		<section id="iddc270f1e508e4521bf5c943aadd67fc8" section-type="resolved"><text>That the bill from the House of Representatives
		(H.R. 1517) entitled <quote>An Act to allow certain U.S. Customs and Border
		Protection employees who serve under an overseas limited appointment for at
		least 2 years, and whose service is rated fully successful or higher throughout
		that time, to be converted to a permanent appointment in the competitive
		service.</quote>, do pass with the following</text>
		</section><amendment><amendment-instruction blank-lines-after="0"><text>Strike out all
	 after the enacting clause and
	 insert:</text></amendment-instruction><amendment-block blank-lines-after="1" changed="added" reported-display-style="italic">
				<legis-body changed="added" display-enacting-clause="no-display-enacting-clause" reported-display-style="italic">
					<section commented="no" display-inline="no-display-inline" id="id80b2b698-3034-4bc2-8f0f-d0951c515330" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">For purposes of this Act—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="idcb22f0bd-ca54-4934-b52a-69fc3f8e47b5"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Commissioner</term> means
		  the Commissioner of U.S. Customs and Border Protection;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11b8c4ce-4c48-450e-a9b3-9b39832cf7ff"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>U.S. Customs and Border
		  Protection</term> means U.S. Customs and Border Protection of the Department of
		  Homeland Security;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf5ae44c9-a7da-42a7-8290-678d79b055cc"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>competitive service</term>
		  has the meaning given such term by
		  <external-xref legal-doc="usc" parsable-cite="usc/5/2102">section
		  2102</external-xref> of title 5, United States Code; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5ccdd7c5-4cf7-432c-bcf7-4c4b2a2962bc"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>overseas limited
		  appointment</term> means an appointment under—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id317e985c-3802-4728-99df-f9f57a0114a3"><enum>(A)</enum><text display-inline="yes-display-inline">subpart B of part 301 of title 5 of the
		  Code of Federal Regulations, as in effect on January 1, 2008; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf566a727-3a76-4b9b-a9f4-89bf70c415be"><enum>(B)</enum><text display-inline="yes-display-inline">any similar antecedent or succeeding
		  authority, as determined by the Commissioner.</text>
							</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="idecaa1506-b37c-4587-be13-37037838ef01" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Authority to convert certain overseas
		  limited appointments to permanent appointments</header>
						<subsection commented="no" display-inline="no-display-inline" id="ide92dd8a4-f79f-44ee-8a53-6849a66a3ff8"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding
		  <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter
		  33</external-xref> of title 5, United States Code, or any other provision of
		  law relating to the examination, certification, and appointment of individuals
		  in the competitive service, the Commissioner may convert an employee serving
		  under an overseas limited appointment within U.S. Customs and Border Protection
		  to a permanent appointment in the competitive service within U.S. Customs and
		  Border Protection, if—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id3eedc427-b1e9-4d64-8420-1a2bdbfe90f7"><enum>(1)</enum><text display-inline="yes-display-inline">as of the time of conversion, the employee
		  has completed at least 2 years of current continuous service under 1 or more
		  overseas limited appointments; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2cac2359-ea6b-4bba-a9b9-0f0af5217829"><enum>(2)</enum><text display-inline="yes-display-inline">the employee’s performance has, throughout
		  the period of continuous service referred to in paragraph (1), been rated at
		  least fully successful or the equivalent.</text>
							</paragraph><continuation-text commented="no" continuation-text-level="subsection">An
		  employee whose appointment is converted under the preceding sentence acquires
		  competitive status upon conversion.</continuation-text></subsection><subsection commented="no" display-inline="no-display-inline" id="id786f8a94-f72a-4a02-b057-5fb723c96057"><enum>(b)</enum><header display-inline="yes-display-inline">Indemnification and privileges</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id5fa41018-2868-49b4-9fc7-531fcf28f269"><enum>(1)</enum><header display-inline="yes-display-inline">Indemnification</header><text display-inline="yes-display-inline">The United States shall, in the case of any
		  individual whose appointment is converted under subsection (a), indemnify and
