<section id="H7AB3452D14A84899B3CD79B16E37006C"><enum>101.</enum><header>Leasing program considered approved</header> 
<subsection id="HCFE500A35341407A8D13F2CBFB386F4F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Draft Proposed Outer Continental Shelf Oil and Gas Leasing Program 2010–2015 issued by the Secretary of the Interior (referred to in this section as the <quote>Secretary</quote>) under section 18 of the Outer Continental Shelf Lands Act (43 U.S.C. 1344) is considered to have been approved by the Secretary as a final oil and gas leasing program under that section.</text> </subsection>
<subsection id="HC59646C565FB446EB023CD0544F0083"><enum>(b)</enum><header>Final environmental impact statement</header><text display-inline="yes-display-inline">The Secretary is considered to have issued a final environmental impact statement for the program described in subsection (a) in accordance with all requirements under section 102(2)(C) of the National Environmental Policy Act of 1969 (42 U.S.C. 4332(2)(C)).</text> </subsection></section>
<section id="HEE9D3AC43BFE45E9AFA819E8F38DDBE0"><enum>102.</enum><header>Lease sales</header> 
<subsection id="HF010082C84F647728FD374A391532522"><enum>(a)</enum><header>Outer Continental Shelf</header> 
<paragraph id="HB84BDAE4ED1F4D4B94007BF682A9E6A7"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), not later than 30 days after the date of enactment of this Act and every 270 days thereafter, the Secretary of the Interior (referred to in this section as the <quote>Secretary</quote>) shall conduct a lease sale in each outer Continental Shelf planning area for which the Secretary determines that there is a commercial interest in purchasing Federal oil and gas leases for production on the outer Continental Shelf.</text> </paragraph>
<paragraph id="HE769AE3240F34727A9AC3669D48515A0"><enum>(2)</enum><header>Subsequent determinations and sales</header><text>If the Secretary determines that there is not a commercial interest in purchasing Federal oil and gas leases for production on the outer Continental Shelf in a planning area under this subsection, not later than 2 years after the date of enactment of the determination and every 2 years thereafter, the Secretary shall—</text> 
<subparagraph id="H4A25FF44D777403FA9153716D969E6C1"><enum>(A)</enum><text>determine whether there is a commercial interest in purchasing Federal oil and gas leases for production on the outer Continental Shelf in the planning area; and</text> </subparagraph>
<subparagraph id="H98F2A31355A24C029475671B4BAA6515"><enum>(B)</enum><text>if the Secretary determines that there is a commercial interest described in subparagraph (A), conduct a lease sale in the planning area.</text> </subparagraph></paragraph></subsection>
<subsection id="HA415AD717FAF46A8A38B3670F11247E7"><enum>(b)</enum><header>Renewable energy and mariculture</header><text>The Secretary may conduct commercial lease sales of resources owned by United States—</text> 
<paragraph id="HFB93C3183A344561A46E321CC9009B14"><enum>(1)</enum><text>to produce renewable energy (as defined in section 203(b) of the Energy Policy Act of 2005 (42 U.S.C. 15852(b))); or</text> </paragraph>
<paragraph id="HD335BA0B87944980009F889615A42D32"><enum>(2)</enum><text>to cultivate marine organisms in the natural habitat of the organisms.</text> </paragraph></subsection></section>
<section id="H1F95CD6F7A1748FF816CABE39D369D11"><enum>103.</enum><header>Coastal Impact assistance program amendments</header><text display-inline="no-display-inline">Section 31 of the Outer Continental Shelf Lands Act (43 U.S.C. 1356a) is amended—</text> 
<paragraph id="H2CDFAA6E48854DFB84830956E66F3D04"><enum>(1)</enum><text>in subsection (c), by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H90DA413C17444096A55427764159CD74" style="OLC"> 
<paragraph id="HDBD90D44EB0A4CABA6F498CBC57ECA77"><enum>(5)</enum><header>Application requirements; availability of funding</header><text>On approval of a plan by the Secretary under this section, the producing State shall—</text> 
<subparagraph id="HC0C5CD6DA4534D088958D8E4B68D365E"><enum>(A)</enum><text>not be subject to any additional application or other requirements (other than notifying the Secretary of which projects are being carried out under the plan) to receive the payments; and</text> </subparagraph>
<subparagraph id="HB2F3E51C05DE49BA9173A37BB7B96D5F"><enum>(B)</enum><text>be immediately eligible to receive payments under this section.</text> </subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph>
<paragraph id="HD876184BAA6C45D4826B45A416A54035"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HB1AE2797D1DB42CF9850EC9072FA8500" style="OLC"> 
<subsection id="HA38C5AFBA46941A295003817B8E5DC5"><enum>(e)</enum><header>Funding</header> 
<paragraph id="HF147011C8D8941A890D2AED9068EDCC6"><enum>(1)</enum><header>Streamlining</header> 
<subparagraph id="H41587157870D4A8882E34D00AB38DB6E"><enum>(A)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this subsection, the Secretary of the Interior (acting through the Director of the Minerals Management Service) (referred to in this subsection as the <quote>Secretary</quote>) shall develop a plan that addresses streamlining the process by which payments are made under this section, including recommendations for—</text> 
<clause id="H6401AF4DB5BA439888BA9EBE4F2EBACA"><enum>(i)</enum><text>decreasing the time required to approve plans submitted under subsection (c)(1);</text> </clause>
<clause id="H16949BD5E97E43BAB8FDEC859E1B5BA7"><enum>(ii)</enum><text>ensuring that allocations to producing States under subsection (b) are adequately funded; and</text> </clause>
<clause id="H7FAF217D982F43239076E5FCF304CEE7"><enum>(iii)</enum><text>any modifications to the authorized uses for payments under subsection (d).</text> </clause></subparagraph>
<subparagraph id="H2038F71918DC47E9B637018C6774305F"><enum>(B)</enum><header>Clean water</header><text>Not later than 180 days after the date of enactment of this subsection, the Secretary and the Administrator of the Environmental Protection Agency shall jointly develop procedures for streamlining the permit process required under the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (33 U.S.C. 1251 et seq.) and State laws for restoration projects that are included in an approved plan under subsection (c).</text> </subparagraph>
<subparagraph id="H052FC8C85080433AB26EFE02AFF5C3A7"><enum>(C)</enum><header>Environmental requirements</header><text>A project funded under this section that does not involve wetlands shall not be subject to environmental review requirements under Federal law.</text> </subparagraph></paragraph>
<paragraph id="H95F35289CE6D41B389B786D722C36701"><enum>(2)</enum><header>Cost-sharing requirements</header><text>Any amounts made available to producing States under this section may be used to meet the cost-sharing requirements of other Federal grant programs, including grant programs that support coastal wetland protection and restoration.</text> </paragraph>
<paragraph id="H9BCA51C263E348589EBF638638B07CFE"><enum>(3)</enum><header>Expedited funding</header><text>Not later than 180 days after the date of enactment of this subsection, the Secretary shall develop a procedure to provide expedited funding to projects under this section based on estimated revenues to ensure that the projects may—</text> 
<subparagraph id="HBD274562BDFB410EAC8087B75C494F93"><enum>(A)</enum><text>secure additional funds from other sources; and</text> </subparagraph>
<subparagraph id="H7D60B30AD26349B397D12CC12B6298DC"><enum>(B)</enum><text>use the amounts made available under this section on receipt.</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>
<section id="H8BAA21232C55445E99B9C0FB5F52C093"><enum>104.</enum><header>Seaward boundaries of States</header> 
<subsection id="H9A9C1887D1194F20B9DC59A8AD00001E"><enum>(a)</enum><header>Seaward boundaries</header><text>Section 4 of the Submerged Lands Act (43 U.S.C. 1312) is amended by striking <quote>three geographical miles</quote> each place it appears and inserting <quote>12 nautical miles</quote>.</text> </subsection>
<subsection id="HED21A0640C5F4AD0BB3BE8DC6C1D45BC"><enum>(b)</enum><header>Conforming amendments</header><text>Section 2 of the Submerged Lands Act (43 U.S.C. 1301) is amended—</text> 
