<official-title>To increase public confidence in the justice system and address any unwarranted racial and ethnic disparities in the criminal process.</official-title>

<section id="H72FC4157EB67403082BFEAD43E31F3F5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Justice Integrity Act of 2009</short-title></quote>.</text></section>
<section id="H0B824CF5409C4CB892003687878890EE"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
<paragraph id="H54DC557EEC8D4D68003CFDE17C7748DF"><enum>(1)</enum><text>the pursuit of justice requires the fair application of the law;</text></paragraph>
<paragraph id="H698B1B62240C4565B343DA46EE7842FC"><enum>(2)</enum><text>racial and ethnic disparities in the criminal process have contributed to a growing perception of bias in the criminal justice system;</text></paragraph>
<paragraph id="HF4F2A50503174063B992BAB859F61B33"><enum>(3)</enum><text>there are a variety of possible causes of disparities in criminal justice statistics among racial and ethnic groups and these causes may differ throughout the United States, including crime rates, racial discrimination, ethnic and cultural insensitivity, or unconscious bias, as well as other factors;</text></paragraph>
<paragraph id="H24EAA31721774E0C9E6215E03686817E"><enum>(4)</enum><text>the Nation would benefit from an understanding of all factors causing a disparate impact on the criminal justice system; and</text></paragraph>
<paragraph id="HB8FBF1695BB54A32BB24293FA1579EF3"><enum>(5)</enum><text>programs that promote fairness will increase public confidence in the criminal justice system, increase public safety, and further the pursuit of justice.</text></paragraph></section>
<section id="H5B022B2801A0434E9D7822F6274BCE9B"><enum>3.</enum><header>Pilot program</header>
<subsection id="HF839ACE49BC14E5399285C6661EF6E38"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Attorney General shall establish a pilot program in 10 United States districts in order to promote fairness, and the perception of fairness, in the Federal criminal justice system, and to determine whether legislation is required.</text></subsection>
<subsection id="H56C85526893C4683AA1B3826A24B0961"><enum>(b)</enum><header>Program requirements</header>
<paragraph id="HA7A2BC69D653421E9DBFBB002FF3635B"><enum>(1)</enum><header>U.S. Attorneys</header><text>The Attorney General shall designate, in accordance with paragraph (3), 10 United States Attorneys who shall each implement a plan in accordance with section 4, beginning not later than 1 month after those United States Attorneys are designated by the Attorney General.</text></paragraph>
<paragraph id="H4B1A972C6E1249FA86B05DEEEFDEECD"><enum>(2)</enum><header>Purpose</header><text>The purposes of the plans required by this section are—</text>
<subparagraph id="HB73393F9825B4BC08F743D97A18BFC7"><enum>(A)</enum><text>to gather racial and ethnic data on investigations and prosecutions in the United States districts and the causes of disparities, if any;</text></subparagraph>
<subparagraph id="H78911A99CB474FA687A6BF039D2BDD"><enum>(B)</enum><text>to determine the extent to which the communities’ perception of bias has affected confidence in the Federal criminal justice system;</text></subparagraph>
<subparagraph id="H89C0EB185430417BA2C2BEFE50DEBB14"><enum>(C)</enum><text>to analyze whether measures may be taken to reduce unwarranted disparities, if any, and increase confidence in the criminal justice system; and</text></subparagraph>
<subparagraph id="H1E9B5E94C09C41939529FABF36010070"><enum>(D)</enum><text>to make recommendations, to the extent possible, to ensure that law enforcement priorities and initiatives, charging and plea bargaining decisions, sentencing recommendations, and other steps within the criminal process are not influenced by racial and ethnic stereotyping or bias, and do not produce unwarranted disparities from otherwise neutral laws or policies.</text></subparagraph></paragraph>
<paragraph id="H96C375CC8BA140D09445F8C2B95E484"><enum>(3)</enum><header>Criteria for selection</header>
<subparagraph id="H6605A73A3EEC4DFEB5B4F6681CFE19CC"><enum>(A)</enum><header>In general</header><text>The 10 pilot districts referred to in subsection (a) shall include districts of varying compositions with respect to size, case load, geography, and racial and ethnic composition.</text></subparagraph>
<subparagraph id="H0D46018689FE4234A500535D13DBD4C4"><enum>(B)</enum><header>Metropolitan areas</header><text>At least 3 of the United States Attorneys designated by the Attorney General shall be in Federal districts encompassing metropolitan areas.</text></subparagraph></paragraph></subsection></section>
