		<official-title>To amend the Internal Revenue Code of 1986 to require the
		  Secretary of the Treasury to notify the Secretary of Homeland Security of
		  employer returns showing the employment of individuals not authorized to be
		  employed in the United States, to notify the employers that they must terminate
		  the employment of those employees, to provide an opportunity for those
		  employees to contest the information, and to establish a procedure for
		  determining whether individuals who are not authorized to be employed in the
		  United States are so employed.</official-title>

		<section commented="no" id="HA62D6BD1C1244F3A8B334C1BAE01A46C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Enforce Immigration Law Act of
			 2009</short-title></quote>.</text>
		</section><section id="H36D7890A4341421D9555E2C1321514F8"><enum>2.</enum><header>Notification of
			 employment status of individuals not authorized to work in the United
			 States</header>
			<subsection id="HC55B0B42D0FC4D7FA352F76DFDC9DFA5"><enum>(a)</enum><header>In
			 general</header><text>Subsection (i) of section 6103 of the Internal Revenue
			 Code of 1986 (relating to confidentiality and disclosure of returns and return
			 information) is amended by adding at the end the following new
			 paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H3FBE8F133FBC4B198CDF73BE00D4242D" style="OLC">
					<paragraph id="H9335FD3307A84A28B321F528962D9D00"><enum>(9)</enum><header>Disclosure to
				Secretary of Homeland Security of employment information of employees not
				authorized to be employed in United States</header>
						<subparagraph id="H05FC3142F961499488C7C92BB1BED865"><enum>(A)</enum><header>In
				general</header><text>If—</text>
							<clause display-inline="no-display-inline" id="H3023D82A16F94BBCB1E586C06B476CB"><enum>(i)</enum><text>the Secretary
				receives a return from any person or entity (hereafter in this paragraph
				referred to as the <quote>employer</quote>) showing wages (as defined in
				section 3121(a)) paid to any employee, and</text>
							</clause><clause id="H153AC4ADA47040BFBFBB9003BFA5612E"><enum>(ii)</enum><text>the TIN of such
				employee, as shown on such return, indicates that such employee is not
				authorized to be employed in the United States,</text>
							</clause><continuation-text continuation-text-level="subparagraph">the
				Secretary shall provide electronically to the Secretary of Homeland Security
				the following information as shown on such return: the name, address, and TIN
				of such employee and the name, address, and employer identification number of
				the employer.</continuation-text></subparagraph><subparagraph id="HC2C80F4DC081477A81A332066F9D6996"><enum>(B)</enum><header>Notice to
				employer and employee</header><text display-inline="yes-display-inline">Whenever the Secretary sends a notice under
				subparagraph (A) with respect to any employer and employee, the Secretary also
				shall notify the employer and the employee in writing that such employee is not
				authorized to be employed in the United States and that the employee’s
				employment with the employer should be terminated not later than the 30th day
				after the date of the notice. Such notice shall also describe—</text>
							<clause id="H659C4FAEF02E4042A8EA623DB35900AE"><enum>(i)</enum><text>the employer’s
				obligations under this paragraph,</text>
							</clause><clause id="HA302F5EBD25745BAB6FEA5189FC32374"><enum>(ii)</enum><text display-inline="yes-display-inline">the employee’s right under this paragraph
				to contest the determination that the employee is not authorized to be employed
				in the United States, and</text>
							</clause><clause id="H53F7F5AD96754F59B5E5521DA7229752"><enum>(iii)</enum><text>the procedure
				under this paragraph for contesting such determination.</text>
							</clause></subparagraph><subparagraph id="H0690EB4103534FE896E2B8B4078E9DCB"><enum>(C)</enum><header>Employee’s right
				to contest</header>
							<clause id="H99D28E68E43E4FB49CADB99028110096"><enum>(i)</enum><header>Notice to
				employee</header><text>If any employer receives such a notice from the
				Secretary with respect to an employee, the employer shall, within 3 business
				days after the date the employer received such notice, provide a copy of such
				notice to the employee.</text>
							</clause><clause id="H7D023F67074B4FBE81F6B9AB6151D00"><enum>(ii)</enum><header>Right to
				contest</header><text>An employee may contest the accuracy of such notice
				during the 30-day period beginning on the date that the employer provided the
				notice under clause (i) to the employee.</text>
							</clause><clause id="H7D0E0622C26147E791A895D7AC216BD2"><enum>(iii)</enum><header>Contest
				procedure</header><text>If, during such 30-day period, the employee provides
				the employer with information substantiating such employee’s claimed