<paragraph id="H08005CF0128A4B46BAF8A0F953FCC00"><enum>(1)</enum><text>in subsection (a)(2), by striking <quote>three geographical miles</quote> and inserting <quote>12 nautical miles</quote>; and</text> </paragraph>
<paragraph id="H0DC6340BD6C24F00AF41179C08DBC1"><enum>(2)</enum><text>in subsection (b)—</text> 
<subparagraph id="H7DEF36637C9B4FB1BB98BC0052036F69"><enum>(A)</enum><text>by striking <quote>three geographical miles</quote> and inserting <quote>12 nautical miles</quote>; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H450FD5B3485D4FEAB3BC9E60EBAD7011"><enum>(B)</enum><text>by striking <quote>three marine leagues</quote> and inserting <quote>12 nautical miles</quote>.</text> </subparagraph></paragraph></subsection>
<subsection id="H0ABF7D8ABA944308B613F04FB42EAA27"><enum>(c)</enum><header>Effect of amendments</header> 
<paragraph id="H5EFE3AFC55D04A89004BF620B871EA0"><enum>(1)</enum><header>In general</header><text>Subject to paragraphs (2) through (4), the amendments made by this section shall not effect Federal oil and gas mineral rights.</text> </paragraph>
<paragraph id="H98FED197AB4B40DBBF9BBF4D1908A243"><enum>(2)</enum><header>Submerged land</header><text>Submerged land within the seaward boundaries of States shall be—</text> 
<subparagraph id="HEA1B30B2352B4DE19CC354FD2EFB2231"><enum>(A)</enum><text>subject to Federal oil and gas mineral rights to the extent provided by law;</text> </subparagraph>
<subparagraph id="HB96F5812AC69496989FE30C38FE09C00"><enum>(B)</enum><text>considered to be part of the Federal outer Continental Shelf for purposes of the Outer Continental Shelf Lands Act (43 U.S.C. 1331 et seq.); and</text> </subparagraph>
<subparagraph id="HA580AD92E405445890009300B0777137"><enum>(C)</enum><text>subject to leasing under the authority of that Act and to laws applicable to the leasing of the oil and gas resources of the Federal outer Continental Shelf.</text> </subparagraph></paragraph>
<paragraph id="H13B45CAA70C74BC5A564C6D4BFBBC9CB"><enum>(3)</enum><header>Existing leases</header><text>The amendments made by this section shall not affect any Federal oil and gas lease in effect on the date of enactment of this Act.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H9C8F1B22729845768710BA927B3624AD"><enum>(4)</enum><header>Taxation</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="HE1B690CF3DC84C9BBFE0717138B2887B"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), a State may exercise all of the sovereign powers of taxation of the State within the entire extent of the seaward boundaries of the State (as extended by the amendments made by this section).</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HDA5598D9DB6443C6B8F5A820601B4F3B"><enum>(B)</enum><header>Limitation</header><text>Nothing in this paragraph affects the authority of a State to tax any Federal oil and gas lease in effect on the date of enactment of this Act.</text> </subparagraph></paragraph></subsection></section></title>
<title id="H4CD3325EDD5C4C0A908E69589F85CF91"><enum>II</enum><header>Leasing program for land within Coastal Plain</header> 
<section id="HA202D33B4C2F485E0000A0F56DA1F623"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text> 
<paragraph id="H4C8C87E1C09D4ED999FD13F486E12B6F"><enum>(1)</enum><header>Coastal Plain</header><text>The term <term>Coastal Plain</term> means that area identified as the <quote>1002 Coastal Plain Area</quote> on the map.</text> </paragraph>
<paragraph id="H258C2906AA7746679DE208CC002415C5"><enum>(2)</enum><header>Federal agreement</header><text>The term <term>Federal Agreement</term> means the Federal Agreement and Grant Right-of-Way for the Trans-Alaska Pipeline issued on January 23, 1974, in accordance with section 28 of the Mineral Leasing Act (30 U.S.C. 185) and the Trans-Alaska Pipeline Authorization Act (43 U.S.C. 1651 et seq.).</text> </paragraph>
<paragraph id="H41A231742D3C45EFB4AE09D6F86B5D42"><enum>(3)</enum><header>Final statement</header><text>The term <term>Final Statement</term> means the final legislative environmental impact statement on the Coastal Plain, dated April 1987, and prepared pursuant to section 1002 of the Alaska National Interest Lands Conservation Act (16 U.S.C. 3142) and section 102(2)(C) of the National Environmental Policy Act of 1969 (42 U.S.C. 4332(2)(C)).</text> </paragraph>
<paragraph id="H5599292584364C080001C276E9C7D522"><enum>(4)</enum><header>Map</header><text>The term <term>map</term> means the map entitled <quote>Arctic National Wildlife Refuge</quote>, dated September 2005, and prepared by the United States Geological Survey.</text> </paragraph>
<paragraph id="H58525A1DE5BE42F087E4F17400BFD1CB"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior (or the designee of the Secretary), acting through the Director of the Bureau of Land Management, in consultation with the Director of the United States Fish and Wildlife Service.</text> </paragraph></section>
<section id="HB559BBE87AC4417BB7A5C018C3F234AD"><enum>202.</enum><header>Leasing program for land within the Coastal Plain</header> 
<subsection id="H0E03A8971FA04138B865AB1CFFCADD33"><enum>(a)</enum><header>In general</header><text>The Secretary shall take such actions as are necessary—</text> 
<paragraph id="HDDF20552F89B4D2C99B78749F78708C3"><enum>(1)</enum><text>to establish and implement, in accordance with this title, a competitive oil and gas leasing program that will result in an environmentally sound program for the exploration, development, and production of the oil and gas resources of the Coastal Plain; and</text> </paragraph>
<paragraph id="HF5034226BD78481CBA05D709EBFCF167"><enum>(2)</enum><text>to administer this title through regulations, lease terms, conditions, restrictions, prohibitions, stipulations, and other provisions that—</text> 
<subparagraph id="HC7AEA9DAC7C24FFDBDF21EBCCB322828"><enum>(A)</enum><text>ensure the oil and gas exploration, development, and production activities on the Coastal Plain will result in no significant adverse effect on fish and wildlife, their habitat, subsistence resources, and the environment; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H62695F22B5EF40DCBCC108B57C20BEE0"><enum>(B)</enum><text>require the application of the best commercially available technology for oil and gas exploration, development, and production to all exploration, development, and production operations under this title in a manner that ensures the receipt of fair market value by the public for the mineral resources to be leased.</text> </subparagraph></paragraph></subsection>
<subsection id="HBA061B2139454CC1B02D079EB6E4BB2F"><enum>(b)</enum><header>Repeal</header> 
<paragraph id="H944C201EC0364074901B562EFBBF2D43"><enum>(1)</enum><header>Repeal</header><text>Section 1003 of the Alaska National Interest Lands Conservation Act of 1980 (16 U.S.C. 3143) is repealed.</text> </paragraph>
<paragraph id="H03B478F7424840F189E7B9FBC4BE51B8"><enum>(2)</enum><header>Conforming amendment</header><text>The table of contents contained in section 1 of that Act (16 U.S.C. 3101 note) is amended by striking the item relating to section 1003.</text> </paragraph>
<paragraph id="H6F7FE64E8847429D86CC5DDD00E0BF2B"><enum>(3)</enum><header>Compliance with NEPA for other actions</header> 
<subparagraph id="H6D19D71A5BAD4913AADB6EF139016FE3"><enum>(A)</enum><header>In general</header><text>Before conducting the first lease sale under this title, the Secretary shall prepare an environmental impact statement in accordance with the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) with respect to the actions authorized by this title that are not referred to in paragraph (2).</text> </subparagraph>
<subparagraph id="H23F27BD6932A406683E04EE0A8D25C7D"><enum>(B)</enum><header>Identification and analysis</header><text>Notwithstanding any other provision of law, in carrying out this paragraph, the Secretary shall not be required—</text> 
<clause id="H196849C28D934009A0243D3718707D61"><enum>(i)</enum><text>to identify nonleasing alternative courses of action; or</text> </clause>
<clause id="H10FB602339D144FE9B6DE00025E008E"><enum>(ii)</enum><text>to analyze the environmental effects of those courses of action.</text> </clause></subparagraph>
<subparagraph id="HE1007FBDF7E0461096B3BDB1D947819B"><enum>(C)</enum><header>Identification of preferred action</header><text>Not later than 18 months after the date of enactment of this Act, the Secretary shall—</text> 
