		<official-title>To authorize the Secretary of Health and Human Services
		  to provide services for birth parents who have placed a child for adoption, and
		  for other purposes.</official-title>

		<section id="H0A21329CBB6A4856009641891D530050" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Birth Parent Assistance Act of
			 2009</short-title></quote>.</text>
		</section><section id="HBF159BE45898412B84BC2DF744F41EAB"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
			<paragraph id="H530EDA922BB349C8B766A3492FA56D4B"><enum>(1)</enum><text>to enhance
			 post-placement services for birth parents who have placed a child for
			 adoption;</text>
			</paragraph><paragraph id="H8521D2FE28FF466EB77113482CFA4438"><enum>(2)</enum><text>to initiate or
			 enhance post-placement counseling services for birth parents who have placed a
			 child for adoption; and</text>
			</paragraph><paragraph id="H120B3648859940D7A95B9EE0AE9C5F80"><enum>(3)</enum><text>to identify how
			 post-placement services for birth parents who have placed a child for adoption
			 can be improved.</text>
			</paragraph></section><section id="H1F9ACE6CA0CC4DFFB5BFB531D7208C2B"><enum>3.</enum><header>Authorization of
			 post-adoption services for birth parents</header>
			<subsection id="HD371E93EFCE94BF19BF749842933239E"><enum>(a)</enum><header>Services
			 authorized</header><text display-inline="yes-display-inline">The Secretary of
			 Health and Human Services shall, either directly or by grant to or contract
			 with the eligible entities described in subsection (b), provide services
			 described in subsection (c) for birth parents who have placed a child for
			 adoption.</text>
			</subsection><subsection id="HE7ADA8A39D25412F9DB2147426D46F23"><enum>(b)</enum><header>Eligible
			 entities</header><text>The eligible entities referred to in subsection (a) are
			 States, local governmental entities, and public or private agencies or
			 organizations, including public or private licensed child welfare or adoption
			 agencies or adoptive family groups and faith-based organizations.</text>
			</subsection><subsection id="HCBD544649B4D46349E0464CD7B2585E8"><enum>(c)</enum><header>Types of
			 services</header><text>The types of services referred to in subsection (a)
			 are—</text>
				<paragraph id="HD2D177043DC44E678D0954EBC1A9C9C8"><enum>(1)</enum><text>post-legal
			 adoption services for birth parents;</text>
				</paragraph><paragraph id="HF9EC01460BCA4E30B89300068B636920"><enum>(2)</enum><text>counseling
			 services for birth parents who have placed a child for adoption,
			 including—</text>
					<subparagraph id="H08B91B45CAC54D708CEC812A62C39E"><enum>(A)</enum><text>individual
			 counseling;</text>
					</subparagraph><subparagraph id="H7CDED9B775254707B6B450F58F56AF00"><enum>(B)</enum><text>group counseling;
			 and</text>
					</subparagraph><subparagraph id="HC6455DB7702D4324B5AE21CC2E73D74"><enum>(C)</enum><text>family counseling;
			 and</text>
					</subparagraph></paragraph><paragraph id="HA3DC9E06FE6B4978BAD9D57BF0149FB"><enum>(3)</enum><text display-inline="yes-display-inline">training of mental health professionals,
			 social workers, and staff at hospitals and other appropriate birth care
			 facilities relating to interaction of such individuals with birth parents and
			 adoptive families.</text>
				</paragraph></subsection><subsection id="HBB3D81177ABD458BAF77B4865DDF1377"><enum>(d)</enum><header>Application</header><text display-inline="yes-display-inline">Each eligible entity referred to in
			 subsection (a) that desires to receive a grant or enter into a contract with
			 the Secretary under subsection (a) shall submit an application to the Secretary
			 that describes the manner in which the entity will use funds under the grant or
			 contract during the 3 fiscal years subsequent to the date of the application to
			 accomplish the purposes of this section. Such application shall be in a form
			 and manner determined to be appropriate by the Secretary.</text>
