<section id="HC36B07D5777D4B2AA126D0439421D73E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Servicemembers Access to Justice Act of 2009</short-title></quote>.</text></section> 
<section commented="no" display-inline="no-display-inline" id="H186B442225AA47378A3BD7A679486BB9" section-type="subsequent-section"><enum>2.</enum><header>Waiver of sovereign immunity under the 11th Amendment with respect to enforcement of USERRA</header> 
<subsection commented="no" display-inline="no-display-inline" id="H9788F82AABB641F28D49AFBD676296C6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 4323 of title 38, United States Code, is amended—</text> 
<paragraph id="HC0C369D19CB74FFA8ABC2BBA9B8DB0A1"><enum>(1)</enum><text>in subsection (b) by striking paragraph (2) and inserting the following new paragraph:</text> 
<quoted-block id="H3238491B67DF42CE854F9317E2444A47" style="OLC"> 
<paragraph id="H81527D8C9802487B8BF3BE13366148F6" indent="up1"><enum>(2)</enum><text>In the case of an action against a State (as an employer) by a person, the action may be brought in the appropriate district court of the United States or State court of competent jurisdiction.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H07EA09FD2A1E431AB81950D76CC9285E"><enum>(2)</enum><text>by redesignating subsection (i) as subsection (j); and</text></paragraph> 
<paragraph id="HE592281719364530B3F973ADE68EE571"><enum>(3)</enum><text>by inserting after subsection (h) the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="HA1A9C01A89904B7C8C07E7730BF5D9ED" style="OLC"> 
<subsection id="H37171C60724645FE9BBA376B50B7A861"><enum>(i)</enum><header>Waiver of State sovereign immunity</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H5D983390573F40EF879F3D621D85D0A1"><enum>(1)</enum><text display-inline="yes-display-inline">A State’s receipt or use of Federal financial assistance for any program or activity of a State shall constitute a waiver of sovereign immunity, under the 11th amendment to the Constitution or otherwise, to a suit brought by—</text> 
<subparagraph id="H031B865F5E51453DB6B0A610008993BC" indent="up1"><enum>(A)</enum><text>a person who is or was an employee in that program or activity for the rights or benefits authorized the person by this chapter;</text></subparagraph> 
<subparagraph id="H9BE3135D77E24D55A40BFFD94B9DCD7C" indent="up1"><enum>(B)</enum><text>a person applying to be such an employee in that program or activity for the rights or benefits authorized the person by this chapter; or</text></subparagraph> 
<subparagraph id="H632CBC4726C744D998A7BB828FEE2E5C" indent="up1"><enum>(C)</enum><text>a person seeking reemployment as an employee in that program or activity for the rights or benefits authorized the person by this chapter.</text></subparagraph></paragraph> 
<paragraph id="H3C94E56B0F5F4D11886237248EE7A7E6" indent="up1"><enum>(2)</enum><text>In this subsection, the term <term>program or activity</term> has the meaning given that term in section 309 of the <act-name parsable-cite="ADA75">Age Discrimination Act of 1975</act-name> (42 U.S.C. 6107).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HBD3821A8EF2D469ABF5BD47D48F1A623"><enum>(b)</enum><header>Application</header><text>The amendments made by subsection (a) shall apply to—</text> 
<paragraph id="H953A5E1B55F24CBF9B888151CA909E8E"><enum>(1)</enum><text>any failure to comply with a provision of or any violation of chapter 43 of title 38, United States Code, that occurs before, on, or after the date of the enactment of this Act; and</text></paragraph> 
<paragraph id="HFC2EB410D5404D74B95F06903FA587C4"><enum>(2)</enum><text>to all actions or complaints filed under such chapter 43 that are commenced after the date of the enactment of this Act.</text></paragraph></subsection></section> 
<section id="HE2CD4ACFE52B4DCBA91D1325161D94FF"><enum>3.</enum><header>Unenforceability of agreements to arbitrate disputes arising under USERRA</header> 
<subsection id="H0CE7ECB0B6D34E3EA1C6127EB26B9EC2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 43 of title 38, United States Code, is amended by inserting after section 4327 the following new section:</text> 
<quoted-block id="H839772457B214B1ABC8651B981C9B72F" style="USC"> 
<section id="HB84DF33719A442689E40D2F71A51E80A"><enum>4328.</enum><header>Unenforceability of agreements to arbitrate disputes</header> 