				authorization to be employed in the United States, the employer shall, in such
				form and manner as the Secretary shall prescribe, provide to the
				Secretary—</text>
								<subclause display-inline="no-display-inline" id="H925129235EE24863BB830065307D701D"><enum>(I)</enum><text display-inline="yes-display-inline">the employee’s name, address, and taxpayer
				identification number,</text>
								</subclause><subclause id="HDCBBF4ADEEBD439BBCD91682CAB12B4"><enum>(II)</enum><text>the employer’s
				name, address, telephone number, and employer identification number, and</text>
								</subclause><subclause id="H40899F5974AA444F00E6E7C5F9B501C0"><enum>(III)</enum><text display-inline="yes-display-inline">the information provided by the employee to
				the employer substantiating such employee’s authorization to be employed in the
				United States.</text>
								</subclause></clause></subparagraph><subparagraph id="HF878F373724048EDA3FC622F0066C63B"><enum>(D)</enum><header>Verification
				from Department of Homeland Security</header>
							<clause id="H1D0EB584DAE141B58D1421932D4213D1"><enum>(i)</enum><header>Transmittal of
				inquiry</header><text display-inline="yes-display-inline">Within 3 business
				days after receiving the information described in subparagraph (C)(iii), the
				Secretary shall provide such information electronically to the Secretary of
				Homeland Security.</text>
							</clause><clause id="H972B63DACCD34547BF7E48C38E8FEA4D"><enum>(ii)</enum><header>Response</header><text display-inline="yes-display-inline">Within 7 business days after receiving such
				information, the Secretary of Homeland Security shall electronically notify the
				Secretary, and shall notify the employer and employee in writing, as to whether
				the employee is authorized to be employed in the United States.</text>
							</clause></subparagraph><subparagraph id="H7F5920EAE1294EE2A982F2643C2B9B5D"><enum>(E)</enum><header>Suspension of
				obligation to terminate employment until response received</header>
							<clause id="H369CE22771F844B7ABE43DDA578FD47"><enum>(i)</enum><header>In
				general</header><text>Except as provided in clause (ii), if the employee meets
				the requirement of subparagraph (C)(iii), the employer’s obligation to
				terminate the employment of such employee shall be suspended until the employer
				receives the notice described in subparagraph (D)(ii).</text>
							</clause><clause id="HB6B3DA5DD637410996BE7B7E083EEABE"><enum>(ii)</enum><header>Timely response
				not received</header><text>If the employer does not receive such notice before
				the 30th day after the close such 30-day period, the employer shall so notify
				the Secretary.</text>
							</clause></subparagraph><subparagraph id="H9E6DACD670984863BB96AAE3F602A7CA"><enum>(F)</enum><header>Rebuttable
				presumption of violation of the Immigration and Nationality Act</header>
							<clause id="H6746BDF109164B10AF9DCAFEAAAA892F"><enum>(i)</enum><header>In
				general</header><text>A rebuttable presumption is created that the employer has
				violated section 274A(a)(1)(A) of the Immigration and Nationality Act
				if—</text>
								<subclause id="H3403F90BB9FB439FB06995ADC903E73"><enum>(I)</enum><text>the employer
				employs an individual with respect to whom a notice is received under
				subparagraph (B) after the 30 days described in such subparagraph,</text>
								</subclause><subclause id="H1F9DC29069014AEEAB27D5A367391B36"><enum>(II)</enum><text>the employer
				fails to notify the Secretary as required by subparagraph (E)(ii) and employs
				such individual, or</text>
								</subclause><subclause id="H3D72FB6009B34F4F8957ED003E12AD8"><enum>(III)</enum><text>the employer
				refers the individual for employment after receiving a notice under
				subparagraph (B) with respect to such individual.</text>
								</subclause></clause><clause id="H3F24F7BA9CDE4B30A4DB5F9E87BFF286"><enum>(ii)</enum><header>Exceptions</header>
								<subclause id="H26250267355A4864933E5FE86216B7E2"><enum>(I)</enum><header>Suspension
				period</header><text>Clause (i)(I) shall not apply during the suspension period
				described in subparagraph (E)(i).</text>
								</subclause><subclause id="H3B8B3D543CAE462D92003314CF7E6611"><enum>(II)</enum><header>Notice from
				secretary of homeland security</header><text>Clause (i) shall cease to apply
				with respect to an individual after the date that the employer is notified by
				the Secretary of Homeland Security that such individual is authorized to be
				employed in the United States.</text>
								</subclause></clause></subparagraph><subparagraph display-inline="no-display-inline" id="HEAA08FB4572843BA8B169D345847DE6D"><enum>(G)</enum><header>Refunds
				denied</header><text>No refund of any tax imposed by this title shall be made
				to any individual for any taxable year during any portion of which such
				individual is employed in the United States without being authorized to be so