<clause id="HD37D405D80334DD8BA5752FE5723800"><enum>(i)</enum><text>identify only a preferred action and a single leasing alternative for the first lease sale authorized under this title; and</text> </clause>
<clause id="H697A384B69E341F4A166A33D47390072"><enum>(ii)</enum><text>analyze the environmental effects and potential mitigation measures for those 2 alternatives.</text> </clause></subparagraph>
<subparagraph id="H93DE6795CBC04C83918D00E555B830E7"><enum>(D)</enum><header>Public comments</header><text>In carrying out this paragraph, the Secretary shall consider only public comments that are filed not later than 20 days after the date of publication of a draft environmental impact statement.</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HCAB3745FE5614D96813E95481EA6DC75"><enum>(E)</enum><header>Effect of compliance</header><text>Notwithstanding any other provision of law, compliance with this paragraph shall be considered to satisfy all requirements for the analysis and consideration of the environmental effects of proposed leasing under this title.</text> </subparagraph></paragraph></subsection>
<subsection id="HC7FFB950D7174E26849EF12EC65F85E1"><enum>(c)</enum><header>Relationship to State and local authority</header><text>Nothing in this title expands or limits any State or local regulatory authority.</text> </subsection>
<subsection id="HE53A4583FA094A96B6FD18259B108EE0"><enum>(d)</enum><header>Special areas</header> 
<paragraph id="HB7A7537C9E164919AED5C0D0C1E9E12F"><enum>(1)</enum><header>Designation</header> 
<subparagraph id="HF1B236D5E6754971BBF0B0082EC9E6B"><enum>(A)</enum><header>In general</header><text>The Secretary, after consultation with the State of Alaska, the North Slope Borough, Alaska, and the City of Kaktovik, Alaska, may designate not more than 45,000 acres of the Coastal Plain as a special area if the Secretary determines that the special area would be of such unique character and interest as to require special management and regulatory protection.</text> </subparagraph>
<subparagraph id="H91B35D915D0C401B856452D372FC92EB"><enum>(B)</enum><header>Sadlerochit spring area</header><text>The Secretary shall designate as a special area in accordance with subparagraph (A) the Sadlerochit Spring area, comprising approximately 4,000 acres as depicted on the map.</text> </subparagraph></paragraph>
<paragraph id="H0D8DAEA5838F49D09C7C26244E003DCE"><enum>(2)</enum><header>Management</header><text>The Secretary shall manage each special area designated under this subsection in a manner that preserves the unique and diverse character of the area, including fish, wildlife, subsistence resources, and cultural values of the area.</text> </paragraph>
<paragraph id="HE5CDF564C51C47968B13549DBB2936BD"><enum>(3)</enum><header>Exclusion from leasing or surface occupancy</header> 
<subparagraph id="HBF2FFFF47FCF4629B5D59C52E6325C42"><enum>(A)</enum><header>In general</header><text>The Secretary may exclude any special area designated under this subsection from leasing.</text> </subparagraph>
<subparagraph id="H04E1FE0C9756477BB1563BDF4B77F6AC"><enum>(B)</enum><header>No surface occupancy</header><text>If the Secretary leases all or a portion of a special area for the purposes of oil and gas exploration, development, production, and related activities, there shall be no surface occupancy of the land comprising the special area.</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HC892B8FC6D10476CAA9DCE025D15183D"><enum>(4)</enum><header>Directional drilling</header><text>Notwithstanding any other provision of this subsection, the Secretary may lease all or a portion of a special area under terms that permit the use of horizontal drilling technology from sites on leases located outside the special area.</text> </paragraph></subsection>
<subsection id="H472918867D2E45AFBC1D071178599BA0"><enum>(e)</enum><header>Limitation on closed areas</header><text>The Secretary may not close land within the Coastal Plain to oil and gas leasing or to exploration, development, or production except in accordance with this title.</text> </subsection>
<subsection id="HC400A721CDFA453AA401AC3292CEF5A2"><enum>(f)</enum><header>Regulations</header> 
<paragraph id="H5C749EDFE3034E7EA26440AA2ED109EB"><enum>(1)</enum><header>In general</header><text>Not later than 15 months after the date of enactment of this Act, the Secretary shall promulgate such regulations as are necessary to carry out this title, including rules and regulations relating to protection of the fish and wildlife, fish and wildlife habitat, subsistence resources, and environment of the Coastal Plain.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H7B6CC36A83B442FD8F9954B7E8934896"><enum>(2)</enum><header>Revision of regulations</header><text>The Secretary shall periodically review and, as appropriate, revise the rules and regulations issued under paragraph (1) to reflect any significant biological, environmental, scientific or engineering data that come to the attention of the Secretary.</text> </paragraph></subsection></section>
<section id="H92F3E87F1E8D4548AB09A8009193D900"><enum>203.</enum><header>Lease sales</header> 
<subsection id="H69C0279D29BD424486DB22DE0083C16C"><enum>(a)</enum><header>In general</header><text>Land may be leased pursuant to this title to any person qualified to obtain a lease for deposits of oil and gas under the Mineral Leasing Act (30 U.S.C. 181 et seq.).</text> </subsection>
<subsection id="HB4C3B4E7863840D985A4786A05BB142"><enum>(b)</enum><header>Procedures</header><text>The Secretary shall, by regulation, establish procedures for—</text> 
<paragraph id="H15C810596E8D475986C3092B8CD1B4E8"><enum>(1)</enum><text>receipt and consideration of sealed nominations for any area in the Coastal Plain for inclusion in, or exclusion (as provided in subsection (c)) from, a lease sale;</text> </paragraph>
<paragraph id="HD78A2332897044C4B01D66159390C352"><enum>(2)</enum><text>the holding of lease sales after that nomination process; and</text> </paragraph>
<paragraph id="H40B5B18726374E2BB3538996D4FCA5F"><enum>(3)</enum><text>public notice of and comment on designation of areas to be included in, or excluded from, a lease sale.</text> </paragraph></subsection>
<subsection id="H4D246003003D483294C81B117583B2F6"><enum>(c)</enum><header>Lease sale bids</header><text>Bidding for leases under this title shall be by sealed competitive cash bonus bids.</text> </subsection>
<subsection id="H9322E032B6AC4139AC189CA9F8FCDB53"><enum>(d)</enum><header>Acreage minimum in first sale</header><text>For the first lease sale under this title, the Secretary shall offer for lease those tracts the Secretary considers to have the greatest potential for the discovery of hydrocarbons, taking into consideration nominations received pursuant to subsection (b)(1), but in no case less than 200,000 acres.</text> </subsection>
<subsection id="HCD6C194A08D04BE690D560040182839"><enum>(e)</enum><header>Timing of lease sales</header><text>The Secretary shall—</text> 
<paragraph id="H9BF2358224B74DC4B865884DFF97DF1E"><enum>(1)</enum><text>not later than 22 months after the date of enactment of this Act, conduct the first lease sale under this title;</text> </paragraph>
<paragraph id="H906C8D1832FE485BACCF533EF3BEC78"><enum>(2)</enum><text>not later than 90 days after the date of the completion of the sale, evaluate the bids in the sale and issue leases resulting from the sale; and</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HFFDAE33C5385456297CF4B3CA145E84C"><enum>(3)</enum><text>conduct additional sales at appropriate intervals if sufficient interest in exploration or development exists to warrant the conduct of the additional sales.</text> </paragraph></subsection></section>
<section id="H770AF13703E34230AD7B5623E13351C2"><enum>204.</enum><header>Grant of leases by the Secretary</header> 
<subsection id="H80BAC8BA7F7342D19CDBF08B5F77880"><enum>(a)</enum><header>In general</header><text>On payment by a lessee of such bonus as may be accepted by the Secretary, the Secretary may grant to the highest responsible qualified bidder in a lease sale conducted pursuant to section 203 a lease for any land on the Coastal Plain.</text> </subsection>
<subsection id="HD1450CED1B2345C9BBF1544286000048"><enum>(b)</enum><header>Subsequent transfers</header> 