<subsection id="H8336146ADF9D4EEFAB0B1B05F6C2C67B"><enum>(a)</enum><header>Protection of employee rights</header><text>Notwithstanding any other provision of law, any clause of any agreement between an employer and an employee that requires arbitration of a dispute arising under this chapter shall not be enforceable.</text></subsection> 
<subsection id="H48606A10D68F49AB9850F305F460674A"><enum>(b)</enum><header>Exceptions</header> 
<paragraph id="H51BBA36CB6044777AAF73140A2EC9697"><enum>(1)</enum><header>Waiver or agreement after dispute arises</header><text>Subsection (a) shall not apply with respect to any dispute if, after such dispute arises, the parties involved knowingly and voluntarily agree to submit such dispute to arbitration.</text></paragraph> 
<paragraph id="HDC6B724158F6459CB826D9CBEC9C5640"><enum>(2)</enum><header>Collective bargaining agreements</header><text>Subsection (a) shall not preclude the enforcement of any of the rights or terms of a valid collective bargaining agreement.</text></paragraph></subsection> 
<subsection id="HFE07376B4EDA4EDF848E0BB64911B307"><enum>(c)</enum><header>Validity and enforcement</header><text>Any issue as to whether this section applies to an arbitration clause shall be determined by Federal law. Except as otherwise provided in chapter 1 of title 9, the validity or enforceability of an agreement to arbitrate referred to in subsection (a) or (b)(1), shall be determined by a court, rather than the arbitrator, irrespective of whether the party resisting arbitration challenges the agreement to arbitrate specifically or in conjunction with other terms of the agreement.</text></subsection> 
<subsection id="H01A142D7A6564B1C8E06BA35BA906142"><enum>(d)</enum><header>Application</header><text>This section shall apply with respect to all contracts and agreements between an employer and an employee in force before, on, or after the date of the enactment of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2D5199E1AE924B7EB80C63A061A5FB3C"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for such chapter is amended by inserting after the item relating to section 4326 the following new item:</text>

<toc regeneration="no-regeneration"> 
<toc-entry level="section">4328. Unenforceability of agreements to arbitrate disputes.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF8A20EB00B6745D7A19727A380415D3E"><enum>(c)</enum><header>Application</header><text>The provisions of section 4328 of title 38, United States Code, as added by subsection (a), shall apply to—</text> 
<paragraph id="H09BF8958909448F58C6CCAD3043E8F72"><enum>(1)</enum><text>any failure to comply with a provision of or any violation of chapter 43 of title 38, United States Code, that occurs before, on, or after the date of the enactment of this Act; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H6955219F158F47B3A305B5BB44591A77"><enum>(2)</enum><text>to all actions or complaints filed under such chapter 43 that are pending on or after the date of the enactment of this Act.</text></paragraph></subsection></section> 
<section id="H57D5712CC4AA47E3BCFCE2B46142A172"><enum>4.</enum><header>Enhanced remedies for enforcement of USERRA</header> 
<subsection id="H6E16A6C6B17B4303A8639C04F45F5D49"><enum>(a)</enum><header>State and private employers</header><text>Section 4323(d) of title 38, United States Code, is amended—</text> 
<paragraph id="H6B74C533B6ED460582FEC3BE9CC170E3"><enum>(1)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (4) and (5), respectively;</text></paragraph> 
<paragraph id="HD9742CAB6D9F4EDB8C7F0DD130871C20"><enum>(2)</enum><text>in paragraph (4) (as so redesignated)—</text> 
<subparagraph id="H5EA005A286F34DDC95B600BD7C7D4526"><enum>(A)</enum><text>by inserting after <quote>compensation</quote> each place it appears the following: <quote>or damages</quote>;</text></subparagraph> 
<subparagraph id="H724CB9D9923141BAA1C420A0CC96B0D8"><enum>(B)</enum><text>by striking <quote>subparagraph (B) or (C) of paragraph (1)</quote> the first place it appears and inserting <quote>paragraph (1) or (3), or both,</quote>; and</text></subparagraph> 