<section id="HBE18CE91B5B649E796E0BE4470442FBE"><enum>4.</enum><header>Plan and report</header>
<subsection id="HE192F1BC587F4ECA00D5204C8142F443"><enum>(a)</enum><header>In general</header>
<paragraph id="H32409170D6E248F0BD95150045C3DBE3"><enum>(1)</enum><header>United States Attorney</header><text>Each United States Attorney shall, in consultation with an advisory group appointed in accordance with paragraph (2), develop and implement a plan in accordance with subsections (b) and (c).</text></paragraph>
<paragraph id="HE0541E27EAE748088EA78276ED535DD8"><enum>(2)</enum><header>Advisory group</header>
<subparagraph id="HB129A16630D948AB9C3CE300D6756BC"><enum>(A)</enum><header>Appointment</header><text>Not later than 90 days after designation by the Attorney General, the United States Attorney in each of the 10 pilot districts selected pursuant to section 3 shall appoint an advisory group, after consultation with the chief judge of the district and criminal justice professionals within the district.</text></subparagraph>
<subparagraph id="H17249FFB351D45FAAC0860081227E6E6"><enum>(B)</enum><header>Membership</header><text>The advisory group of a United States Attorney shall include—</text>
<clause id="HA97ADCFB18D9423FA39FF12269ECBE"><enum>(i)</enum><text>1 or more senior social scientists with expertise in research methods or statistics; and</text></clause>
<clause id="H5F1D51595535441184DEBE93B8BF0865"><enum>(ii)</enum><text>individuals and entities who play important roles in the criminal justice process and have broad-based community representation such as—</text>
<subclause id="HDB821E1480D743FE90F95FB0CD005B79"><enum>(I)</enum><text>Federal and State prosecutors;</text></subclause>
<subclause id="HE47A427631BC435EA90819D5683CF72"><enum>(II)</enum><text>Federal and State defenders, if present in the district, and private defense counsel;</text></subclause>
<subclause id="H7CEA61FC0E794B6FAE644333618CF749"><enum>(III)</enum><text>Federal and State judges;</text></subclause>
<subclause id="H8643B5E78D16409C9210BC7425427EFB"><enum>(IV)</enum><text>Federal and State law enforcement officials and union representatives;</text></subclause>
<subclause id="HCB8834C8DBC2479C9435D26139C73B5F"><enum>(V)</enum><text>a member of the United States Sentencing Commission or designee;</text></subclause>
<subclause id="H8AE6665955754CBABFC6606C8991002C"><enum>(VI)</enum><text>parole and probation officers;</text></subclause>
<subclause id="H7CEE4862808747D6A7A9E6120093D4A5"><enum>(VII)</enum><text>correctional officers;</text></subclause>
<subclause id="H22D1EB346D634794AB57A04D86D810F2"><enum>(VIII)</enum><text>victim’s rights representatives;</text></subclause>
<subclause id="H60A6F1BE695148628200F63FF6AA1DB7"><enum>(IX)</enum><text>civil rights organizations;</text></subclause>
<subclause id="H0214125C396B4AF999DD0000D8667D93"><enum>(X)</enum><text>business and professional representatives; and</text></subclause>
<subclause id="HC37CE50A253E4BC0ACECE91DDAA6C09E"><enum>(XI)</enum><text>faith based organizations that provide services to people involved in the criminal justice system.</text></subclause></clause></subparagraph>
<subparagraph id="HA9F9B718851B498F89E336FB50A4D438"><enum>(C)</enum><header>Term limit</header><text>Subject to subparagraph (D), a member of the advisory group shall not serve longer than 5 years.</text></subparagraph>
<subparagraph id="H50B48352E47641CCA9386280933CAA7C"><enum>(D)</enum><header>Permanent members</header><text>Notwithstanding subparagraph (C), the following shall be permanent members of the advisory group for that district:</text>
<clause id="HE23925903AA549FD99009FDAFFAFCB1"><enum>(i)</enum><text>The chief judge for the judicial district.</text></clause>
<clause id="H2268D5F056B24BAD8EA4004501E25C68"><enum>(ii)</enum><text>The Federal defender for the judicial district.</text></clause>
<clause id="HC399F708F17D4430BC84D3743D925811"><enum>(iii)</enum><text>The United States Attorney for the judicial district.</text></clause></subparagraph>
<subparagraph id="HC3F47DD521FF45C0ABD05300D9425999"><enum>(E)</enum><header>Reporter</header><text>The United States Attorney may designate a reporter for each advisory group, who may be compensated in accordance with guidelines established by the Executive Office of the United States Attorneys.</text></subparagraph>
