-inline">In 2000, an estimated 18,000,000 inpatient days of ICU care were provided in the United States through approximately 59,000 ICU beds in 3,200 hospitals.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H2CCDD4B8C0A74604828408F29330961F"><enum>(2)</enum><text display-inline="yes-display-inline">Patient outcomes and the quality of care in the ICU are related to who delivers that care and how care is organized.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H313E76B6A4B34D7585518D50C641F589"><enum>(3)</enum><text display-inline="yes-display-inline">The demand in the United States for critical care medical services is rising sharply and will continue to rise sharply largely as a result of the following 3 factors:</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HB5385C2895FA4ADDBFC49DC27AC0455C"><enum>(A)</enum><text display-inline="yes-display-inline">There is strong evidence demonstrating improvements in outcomes and efficiency when intensive care services are provided by nurses and intensivist physicians who have advanced specialty training in critical care medicine.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H760CC3478F3F4A3DACFD9DFA40492FF7"><enum>(B)</enum><text display-inline="yes-display-inline">The Leapfrog Group, health care payors, and providers are encouraging greater use of such personnel in intensive care settings.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HFC6A5CBD877B483AB1DE77E97C34258B"><enum>(C)</enum><text display-inline="yes-display-inline">Critical care services are overwhelmingly consumed by patients over the age of 65 and the aging of the United States population is driving demand for these services.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HB519554F92444CA78C06A38185AABAC4"><enum>(4)</enum><text display-inline="yes-display-inline">The future growth in the number of critical care physicians in ICU settings will be insufficient to keep pace with growing demand.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HB1E7D84662804416A3ECEA653935D644"><enum>(5)</enum><text display-inline="yes-display-inline">This growing shortage of critical care physicians presents a serious threat to the quality and availability of health care services in the United States.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HDA77649118D44BE2A77EF0E093B8F436"><enum>(6)</enum><text display-inline="yes-display-inline">This shortage will disproportionately impact rural and other areas of the United States that already often suffer from a suboptimal level of critical care services.</text></paragraph></section> 
<section commented="no" display-inline="no-display-inline" id="H12DD9C51541B41DAB24092D140BAC1F9" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Research</header> 
<subsection commented="no" display-inline="no-display-inline" id="HAB9A06B47CA9430E95FECA0A126D4E8E"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services, through the Agency for Healthcare Research and Quality, shall conduct research to assess—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HCC3B2E9A302C4B47902745BCCD0A236D"><enum>(1)</enum><text display-inline="yes-display-inline">the standardization of critical care protocols, intensive care unit layout, equipment interoperability, and medical informatics;</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H0E106F1F21E646A7A57DD8717EF50038"><enum>(2)</enum><text display-inline="yes-display-inline">the impact of differences in staffing, organization, size, and structure of intensive care units on access, quality, and efficiency of care; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H0A4B0C5BEA2041E5AF50ED7B57F3141D"><enum>(3)</enum><text display-inline="yes-display-inline">coordinated community and regional approaches to providing critical care services, including approaches whereby critical care patients are assessed and provided care based upon intensity of services required.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H42D7206C929B4E218D87BD6DA328B48C"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Agency for Healthcare Research and Quality shall submit a report to Congress, that, based on the review under subsection (a), evaluates and makes recommendations regarding best practices in critical care medicine.</text></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="H7CCE4FB0034E42B48AC65E2F811ACA77" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Innovative approaches to critical care services</header><text display-inline="no-display-inline">The Secretary of Health and Human Services shall undertake the following demonstration projects:</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H8F9254A47B544C19A3E265EA00ACAD29"><enum>(1)</enum><header display-inline="yes-display-inline">Optimization of critical care services</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="H46081F096E774628AFB7D764FA2E3450"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator of the Centers for Medicare &amp; Medicaid Services shall solicit proposals submitted by inpatient providers of critical care services who propose to demonstrate methods to optimize the provision of critical care services to Medicare beneficiaries through innovations in such areas as staffing, ICU arrangement, and utilization of technology.