		<official-title>To amend the Small Business Investment Act of 1958 to
		  reauthorize and expand the New Markets Venture Capital Program, and for other
		  purposes.</official-title>

		<section id="H5B9B449C826541AFB08424C6F3A757FB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Securing Equity for the Economic Development of Low Income
			 Areas Act of 2009</short-title></quote>.</text>
		</section><section id="HAB882E499D8B445A8B05AB37C859E5B6"><enum>2.</enum><header>Expansion of new
			 markets venture capital program</header>
			<subsection id="HFFAB1EDD5EA54334AA15E5E4D871D372"><enum>(a)</enum><header>Selection of
			 Companies in Each Geographic Region</header><text>Section 354 of the Small
			 Business Investment Act of 1958 (15 U.S.C. 689b) is amended by adding at the
			 end the following new subsection:</text>
				<quoted-block id="H6EB1359229C44404009B6B452BA5D02" style="OLC">
					<subsection id="HD3B465A35A464AC1BC9382A7F25D5D85"><enum>(f)</enum><header>Geographic
				Requirement</header><text>In selecting companies to participate as New Markets
				Venture Capital companies in the program established under this part, the
				Administrator shall select, to the extent practicable, from among companies
				submitting applications under subsection (b), at least one company from each
				geographic region of the Small Business
				Administration.</text>
					</subsection><after-quoted-block></after-quoted-block></quoted-block>
			</subsection><subsection id="HD2234D42DC9547F9847F149F4159F4D1"><enum>(b)</enum><header>Participation in
			 New Markets Venture Capital Program</header>
				<paragraph id="H4A7B9A8B633E4F9B8FF3D065B3C17EF9"><enum>(1)</enum><header>Administration
			 participation required</header><text>Section 353 of the Small Business
			 Investment Act of 1958 (15 U.S.C. 689b) is amended by striking <quote>under
			 which the Administrator may</quote> and inserting <quote>under which the
			 Administrator shall</quote>.</text>
				</paragraph><paragraph id="H4662A3E6603348EE869794BD8D0371F"><enum>(2)</enum><header>Small
			 manufacturer participation agreements required</header><text>Such section, as
			 amended by paragraph (1), is further amended, by inserting after <quote>section
			 352</quote> the following: <quote>(with at least one such agreement to be with
			 a company engaged primarily in development of and investment in small
			 manufacturers, to the extent practicable)</quote>.</text>
				</paragraph></subsection><subsection id="H8683B80A9FA64B06881876EBD70D58D"><enum>(c)</enum><header>Report to
			 Congress</header><text>Not later than 1 year after the date of the enactment of
			 this Act, the Administrator of the Small Business Administration shall submit
			 to Congress a report evaluating the success of the expansion of the New Markets
			 Venture Capital Program under this section.</text>
			</subsection></section><section id="H2D6C935410C2495C8CE0F5819593883"><enum>3.</enum><header>Establishment of
			 office of new markets venture capital</header>
			<subsection id="HCBF718454C984A8D9556B982CBCB688C"><enum>(a)</enum><header>In
			 General</header><text>Title II of the Small Business Investment Act of 1958 (15
			 U.S.C. 671 et seq.) is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="H5505298F25444828809E2588C5B73772" style="OLC">
					<section id="H1B75C85D9D1B442FA700B1B0C4A40069"><enum>202.</enum><header>Office of New
				Markets Venture Capital</header>
						<subsection id="H94A1952CD8904CFBA31F3C807C8751A7"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is hereby established in the
				Investment Division of the Small Business Administration an office to be known
				as the <quote>Office of New Markets Venture Capital</quote>.</text>
						</subsection><subsection id="HECC8805BEE2D433F80AF00337C382E31"><enum>(b)</enum><header>Director</header><text display-inline="yes-display-inline">The Office of New Markets Venture Capital
				shall be headed by a Director who shall be appointed by the
				Administrator.</text>
						</subsection><subsection id="H5C93A54E9001498D9D5211BBCF45FB9C"><enum>(c)</enum><header>Responsibilities
				of Director</header><text display-inline="yes-display-inline">Subject to the
				direction and control of the Administrator, the responsibilities of the
				Director of the Office of New Markets Venture Capital are as follows:</text>
							<paragraph id="HDEFDB9F562504EF986FC177177737D26"><enum>(1)</enum><text display-inline="yes-display-inline">To administer the New Markets Venture
				Capital Program.</text>
							</paragraph><paragraph id="H5F865103E8D24D149094513E25627D86"><enum>(2)</enum><text display-inline="yes-display-inline">To periodically assess the nature and scope
				of the New Markets Venture Capital Program and to advise the Administrator on
				recommended changes to the program based on such assessment.</text>
							</paragraph><paragraph id="HF7653C8D46BD49A3A700EAB41FF83789"><enum>(3)</enum><text display-inline="yes-display-inline">To work to expand the number of small
				business concerns participating in the New Markets Venture Capital
				Program.</text>
							</paragraph><paragraph id="H0754A23F7AB044A29EEA8004F3AEC9B"><enum>(4)</enum><text display-inline="yes-display-inline">To encourage investment in small
				manufacturing.</text>
							</paragraph><paragraph id="HCBFBC00FF33B4685BE75002CB7E89CED"><enum>(5)</enum><text display-inline="yes-display-inline">To perform such other duties relating to