<subparagraph id="H47B5A2FDD5304EBF8E4923A8026B1208"><enum>(C)</enum><text>by striking <quote>subparagraph (B) or (C) of paragraph (1)</quote> the second place it appears and inserting <quote>paragraph (1) or (3), or both</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H04D726C080484A428C9203D3E9849102"><enum>(3)</enum><text>by striking the subsection designation and heading and paragraph (1) and inserting the following:</text> 
<quoted-block id="HB593F94987FE40E4AE914BCDA12F69F8" style="OLC"> 
<subsection id="H924EE4F9DDAF425280F37D1781DC1365"><enum>(d)</enum><header>Remedies</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H5AB60D68CFDF4D2A9839F1F7357E8CAB"><enum>(1)</enum><text>A State or private employer who violates the provisions of this chapter shall be liable to any person affected—</text> 
<subparagraph id="H9958265205BE4D7FBAC2D4889C62DDBA" indent="up1"><enum>(A)</enum><text>for damages in the amount of—</text> 
<clause id="H5F428499324E4BB094ADD11D81F48710"><enum>(i)</enum><text>any wages, salary, benefits, or other compensation denied or lost by such person by reason of the violation; or</text></clause> 
<clause id="HF0334E5E40B247E0BC33BCCC5C4B4E39"><enum>(ii)</enum><text>in a case in which wages, salary, benefits, or other compensation have not been denied or lost to the person, any actual monetary losses sustained by the person as a result of the violation;</text></clause></subparagraph> 
<subparagraph id="HC85EAA19339D4788925E0CF88811C871" indent="up1"><enum>(B)</enum><text>the interest on the amount described in subparagraph (A) calculated at the prevailing interest rates over the period of time for which the damages are due; and</text></subparagraph> 
<subparagraph id="H4DBFA8E6B71147DBB3410AE304143925" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">an additional amount as liquidated damages equal to the sum of the amount described in subparagraph (A) and the interest described in subparagraph (B), or $10,000, whichever is greater except that, if the employer proves to the satisfaction of the court that the act or omission giving rise to the person’s action was in good faith and that the employer had reasonable grounds for believing the act or omission was not a violation of the provisions of this chapter, the court may award, in its discretion, no liquidated damages or award any amount of liquidated damages not to exceed 100 percent of the compensation or damages awarded under subparagraph (A) and the interest described in subparagraph (B).</text></subparagraph></paragraph> 
<paragraph id="H79FBF664145A49DD9C68C66C63DC9978" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In any action under this section, the court may require the employer to comply with the provisions of this chapter.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H05B515D8D6714799BFA63BE745D104DA"><enum>(b)</enum><header>Punitive damages</header><text>Section 4323(d) of such title is further amended by inserting after paragraph (2) (as inserted by subsection (a)(3) of this section) the following new paragraph:</text> 
<quoted-block id="H7A213F4A650B460890940135C6FA36CE" style="OLC"> 
<paragraph id="H69548841A2D64364BF2DC6A53B47297D" indent="up1"><enum>(3)</enum><text>In the case of a violation of the provisions of this chapter by a State or private employer with 25 or more employees, the court shall require the employer to pay the person affected punitive damages if the court determines that the employer’s violation of the provisions of this chapter was done with malice or reckless indifference to the rights of the person under this chapter.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H36C507716E1B47238471F99DB6639490"><enum>(c)</enum><header>Right to jury trial</header><text>Section 4323(d) of such title is further amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HDF5B86E560BB4EA78ADA510AC9198B4B" style="OLC"> 
<paragraph commented="no" id="HB9629BFE5F3A4AAA846215904CFC565A" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">A person who commences an action under this section shall be entitled to a trial by jury.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1B03BF8C512246CA9C62A9C5D76BDB66"><enum>(d)</enum><header>Federal Government employers</header><text>Paragraph (2) of section 4324(c) of such title is amended to read as follows:</text> 
<quoted-block id="H62F2667A23E140459C85400721A50324" style="OLC"> 