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H9FA9B29D640A43EF97AE6CE2ACA9C1D6"><enum>(B)</enum><header display-inline="yes-display-inline">Funding of proposals</header><text display-inline="yes-display-inline">The Administrator of the Centers for Medicare &amp; Medicaid Services shall fund not more than 5 proposals, not less than 1 of which shall focus on the training of hospital-based physicians in rural or community, or both, hospital facilities in the provision of critical care medicine. Such projects shall emphasize outcome measures based on the Institute of Medicine's following 6 domains of quality care:</text> 
<clause commented="no" display-inline="no-display-inline" id="HBD762E6E1CD4496D850E4A787E35730E"><enum>(i)</enum><text display-inline="yes-display-inline">Care should be safe.</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H5D75B080F5A043479076D1C6D1A1C3E0"><enum>(ii)</enum><text display-inline="yes-display-inline">Care should be effective.</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H60B6338913F2405982C437863782A707"><enum>(iii)</enum><text display-inline="yes-display-inline">Care should be patient-centered.</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H9F87933243D64DB6837AF7E08115AF84"><enum>(iv)</enum><text display-inline="yes-display-inline">Care should be timely.</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H856FD1FCC180451282661095AC9134E3"><enum>(v)</enum><text display-inline="yes-display-inline">Care should be efficient.</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HB749A3614719400EB3BD52225A5D066D"><enum>(vi)</enum><text display-inline="yes-display-inline">Care should be equitable.</text></clause></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H3192C785F4D944D8950E6B8B6A8E24C4"><enum>(2)</enum><header display-inline="yes-display-inline">Family assistance programs for the critically ill</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="H8DE64F480147427490E8769D5D584688"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services shall solicit proposals and make an award to support a consortium consisting of 1 or more providers of inpatient critical care services and a medical specialty society involved in the education and training of critical care providers.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H616B6393FEF24BF2AF572860F86862BA"><enum>(B)</enum><header display-inline="yes-display-inline">Measurement and evaluation</header><text display-inline="yes-display-inline">A provider that receives support under subparagraph (A) shall measure and evaluate outcomes derived from a <quote>family-centered</quote> approach to the provision of inpatient critical care services that includes direct and sustained communication and contact with beneficiary family members, involvement of family members in the critical care decisionmaking process, and responsiveness of critical care providers to family requests. Such project shall evaluate the impact of a family-centered, multiprofessional team approach on, and the correlation between—</text> 
<clause commented="no" display-inline="no-display-inline" id="H2BF8FF8FFFFE43D6B8BB94144B215B54"><enum>(i)</enum><text display-inline="yes-display-inline">family satisfaction;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H4F08A4B7798047CD8FACB86BCDAF92BC"><enum>(ii)</enum><text display-inline="yes-display-inline">staff satisfaction;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H07B1BFD0034B47B4BD5F956EE619A0DB"><enum>(iii)</enum><text display-inline="yes-display-inline">length of patient stay in an intensive care unit; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H7E0E1735E8C5497A9B5315DE5E33280F"><enum>(iv)</enum><text display-inline="yes-display-inline">cost of care.</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H61D079B409134D2B8982AEA9AE163E50"><enum>(C)</enum><header display-inline="yes-display-inline">Outcome measures</header><text display-inline="yes-display-inline">A provider that receives support under subparagraph (A) shall emphasize outcome measures based on the Institute of Medicine's following 6 domains of quality care:</text>

<clause commented="no" display-inline="no-display-inline" id="H4BC72DC5CEB14A13B6C4EF4663DC189D"><enum>(iii)</enum><text display-inline="yes-display-inline">Care should be patient-centered.</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HE1EBF73190114FFB95A660405921E5E0"><enum>(iv)</enum><text display-inline="yes-display-inline">Care should be timely.</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HBD2F8A917FA448208CE2639C00C5537B"><enum>(v)</enum><text display-inline="yes-display-inline">Care should be efficient.</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HC857BB09B9EB4FC6A65A754E6D8D0E1D"><enum>(vi)</enum><text display-inline="yes-display-inline">Care should be equitable.</text></clause></subparagraph></paragraph></section> 
