		<official-title>To debar or suspend contractors from Federal contracting
		  for unlawful employment of aliens, and for other purposes.</official-title>

		<section id="H998E078CE6E644C4B625CC5BC3C24565" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Border Control and Contractor
			 Accountability Act of 2009</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H21D8A46915614404986BBA5548F872AE" section-type="subsequent-section"><enum>2.</enum><header>Debarment or
			 suspension from Federal contracting for employment of illegal aliens</header>
			<subsection id="HCED16255720B4F92B831170200E23783"><enum>(a)</enum><header>Requirement</header><text>In
			 the case of a contract awarded by an Executive agency, if the head of the
			 agency determines, by a preponderance of the evidence, that the contractor
			 performing the contract directly employed, or had knowledge of a
			 subcontractor’s employment of, any alien whose immigration status does not
			 authorize the alien to be so employed, the head of the agency shall—</text>
				<paragraph id="H14548F93ADA14C4B9D1491572B1BC666"><enum>(1)</enum><text>debar or suspend
			 the contractor in accordance with the Federal Acquisition Regulation;
			 and</text>
				</paragraph><paragraph id="H540D157EAA7C40CCA7FC2BB9DFB8009B"><enum>(2)</enum><text>terminate the
			 contract in accordance with the Federal Acquisition Regulation, unless the
			 contractor or subcontractor, as the case may be, agrees to terminate the
			 employment of any such alien.</text>
				</paragraph></subsection><subsection id="H20616A8C3E3C43C7BDC3D3399D6F59C4"><enum>(b)</enum><header>Period of
			 debarment or suspension</header><text>The period of debarment or suspension
			 under subsection (a) shall be 3 years.</text>
			</subsection><subsection id="H521F517DCB64461CB6B88EFE7E8F14"><enum>(c)</enum><header>Annual
			 report</header><text>The head of each Executive agency shall submit to Congress
			 each year a report describing—</text>
				<paragraph id="HE6939E9664CB4C12BEC9E9E1D37B999F"><enum>(1)</enum><text>the contractors
			 that the agency has debarred or suspended pursuant to this section;</text>
				</paragraph><paragraph id="H8DEEED10771949F300A4B609E6FCC79B"><enum>(2)</enum><text>the contracts that
			 the agency has terminated pursuant to this section; and</text>
				</paragraph><paragraph id="HC3C28125E7F442E2B4CF2F53FFF5B2A2"><enum>(3)</enum><text>any cost
			 implications of debarments, suspensions, or terminations of contracts referred
			 to in paragraphs (1) and (2).</text>
				</paragraph></subsection><subsection id="H4BAD7545D1424C83B8681FB8A95BFFC5"><enum>(d)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>Executive
			 agency</term> has the meaning provided in section 105 of title 5, United States
			 Code.</text>
			</subsection></section><section display-inline="no-display-inline" id="H9E084D87176340A09746565F83AD209" section-type="subsequent-section"><enum>3.</enum><header>Small Business
			 Administration Liaison</header>
			<subsection id="H1851E32B99524055B44530C859ABC741"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall
			 establish the position of Small Business Administration Liaison within United
			 States Immigration and Customs Enforcement.</text>
			</subsection><subsection id="HC114BD9DCFB340EEAD9D31CBCB723B85"><enum>(b)</enum><header>Functions</header><text display-inline="yes-display-inline">The Liaison shall, in consultation with the
			 Administrator of the Small Business Administration, ensure that the Small
			 Business Administration does not make or guarantee a loan to an alien who is
			 unlawfully present in the United States.</text>
			</subsection></section><section id="HD3B3390861634959804B249B96B59B95"><enum>4.</enum><header>Transport of
			 aliens unlawfully present in the United States</header>
			<subsection id="H113AD2B8509A4179BEFD6A7435F4957"><enum>(a)</enum><header>Transport</header><text>The
			 Secretary of Homeland Security is authorized to enter into contracts with
			 private entities for the purpose of providing secure domestic transport of
			 aliens who are apprehended at or along the international land or maritime
			 borders of the United States from the custody of the Border Patrol to detention
			 facilities.</text>
			</subsection><subsection id="H2F4146A7D0D64F89AAB0D0CAA7D09049"><enum>(b)</enum><header>Criteria for
			 selection</header><text>To enter into a contract under subsection (a), a
			 private entity shall submit an application to the Secretary at such time, in
			 such manner, and containing such information as the Secretary may require. The
			 Secretary shall select from such applications those entities which offer, in
			 the determination of the Secretary, the best combination of quality, lowest
			 cost, and security.</text>
			</subsection></section><section id="H9CBBCDC1AA3E4A2DAE8E950000F0066"><enum>5.</enum><header>Prohibition on
			 Department of Homeland Security from contracting with companies not
			 participating in basic pilot program</header><text display-inline="no-display-inline">No contract may be awarded by the Department
			 of Homeland Security to an entity that employs individuals unless the entity
			 agrees to elect to participate in the basic pilot program described in section
			 403(a) of the Illegal Immigration Reform and Immigrant Responsibility Act of
			 1996 (8 U.S.C. 1324a note).</text>