<paragraph id="H36BCCC7C139044288CAFC482044263F0" indent="up1"><enum>(2)</enum><text>If the Board determines that a Federal executive agency or the Office of Personnel Management has violated the provisions of this chapter relating to the employment or reemployment of a person by the agency, the Board shall enter an order requiring the agency or Office to comply with such provisions and to compensate such person—</text> 
<subparagraph id="H23F856A2BA604673891732F1B953A409"><enum>(A)</enum><text>for damages in the amount of—</text> 
<clause id="H3B7362325D724829A8389965756BC073"><enum>(i)</enum><text>any wages, salary, benefits, or other compensation denied or lost by such person by reason of the violation; or</text></clause> 
<clause id="H03B466F74EA54AE3A3E05B842E2A776A"><enum>(ii)</enum><text>in a case in which wages, salary, benefits, or other compensation has not been denied or lost to the person, any actual monetary losses sustained by the person as a result of the violation;</text></clause></subparagraph> 
<subparagraph id="HE6920ACBA9A34570AD69A1919AD2A29E"><enum>(B)</enum><text>the interest on the amount described in subparagraph (A) calculated at the prevailing interest rates over the period of time for which the damages are due; and</text></subparagraph> 
<subparagraph id="H6BFCE740454744D59D9CCC84C66F2C19"><enum>(C)</enum><text display-inline="yes-display-inline">an additional amount as liquidated damages equal to the sum of the amount described in subparagraph (A) and the interest described in subparagraph (B), or $10,000, whichever is greater; except that, if the Federal executive agency or the Office of Personnel Management proves to the satisfaction of the Board that the act or omission giving rise to such person’s complaint was in good faith and that the agency or Office had reasonable grounds for believing that the act or omission was not a violation of the provisions of this chapter, the Board may award, in the discretion of the Board, no liquidated damages or award any amount of liquidated damages not to exceed 100 percent of the compensation or damages awarded under subparagraph (A) and the interest described in subparagraph (B).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA77B0993F62E48CEB817DA50D51BEA13"><enum>(e)</enum><header>Application</header><text>The amendments made by this section shall apply to—</text> 
<paragraph id="HD0A70785D4AA41D2ADF4B25436F41802"><enum>(1)</enum><text>any failure to comply with a provision of or any violation of chapter 43 of title 38, United States Code, that occurs before, on, or after the date of the enactment of this Act; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H8867081FCB414ED89A595F260080BC2D"><enum>(2)</enum><text>to all actions or complaints filed under such chapter 43 that are commenced after the date of the enactment of this Act.</text></paragraph></subsection></section> 
<section id="HFBDF1B8B1C114D52B2387F27D1A1E17C"><enum>5.</enum><header>Required award of attorney fees in actions to enforce provisions of USERRA</header> 
<subsection id="H3E0434806E2A403BB088D84FCCE615DB"><enum>(a)</enum><header>Enforcement of rights with respect to a State or private employer</header><text display-inline="yes-display-inline">Section 4323(h)(2) of title 38, United States Code, is amended by striking <quote>may</quote> and inserting <quote>shall</quote>.</text></subsection> 
<subsection id="H7E6B3A884095464C905E47A16972C5AC"><enum>(b)</enum><header>Enforcement of rights with respect to Federal executive agencies</header><text>Section 4324(c)(4) of such title is amended by striking <quote>the Board may, in its discretion, award</quote> and inserting <quote>the Board shall award</quote>.</text></subsection> 
<subsection id="HF5552E8DA12A4DAEBADDB608073CCFEF"><enum>(c)</enum><header>Application</header><text>The amendments made subsections (a) and (b) shall apply to—</text> 
<paragraph id="H12AF0D65D0E54AE8BB61F5B1BC0A3077"><enum>(1)</enum><text>any failure to comply with a provision of or any violation of chapter 43 of title 38, United States Code, that occurs before, on, or after the date of the enactment of this Act; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H9E77CBA05E8D432B8D0363F2F18F3B06"><enum>(2)</enum><text>to all actions or complaints filed under such chapter 43 that are pending on or after the date of the enactment of this Act.</text></paragraph></subsection></section> 
