		  former system of good time allowances toward service of Federal prison terms,

		<section id="H71C1723943614FC297A673C244EB55" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Prison Work Incentive Act of
			 2009</short-title></quote>.</text>
		</section><section id="H01E9A7C8F311458A844FF0995D76233C" section-type="subsequent-section"><enum>2.</enum><header>Restoration of former
			 good time system</header>
			<subsection id="H9A5D916D7FBD431A89ABE039D2238F67"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Part III of title 18,
			 United States Code, is amended by inserting after chapter 307 the
			 following:</text>

						<section id="H67852E2BFBCA4B79A85111D6006EFF02"><enum>4161.</enum><header>Computation
				generally</header>
							<subsection id="HB313FB161CD84F3FB3927D65FA349BC1"><enum>(a)</enum><text display-inline="yes-display-inline">Each prisoner convicted of an offense
				against the United States and confined in a penal or correctional institution
				for a definite term other than for life, whose record of conduct shows that the
				prisoner has substantially observed all regulations promulgated by the Director
				of the Bureau of Prisons and has not been subjected to punishment, shall be
				entitled to a deduction from the term of his sentence imposed beginning with
				the day on which the sentence commences to run, and including time served in
				pretrial confinement, as follows:</text>
								<paragraph id="HCCF5A7B58DF24B22AE05C4BB95318994"><enum>(1)</enum><text>5 days for each
				month of the sentence, if the sentence is not less than 6 months and not more
				than 1 year.</text>
								</paragraph><paragraph id="H77FA302D4113471EA927C200DE799F00"><enum>(2)</enum><text display-inline="yes-display-inline">6 days for each month of the sentence, if
				the sentence is more than 1 year and less than 3 years.</text>
								</paragraph><paragraph id="H49C14EE0C28644B29DD8E943EEAB0A3"><enum>(3)</enum><text display-inline="yes-display-inline">7 days for each month of the sentence, if
				the sentence is not less than 3 years and less than 5 years.</text>
								</paragraph><paragraph id="HFCC1859EA40E44378DBF206C20E75594"><enum>(4)</enum><text display-inline="yes-display-inline">8 days for each month of the sentence, if
				the sentence is not less than 5 years and less than 10 years.</text>
								</paragraph><paragraph id="HBAF2475950214361A137C3B0AAFF201"><enum>(5)</enum><text display-inline="yes-display-inline">10 days for each month of the sentence, if
				the sentence is 10 years of more.</text>
								</paragraph></subsection><subsection id="H5509A8C4D1B5464BB2E6DFC61B582749"><enum>(b)</enum><text>When 2 or more
				consecutive sentences are to be served, the aggregate of the several sentences
				shall be the basis upon which the deduction shall be computed.</text>
							</subsection></section><section id="HAEE10B8C3ECC40BDA2B05158D9FE7B89"><enum>4162.</enum><header>Industrial
				good time</header>
							<subsection id="HEDB8C7D61D7748C900877F8B63B41BDE"><enum>(a)</enum><text display-inline="yes-display-inline">A prisoner may, in the discretion of the
				Director of the Bureau of Prisons, be allowed a deduction from that prisoner’s
				sentence of not to exceed 3 days for each month of actual employment in an
				industry or camp for the first year or any part thereof, and not to exceed 5
				days for each month of any succeeding year or part thereof.</text>
							</subsection><subsection id="H84853E76DE954D35B22C57BF45E81840"><enum>(b)</enum><text>In the discretion
				of the Director of the Bureau of Prisons such allowance may also be made to a
				prisoner performing exceptionally meritorious service or performing duties of
				outstanding importance in connection with institutional operations.</text>
							</subsection><subsection id="HA151C57384854BF8971FCA2392AEAB14"><enum>(c)</enum><text>Such allowance
				shall be in addition to commutation of time for good conduct, and under the
				same terms and conditions and without regard to length of sentence.</text>
							</subsection></section><section id="HA458304CFD344D13B662550200A192AC"><enum>4163.</enum><header>Discharge</header><text display-inline="no-display-inline">Except as otherwise provided by law a
				prisoner shall be released at the expiration of the term of sentence less the
				time deducted for good conduct. A certificate of such deduction shall be
				entered on the commitment by the Warden or keeper. If such release date falls
				upon a Saturday, a Sunday, or on a Monday which is a legal holiday at the place
				of confinement, the prisoner may be released at the discretion of the warden or
				keeper on the preceding Friday. If such release date falls on a holiday which
				falls other than on a Saturday, Sunday, or Monday, the prisoner may be released
				at the discretion of the warden or keeper on the day preceding the
				holiday.</text>
						</section><section id="HF0FBFAD61CC54E7A96CAC3EEE49846A4"><enum>4164.</enum><header>Forfeiture for
				offense</header><text display-inline="no-display-inline">If during the term of
				imprisonment a prisoner commits any offense or violates the regulations
				promulgated by the Director of the Bureau of Prisons, all or any part of his
				earned good time may be forfeited.</text>
						</section><section id="HC08F40BF6FED4B77A64CB16E2018FC7C"><enum>4165.</enum><header>Restoration of
				forfeited commutation</header><text display-inline="no-display-inline">The
				Director of the Bureau of Prisons shall by regulation provide for the criteria
				for and means of restoration of any forfeited or lost good time or
				portion.</text>
						</section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC983F915545B4E449D96CDF66D5EFC"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 chapters for part III of title 18, United States Code, is amended by striking
			 the item relating to chapter 309 and inserting the following:</text>

			</subsection><subsection id="H2AEE6AB16F8446DFAEBA936E3CF4395"><enum>(c)</enum><header>Conforming repeal
			 and cross reference change</header><text>Section 3624 of title 18, United
			 States Code, is amended—</text>
				<paragraph id="HCE6F6768C123475EAE854CA6CDD67B64"><enum>(1)</enum><text>by striking
			 subsection (b); and</text>
				</paragraph><paragraph id="HA631ABE25ACB44619EF059EECE5DB654"><enum>(2)</enum><text>in subsection (a),
			 by striking <quote>subsection (b)</quote> and inserting <quote>chapter
			 309</quote>.</text>
				</paragraph></subsection><subsection id="HBF998320BE5046FD00960002CFEF0436"><enum>(d)</enum><header>Application of
			 amendments</header><text>This Act and the amendments made by this Act shall
			 apply with respect to—</text>
				<paragraph id="HD8570F851896482FB9AF9C645312B384"><enum>(1)</enum><text>all prisoners,
			 other than those to whom the former system of the former chapter 309 of title
			 18 applies, as of the date of the enactment of this Act; and</text>
				</paragraph><paragraph id="H888741DCE8004008A39729AD2CDE98B8"><enum>(2)</enum><text>all periods of
			 imprisonment of the prisoners to whom it applies that occur after the date of
			 that enactment.</text>