<paragraph id="HFC309895F23C49D79981B7716EE94C90"><enum>(1)</enum><header>In general</header><text>No lease issued under this title may be sold, exchanged, assigned, sublet, or otherwise transferred except with the approval of the Secretary.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HDE6880CF11CC47B1B323B5B7EFBC2106"><enum>(2)</enum><header>Condition for approval</header><text>Before granting any approval described in paragraph (1), the Secretary shall consult with and give due consideration to the opinion of the Attorney General.</text> </paragraph></subsection></section>
<section id="H1F4520A126984405AC84C73813BAA1F2"><enum>205.</enum><header>Lease terms and conditions</header><text display-inline="no-display-inline">An oil or gas lease issued pursuant to this title shall—</text> 
<paragraph id="H42E264E52FCD4C10A713B189B422042D"><enum>(1)</enum><text>provide for the payment of a royalty of not less than 12<fraction>1/2</fraction> percent of the amount or value of the production removed or sold from the lease, as determined by the Secretary in accordance with regulations applicable to other Federal oil and gas leases;</text> </paragraph>
<paragraph id="H0C583D396E03488F8182A618DB8652D"><enum>(2)</enum><text>provide that the Secretary may close, on a seasonal basis, such portions of the Coastal Plain to exploratory drilling activities as are necessary to protect caribou calving areas and other species of fish and wildlife;</text> </paragraph>
<paragraph id="H7E500125EA9D4259A08100463012DD19"><enum>(3)</enum><text>require that each lessee of land within the Coastal Plain shall be fully responsible and liable for the reclamation of land within the Coastal Plain and any other Federal land that is adversely affected in connection with exploration, development, production, or transportation activities within the Coastal Plain conducted by the lessee or by any of the subcontractors or agents of the lessee;</text> </paragraph>
<paragraph id="HEBF86330AF8243CD847BF4F764DBA49"><enum>(4)</enum><text>provide that the lessee may not delegate or convey, by contract or otherwise, that reclamation responsibility and liability to another person without the express written approval of the Secretary;</text> </paragraph>
<paragraph id="H0F2E57B8091E4E56B400DBD2C4EBA67B"><enum>(5)</enum><text>provide that the standard of reclamation for land required to be reclaimed under this title shall be, to the maximum extent practicable—</text> 
<subparagraph id="HEBB59897CA18448C841F841ED000747F"><enum>(A)</enum><text>a condition capable of supporting the uses that the land was capable of supporting prior to any exploration, development, or production activities; or</text> </subparagraph>
<subparagraph id="H18CE8A7D627B4A0699DFB213CC8327A5"><enum>(B)</enum><text>on application by the lessee, to a higher or better standard, as approved by the Secretary;</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H275AE43FC2974692A5C6B99D1449EA3"><enum>(6)</enum><text>contain terms and conditions relating to protection of fish and wildlife, fish and wildlife habitat, subsistence resources, and the environment as required under section 202(a)(2);</text> </paragraph>
<paragraph id="H5F6970B68D1D4F25B2D1834BF4C6B8D"><enum>(7)</enum><text>provide that each lessee, and each agent and contractor of a lessee, use their best efforts to provide a fair share of employment and contracting for Alaska Natives and Alaska Native Corporations from throughout the State of Alaska, as determined by the level of obligation previously agreed to in the Federal Agreement; and</text> </paragraph>
<paragraph id="H4B5FC34E5591455A8E3DA207A299341B"><enum>(8)</enum><text>contain such other provisions as the Secretary determines to be necessary to ensure compliance with this title and the regulations promulgated under this title.</text> </paragraph></section>
<section id="H92175B5510514E3F981768E88F6FB08"><enum>206.</enum><header>Coastal plain environmental protection</header> 
<subsection id="H7390EE07585B4A93B004455FFEFE6FA5"><enum>(a)</enum><header>No significant adverse effect standard To govern authorized coastal plain activities</header><text>In accordance with section 202, the Secretary shall administer this title through regulations, lease terms, conditions, restrictions, prohibitions, stipulations, or other provisions that—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H47A6B34FD3D4444495851DE313350955"><enum>(1)</enum><text>ensure, to the maximum extent practicable, that oil and gas exploration, development, and production activities on the Coastal Plain will result in no significant adverse effect on fish and wildlife, fish and wildlife habitat, and the environment;</text> </paragraph>
<paragraph id="HB6B11B8AF4054E75AA24BE0800657D1C"><enum>(2)</enum><text>require the application of the best commercially available technology for oil and gas exploration, development, and production on all new exploration, development, and production operations; and</text> </paragraph>
<paragraph id="HCA0C11021E144BCEB998DA3FDCA00667"><enum>(3)</enum><text>ensure that the maximum surface acreage covered in connection with the leasing program by production and support facilities, including airstrips and any areas covered by gravel berms or piers for support of pipelines, does not exceed 2,000 acres on the Coastal Plain.</text> </paragraph></subsection>
<subsection id="H1D596575B0424465BA4C95F120195445"><enum>(b)</enum><header>Site-specific assessment and mitigation</header><text>The Secretary shall require, with respect to any proposed drilling and related activities on the Coastal Plain, that—</text> 
<paragraph id="H0D669F0AFB2243A0A5CED8D17D256176"><enum>(1)</enum><text>a site-specific analysis be made of the probable effects, if any, that the drilling or related activities will have on fish and wildlife, fish and wildlife habitat, subsistence resources, subsistence uses, and the environment;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H04CB9F31D7134CEFA55C20723D618851"><enum>(2)</enum><text>a plan be implemented to avoid, minimize, and mitigate (in that order and to the maximum extent practicable) any significant adverse effect identified under paragraph (1); and</text> </paragraph>
<paragraph id="HB46D42D2940B49DDBCD42B3FA69006BC"><enum>(3)</enum><text>the development of the plan shall occur after consultation with the 1 or more agencies having jurisdiction over matters mitigated by the plan.</text> </paragraph></subsection>
<subsection id="H02F7A4706D15409DA059D50ADCDD149"><enum>(c)</enum><header>Regulations To protect coastal plain fish and wildlife resources, subsistence users, and the environment</header><text>Before implementing the leasing program authorized by this title, the Secretary shall prepare and issue regulations, lease terms, conditions, restrictions, prohibitions, stipulations, or other measures designed to ensure, to the maximum extent practicable, that the activities carried out on the Coastal Plain under this title are conducted in a manner consistent with the purposes and environmental requirements of this title.</text> </subsection>
<subsection id="H592B3A7EC16E48BAAA45B7488EA59193"><enum>(d)</enum><header>Compliance with Federal and State environmental laws and other requirements</header><text>The proposed regulations, lease terms, conditions, restrictions, prohibitions, and stipulations for the leasing program under this title shall require—</text> 
<paragraph id="H285520C7F618414F8D4786B39F63C00"><enum>(1)</enum><text>compliance with all applicable provisions of Federal and State environmental law (including regulations);</text> </paragraph>
<paragraph id="HA04A04BE7E304078B26816DAB68179A3"><enum>(2)</enum><text>implementation of and compliance with—</text> 
<subparagraph id="H032B3E1DC2A84B50B4D6A7E182EFD81"><enum>(A)</enum><text>standards that are at least as effective as the safety and environmental mitigation measures, as described in items 1 through 29 on pages 167 through 169 of the Final Statement, on the Coastal Plain;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HB21654EA60FA48648190FE3CAC04FCBD"><enum>(B)</enum><text>seasonal limitations on exploration, development, and related activities, as necessary, to avoid significant adverse effects during periods of concentrated fish and wildlife breeding, denning, nesting, spawning, and migration;</text> </subparagraph>