<section id="H4274A2FD373D4FCEA29B7F98347F2AFE"><enum>6.</enum><header>Clarifying the definition of <quote>successor in interest</quote></header> 
<subsection id="HF5C2F5AB385A4A0BB397C470F32E3BA5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 4303(4) of title 38, United States Code, is amended by adding at the end the following new subparagraph:</text> 
<quoted-block id="HD1B3F6BA50784EF8B1EB90A9BDCB8AAD" style="OLC"> 
<subparagraph id="HD0E82FD254EE432D8BCEAED3C16EC0E1" indent="up1"><enum>(D)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="HF2101B64EA1548C3934A113D8BD934E6"><enum>(i)</enum><text>The term <term>successor in interest</term> shall be determined for purposes of subparagraph (A)(iv) on a case-by-case basis using a multi-factor test which considers the following factors regardless of the form of the succession:</text> 
<subclause id="H60A978BBEC294B2B8FFF27F047E83A1C" indent="up1"><enum>(I)</enum><text>Substantial continuity of the same business operations.</text></subclause> 
<subclause id="HF5701814447B455F9D9D71E888471C99" indent="up1"><enum>(II)</enum><text>Use of the same plant.</text></subclause> 
<subclause id="HC50B94A296D24A9585E3A9FE6D5B8B3D" indent="up1"><enum>(III)</enum><text>Continuity of work force.</text></subclause> 
<subclause id="HA26129E9E13145C7BA0B1F1A9EAC2FF0" indent="up1"><enum>(IV)</enum><text>Similarity of jobs and working conditions.</text></subclause> 
<subclause id="H8AF40704ABEA4EF582F828F0D054756B" indent="up1"><enum>(V)</enum><text>Similarity of supervisory personnel.</text></subclause> 
<subclause id="HB0D14F60C09E40C98B1F9A342F2344F6" indent="up1"><enum>(VI)</enum><text>Similarity in machinery, equipment, and production methods.</text></subclause> 
<subclause id="H7A8CAAED78684965A84117216B501881" indent="up1"><enum>(VII)</enum><text>Similarity of products or services.</text></subclause></clause> 
<clause id="H4A331DB3B6364F29AA1BBADDE86B7F3D" indent="up1"><enum>(ii)</enum><text>The successor’s lack of notice or awareness of a potential or pending claim under this chapter at the time of a merger, acquisition, or other form of succession shall not be considered when applying the multi-factor test under clause (i).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD8411EB6207E4F5A8F3BA3B8A604C6D9"><enum>(b)</enum><header>Application</header><text>The amendment made by subsection (a) shall apply to—</text> 
<paragraph id="H91D9346773574911A92D941131E60FA3"><enum>(1)</enum><text>any failure to comply with a provision of or any violation of chapter 43 of title 38, United States Code, that occurs before, on, or after the date of the enactment of this Act; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HA84BED55A82B4CCC99F76FF35BE2C41C"><enum>(2)</enum><text>to all actions or complaints filed under such chapter 43 that are pending on or after the date of the enactment of this Act.</text></paragraph></subsection></section> 
<section id="H885D4D1AA95848899079C5FE83E3F305"><enum>7.</enum><header>Clarifying that USERRA prohibits wage discrimination against members of the Armed Forces</header> 
<subsection id="H2F47C50BBA894A0B91E2717219A18F38"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 4303(2) of title 38, United States Code, is amended by striking <quote>(other than wages or salary for work performed)</quote> and inserting <quote>(including wages or salary)</quote>.</text></subsection> 
<subsection id="H143076456473441597C8A3C3DF1A3286"><enum>(b)</enum><header>Application</header><text>The amendment made by subsection (a) shall apply to—</text> 
<paragraph id="H7F47C20799214FF28D1AFFF0A63851A3"><enum>(1)</enum><text>any failure to comply with a provision of or any violation of chapter 43 of title 38, United States Code, that occurs before, on, or after the date of the enactment of this Act; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H8A57697D782E4D72BD9576AB84ECCD00"><enum>(2)</enum><text>to all actions or complaints filed under such chapter 43 that are pending on or after the date of the enactment of this Act.</text></paragraph></subsection></section> 
<section id="HE7F89807671A409B9B9ADC8FEE6AF60E"><enum>8.</enum><header>Requiring equitable relief when appropriate</header> 
