<official-title>To amend the lead prohibition provisions of the Consumer Product Safety Improvement Act of 2008 to provide an exemption for certain all-terrain vehicles, and for other purposes.</official-title>

<section id="HA328E09E88A347D8AFB22D82D45844BE" section-type="section-one"><enum>1.</enum><header>Exemption for all-terrain vehicles</header>
<subsection id="HE9CC213DAB1840FE850F524773C77B5F"><enum>(a)</enum><header>Exclusion of certain materials or products and inaccessible component parts</header><text display-inline="yes-display-inline">Section 101(b) of the Consumer Product Safety Improvement Act of 2008 is amended by redesignating paragraph (5) as paragraph (6) and inserting after paragraph (4) the following:</text>

<paragraph id="HFCB137CEE93B407595C5950643DB7875"><enum>(5)</enum><header>Exception for all-terrain vehicles</header>
<subparagraph id="HE175DC5BA09C42CE8B532CB79921D04B"><enum>(A)</enum><header>Determination by Commission</header><text>If the Commission determines that it is not technologically feasible for certain all-terrain vehicles to comply with subsection (a) due to certain component parts that are required for the safety or functionality of such vehicles, the Commission, by regulation, shall exempt such vehicles from the requirements of such subsection.</text></subparagraph>
<subparagraph id="H2A893536531544B58C7E77DFF1997105"><enum>(B)</enum><header>All-terrain vehicles defined</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>all-terrain vehicle</term> means any motorized, off-highway vehicle designed to travel on 2, 3, or 4 wheels, having a seat designed to be straddled by the operator and handlebars for steering control.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H68F742F1986B458E8ABB32399872906D"><enum>(b)</enum><header>Additional amendment</header><text>Such section is further amended in paragraph (1)(A) by striking <quote>any</quote>.</text> </subsection></section>