				employed.</text>
						</subparagraph><subparagraph id="H9175FD69ADAB4EEEA8F7BB3F0087DB5F"><enum>(H)</enum><header>Special
				rules</header>
							<clause id="H5BA8FA87501A4AF29F8CFB27360096C7"><enum>(i)</enum><header>Protection from
				liability</header><text>No employer shall be civilly or criminally liable under
				any law for any action taken in good faith reliance on information provided by
				the Secretary or the Secretary of Homeland Security with respect to any
				individual’s eligibility to be employed in the United States.</text>
							</clause><clause id="H12A99DBAD0CD4B5C8CCAD159BC5F4F2C"><enum>(ii)</enum><header>Timely mailing
				treated as timely notice</header><text>Rules similar to the rules of section
				7502 shall apply for purposes of this section.</text>
							</clause><clause id="H0E31E16553BF48D4B8D6FE5607B3533E"><enum>(iii)</enum><header>Last known
				address of employee</header><text>Any notice required to be provided to an
				employee under this section shall be sufficient if mailed to the employee at
				the last known address of the
				employee.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5A2841F9D6A64C76B499243F795928EF"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Paragraph (4) of section 6103(p) of such Code is
			 amended by striking <quote>(5) or (7)</quote> each place it appears and
			 inserting <quote>(5), (7), or (9)</quote>.</text>
			</subsection><subsection id="H6CD384EF4AAA4B15ACD2FE6FA7238D20"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to returns
			 received more than 180 days after the date of the enactment of this Act.</text>
			</subsection></section><section id="HDBB9A303314C4CD88E9E3BC527075421"><enum>3.</enum><header>Procedure for
			 determining whether individuals who are not authorized to be employed in the
			 United States are so employed</header>
			<subsection id="HAFC7E5096A9842D6A5DECBB971CAFC41"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (i) of
			 section 6103 of the Internal Revenue Code of 1986 (relating to confidentiality
			 and disclosure of returns and return information), as amended by section 2, is
			 amended by adding at the end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HEE37070CF6824005B5882E9B3BD99DCD" style="OLC">
					<paragraph id="HC8DAC65491DD4A93A22C07DE4D1F4620"><enum>(10)</enum><header>Disclosure of
				employment information to Secretary of Homeland Security</header>
						<subparagraph id="H975530AF803041E39CAEE282F46D189C"><enum>(A)</enum><header>In
				general</header><text>During December of each calendar year, the Secretary of
				Homeland Security shall submit electronically a request to the Secretary for
				the information described in subparagraph (B)(ii) with respect to each
				individual who had been authorized to be employed in the United States during
				any prior calendar year but who was not so authorized as of December 31 of the
				immediately preceding calendar year. Such request shall specify—</text>
							<clause id="HC65E472F917F4C78B0555F4610CEFBF2"><enum>(i)</enum><text display-inline="yes-display-inline">the name and TIN of the individual,
				and</text>
							</clause><clause id="H64D83F988BE04AB38DB953CB8666DF71"><enum>(ii)</enum><text display-inline="yes-display-inline">the taxable period or periods for which the
				information is requested.</text>
							</clause></subparagraph><subparagraph id="H030D99B6BFBA4097BBC5ADE97BAFB64C"><enum>(B)</enum><header>Disclosure of
				employment information</header>
							<clause id="HE159B71C5C854A6786DF46EAF6ACDCAE"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than the
				first March 5 following the receipt by the Secretary of such request, the
				Secretary shall electronically disclose return information described in clause
				(ii) to officers and employees of the Department of Homeland Security who are
				personally and directly engaged in the enforcement of the Immigration and
				Nationality Act.</text>
							</clause><clause id="H71F87C57DBBD4645A2FD667F79DF104C"><enum>(ii)</enum><header>Information to
				be disclosed</header><text>The information described in this clause with
				respect to any individual is—</text>
								<subclause id="HA809B6C18E8C47D384D2E9EF272F473"><enum>(I)</enum><text display-inline="yes-display-inline">such individual’s mailing address,</text>
								</subclause><subclause id="HD902B9BE5F02483A80A004BDA0387D80"><enum>(II)</enum><text>the total amount
				of wages (as defined in section 3121(a)) paid to such individual during the
				period or periods specified in subparagraph (A)(ii), and</text>
								</subclause><subclause id="H372960542D234A8B8061C1A1AA110563"><enum>(III)</enum><text>the name,
				address, and employer identification number of each employer paying such wages
				during such period or periods.</text>
								</subclause></clause></subparagraph><subparagraph id="H66415FF7B31346E2BEEA59D43BF9553"><enum>(C)</enum><header>Refunds, etc.