				such responsibilities as the Administrator may
				provide.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H7181F1FAEF704096B128F8DDD815B282"><enum>(b)</enum><header>Authorization of
			 Appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated $1,000,000 to carry out this section.</text>
			</subsection></section><section id="H6D7B6F6CBE374D2B9F1E8D0021050058"><enum>4.</enum><header>Low-income
			 geographic areas</header>
			<subsection id="HCC964D2A43D34DC78EEC36B147504C8D"><enum>(a)</enum><header>Modification of
			 Definition of Low-Income Geographic Area for Purposes of New Markets Venture
			 Capital Program</header>
				<paragraph id="HA678554DD09842008F01DA52F85BC4F6"><enum>(1)</enum><header>In
			 general</header><text>Section 351(3)(A)(ii)(I) of the Small Business Investment
			 Act of 1958 (15 U.S.C. 689(3)(A)(ii)(I)) is amended by striking <quote>50
			 percent</quote> and all that follows through the end and inserting <quote>the
			 median family income in that tract does not exceed 80 percent of the greater of
			 the statewide median family income or the metropolitan area median family
			 income; or</quote>.</text>
				</paragraph><paragraph id="H5522188A3DDE4F2900BAD2CE3F014D1"><enum>(2)</enum><header>Application of
			 amended definition to capital requirement</header><text>The definition of
			 low-income geographic area in section 351(3) of the Small Business Investment
			 Act of 1958 (15 U.S.C. 689(3)), as amended by subsection (a), shall apply to
			 private capital raised under section 354(d)(1) of the Small Business Investment
			 Act of 1958 (15 U.S.C. 689c(d)(1)) before, on, or after the effective date of
			 the amendment made by subsection (a).</text>
				</paragraph></subsection><subsection id="HEA894B90A9654819B22E65DEBCEB21E1"><enum>(b)</enum><header>Study on
			 Availability of Equity Capital</header>
				<paragraph id="H475A8A6471E44945BEAB41467DC4523B"><enum>(1)</enum><header>Study
			 required</header><text>Before the expiration of the 180-day period that begins
			 on the date of the enactment of this Act, the Chief Counsel for Advocacy of the
			 Small Business Administration shall conduct a study on the availability of
			 equity capital in low-income urban and rural areas.</text>
				</paragraph><paragraph id="HBBB007E5CB8B4034A60651DEF3A4037E"><enum>(2)</enum><header>Report</header><text>Not
			 later than 90 days after the completion of the study under paragraph (1) the
			 Administrator shall submit to Congress a report containing the findings of the
			 study required under paragraph (1) and any recommendations of the Administrator
			 based on such study.</text>
				</paragraph></subsection></section><section id="H2F6B2A9CC384443B92E9005B3BEDEBF"><enum>5.</enum><header>Conditionally
			 approved companies</header>
			<subsection id="HFCADC0978E664E3BB96D0092C4A3EA4E"><enum>(a)</enum><header>Operational
			 Assistance Grants to Conditionally Approved Companies</header><text>Section
			 358(a) of the Small Business Investment Act of 1958 (15 U.S.C. 689(a)) is
			 amended by adding at the end the following new paragraph:</text>
				<quoted-block id="HDC725842C81D441F8BD96D3066E6900" style="OLC">
					<paragraph id="H594F8C724EF94E378689BDA5E727C6A2"><enum>(6)</enum><header>Grants to
				conditionally approved companies</header>
						<subparagraph id="HD08313DCEA0A4677B8FB89D139007135"><enum>(A)</enum><header>In
				general</header><text>Subject to subparagraphs (A) and (B), upon the request of
				a company conditionally approved under section 354(c), the Administrator shall
				make a grant to the company under this subsection.</text>
						</subparagraph><subparagraph id="HAFF4FBF258154D86B1842B87EF810079"><enum>(B)</enum><header>Repayment by
				companies not approved</header><text>If a company receives a grant under
				paragraph (6) and does not enter into a participation agreement for final
				approval, the company shall repay the amount of the grant to the
				Administrator.</text>
						</subparagraph><subparagraph id="HAEA5253EE8C94AD686765B4100172D68"><enum>(C)</enum><header>Deduction from
				grant to approved company</header><text>If a company receives a grant under
				paragraph (6) and receives final approval under section 354(e), the
				Administrator shall deduct the amount of the grant under that paragraph from
				the total grant amount that the company receives for operational
				assistance.</text>
						</subparagraph><subparagraph id="H5EDFD7543B6141E8987EC0002171E1C8"><enum>(D)</enum><header>Amount of
				grant</header><text>No company may receive a grant of more than $50,000 under
				this
				paragraph.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF0D4555DA08E42E69E5DFD00F229D597"><enum>(b)</enum><header>Limitation on
			 Time for Final Approval</header><text>Section 354(d) of the Small Business
			 Investment Act of 1958 (15 U.S.C. 689c(d)) is amended by striking <quote>a
			 period of time, not to exceed 2 years,</quote> and inserting <quote>2
			 years</quote>.</text>
			</subsection></section><section id="HAE55BDC98264489E9D6D0748094D797D"><enum>6.</enum><header>Applications for
			 new markets venture capital program</header><text display-inline="no-display-inline">Not later than 60 days after the date of the
			 enactment of this section, the Administrator shall prescribe standard documents
			 for final New Markets Venture Capital Company approval application under
			 section 354(e) of the Small Business Investment Act of 1958 (15 U.S.C.