<section commented="no" display-inline="no-display-inline" id="H8B292CF0451844CCA955F781BA6F710B" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Use of telemedicine to enhance critical care services in rural areas</header> 
<subsection commented="no" display-inline="no-display-inline" id="H76E324719D87450CAFF2AC47CE28873B"><enum>(a)</enum><header display-inline="yes-display-inline">Amendment to rural utilities service distance learning and telemedicine program</header><text display-inline="yes-display-inline">Chapter 1 of subtitle D of title XXIII of the Food, Agriculture, Conservation, and Trade Act of 1990 (7 U.S.C. 950aaa et seq.) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H36AF0EC30A0645EAB3B3EC0E377A9887" style="OLC"> 
<section commented="no" display-inline="no-display-inline" id="H8C1C332E0D174AC48549339F1CCAEC43" section-type="subsequent-section"><enum>2335B.</enum><header display-inline="yes-display-inline">Additional authorization of appropriations for telemedicine critical care initiatives</header><text display-inline="no-display-inline">In addition to amounts authorized under section 2335A, there is authorized to be appropriated $5,000,000 in each of fiscal years 2010 through 2012 to carry out telemedicine initiatives under this chapter whereby 1 or more rural providers of inpatient critical care services propose, through collaboration with other providers, to augment the delivery of critical care services in the rural inpatient setting through the use of telecommunications systems that allow for consultation with critical care providers not located in the rural facility regarding the care of such patients.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HC86D47C59A8D4BC1ACD5CF5815490D1E"><enum>(b)</enum><header display-inline="yes-display-inline">Amendment to telehealth network grant program</header><text display-inline="yes-display-inline">Section 330I(i)(1)(B) of the Public Health Service Act (42 U.S.C. 254c–14(i)(1)(B)) is amended by striking the period at the end and inserting <quote>, or that augment the delivery of critical care services in rural inpatient settings through consultation with providers located elsewhere.</quote>.</text></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="H0E7B93BCD33B4AC9B6B1591F81C54683" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Increasing the supply of critical care providers</header><text display-inline="no-display-inline">Section 338B of the Public Health Service Act (42 U.S.C. 254l–1) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H2B0496DEEF234FBA8E6D9F7638476927" style="OLC"> 
<subsection commented="no" display-inline="no-display-inline" id="H1870099D39F64190BF7858060B6AE120"><enum>(i)</enum><header display-inline="yes-display-inline">Critical care initiative</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H4B0A2DF956F64EECAA3AF83FF66DDCE1"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Secretary shall undertake an initiative that has as its goal the annual recruitment of not less than 50 providers of critical care services into the National Health Service Corps Loan Repayment Program. Providers recruited pursuant to this initiative shall be additional to, and not detract from, existing recruitment activities otherwise authorized by this section.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H28F153E8176F456EA7CF28312CCB8A20"><enum>(2)</enum><header display-inline="yes-display-inline">Clarifying amendment</header><text display-inline="yes-display-inline">The initiative described in paragraph (1) shall be undertaken pursuant to the authority of this section, and for purposes of the initiative—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H556FD4B3051A4A51B7C3C14E4208D538"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>primary health services</term> as used in subsection (a) shall be understood to include critical care services; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HAB0266693D144E1F99002F9BCA1F1D24"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>an approved graduate training program</term> as used in subsection (b)(1)(B) shall be limited to pulmonary fellowships or critical care fellowships, or both, for physicians.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section commented="no" display-inline="no-display-inline" id="H0308ADBF40744A2481E4516AC390B907" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to carry out this Act—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HB78B4996BC0F4F3EA18A69C43FCFB239"><enum>(1)</enum><text display-inline="yes-display-inline">$5,000,000 for the research to be conducted under section 4; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HA538AAF775AD4EE3B4B2D7CBC2CFAAC5"><enum>(2)</enum><text display-inline="yes-display-inline">$4,000,000 for the demonstration projects authorized under section 5.</text></paragraph></section>