<subparagraph id="H72E432EEDAE4410397BEC7E867D79052"><enum>(C)</enum><text>design safety and construction standards for all pipelines and any access and service roads that minimize, to the maximum extent practicable, adverse effects on—</text> 
<clause id="HEA6A857DA1D24C46A1D257A5015020A4"><enum>(i)</enum><text>the passage of migratory species (such as caribou); and</text> </clause>
<clause id="H2B92B5EA2ADE4EAF957C155D95101CF8"><enum>(ii)</enum><text>the flow of surface water by requiring the use of culverts, bridges, or other structural devices;</text> </clause></subparagraph>
<subparagraph id="H746356D36C1248EB9DC8F75C111FA457"><enum>(D)</enum><text>prohibitions on general public access to, and use of, all pipeline access and service roads;</text> </subparagraph>
<subparagraph id="H4C26A4CFCE2C46ECBB5600E89FE32CD"><enum>(E)</enum><text>stringent reclamation and rehabilitation requirements in accordance with this title for the removal from the Coastal Plain of all oil and gas development and production facilities, structures, and equipment on completion of oil and gas production operations, except in a case in which the Secretary determines that those facilities, structures, or equipment—</text> 
<clause id="H9B83086FD13B4CD89FEF3A0B6E5C9EB"><enum>(i)</enum><text>would assist in the management of the Arctic National Wildlife Refuge; and</text> </clause>
<clause id="H2361E17CD4704C7E9ECB68D3F89B9F19"><enum>(ii)</enum><text>are donated to the United States for that purpose;</text> </clause></subparagraph>
<subparagraph id="H2DB7DEDCCE6443E2A900A9FA27E29D40"><enum>(F)</enum><text>appropriate prohibitions or restrictions on—</text> 
<clause id="H1C2D916CE34B45DBBBA1ECD4E1413C0"><enum>(i)</enum><text>access by all modes of transportation;</text> </clause>
<clause id="HFEB73C1498844F2893FC56D300FC49D6"><enum>(ii)</enum><text>sand and gravel extraction; and</text> </clause>
<clause id="H2CE17518669A41CDBF2CFA825427AE9F"><enum>(iii)</enum><text>use of explosives;</text> </clause></subparagraph>
<subparagraph id="H8AA1AA01B7A24CE1B552C655BEBFEDA0"><enum>(G)</enum><text>reasonable stipulations for protection of cultural and archaeological resources;</text> </subparagraph>
<subparagraph id="HE8554C02CA894D65A2CA2F316B2223AD"><enum>(H)</enum><text>measures to protect groundwater and surface water, including—</text> 
<clause id="H129E125101F048A6BA29D26E2EBC57BB"><enum>(i)</enum><text>avoidance, to the maximum extent practicable, of springs, streams, and river systems;</text> </clause>
<clause id="HDE12CFE31CF541AB9F44FFCE00D6A745"><enum>(ii)</enum><text>the protection of natural surface drainage patterns and wetland and riparian habitats; and</text> </clause>
<clause id="H65928A9F9E904731B213B81892B6B59"><enum>(iii)</enum><text>the regulation of methods or techniques for developing or transporting adequate supplies of water for exploratory drilling; and</text> </clause></subparagraph>
<subparagraph id="H1633E6A187CF4464A825D06BDCC99C7B"><enum>(I)</enum><text>research, monitoring, and reporting requirements;</text> </subparagraph></paragraph>
<paragraph id="H70527F0B32AF437C9309009625FB9D95"><enum>(3)</enum><text>that exploration activities (except surface geological studies) be limited to the period between approximately November 1 and May 1 of each year and be supported, if necessary, by ice roads, winter trails with adequate snow cover, ice pads, ice airstrips, and air transport methods (except that those exploration activities may be permitted at other times if the Secretary determines that the exploration will have no significant adverse effect on fish and wildlife, fish and wildlife habitat, and the environment of the Coastal Plain);</text> </paragraph>
<paragraph id="H47F0FF01633B4ABDB3A306C2CAFE173E"><enum>(4)</enum><text>consolidation of facility siting;</text> </paragraph>
<paragraph id="H8B320AA020B344AAA5D69BBECDF01189"><enum>(5)</enum><text>avoidance or reduction of air traffic-related disturbance to fish and wildlife;</text> </paragraph>
<paragraph id="H30688FD8DB81499CB35004FC83E48EE7"><enum>(6)</enum><text>treatment and disposal of hazardous and toxic wastes, solid wastes, reserve pit fluids, drilling muds and cuttings, and domestic wastewater, including, in accordance with applicable Federal and State environmental laws (including regulations)—</text> 
<subparagraph id="H88C786A3AB524049B390804B2368DD47"><enum>(A)</enum><text>preparation of an annual waste management report;</text> </subparagraph>
<subparagraph id="HF747B73311FA4111A62D267D62A7576D"><enum>(B)</enum><text>development and implementation of a hazardous materials tracking system; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H9DB9B5C29B524D9D005DD87574D4C275"><enum>(C)</enum><text>prohibition on the use of chlorinated solvents;</text> </subparagraph></paragraph>
<paragraph id="H3ECD4E79E6154B82B2D744E4CE2408EE"><enum>(7)</enum><text>fuel storage and oil spill contingency planning;</text> </paragraph>
<paragraph id="H2045029AD14B4D80962EB86C57E465C6"><enum>(8)</enum><text>conduct of periodic field crew environmental briefings;</text> </paragraph>
<paragraph id="H031E953A9E1A4F5D9EEF489101F86300"><enum>(9)</enum><text>avoidance of significant adverse effects on subsistence hunting, fishing, and trapping;</text> </paragraph>
<paragraph id="H5166BD1D1C884FC38F6BFBE4CB311B6D"><enum>(10)</enum><text>compliance with applicable air and water quality standards;</text> </paragraph>
<paragraph id="HDF6BA52539204541A7C888B0FF64ACE2"><enum>(11)</enum><text>appropriate seasonal and safety zone designations around well sites, within which subsistence hunting and trapping shall be limited; and</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H49DF759FD81A4F8C8509F49498C2CEAA"><enum>(12)</enum><text>development and implementation of such other protective environmental requirements, restrictions, terms, or conditions as the Secretary determines to be necessary.</text> </paragraph></subsection>
<subsection id="H3FFBED90FD8B4478A28E00D4DBB7791"><enum>(e)</enum><header>Considerations</header><text>In preparing and issuing regulations, lease terms, conditions, restrictions, prohibitions, or stipulations under this section, the Secretary shall take into consideration—</text> 
<paragraph id="H33E3DA7B79954886841FBD7486CD00BD"><enum>(1)</enum><text>the stipulations and conditions that govern the National Petroleum Reserve-Alaska leasing program, as set forth in the 1999 Northeast National Petroleum Reserve-Alaska Final Integrated Activity Plan/Environmental Impact Statement;</text> </paragraph>
<paragraph id="H92820BA509EE441AB7EAC265147800C2"><enum>(2)</enum><text>the environmental protection standards that governed the initial Coastal Plain seismic exploration program under parts 37.31 through 37.33 of title 50, Code of Federal Regulations (or successor regulations); and</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H84651C174CEE41AEBD4B05A763CAB1B2"><enum>(3)</enum><text>the land use stipulations for exploratory drilling on the KIC–ASRC private land described in appendix 2 of the agreement between Arctic Slope Regional Corporation and the United States dated August 9, 1983.</text> </paragraph></subsection>
<subsection id="H04DA3D8C6C5541CEB3B1C6289F6202F"><enum>(f)</enum><header>Facility consolidation planning</header> 
<paragraph id="H06F59413EF68458BAF284C4D5E67ED1C"><enum>(1)</enum><header>In general</header><text>After providing for public notice and comment, the Secretary shall prepare and periodically update a plan to govern, guide, and direct the siting and construction of facilities for the exploration, development, production, and transportation of oil and gas resources from the Coastal Plain.</text> </paragraph>
<paragraph id="H4E9C3D7ECBD7458C89DADFB035FD0062"><enum>(2)</enum><header>Objectives</header><text>The objectives of the plan shall be—</text> 
<subparagraph id="HA4C5A33B37B449D0A300EFD7CDF54141"><enum>(A)</enum><text>the avoidance of unnecessary duplication of facilities and activities;</text> </subparagraph>
<subparagraph id="H8B3D9F8F62CA426F88B49CA8E69B0CE"><enum>(B)</enum><text>the encouragement of consolidation of common facilities and activities;</text> </subparagraph>
<subparagraph id="H0263677278434A448F5895622584B28F"><enum>(C)</enum><text>the location or confinement of facilities and activities to areas that will minimize impact on fish and wildlife, fish and wildlife habitat, subsistence resources, and the environment;</text> </subparagraph>