<subsection id="HA5F069F8B0354476B19DBF2C32AB4188"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 4323(e) of title 38, United States Code, is amended—</text> 
<paragraph id="H9B6D3F795CEE4570AA87BA3B63FC24A3"><enum>(1)</enum><text>by striking <quote>The court shall use,</quote> and inserting <quote>(1) The court shall use,</quote>; and</text></paragraph> 
<paragraph id="H23DDBDDF143740D3BCCD45F8249A0AE9"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block id="HDC621AB508CB4A5DAD07963966207C3D" style="OLC"> 
<paragraph id="HD0B5937799D643419167DE7AE10C81AA" indent="up1"><enum>(2)</enum><text>Notwithstanding rule 65 of the Federal Rules of Civil Procedure or any other provision of law, for purposes of determining whether to issue an injunction or restraining order pursuant to paragraph (1)—</text> 
<subparagraph id="H8F454B67DBE44164AB2308153D77E83B"><enum>(A)</enum><text>an employer’s denial of reemployment or retention in employment shall constitute irreparable harm to a person who is denied reemployment or retention in employment if an injunction to reinstate such person is not issued, and such person shall be considered to have no adequate remedy at law;</text></subparagraph> 
<subparagraph id="HD8D7167D2BD049399C77B4AED5E8B173"><enum>(B)</enum><text>if the court balances the hardships between the parties, there shall be a rebuttable presumption that the balance of harm to a person who is denied reemployment or retention in employment if an injunction to reinstate such person is not issued outweighs the harm to such person’s employer or former employer if an injunction is issued to reinstate such person; and</text></subparagraph> 
<subparagraph id="HBC306DDBFCDE4AD5B75F51B6814FEF37"><enum>(C)</enum><text>if the court considers the public interest or public policy, there shall be a rebuttable presumption that the issuance of an injunction to reinstate a person who is denied reemployment or retention in employment is in the public interest and advances public policy.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HA3565FFF421A4566BF535C39B365AA88"><enum>(b)</enum><header>Application</header><text>The amendments made by subsection (a) shall apply to—</text> 
<paragraph id="H8BDEFB7814E6411699385DBAD7DD2C6F"><enum>(1)</enum><text>any failure to comply with a provision of or any violation of chapter 43 of title 38, United States Code, that occurs before, on, or after the date of the enactment of this Act; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HC35A32D45B844DED84E785326665E095"><enum>(2)</enum><text>to all actions or complaints filed under such chapter 43 that are pending on or after the date of the enactment of this Act.</text></paragraph></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="HB17B31A3127A4364998DA4682467736E"><enum>9.</enum><header>Requirement that Federal agencies provide notice to contractors of potential USERRA obligations</header> 
<subsection commented="no" display-inline="no-display-inline" id="HF4B7F697FE3B433A9BD4A57F1080F993"><enum>(a)</enum><header>Civilian agencies</header><text>The Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251 et seq.) is amended by adding at the end the following new section:</text>

<section commented="no" display-inline="no-display-inline" id="H170C9F9E85844FD0A7CAC6579B40659A"><enum>318.</enum><header>Notice to contractors of potential obligations relating to employment and reemployment of members of the Armed Forces</header><text display-inline="no-display-inline">Each contract for the procurement of property or services that is entered into by the head of an executive agency shall include a notice to the contractor that the contractor may have obligations under chapter 43 of title 38, United States Code.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H0891D5DDB42143C1A823A5DF99860D82"><enum>(b)</enum><header>Armed Forces</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H47805DA977134F3B8BF83F1A23E161BB"><enum>(1)</enum><header>In general</header><text>Chapter 137 of title 10, United States Code, is amended by adding at the end the following new section:</text>