			 689c(e)). The Administrator shall assure that the standard documents shall be
			 designed to substantially reduce the cost burden of the application process on
			 the companies involved.</text>
		</section><section id="H4BA91CEAAE9A410999A22D7F00B59CE"><enum>7.</enum><header>Elimination of
			 matching requirement</header><text display-inline="no-display-inline">Section
			 354(d)(2)(A)(i) of the Small Business Investment Act of 1958 (15 U.S.C.
			 689c(d)(2)(A)(i)) is amended—</text>
			<paragraph id="HC2CA01314F7A41929C9EC7D9E6D790D0"><enum>(1)</enum><text>in subclause (I)
			 by adding <quote>and</quote> at the end;</text>
			</paragraph><paragraph id="H817CCCFFE2FA49B69901000042DD829"><enum>(2)</enum><text>in
			 subclause (II) by striking <quote>and</quote> at the end; and</text>
			</paragraph><paragraph id="H311C0EEC54F74E21859C22C3D2AD60AA"><enum>(3)</enum><text>by striking
			 subclause (III).</text>
			</paragraph></section><section id="H1B3CFA4CA00942FA004D3B11E85CCF8C"><enum>8.</enum><header>Operational
			 assistance grants</header><text display-inline="no-display-inline">Section
			 358(a)(4)(A) of the Small Business Investment Act of 1958 (15 U.S.C.
			 689g(a)(4)(A)) is amended—</text>
			<paragraph id="H240E1043AE50448799ED86B5D40F75B"><enum>(1)</enum><text>by
			 striking <quote>shall be equal to</quote> and all that follows through the
			 period at the end and by inserting <quote>shall be equal to the lesser
			 of—</quote>; and</text>
			</paragraph><paragraph id="HCE860B74962A4AA6B2477288E94C4750"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block id="HE79FEE571F944E1488B446C808A93083" style="OLC">
					<clause id="H72C77D12A3C14EA5B2EA4301ED0507DC"><enum>(i)</enum><text>10
				percent of the resources (in cash or in kind) raised by the company under
				section 354(d)(2); or</text>
					</clause><clause id="H7E1CF099C32A45B9AA7341C6C673D41F"><enum>(ii)</enum><text display-inline="yes-display-inline">$1,000,000.</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HE0C39A4BBA2E4BA09065F54D97839E8"><enum>9.</enum><header>Authorization of
			 appropriations</header>
			<subsection id="H3E269D181D9A424FA21F0655FA150008"><enum>(a)</enum><header>Reauthorization
			 of New Markets Venture Capital Program</header><text>Section 368(a) of the
			 Small Business Investment Act of 1958 (15 U.S.C. 689q(a)) is amended—</text>
				<paragraph id="HCDDB1CCDD39641E39359009F76008E63"><enum>(1)</enum><text>by striking
			 <quote>fiscal years 2001 through 2006</quote> and inserting <quote>fiscal years
			 2009 through 2011</quote>;</text>
				</paragraph><paragraph id="HDB7E3B8436504CE68600D75869F00837"><enum>(2)</enum><text>in paragraph (1),
			 by striking <quote>$150,000,000</quote> and inserting
			 <quote>$100,000,000</quote>; and</text>
				</paragraph><paragraph id="H947E0D9B84214AA3B8F68343074656B"><enum>(3)</enum><text>in
			 paragraph (2), by striking <quote>$30,000,000</quote> and inserting
			 <quote>$25,000,000</quote>.</text>
				</paragraph></subsection><subsection id="HFED02080AED4433C949DF9549D9438B9"><enum>(b)</enum><header>Authorization
			 for Manufacturing and Regional New Markets Venture Capital
			 Companies</header><text>There is authorized to be appropriated $1,000,000, to
			 be available until expended, to carry out section 354(f) of the Small Business
			 Investment Act of 1958, as added by section 2, and to enter into participation
			 agreements with companies engaged primarily in development of and investment in
			 small manufacturers under section 353(1) of such Act, as amended by section
			 2.</text>