<subparagraph id="H991BC5D48CC54AF9A9169CD369FA3859"><enum>(D)</enum><text>the use of existing facilities, to the maximum extent practicable; and</text> </subparagraph>
<subparagraph id="H50BBEF197DB64FB4BAEEDB30F2BE2BFE"><enum>(E)</enum><text>the enhancement of compatibility between wildlife values and development activities.</text> </subparagraph></paragraph></subsection>
<subsection id="HF8DBDFB676D2406CB42ED1000009FF05"><enum>(g)</enum><header>Access to public land</header><text>The Secretary shall—</text> 
<paragraph id="H1C5D88A33DB44E75A3695D813D6400F9"><enum>(1)</enum><text>manage public land in the Coastal Plain in accordance with subsections (a) and (b) of section 811 of the Alaska National Interest Lands Conservation Act (16 U.S.C. 3121); and</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H2BD06FB487C64A358005D8A74FAC9768"><enum>(2)</enum><text>ensure that local residents shall have reasonable access to public land in the Coastal Plain for traditional uses.</text> </paragraph></subsection></section>
<section id="H9D43D45F07AF40298E4436E62CB0907"><enum>207.</enum><header>Expedited judicial review</header> 
<subsection id="HB73E28B85D2D4D41004972C52B512FC7"><enum>(a)</enum><header>Filing of complaints</header> 
<paragraph id="HF3B39B5A62B3489FBE64BD7EB535145"><enum>(1)</enum><header>Deadline</header><text>A complaint seeking judicial review of a provision of this title or an action of the Secretary under this title shall be filed—</text> 
<subparagraph id="H1E1412E86BE64860BC08DFE8C0E5FCFF"><enum>(A)</enum><text>except as provided in subparagraph (B), during the 90-day period beginning on the date on which the action being challenged was carried out; or</text> </subparagraph>
<subparagraph id="H7CF545E726614535B96CAA4BC8C4EFE0"><enum>(B)</enum><text>in the case of a complaint based solely on grounds arising after the 90-day period described in subparagraph (A), by not later than 90 days after the date on which the complainant knew or reasonably should have known about the grounds for the complaint.</text> </subparagraph></paragraph>
<paragraph id="H1AA2C815B20D47ECAA00F641D0C9B0D0"><enum>(2)</enum><header>Venue</header><text>A complaint seeking judicial review of a provision of this title or an action of the Secretary under this title shall be filed in the United States Court of Appeals for the District of Columbia Circuit.</text> </paragraph>
<paragraph id="H49710FFA8D274D84882B2C6EB88802E0"><enum>(3)</enum><header>Scope</header> 
<subparagraph id="H13BD5D23DDCE4B1D9D8FA22802A6B95"><enum>(A)</enum><header>In general</header><text>Judicial review of a decision of the Secretary relating to a lease sale under this title (including an environmental analysis of such a lease sale) shall be—</text> 
<clause id="HA172D08980BC4AF09EE39289B29AF59"><enum>(i)</enum><text>limited to a review of whether the decision is in accordance with this title; and</text> </clause>
<clause id="H01DA09C58ED8409D919E1DB0B5497F77"><enum>(ii)</enum><text>based on the administrative record of the decision.</text> </clause></subparagraph>
<subparagraph id="H7EA4A94A4DFD45AF00EE36007467A811"><enum>(B)</enum><header>Presumptions</header><text>Any identification by the Secretary of a preferred course of action relating to a lease sale, and any analysis by the Secretary of environmental effects, under this title shall be presumed to be correct unless proven otherwise by clear and convincing evidence.</text> </subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HD758F6458E314266A21852CCEBC66C00"><enum>(b)</enum><header>Limitation on other review</header><text>Any action of the Secretary that is subject to judicial review under this section shall not be subject to judicial review in any civil or criminal proceeding for enforcement.</text> </subsection></section>
<section id="H87F1A55D2BBD48F2A4E16329CF106105"><enum>208.</enum><header>Federal and State distribution of revenues</header> 
<subsection id="H476EDD21A52646F88DCCF384CC7546D7"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, of the amount of adjusted bonus, rental, and royalty revenues from Federal oil and gas leasing and operations authorized under this title for each fiscal year—</text> 
<paragraph id="H9569A59FA9AD4553B8CF2822E57F52D4"><enum>(1)</enum><text>50 percent shall be paid to the State of Alaska; and</text> </paragraph>
<paragraph id="H08FF5AAA38AF4084B45E8783E6B59EEC"><enum>(2)</enum><text>except as provided in section 211(d), the balance shall be—</text> 
<subparagraph id="H6CFB966A426747349EE16296381BC851"><enum>(A)</enum><text>used to offset the provisions of this Act; and</text> </subparagraph>
<subparagraph id="HB1756425ED024815A5C0C03DF700888E"><enum>(B)</enum><text>after making the offsets under subparagraph (A), transferred to the ANWR Alternative Energy Trust Fund established by section 212.</text> </subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H5DE69415DD5B4EEF83C4EB16C01D974C"><enum>(b)</enum><header>Payments to Alaska</header><text>Payments to the State of Alaska under this section shall be made semiannually.</text> </subsection></section>
<section id="HD5AC0DEEE3FC478B9087D1B52C4000A8"><enum>209.</enum><header>Rights-of-way across the Coastal plain</header> 
<subsection id="H1D85601173764C86A1E223083B3F684E"><enum>(a)</enum><header>In general</header><text>The Secretary shall issue rights-of-way and easements across the Coastal Plain for the transportation of oil and gas—</text> 
<paragraph id="HB62881E2586C403B933CA24F7E698F88"><enum>(1)</enum><text>except as provided in paragraph (2), under section 28 of the Mineral Leasing Act (30 U.S.C. 185), without regard to title XI of the Alaska National Interest Lands Conservation Act (16 U.S.C. 3161 et seq.); and</text> </paragraph>
<paragraph id="HEACEF5EB0AC34D3290025343DC04D367"><enum>(2)</enum><text>under title XI of the Alaska National Interest Lands Conservation Act (16 U.S.C. 3161 et seq.), for access authorized by sections 1110 and 1111 of that Act (16 U.S.C. 3170, 3171).</text> </paragraph></subsection>
<subsection id="H04D65D6F468A43C1822E37F90017988E"><enum>(b)</enum><header>Terms and conditions</header><text>The Secretary shall include in any right-of-way or easement issued under subsection (a) such terms and conditions as may be necessary to ensure that transportation of oil and gas does not result in a significant adverse effect on the fish and wildlife, subsistence resources, their habitat, and the environment of the Coastal Plain, including requirements that facilities be sited or designed so as to avoid unnecessary duplication of roads and pipelines.</text> </subsection>
<subsection id="H58A80F6963E04EE8956C53A4DAF5B93B"><enum>(c)</enum><header>Regulations</header><text>The Secretary shall include in regulations under section 202(f) provisions granting rights-of-way and easements described in subsection (a).</text> </subsection></section>
<section id="H058DF42C00F043BEAFE3F62CE6AEB9AD"><enum>210.</enum><header>Conveyance</header><text display-inline="no-display-inline">Notwithstanding section 1302(h)(2) of the Alaska National Interest Lands Conservation Act (16 U.S.C. 3192(h)(2)), to remove any cloud on title to land, and to clarify land ownership patterns in the Coastal Plain, the Secretary shall—</text> 
<paragraph id="HB20A8FA4587F44F0BB003DF09C755B3C"><enum>(1)</enum><text>to the extent necessary to fulfill the entitlement of the Kaktovik Inupiat Corporation under sections 12 and 14 of the Alaska Native Claims Settlement Act (43 U.S.C. 1611, 1613), as determined by the Secretary, convey to that Corporation the surface estate of the land described in paragraph (1) of Public Land Order 6959, in accordance with the terms and conditions of the agreement between the Secretary, the United States Fish and Wildlife Service, the Bureau of Land Management, and the Kaktovik Inupiat Corporation, dated January 22, 1993; and</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HBD09AE1918AD44589C16311B3B37F7B5"><enum>(2)</enum><text>convey to the Arctic Slope Regional Corporation the remaining subsurface estate to which that Corporation is entitled under the agreement between that corporation and the United States, dated August 9, 1983.</text> </paragraph></section>
<section id="H8C099B7B0D0344569EFC9872E222F9BF"><enum>211.</enum><header> Local government impact aid and community service assistance</header> 
<subsection id="H8F036B347E84461400CFF11DC9A9B1BC"><enum>(a)</enum><header>Financial assistance authorized</header> 