				withheld</header><text>No refund of any tax imposed by this title shall be
				made, and no credit under section 32 (relating to earned income credit) shall
				be allowed, to any individual for any taxable year during any portion of which
				such individual is employed in the United States without being authorized to be
				so employed.</text>
						</subparagraph><subparagraph id="HA936FE41532B49E4AF8FB286AAF3C323"><enum>(D)</enum><header>Notice to
				employer and employee</header><text display-inline="yes-display-inline">If the
				Secretary of Homeland Security receives information under this paragraph
				indicating that an individual was employed in the United States after the
				expiration of the individual’s authority to be so employed, such Secretary
				shall (within 7 business days after receiving such information) notify in
				writing such individual and each person or entity who was an employer of such
				individual after such expiration that such individual is not authorized to be
				employed in the United States and that the individual’s employment with the
				employer should be terminated not later than the 30th day after the date of the
				notice. Such notice shall also describe—</text>
							<clause id="H546B5FF65A5B492385EF5D0815CCB167"><enum>(i)</enum><text>the employer’s
				obligations under this paragraph,</text>
							</clause><clause id="H6E847C6D34A34255BA91088522F0342C"><enum>(ii)</enum><text display-inline="yes-display-inline">the employee’s right under this paragraph
				to contest the determination that the employee is not authorized to be employed
				in the United States, and</text>
							</clause><clause id="H979E20DCC6324BEE942D1EF0AA09C909"><enum>(iii)</enum><text>the procedure
				under this paragraph for contesting such determination.</text>
							</clause></subparagraph><subparagraph display-inline="no-display-inline" id="H3255A816522040B78250D900DE3BD3F"><enum>(E)</enum><header>Employee’s right
				to contest</header>
							<clause id="HC285E08DB5AE49D68370454E3831806D"><enum>(i)</enum><header>Notice to
				employee</header><text display-inline="yes-display-inline">If any employer
				receives such a notice from the Secretary of Homeland Security with respect to
				an employee, the employer shall, within 3 business days after the date the
				employer received such notice, provide a copy of such notice to the
				employee.</text>
							</clause><clause id="H19CD35EA84184D5B838167DB608E4D63"><enum>(ii)</enum><header>Right to
				contest</header><text>An employee may contest the accuracy of such notice
				during the 30-day period beginning on the date that the employer provided the
				notice under clause (i) to the employee.</text>
							</clause><clause id="HB89ACCC2ED5546078230F7DE7E8D04CA"><enum>(iii)</enum><header>Contest
				procedure</header><text>If, during such 30-day period, the employee provides
				the employer with information substantiating such employee’s claimed
				authorization to be employed in the United States, the employer shall, in such
				form and manner as the Secretary of Homeland Security shall prescribe, provide
				to such Secretary—</text>
								<subclause display-inline="no-display-inline" id="H7F6F24B9B538421FBEB55F19F97B00F5"><enum>(I)</enum><text display-inline="yes-display-inline">the employee’s name, address, and taxpayer
				identification number,</text>
								</subclause><subclause id="H603F2EA3D4704A47833B00AF00F23D0"><enum>(II)</enum><text>the employer’s
				name, address, telephone number, and employer identification number, and</text>
								</subclause><subclause id="H51DAA2A995E34A619B5E7FBEFEB1B4DF"><enum>(III)</enum><text display-inline="yes-display-inline">the information provided by the employee to
				the employer substantiating such employee’s authorization to be employed in the
				United States.</text>
								</subclause></clause></subparagraph><subparagraph display-inline="no-display-inline" id="HB8341DF2142C4C3D9C1B1C829085FDE2"><enum>(F)</enum><header>Verification
				from Department of Homeland Security</header><text>Within 7 business days after
				receiving such information, the Secretary of Homeland Security shall
				electronically notify the Secretary, and shall notify the employer and employee
				in writing, as to whether the employee is authorized to be employed in the
				United States.</text>
						</subparagraph><subparagraph id="H5F5237987A00441300A140C38B4B2BE1"><enum>(G)</enum><header>Suspension of
				obligation to terminate employment until response received</header>
							<clause id="H9E24B5B686804066AA54DF2C16121944"><enum>(i)</enum><header>In
				general</header><text>Except as provided in clause (ii), if the employee meets
