		<official-title display="yes">To establish a battlefield acquisition
		  grant program for the acquisition and protection of nationally significant
		  battlefields and associated sites of the Revolutionary War and the War of 1812,
		  and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="H21E3027209E0482087816A1CEFCDAA72" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Revolutionary War and War of 1812
			 Battlefield Protection Act</short-title></quote>.</text>
		</section><section id="H56C717C73A644B49A225DBD1A4AEC8C4"><enum>2.</enum><header>Battlefield
			 Acquisition Grant Program for battlefields of the Revolutionary War and War of
			 1812</header>
			<subsection id="H86DAA69018B748B48FD2C7B9FD7FF096"><enum>(a)</enum><header>Definitions</header><text>In
			 this Act:</text>
				<paragraph id="H3A8B94DF9FC54A2EA196FBC919C53397"><enum>(1)</enum><header>Battlefield
			 report</header><text>The term <term>battlefield report</term> means the
			 document titled <quote>Report to Congress on the Historic Preservation of
			 Revolutionary War and War of 1812 Sites in the United States</quote>, prepared
			 by the National Park Service, and dated September 2007.</text>
				</paragraph><paragraph id="H80DA642BF0F74F0EA350F2FD80728E47"><enum>(2)</enum><header>Eligible
			 entity</header><text>The term <term>eligible entity</term> means a State or
			 local government.</text>
				</paragraph><paragraph id="HA0CEC745200F492C8D678B8DD3F40895"><enum>(3)</enum><header>Eligible
			 site</header><text>The term <term>eligible site</term> means a site
			 that—</text>
					<subparagraph id="HDDB2DEA40BA241118DD5CEAECDFF8DD0"><enum>(A)</enum><text>is not within the
			 exterior boundaries of a unit of the National Park System; and</text>
					</subparagraph><subparagraph id="H4FBB66D2A8E44390983C147C26D36B8F"><enum>(B)</enum><text>is identified in
			 the battlefield report.</text>
					</subparagraph></paragraph><paragraph id="HA19E791D6FA2458194252F393DE996D0"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior, acting through
			 the American Battlefield Protection Program.</text>
				</paragraph></subsection><subsection id="H08A48702C858416E9D212BC6B277CDA6"><enum>(b)</enum><header>Establishment</header><text>The
			 Secretary shall establish a battlefield acquisition grant program for
			 nationally significant battlefields and associated sites of the Revolutionary
			 War and the War of 1812 under which the Secretary may make grants to eligible
			 entities to pay the Federal share of the cost of acquiring fee-simple or lesser
			 interests from willing sellers in eligible sites for the preservation and
			 protection of those eligible sites.</text>
			</subsection><subsection id="HABB83895605641CD8303414764622CC6"><enum>(c)</enum><header>Nonprofit
			 partners</header><text>An eligible entity may acquire an interest in an
			 eligible site using a grant under this section in partnership with a nonprofit
			 organization.</text>
			</subsection><subsection id="HAA39CF14438545D8BEF0B3C8AD86FBAF"><enum>(d)</enum><header>Non-federal
			 share</header><text>The non-Federal share of the total cost of acquiring an
			 interest in an eligible site under this section shall be not less than 50
			 percent.</text>
			</subsection><subsection id="HE615ED2D6EEF48CFA1C1DB50F21FC525"><enum>(e)</enum><header>Limitations on
			 land use</header><text>An interest in an eligible site acquired under this
			 section shall be subject to section 6(f)(3) of the
			 <act-name parsable-cite="LWCFA">Land and Water Conservation Fund Act of
			 1965</act-name> (16 U.S.C. 4601–8(f)(3)).</text>
			</subsection><subsection id="HBEA668151B104C04836DECBC0699DE87"><enum>(f)</enum><header>Willing
			 sellers</header><text>Acquisitions of land and interests in land under this Act
			 shall be limited to acquisitions, from willing sellers only, of conservation
			 easements and fee-simple purchases of eligible sites.</text>
			</subsection><subsection id="H64D51A4569F748E38CB35DF11AF7374F"><enum>(g)</enum><header>Reports</header>
				<paragraph id="HDFA097D4DEB544F2A233DF11DBDD8D61"><enum>(1)</enum><header>In
			 general</header><text>Not later than 5 years after the date of the enactment of
			 this Act, the Secretary shall submit to Congress a report on the activities
			 carried out under this section.</text>
				</paragraph><paragraph id="HBDEA7F66D9DD4503856E14693C4576AC"><enum>(2)</enum><header>Update on
			 battlefield report</header><text>Not later than 3 years after the date of the
			 enactment of this Act, the Secretary shall submit to Congress a report that
			 updates the battlefield report to reflect—</text>
					<subparagraph id="HD69951C7CBE54BF08BA221E4F90BC947"><enum>(A)</enum><text>preservation
			 activities carried out at the 677 battlefields and associated sites identified
			 in the battlefield report during the period between publication of the
			 battlefield report and the update;</text>
					</subparagraph><subparagraph id="H0699A4EB5ED94F8AB7BA434FA7C199A2"><enum>(B)</enum><text>changes in the
			 condition of the battlefields and associated sites during that period;
			 and</text>
					</subparagraph><subparagraph id="H7DBD447B73ED4BC98E8BB3097D391CA3"><enum>(C)</enum><text>any other relevant
			 developments relating to the battlefields and associated sites during that
			 period.</text>
					</subparagraph></paragraph></subsection><subsection id="HFE4C6608357C4A2197D108416659B49D"><enum>(h)</enum><header>Authorizations
			 of appropriations</header>
				<paragraph id="HD66B96F681254C3FA0231A78F3091722"><enum>(1)</enum><header>In
			 general</header><text>There are authorized to be appropriated to the Secretary
			 from the Land and Water Conservation Fund to provide grants under this Act
			 $10,000,000 for each of fiscal years 2010 through 2014.</text>
				</paragraph><paragraph id="HA168E534DC674830A9195AE829FBC12F"><enum>(2)</enum><header>Update of
			 battlefield report</header><text>There are authorized to be appropriated to the
			 Secretary to carry out subsection (g)(2), $500,000.</text>