<subparagraph id="H19E508584E1844208EC54EF57BF92FF"><enum>(F)</enum><header>Independent contractors</header><text>The members of an advisory group of a United States Attorney and any person designated as a reporter for such group—</text>
<clause id="H09275AC233AD49DCAE2239119D70F64C"><enum>(i)</enum><text>shall be considered independent contractors of the United States Attorney’s Office when in the performance of official duties of the advisory group; and</text></clause>
<clause id="HEFCC21B8BA664DE2ABCB94097FBFEE07"><enum>(ii)</enum><text>may not, solely by reason of service on or for the advisory group, be prohibited from practicing law before any court.</text></clause></subparagraph></paragraph></subsection>
<subsection id="H2D7E73CC5116447B9DFBAB696DB6C"><enum>(b)</enum><header>Development and implementation of a plan and report</header>
<paragraph id="HB1EDF1C8F368421C92C6F4989EB40460"><enum>(1)</enum><header>Advisory group report</header><text>The advisory group appointed under subsection (a)(2) shall—</text>
<subparagraph id="H28758401E84A4A858DBBA900BB54D56F"><enum>(A)</enum>
<clause commented="no" display-inline="yes-display-inline" id="H6E2AFBE65C5D4457B2B122A4609D037D"><enum>(i)</enum><text>systematically collect and analyze quantitative data on the race and ethnicity of the defendant and victim at each stage of prosecution, including case intake, bail requests, declinations, selection of charges, diversion from prosecution or incarceration, plea offers, sentencing recommendations, fast-track sentencing, and use of alternative sanctions; and</text></clause>
<clause id="HD8DA1E6D3C474B7D8194FBEE1D18626C" indent="up1"><enum>(ii)</enum><text>at a minimum, collect aggregate data capable of individualization and tracking through the system so that any cumulative racial or ethnic disadvantage can be analyzed;</text></clause></subparagraph>
<subparagraph id="HFC62CDBB34374EA4B7C5E52D3EF9EA5"><enum>(B)</enum><text>seek to determine the causes of racial and ethnic disparities in a district, and whether these disparities are substantially explained by sound law enforcement policies or if they are at least partially attributable to discrimination, insensitivity, or unconscious bias;</text></subparagraph>
<subparagraph id="HB72DFD65C5864FB29B44A12944E88354"><enum>(C)</enum><text>examine the extent to which racial and ethnic disparities are attributable to—</text>
<clause id="H85290FB199AF40B0BE2052C71531886D"><enum>(i)</enum><text>law enforcement priorities, prosecutorial priorities, the substantive provisions of legislation enacted by Congress; or</text></clause>
<clause id="H14879F8CB6AA4C7CBA90004E00368080"><enum>(ii)</enum><text>the penalty schemes enacted by Congress or implemented by the United States Sentencing Commission;</text></clause></subparagraph>
<subparagraph id="H499B341B061E44F89FF6F2C809C35469"><enum>(D)</enum><text>examine data including—</text>
<clause id="H001C1D842B7C4C1C00BF7CFE573D7636"><enum>(i)</enum><text>the racial and ethnic demographics of the United States Attorney’s district;</text></clause>
<clause id="HA11B675AC1F24ED3A0E0BD17BA600050"><enum>(ii)</enum><text>defendants charged in all categories of offense by race and ethnicity, and, where applicable, the race and ethnicity of any identified victim;</text></clause>
<clause id="HBB96EB364FD04E7CB03C95533FB1BC80"><enum>(iii)</enum><text>recommendations for sentencing enhancements and reductions, including the filing of substantial assistance motions, whether at sentencing or post-conviction, by race and ethnicity;</text></clause>
<clause id="H22DF780FD736490989DBFFD9F379B493"><enum>(iv)</enum><text>charging policies, including decisions as to who should be charged in Federal rather than State court when either forum is available, and whether these policies tend to result in racial or ethnic disparities among defendants charged in Federal court, including whether relative disparities exist between State and Federal defendants charged with similar offenses;</text></clause>
<clause id="H34324EA2F94E420AB7215CE2EA4049E7"><enum>(v)</enum><text>the racial and ethnic composition of the Federal prosecutors in the district; and</text></clause>
<clause id="H82BCD2371E29438895A2DED699386F00"><enum>(vi)</enum><text>the extent to which training in the exercise of discretion, including cultural competency, is provided prosecutors;</text></clause></subparagraph>
<subparagraph id="H853F337FBF5A4993946B2F100066F0BC"><enum>(E)</enum><text>consult with an educational or independent research group, if necessary, to conduct work under this subsection; and</text></subparagraph>
