		<official-title display="yes">To increase, effective as of December 1,
		  2009, the rates of disability compensation for veterans with service-connected
		  disabilities and the rates of dependency and indemnity compensation for
		  survivors of certain service-connected disabled veterans, and for other
		  purposes.</official-title>

		<section display-inline="no-display-inline" id="H9417EA05A52144BBAFE62027EB712E49" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Veterans’ Compensation Cost-of-Living Adjustment Act of
			 2009</short-title></quote>.</text>
		</section><section id="H00F465129F5649D0A9E0512957381EF6"><enum>2.</enum><header>Increase in rates
			 of disability compensation and dependency and indemnity compensation</header>
			<subsection id="H9FFF4A159F204182ACC8D3666E1D13D"><enum>(a)</enum><header>Rate
			 adjustment</header><text>Effective on December 1, 2009, the Secretary of
			 Veterans Affairs shall increase, in accordance with subsection (c), the dollar
			 amounts in effect on November 30, 2009, for the payment of disability
			 compensation and dependency and indemnity compensation under the provisions
			 specified in subsection (b).</text>
			</subsection><subsection id="HB3F340003AFC476ABCAC0477AABFD22D"><enum>(b)</enum><header>Amounts To be
			 increased</header><text>The dollar amounts to be increased pursuant to
			 subsection (a) are the following:</text>
				<paragraph id="H82980C1A7194479FAF5F883B6742DD9"><enum>(1)</enum><header>Wartime
			 disability compensation</header><text>Each of the dollar amounts under
			 <external-xref legal-doc="usc" parsable-cite="usc/38/1114">section
			 1114</external-xref> of title 38, United States Code.</text>
				</paragraph><paragraph id="HCAEC8085A6B04A0D96360330FCD0067F"><enum>(2)</enum><header>Additional
			 compensation for dependents</header><text>Each of the dollar amounts under
			 sections 1115(1) of such title.</text>
				</paragraph><paragraph id="H125967B967554B20A4B902FC1567AF72"><enum>(3)</enum><header>Clothing
			 allowance</header><text>The dollar amount under section 1162 of such
			 title.</text>
				</paragraph><paragraph id="HF536F6AE826C4FF79B005CD25B48E976"><enum>(4)</enum><header>Dependency and
			 indemnity compensation to surviving spouse</header><text>Each of the dollar
			 amounts under subsections (a) through (d) of section 1311 of such title.</text>
				</paragraph><paragraph id="H6680B06C6FF3420EA2642CB1372D562E"><enum>(5)</enum><header>Dependency and
			 indemnity compensation to children</header><text>Each of the dollar amounts
			 under sections 1313(a) and 1314 of such title.</text>
				</paragraph></subsection><subsection id="H18A38AA8E2794B58AB44ECE56052ACC"><enum>(c)</enum><header>Determination of
			 Increase</header>
				<paragraph id="H2E800D59BC7A4F6994576215AB189CE6"><enum>(1)</enum><header>Percentage</header><text>Except
			 as provided in paragraph (2), each dollar amount described in subsection (b)
			 shall be increased by the same percentage as the percentage by which benefit
			 amounts payable under title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401 et
			 seq.</external-xref>) are increased effective December 1, 2009, as a result of
			 a determination under section 215(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C.
			 415(i)</external-xref>).</text>
				</paragraph><paragraph id="H21362026DA5D4F3FA219BF27EB99A6AE"><enum>(2)</enum><header>Rounding</header><text>Each
			 dollar amount increased under paragraph (1), if not a whole dollar amount,
			 shall be rounded to the next lower whole dollar amount.</text>
				</paragraph></subsection><subsection id="HB77EA7609FB845F190F9F9B0FC80A4EB"><enum>(d)</enum><header>Special
			 rule</header><text>The Secretary of Veterans Affairs may adjust
			 administratively, consistent with the increases made under subsection (a), the
			 rates of disability compensation payable to persons under section 10 of
			 <external-xref legal-doc="public-law" parsable-cite="pl/85/857">Public Law
			 85–857</external-xref> (72 Stat. 1263) who have not received compensation under
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">chapter 11</external-xref> of title 38,
			 United States Code.</text>
			</subsection></section><section id="H350FDB52A06C49D1BDDE1B65748F2768"><enum>3.</enum><header>Publication of
			 adjusted rates</header><text display-inline="no-display-inline">The Secretary
			 of Veterans Affairs shall publish in the Federal Register the amounts specified
			 in section 2(b), as increased under that section, not later than the date on
			 which the matters specified in section 215(i)(2)(D) of the Social Security Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/415">42 U.S.C.
			 415(i)(2)(D)</external-xref>) are required to be published by reason of a
			 determination made under section 215(i) of such Act during fiscal year
			 2010.</text>