<section commented="no" display-inline="no-display-inline" id="H79325205D19B49CABB396B7EFDFDFDC7"><enum>10.</enum><header>Clarifying that provisions of section 4302 of title 38, United States Code, apply to both substantive and procedural rights</header><text display-inline="no-display-inline">Section 4302 is amended by inserting <quote>substantive or procedural</quote> before <quote>right or benefit</quote> each place it occurs.</text></section> 
<section commented="no" display-inline="no-display-inline" id="HB351A16F84E9415B9E16AED740EE223A"><enum>11.</enum><header>Comptroller General of the United States study on effectiveness of Federal programs of education and outreach on employer obligations under USERRA</header> 
<subsection commented="no" display-inline="no-display-inline" id="H4DDB198C3E87428ABEE176E72AA47DDA"><enum>(a)</enum><header>Study required</header><text>The Comptroller General of the United States shall conduct a study on the effectiveness of Federal programs of education and outreach on employer obligations under chapter 43 of title 38, United States Code.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HC7BCC616B6744EF28DCF594F87E70637"><enum>(b)</enum><header>Contents of study</header><text>In carrying out the study required by subsection (a), the Comptroller General shall—</text> 
<paragraph id="HBBA4098080344A20B1E66D3ECF0048A3"><enum>(1)</enum><text>assess current practices and procedures of Federal agencies for educating employers about their obligations under chapter 43 of title 38, United States Code;</text></paragraph> 
<paragraph id="HF8A4D4E14DF9436480735FFF6731B8AB"><enum>(2)</enum><text>identify best practices for bringing the employment practices of small businesses into compliance with such chapter;</text></paragraph> 
<paragraph id="H5C1A94A9BAFA4EEAA66266D7B2E882C0"><enum>(3)</enum><text>determine whether the Employer Support for the Guard and Reserve, the Small Business Administration, or other agencies could collaborate to develop a program to educate employers regarding their obligations under such chapter; and</text></paragraph> 
<paragraph id="HC169ABCC958A40A3B42ED321CD9E5364"><enum>(4)</enum><text>determine the effect on recruitment and retention in the National Guard and Reserves of the failure of employers to meet their reemployment obligations under such chapter.</text></paragraph></subsection> 
<subsection id="H06734E058AA44FA58A5C233D85D84D8E"><enum>(c)</enum><header>Report to Congress</header><text>Not later than December 31, 2009, the Comptroller General shall submit to Congress a report on the study conducted under subsection (a), including the following:</text> 
<paragraph id="HC81BE597B1BA4471B8B0EBF6FC1AAA84"><enum>(1)</enum><text>The findings of the Comptroller General with respect to such study.</text></paragraph> 
<paragraph id="H6A63CBB4F5584F528F085C03C80D7B69"><enum>(2)</enum><text>The recommendations of the Comptroller General for the improvement of education and outreach for employers with respect to their obligations under chapter 43 of title 38, United States Code.</text></paragraph></subsection></section> 
<section id="H2561D5FD266E440F87EFD93882456D86"><enum>12.</enum><header>Technical amendments</header> 
<subsection id="H515B6B9C1F884181B2E53439A15A1840"><enum>(a)</enum><header>Amendment to Congressional Accountability Act of 1995</header><text>Section 206(b) of the Congressional Accountability Act of 1995 (2 U.S.C. 1316(b)) is amended by striking <quote>under paragraphs (1), (2)(A), and (3) of section 4323(c) of title 38, United States Code</quote> and inserting <quote>under subsection 4323(d) of title 38, United States Code</quote>.</text></subsection> 
<subsection id="H79170F2E7D9F4AA0BA30086A01C432B3"><enum>(b)</enum><header>Amendment to section 416 of title 3, United States Code</header><text>Section 416(b) of title 3, United States Code, is amended by striking <quote>under paragraphs (1) and (2)(A) of section 4323(c) of title 38</quote> and inserting <quote>under section 4323(d) of title 38</quote>.</text></subsection> 
<subsection id="H1F9BBEF465774815A0F33C59619761BC"><enum>(c)</enum><header>Amendment to section 4324 of title 38, United States Code</header><text>Section 4324(b)(4) of title 38, United States Code, is amended by inserting before the period the following: <quote>declining to initiate an action and represent the person before the Merit Systems Protection Board</quote>.</text></subsection></section>