<paragraph id="H4731E1AC6A4B43378DF27E98256BC575"><enum>(1)</enum><header>In general</header><text>The Secretary may use amounts available from the Coastal Plain Local Government Impact Aid Assistance Fund established by subsection (d) to provide timely financial assistance to entities that are eligible under paragraph (2).</text> </paragraph>
<paragraph id="HA296BE7962F446F4AB7D16A9AEB1F82B"><enum>(2)</enum><header>Eligible entities</header><text>The North Slope Borough, the City of Kaktovik, and any other borough, municipal subdivision, village, or other community in the State of Alaska that is directly impacted by exploration for, or the production of, oil or gas on the Coastal Plain under this title, as determined by the Secretary, shall be eligible for financial assistance under this section.</text> </paragraph></subsection>
<subsection id="HBE9330FAF379448898FE38B6AB21331C"><enum>(b)</enum><header>Use of assistance</header><text>Financial assistance under this section may be used only—</text> 
<paragraph id="HC5636144E53548A9BEB35BEC935EF42"><enum>(1)</enum><text>to plan for mitigation, implement a mitigation plan, or maintain a mitigation project to address the potential effects of oil and gas exploration and development on environmental, social, cultural, recreational, and subsistence resources of the community;</text> </paragraph>
<paragraph id="H4941420A53F34EC500C248182DF407A8"><enum>(2)</enum><text>to develop, carry out, and maintain—</text> 
<subparagraph id="H4564816E95D64177A6B7EFCBE9CF6708"><enum>(A)</enum><text>a project to provide new or expanded public facilities; or</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H5F99B6EFD60948F0B2A2610742CFD6BE"><enum>(B)</enum><text>services to address the needs and problems associated with the effects described in paragraph (1), including firefighting, police, water and waste treatment, first responder, and other medical services; and</text> </subparagraph></paragraph>
<paragraph id="H68B963F3B68F45A4B08F5BC1F1F66C7B"><enum>(3)</enum><text>to establish a local coordination office, to be managed by the Mayor of the North Slope Borough, in coordination with the City of Kaktovik, Alaska—</text> 
<subparagraph id="H8364B7897A9845D3A2BA10608618AE73"><enum>(A)</enum><text>to coordinate with and advise developers on local conditions and the history of areas affected by development; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HDE87DF501B704B0CAF285C919394CE51"><enum>(B)</enum><text>to provide to the Committee on Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate annual reports on the status of the coordination between developers and communities affected by development.</text> </subparagraph></paragraph></subsection>
<subsection id="HDA1E4A5C2F0F40AE97F87B2F979EBE21"><enum>(c)</enum><header>Application</header> 
<paragraph id="H7685C47A9145413EAC9388AB79FB3D00"><enum>(1)</enum><header>In general</header><text>Any community that is eligible for assistance under this section may submit an application for such assistance to the Secretary, in such form and under such procedures as the Secretary may prescribe by regulation.</text> </paragraph>
<paragraph id="H7F575A5BEF494D08A1F333C0939F973F"><enum>(2)</enum><header>North Slope Borough communities</header><text>A community located in the North Slope Borough may apply for assistance under this section either directly to the Secretary or through the North Slope Borough.</text> </paragraph>
<paragraph id="HFB2E89ADDBB841FA8384DC487DDB1012"><enum>(3)</enum><header>Application assistance</header><text>The Secretary shall work closely with and assist the North Slope Borough and other communities eligible for assistance under this section in developing and submitting applications for assistance under this section.</text> </paragraph></subsection>
<subsection id="H4EF10486D25E4132936C214771504E7B"><enum>(d)</enum><header>Establishment of Fund</header> 
<paragraph id="H965D01AE39164D6F99C16EB35794E252"><enum>(1)</enum><header>In general</header><text>There is established in the Treasury the <quote>Coastal Plain Local Government Impact Aid Assistance Fund</quote> (referred to in this section as the <quote>Fund</quote>).</text> </paragraph>
<paragraph id="H73A1B17CDDEB4A7FA0602BF7C01F60D3"><enum>(2)</enum><header>Use</header><text>Amounts in the Fund may be used only for providing financial assistance under this section.</text> </paragraph>
<paragraph id="HA112FA17676B45F1A1B672BA7725CDEE"><enum>(3)</enum><header>Deposits</header><text>Subject to paragraph (4), there shall be deposited into the Fund amounts received by the United States as revenues derived from rents, bonuses, and royalties from Federal leases and lease sales authorized under this title.</text> </paragraph>
<paragraph id="H7BC1EC6B9B5D4B74ABCBB3E11DAAF9DA"><enum>(4)</enum><header>Limitation on deposits</header><text>The total amount in the Fund may not exceed $11,000,000.</text> </paragraph>
<paragraph id="H293D44ABDCDE46D3873B236B245DEC54"><enum>(5)</enum><header>Investment of balances</header><text>The Secretary of the Treasury shall invest amounts in the Fund in interest bearing government securities.</text> </paragraph></subsection>
<subsection id="HBDCD58E1FD33401BBB005CC38099D645"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary from the Fund to provide financial assistance under this section $5,000,000 for each fiscal year.</text> </subsection></section>
<section id="HB654DC9E8BDB4EABAC38371939C77471"><enum>212.</enum><header>ANWR Alternative Energy Trust Fund</header> 
<subsection id="H6BD256860E424FFBBE915DB7467A8B"><enum>(a)</enum><header>Establishment of Trust Fund</header><text>There is established in the Treasury of the United States a trust fund to be known as the <quote>ANWR Alternative Energy Trust Fund</quote>, consisting of such amounts as may be transferred to the ANWR Alternative Energy Trust Fund as provided in section 208(a)(2).</text> </subsection>
<subsection id="H9A01829F311846B89F69E2E03EE8B898"><enum>(b)</enum><header>Expenditures from ANWR Alternative Energy Trust Fund</header> 
<paragraph id="HF615F13C07494C6CBC160034B5D6D12"><enum>(1)</enum><header>In general</header><text>Amounts in the ANWR Alternative Energy Trust Fund shall be available without further appropriation to carry out specified provisions of the Energy Policy Act of 2005 (Public Law 109–58; referred to in this section as <quote>EPAct2005</quote>) and the Energy Independence and Security Act of 2007 (Public Law 110–140; referred to in this section as <quote>EISAct2007</quote>) as follows:</text>

<clause id="H584573B0D8D74778878255C9A4B41019"><enum>(i)</enum><text>at least annually, consult with the persons described in paragraph (1) to expedite the commercial leasing program for oil shale resources on public land in the State; and</text> </clause>
<clause id="H75C5CBB91EEA49AB8E745901F6737859"><enum>(ii)</enum><text>at least once every 270 days, conduct a lease sale in the State under the commercial leasing program regulations.</text> </clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>
<section id="H181BE920D0504DFF0041C8EAC6F4E08"><enum>302.</enum><header>Licensing of new nuclear power plants</header> 
<subsection id="H531D4EC93C9C42799B0471C9FDD800E4"><enum>(a)</enum><header>Construction permits and operating licenses</header><text display-inline="yes-display-inline">Section 185 b. of the Atomic Energy Act of 1954 (42 U.S.C. 2235(b)) is amended in the first sentence by striking <quote>holding a public hearing</quote> and inserting <quote>any public hearing held</quote>.</text> </subsection>
<subsection id="HF2D83149BA074854A9BECA96C71E6F71"><enum>(b)</enum><header>Hearings and judicial review</header><text display-inline="yes-display-inline">Section 189 a.(1)(A) of the Atomic Energy Act of 1954 (42 U.S.C. 2239(a)(1)(A)) is amended—</text> 
<paragraph id="HD80CA269DBDE40BC9B0080F8A71183ED"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the second sentence; and</text> </paragraph>
<paragraph id="H16D96DD8DC754CAAABDF9011AC629EE6"><enum>(2)</enum><text display-inline="yes-display-inline">in the third sentence—</text>

<subparagraph commented="no" display-inline="no-display-inline" id="H8D6E95E01DC7494A006B4518D382D47F"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>an operating license</quote> and inserting <quote>a construction permit, an operating license,</quote>.</text> </subparagraph></paragraph></subsection></section>