		  hold such individual harmless from any claim arising from any event, act, or
		  omission—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id716374e3-0fe7-4ae6-b2f5-0d6a7de92a5c"><enum>(A)</enum><text display-inline="yes-display-inline">that arises from the exercise of such
		  individual’s official duties, including by reason of such individual’s
		  residency status, in the foreign country in which such individual resides at
		  the time of conversion;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id28671ec1-7767-4311-8f58-5b7b17dbaea1"><enum>(B)</enum><text display-inline="yes-display-inline">for which the individual would not have
		  been liable had the individual enjoyed the same privileges and immunities in
		  the foreign country as an individual who either was a permanent employee, or
		  was not a permanent resident, in the foreign country at the time of the event,
		  act, or omission involved; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5c751cc5-af55-44c3-b1fb-650ba2fbcd6f"><enum>(C)</enum><text display-inline="yes-display-inline">that occurs before, on, or after the date
		  of the enactment of this Act,</text>
								</subparagraph><continuation-text commented="no" continuation-text-level="paragraph">including any claim for taxes owed to the
		  foreign country or a subdivision thereof.</continuation-text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idde8f6705-cb19-4122-9c11-009a0dc76f8b"><enum>(2)</enum><header display-inline="yes-display-inline">Services and payments</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="id1e6d62b2-8f96-4b17-9a92-0b24cbf4d3c1"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In the case of any individual whose
		  appointment is converted under subsection (a), the United States shall provide
		  to such individual (including any dependents) services and monetary
		  payments—</text>
									<clause commented="no" display-inline="no-display-inline" id="id8e86fccd-49e6-4211-81da-448b6e6ef5d0"><enum>(i)</enum><text display-inline="yes-display-inline">equivalent to the services and monetary
		  payments provided to other U.S. Customs and Border Protection employees in
		  similar positions (and their dependents) in the same country of assignment by
		  international agreement, an exchange of notes, or other diplomatic policy;
		  and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idd000740f-396e-4aab-b934-2b50af8979aa"><enum>(ii)</enum><text display-inline="yes-display-inline">for which such individual (including any
		  dependents) was not eligible by reason of such individual’s overseas limited
		  appointment.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3d1c05aa-65b5-42db-b62c-bfe90995caeb"><enum>(B)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">Services and payments under this paragraph
		  shall be provided to an individual (including any dependents) to the same
		  extent and in the same manner as if such individual had held a permanent
		  appointment in the competitive service throughout the period described in
		  subsection (a)(1).</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6b34976e-46f5-490d-8c42-8572fea6557a"><enum>(c)</enum><header display-inline="yes-display-inline">Guidance on implementation</header><text display-inline="yes-display-inline">The Commissioner shall implement the
		  conversion of an employee serving under an overseas limited appointment to a
		  permanent appointment in the competitive service in a manner that—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ida18d73be-2bab-4166-9fde-571d376554af"><enum>(1)</enum><text display-inline="yes-display-inline">meets the operational needs of the U.S.
		  Customs and Border Protection; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9097e501-17d0-4110-a20c-d321480ef2c0"><enum>(2)</enum><text display-inline="yes-display-inline">to the greatest extent practicable, is not
		  disruptive to the employees affected under this Act.</text>
							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idE206AC26977F429D947F37FFFDBEF013"><enum>3.</enum><header>Rule of
		  Construction</header><text display-inline="no-display-inline">Nothing in this
		  Act shall be construed to affect the pay of any individual for services
		  performed by such individual before the date of the conversion of such
		  individual.</text>
					</section><section id="id04B2E6B6231E434F92D32AAA2EA9E74B"><enum>4.</enum><header>Termination</header><text display-inline="no-display-inline">The authority of the Commissioner to convert
		  an employee serving under an overseas limited appointment within U.S. Customs
		  and Border Protection to a permanent appointment in the competitive service
		  within U.S. Customs and Border Protection shall terminate on the date that is 2
		  years after the date of the enactment of this Act.</text>