				the requirement of subparagraph (E)(iii), the employer’s obligation to
				terminate the employment of such employee shall be suspended until the employer
				receives the notice described in subparagraph (F).</text>
							</clause><clause id="H1DA948C4BBFB4066BF7967F04968027B"><enum>(ii)</enum><header>Timely response
				not received</header><text>If the employer does not receive such notice before
				the 30th day after the close such 30-day period, the employer shall so notify
				the Secretary of Homeland Security.</text>
							</clause></subparagraph><subparagraph display-inline="no-display-inline" id="HDCD8A7206FAA409DA90390C7DD44E66B"><enum>(H)</enum><header>Rebuttable
				presumption of violation of the Immigration and Nationality Act</header>
							<clause id="H54E55F6213D8429D8DAD29ED9B16DE13"><enum>(i)</enum><header>In
				general</header><text>A rebuttable presumption is created that the employer has
				violated section 274A(a)(1)(A) of the Immigration and Nationality Act
				if—</text>
								<subclause id="H8AEA2EFF257D48DAA0F34B95FC72F99B"><enum>(I)</enum><text>the employer
				employs an individual with respect to whom a notice is received under
				subparagraph (D) after the 30 days described in such subparagraph,</text>
								</subclause><subclause id="HB376B480F2324A630076F4E1D5BABF16"><enum>(II)</enum><text>the employer
				fails to notify the Secretary as required by subparagraph (G)(ii) and employs
				such individual, or</text>
								</subclause><subclause id="H2E9E9B6E16C847EAAD6D5533094B1445"><enum>(III)</enum><text>the employer
				refers the individual for employment after receiving a notice under
				subparagraph (D) with respect to such individual.</text>
								</subclause></clause><clause id="H4E22042D8DA2424A9F0417704028F8CF"><enum>(ii)</enum><header>Exceptions</header>
								<subclause id="H9C07CF3B06BB49D494173B23C4CD8829"><enum>(I)</enum><header>Suspension
				period</header><text>Clause (i)(I) shall not apply during the suspension period
				described in subparagraph (G)(i).</text>
								</subclause><subclause id="H0B3DEECA940D42F4AFA9FDB36CE1026D"><enum>(II)</enum><header>Notice from
				secretary of homeland security</header><text>Clause (i) shall cease to apply
				with respect to an individual after the date that the employer is notified by
				the Secretary of Homeland Security that such individual is authorized to be
				employed in the United States.</text>
								</subclause></clause></subparagraph><subparagraph id="H5B98ECC2AC0246DE9FF7C395AB38B365"><enum>(I)</enum><header>Special
				rules</header>
							<clause id="H024865368AA446C5BE4B71E180873489"><enum>(i)</enum><header>Protection from
				liability</header><text>No employer shall be civilly or criminally liable under
				any law for any action taken in good faith reliance on information provided by
				the Secretary or the Secretary of Homeland Security with respect to any
				individual’s eligibility to be employed in the United States.</text>
							</clause><clause id="HB167220DFBF24D3AAA5CFA1494BE00CD"><enum>(ii)</enum><header>Timely mailing
				treated as timely notice</header><text>Rules similar to the rules of section
				7502 shall apply for purposes of this section.</text>
							</clause><clause id="H601B9C6AE54D485A8EA1D44CC9D9BE2"><enum>(iii)</enum><header>Last known
				address of employee</header><text>Any notice required to be provided to an
				employee under this section shall be sufficient if mailed to the employee at
				the last known address of the employee.</text>
							</clause><clause id="H6FDFF9B38020465FB12042617902E185"><enum>(iv)</enum><header>Employment-based
				visas</header><text display-inline="yes-display-inline">For purposes of this
				section, the determination of whether an individual is authorized to be
				employed in the United States includes whether the individual has an immigrant
				visa issued pursuant to the numerical limitation under section 203(b) of the
				Immigration and Nationality Act (8 U.S.C. 1153(b)) (relating to
				employment-based
				visas).</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3287BBCAD5E44C5C86B2304532652900"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Paragraph (4) of section 6103(p) of such Code, as
			 amended by subsection (a), is amended by striking <quote>(7), or (7)</quote>
			 each place it appears and inserting <quote>(7), (9), or (10)</quote>.</text>
			</subsection><subsection id="H74FF5D99E54D439A9571ABC021C6D700"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to requests
			 made in calendar years beginning after the date of the enactment of this
			 Act.</text>
			</subsection></section></legis-body>