<subparagraph id="HF4D622792B1D4E578FF2A25D2B952112"><enum>(F)</enum><text>submit to the United States Attorney by the end of the second year after their initial appointment a report and proposed plan, which shall be made available to the public and which shall include—</text>
<clause id="H75C7920589A04AE1A9ACCCFF9826A5B8"><enum>(i)</enum><text>factual findings and conclusions on racial and ethnic disparities, if any, and the State of public confidence in the criminal process;</text></clause>
<clause id="HB75AF4CCB63B42DD9B552D007CC2FB01"><enum>(ii)</enum><text>recommended measures, rules, and programs for reducing unjustified disparities, if any, and increasing public confidence; and</text></clause>
<clause id="H1FADCFEF3EDE43AD9592731BB91317E1"><enum>(iii)</enum><text>an explanation of the manner in which the recommended plan complies with this paragraph.</text></clause></subparagraph></paragraph>
<paragraph id="H6EDC55903CC947BDA884461C7CBC7000"><enum>(2)</enum><header>Adoption of plan</header><text>Not later than 60 days after receiving and considering the advisory group’s report and proposed plan under paragraph (1), the United States Attorney appointed under section 3 shall adopt and implement a plan.</text></paragraph>
<paragraph id="HBF0D425471EC46EB8121C702983D6C82"><enum>(3)</enum><header>Copy of report</header><text>The United States Attorney shall transmit a copy of the plan and report adopted and implemented, in accordance with this subsection, together with the report and plan recommended by the advisory group, to the Attorney General. The United States Attorney shall include with the plan an explanation of any recommendation of the advisory group that is not included in the plan.</text></paragraph>
<paragraph id="H68F22BE31D804963A6D238CA47F346DE"><enum>(4)</enum><header>Congress</header><text>The Attorney General shall transmit to the United States Attorney’s in every Federal district and to the Committees on the Judiciary of the Senate and the House of Representatives copies of any plan and accompanying report submitted by a pilot district.</text></paragraph></subsection>
<subsection id="H0EBE70E0F63144109FA8CB594DA352A0"><enum>(c)</enum><header>Periodic United States attorney assessment</header><text>After adopting and implementing a plan under subsection (b), each United States Attorney in a pilot district shall annually evaluate the efficacy of the plan. In performing such assessment, the United States Attorney shall consult with the advisory group appointed in accordance with subsection (a)(2). Each assessment shall be submitted to the Executive Office for United States Attorneys for review in accordance with subsection (d).</text></subsection>
<subsection id="H9166CC696B2645EEA3E855BCE58BE082"><enum>(d)</enum><header>Information on the pilot program</header>
<paragraph id="H136A459662884D79AFB6AEF69FB9D798"><enum>(1)</enum><header>Report and model plan</header><text>Not later than 5 years after the date of the enactment of this Act, the Attorney General shall—</text>
<subparagraph id="H89C233C45E0E426683EF1F4C54CBA324"><enum>(A)</enum><text>prepare a comprehensive report on all plans received pursuant to this section;</text></subparagraph>
<subparagraph id="H239BDB30BBDE48F58165F79CDCF7C33F"><enum>(B)</enum><text>based on all the plans received pursuant to this section the Attorney General shall also develop one or more model plans; and</text></subparagraph>
<subparagraph id="HEBB81F5426E94CD9AEF0FCE2E0379C5"><enum>(C)</enum><text>transmit copies of the report and model plan or plans to the Committees on the Judiciary of the Senate and the House of Representatives.</text></subparagraph></paragraph>
<paragraph id="H9A02F6B7F96B4B0CA1BCD1CC86255E8C"><enum>(2)</enum><header>Continued oversight</header><text>The Attorney General shall, on a continuing basis—</text>
<subparagraph id="H540050E6B3DC4629AE9719A477002F96"><enum>(A)</enum><text>study ways to reduce unwarranted racial and ethnic disparate impact in the Federal criminal system; and</text></subparagraph>
<subparagraph id="H30DB3804415A4B038EE4007741366B3C"><enum>(B)</enum><text>make recommendations to all United States Attorneys on ways to improve the system.</text></subparagraph></paragraph></subsection></section>
<section id="H12ABA0DA85B347E59148DB9BC2F11107"><enum>5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated $3,000,000 for use, at the discretion of the Attorney General, by the United States Attorneys’ advisory groups in the development and implementation of plans under this Act.</text></section>