			</subsection><subsection id="HC6E7DD8767CF4B93A1F90689057DB3AB"><enum>(e)</enum><header>Reports</header><text display-inline="yes-display-inline">The Secretary shall require each eligible
			 entity referred to in subsection (a) that receives a grant or enters into a
			 contract with the Secretary under subsection (a) to submit to the Secretary a
			 report on the services provided or activities carried out by the entity for
			 each fiscal year for which the entity receives amounts under the grant or
			 contract. The report shall contain such information as the Secretary determines
			 is necessary to provide an accurate description of the services provided or
			 activities carried out with such amounts.</text>
			</subsection><subsection id="HB8598ECAACFF404CB65DB858BC45589B"><enum>(f)</enum><header>Services To
			 supplement and not supplant</header><text display-inline="yes-display-inline">Services provided under a grant or contract
			 under subsection (a) shall supplement, and not supplant, services provided
			 using any other funds made available for the same general purposes.</text>
			</subsection><subsection id="H46E392FE730343D680D189E278DE4900"><enum>(g)</enum><header>Technical
			 assistance and administrative provisions</header><text display-inline="yes-display-inline">The Secretary shall—</text>
				<paragraph id="HFF0B4D5F4C534532A5CA6C6B0721B60"><enum>(1)</enum><text>provide technical
			 assistance to eligible entities referred to in subsection (a) that receive a
			 grant or enter into a contract with the Secretary under subsection (a) for
			 purposes of providing the services described in subsection (c);</text>
				</paragraph><paragraph id="H45B4F9AE5877480BA864AAE851F42063"><enum>(2)</enum><text>as appropriate,
			 coordinate the provision of services described in subsection (c) with other
			 adoption-related research, training, services, and assistance activities
			 carried out by the Department of Health and Human Services; and</text>
				</paragraph><paragraph id="H438F4C21F5674528A000D534C500605E"><enum>(3)</enum><text>either directly,
			 or by grant to or contract with a public or private agency or
			 organization—</text>
					<subparagraph id="HF3DEABDB481A4F67B2B7B3DF4977005E"><enum>(A)</enum><text>evaluate the
			 implementation and effectiveness of the provision of services described in
			 subsection (c) and other activities carried out under this section;</text>
					</subparagraph><subparagraph id="H34D602754C2F45118E7DD2E117BD007D"><enum>(B)</enum><text>identify different
			 post-placement services provided for birth parents, the availability and
			 utilization of such services, and how post-placement services might be
			 improved; and</text>
					</subparagraph><subparagraph id="H42B47705002E41169EFF7D6654DC6418"><enum>(C)</enum><text display-inline="yes-display-inline">not later than 3 years after the date of
			 the enactment of this Act, submit to Congress a report that contains the
			 results of the evaluation under subparagraph (A) and the information described
			 in subparagraph (B).</text>
					</subparagraph></paragraph></subsection></section><section id="HEC7F6E8F89FC42D7BB09BF81EABB2AF"><enum>4.</enum><header>Authorization of
			 appropriations</header>
			<subsection id="HCF43AD4233E74423B698409724383568"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">To carry out this
			 Act, there are authorized to be appropriated to the Secretary of Health and
			 Human Services—</text>
				<paragraph id="HFA740BD38E804DBCBA7B8652FAC6001F"><enum>(1)</enum><text>$30,000,000 for
			 fiscal year 2010; and</text>
				</paragraph><paragraph id="H7C4657F4E84D47CE8D11A7E7F16156C2"><enum>(2)</enum><text>such sums as may
			 be necessary for each of the fiscal years 2011 through 2014.</text>
				</paragraph></subsection><subsection id="H96C4807511B649EEAA25D2A9E767FEE"><enum>(b)</enum><header>Availability</header><text>Amounts
			 appropriated pursuant to the authorization of appropriations under subsection
			 (a) are authorized to remain available until expended.</text>