<section id="H3B235A2DE7734001B5E1FF12DE567FC"><enum>303.</enum><header>Jurisdiction over covered energy projects</header> 
<subsection id="HEE51302814D747738201F0AC80D0E6E8"><enum>(a)</enum><header>Definition of covered energy project</header><text display-inline="yes-display-inline">In this section, the term <term>covered energy project</term> means any action or decision by a Federal official regarding—</text> 
<paragraph id="H45176DEB69A941618455ED428EFCCFF9"><enum>(1)</enum><text>the leasing of Federal land (including submerged land) for the exploration, development, production, processing, or transmission of oil, natural gas, or any other source or form of energy, including actions and decisions regarding the selection or offering of Federal land for such leasing; or</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H79BDAD2BC34A4EA9BC89D861D95B558E"><enum>(2)</enum><text>any action under such a lease, except that this section and Act shall not apply to a dispute between the parties to a lease entered into a provision of law authorizing the lease regarding obligations under the lease or the alleged breach of the lease.</text> </paragraph></subsection>
<subsection id="H0D4DC4F7C5954BD5B145B4A7C21021F4"><enum>(b)</enum><header>Exclusive jurisdiction over causes and claims relating to covered energy projects</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the United States District Court for the District of Columbia shall have exclusive jurisdiction to hear all causes and claims under this section or any other Act that arise from any covered energy project.</text> </subsection>
<subsection id="HA1FC1C3645754C33861CCE7F80A47331"><enum>(c)</enum><header>Time for filing complaint</header> 
<paragraph id="HEBA5FE8335244481A01BD361CF736BE6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each case or claim described in subsection (b) shall be filed not later than the end of the 60-day period beginning on the date of the action or decision by a Federal official that constitutes the covered energy project concerned.</text> </paragraph>
<paragraph id="H900EFA0CC9F145E48C7EF0BB6E5BE187"><enum>(2)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Any cause or claim described in subsection (b) that is not filed within the time period described in paragraph (1) shall be barred.</text> </paragraph></subsection>
<subsection id="HAC16C14EC52B41FF914E5450D87900F6"><enum>(d)</enum><header>District court for the District of Columbia deadline</header> 
<paragraph id="H53D2817953CF495785463141F52143FE"><enum>(1)</enum><header>In general</header><text>Each proceeding that is subject to subsection (b) shall—</text> 
<subparagraph id="HD3F4C810ADEE4DBEB023EBF06C4F5798"><enum>(A)</enum><text>be resolved as expeditiously as practicable and in any event not more than 180 days after the cause or claim is filed; and</text> </subparagraph>
<subparagraph id="HE44C508606B142259C107E58CC114EEA"><enum>(B)</enum><text>take precedence over all other pending matters before the district court.</text> </subparagraph></paragraph>
<paragraph id="H740F8E41D2734631B4007FD286481153"><enum>(2)</enum><header>Failure to comply with deadline</header><text>If an interlocutory or final judgment, decree, or order has not been issued by the district court by the deadline required under this section, the cause or claim shall be dismissed with prejudice and all rights relating to the cause or claim shall be terminated.</text> </paragraph></subsection>
<subsection id="HFF7C2FE57F644ABCB1BD5811B0F4976F"><enum>(e)</enum><header>Ability To seek appellate review</header><text display-inline="yes-display-inline">An interlocutory or final judgment, decree, or order of the district court under this section may be reviewed by no other court except the Supreme Court.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="H2D1E45E23C1C4B9096E2F94CBC5D600"><enum>(f)</enum><header>Deadline for appeal to the Supreme Court</header><text display-inline="yes-display-inline">If a writ of certiorari has been granted by the Supreme Court pursuant to subsection (e), the interlocutory or final judgment, decree, or order of the district court shall be resolved as expeditiously as practicable and in any event not more than 180 days after the interlocutory or final judgment, decree, order of the district court is issued.</text> </subsection></section>
<section id="HE793D83AA55046CEAB46A336E49C3A3"><enum>304.</enum><header>Environmental impact statements</header><text display-inline="no-display-inline">Title I of the National Environmental Policy Act of 1969 (42 U.S.C. 4331 et seq.) is amended by adding at the end the following:</text>

<section id="HBA273661C17048AF85B9C8260A9E6D1"><enum>106.</enum><header>Completion and review of environmental impact statements</header> 
<subsection id="HBF47549EF0364D478C4C9959AA7DEF00"><enum>(a)</enum><header>Completion</header> 
<paragraph id="H7E8C1F3CC850474DBB0001D2D18FC59C"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, each review carried out under section 102(2)(C) with respect to any action taken under any provision of law, or for which funds are made available under any provision of law, shall be completed not later than the date that is 270 days after the commencement of the review.</text> </paragraph>
<paragraph id="H236D0C8A871447C495EB405253C40180"><enum>(2)</enum><header>Failure to complete review</header><text display-inline="yes-display-inline">If a review described in paragraph (1) has not been completed for an action subject to section 102(2)(C) by the date specified in paragraph (1)—</text> 
<subparagraph id="H991A3CC3A1374B33A08493F5A2AC4853"><enum>(A)</enum><text display-inline="yes-display-inline">the action shall be considered to have no significant impact described in section 102(2)(C); and</text> </subparagraph>
<subparagraph id="H13BEA78E44CA4F32B4545F40BC439839"><enum>(B)</enum><text display-inline="yes-display-inline">that classification shall be considered to be a final agency action.</text> </subparagraph></paragraph></subsection>
<subsection id="HF341B63249AB492A84AACA007DAB1151"><enum>(b)</enum><header>Lead agency</header><text>The lead agency for a review of an action under this section shall be the Federal agency to which funds are made available for the action.</text> </subsection>
<subsection id="H9BD253DFC762416E916159FDC874FE52"><enum>(c)</enum><header>Review</header> 
<paragraph id="H65C656827BB845268F1404097325336D"><enum>(1)</enum><header>Administrative appeals</header><text>There shall be a single administrative appeal for each review carried out pursuant to section 102(2)(C).</text> </paragraph>
<paragraph id="H0A5B78D38AF24882AE9E4262ABDD90D6"><enum>(2)</enum><header>Judicial review</header> 
<subparagraph id="H712F203E2AE94AEDA015E7BD005BBEF0"><enum>(A)</enum><header>In general</header><text>On resolution of the administrative appeal, judicial review of the final agency decision after exhaustion of administrative remedies shall lie with the United States Court of Appeals for the District of Columbia Circuit.</text> </subparagraph>
<subparagraph id="H6115CBB4895C436F807E6112F79CB208"><enum>(B)</enum><header>Administrative record</header><text>An appeal to the court described in subparagraph (A) shall be based only on the administrative record.</text> </subparagraph>
<subparagraph id="H6080916B30124F8D967E86150094B5FE"><enum>(C)</enum><header>Pendency of judicial review</header><text>After an agency has made a final decision with respect to a review carried out under this subsection, the decision shall be effective during the course of any subsequent appeal to a court described in subparagraph (A).</text> </subparagraph></paragraph>
<paragraph id="HE9771DD2021D449F82D0592801174947"><enum>(3)</enum><header>Civil action</header><text>Each civil action covered by this section shall be considered to arise under the laws of the United States.</text> </paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section>

<section id="H69D69EEA4BEB4513977D89E845B425B2" section-type="subsequent-section"><enum>306.</enum><header>Endangered species</header> 
<subsection id="H042EAC263BC646C2BE362E08A2B2CCD"><enum>(a)</enum><header>Emergencies</header><text>Section 10 of the Endangered Species Act of 1973 (16 U.S.C. 1539) is amended by adding at the end the following:</text>
