		  Substances Import and Export Act regarding penalties for cocaine offenses, and

		<section id="H77504AFC9875485A993C5B6C6400643F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fairness in Cocaine Sentencing Act of
			 2009</short-title></quote>.</text>
		</section><section id="H971952449D7C415AB91DAFEAE3D20076"><enum>2.</enum><header>Elimination of
			 increased penalties for cocaine offenses where the cocaine involved is cocaine
			 base</header>
			<subsection id="HA655DA65D5B84534AE905B968D8F9DD6"><enum>(a)</enum><header>Controlled
			 Substances Act</header><text display-inline="yes-display-inline">The following
			 provisions of the Controlled Substances Act (21 U.S.C. 801 et seq.) are
			 repealed:</text>
				<paragraph id="H1F0FE7C704AF4A9B90621C131006BC7C"><enum>(1)</enum><text>Clause (iii) of
			 section 401(b)(1)(A).</text>
				</paragraph><paragraph id="HBEE016D3E2A14D11005949CA21014171"><enum>(2)</enum><text>Clause (iii) of
			 section 401(b)(1)(B).</text>
				</paragraph><paragraph id="HA17B4B52D6834CA987663914D8510014"><enum>(3)</enum><text display-inline="yes-display-inline">The sentence beginning
			 <quote>Notwithstanding the preceding sentence</quote> in section 404(a).</text>
				</paragraph></subsection><subsection id="HF1AEA10F403048A79D1B324DE5D326BD"><enum>(b)</enum><header>Controlled
			 Substances Import and Export Act</header><text display-inline="yes-display-inline">The following provisions of the Controlled
			 Substances Import and Export Act (21 U.S.C. 951 et seq.) are repealed:</text>
				<paragraph id="HE5DE03957EFC4C59000096403DDD6845"><enum>(1)</enum><text>Subparagraph (C)
			 of section 1010(b)(1).</text>
				</paragraph><paragraph id="H5DFD24CD21704290ACB18D914B008B9F"><enum>(2)</enum><text>Subparagraph (C)
			 of section 1010(b)(2).</text>
				</paragraph></subsection></section><section id="H7B805637D3FF4261B1FEDF5B906C6600"><enum>3.</enum><header>Reestablishment
			 of possibility of probationary sentence</header>
			<subsection id="H36717E47919248EB00CD1C3817223501"><enum>(a)</enum><header>Controlled
			 Substances Act</header><text display-inline="yes-display-inline">Section
			 401(b)(1) of the Controlled Substances Act (21 U.S.C. 841(b)(1)) is
			 amended—</text>
				<paragraph id="H47F94C7E875046CABD974253DB38362F"><enum>(1)</enum><text>in each of
			 subparagraphs (A) and (B), by striking the last two sentences; and</text>
				</paragraph><paragraph id="H4E0BA298187A43878842D465B8D40313"><enum>(2)</enum><text display-inline="yes-display-inline">by striking the final sentence of
			 subparagraph (C).</text>
				</paragraph></subsection><subsection id="HD9A38B8B838449DBAD00EE2B59FE4732"><enum>(b)</enum><header>Controlled
			 Substances Import and Export Act</header><text>Section 1010(b) of the
			 Controlled Substances Import and Export Act (21 U.S.C. 960(b)) is amended in
			 each of paragraphs (1) and (2), by striking the last two sentences.</text>
			</subsection></section><section id="H4D3823523B3A4936B71C42A57B557D7E"><enum>4.</enum><header>Elimination of
			 minimum mandatory imprisonment penalties for cocaine offenses</header>
			<subsection id="HC1DB4BCAA02742AA00E76B34AE079D38"><enum>(a)</enum><header>Controlled
			 Substances Act</header>
				<paragraph id="HEB62582FE9F9415E9700BD78BDE76ECD"><enum>(1)</enum><text>Section
			 401(b)(1)(A) of the Controlled Substances Act (21 U.S.C. 841(b)(1)(A)) is
			 amended by adding at the end the following: <quote>However, any minimum term of
			 imprisonment otherwise required under this subparagraph shall not apply to an
			 offense under clause (ii).</quote>.</text>
				</paragraph><paragraph id="HB00138DECC9D4E0B9B02FDCECE9E3C49"><enum>(2)</enum><text display-inline="yes-display-inline">Section 401(b)(1)(B) of the Controlled
			 Substances Act (21 U.S.C. 841(b)(1)(B)) is amended by adding at the end the
			 following: <quote>However, any minimum term of imprisonment otherwise required
			 under this subparagraph shall not apply to an offense under clause
			 (ii).</quote>.</text>
				</paragraph></subsection><subsection id="H0A21096E0AA546AEBE190464F4825F62"><enum>(b)</enum><header>Controlled
			 Substances Import and Export Act</header>
				<paragraph id="HEA0803F0058945579CD5EBBAB58F3D5"><enum>(1)</enum><text display-inline="yes-display-inline">Section 1010(b)(1) of the Controlled
			 Substances Import and Export Act (21 U.S.C. 960(b)(1)) is amended by adding at
			 the end the following: <quote>However, any minimum term of imprisonment
			 otherwise required under this paragraph shall not apply to an offense under
			 subparagraph (B). </quote>.</text>
				</paragraph><paragraph id="H7F473EADC0FB44A5B48E3BA755F65BB1"><enum>(2)</enum><text>Section 1010(b)(2)
			 of the Controlled Substances Import and Export Act (21 U.S.C. 960(b)(2)) is
			 amended by adding at the end the following: <quote>However, any minimum term of
			 imprisonment otherwise required under this paragraph shall not apply to an
			 offense under subparagraph (B). </quote>.</text>
