<official-title>To amend the Richard B. Russell National School Lunch Act to require schools participating in the school lunch program under such Act to donate any excess food to local food banks.</official-title>

<section id="HBD4AAC36CF7B4613BFF6ACC305AA18" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>School Food Recovery Act</short-title></quote>. </text></section> 
<section id="HF1EEB1003EA44C5DB4D05E76E5F98B31"><enum>2.</enum><header>Food Donation Program</header><text display-inline="no-display-inline">Section 9 of the Richard B. Russell National School Lunch Act (42 U.S.C. 1758) is amended by adding at the end the following:</text>

<subsection id="H502C816FB1E34536902FE3AF7260A800"><enum>(k)</enum><header>Food Donation Program</header> 
<paragraph id="H770E9441559A42BC84B6302C4C3F79E"><enum>(1)</enum><header>In general</header><text>The Secretary shall require each school participating in the school lunch program under this Act to donate any food not consumed under such program to eligible local food banks or charitable organizations.</text> </paragraph> 
<paragraph id="HDF9139252F0143CA947431EB2BD3AFCE"><enum>(2)</enum><header>Plan Requirement</header><text>Each school described in paragraph (1) shall prepare and submit to the local educational agency that serves such school a plan that—</text> 
<subparagraph id="HEBC9516270524B2999710787552380DC"><enum>(A)</enum><text>describes how such school will carry out the food donation program requirements under this subsection;</text></subparagraph> 
<subparagraph id="HA8E01BF78E414EAF89ADD8C08DA0A326"><enum>(B)</enum><text>identifies the name and contact information of the school employee administering the food donation program; and</text></subparagraph> 
<subparagraph id="H6475A87DE53B475FB9AA67A542061641"><enum>(C)</enum><text display-inline="yes-display-inline">identifies any eligible local food banks or charitable organizations that are located within the jurisdiction of the same local government as the local educational agency that serves such school is located.</text></subparagraph></paragraph> 
<paragraph id="H15F40646395942038C41003107130191"><enum>(3)</enum><header>Reporting Requirement</header><text display-inline="yes-display-inline">Not later than the first day of the fiscal year after the effective date of this subsection, and annually thereafter, each local educational agency that receives plans under paragraph (2) shall submit to the Secretary such plans.</text></paragraph> 
<paragraph id="HC5623B2DF4194CAC818EEC1E1770DDBD"><enum>(4)</enum><header>Database Requirement</header><text>Not later than 2 years after the effective date of this subsection, the Secretary shall develop and maintain a database of the information described in paragraph (2)(B).</text> </paragraph> 
<paragraph id="H28BE17F9D0D34C8B99B407E72DCEBCE0"><enum>(5)</enum><header>Guidance</header> 
<subparagraph id="H38B7FEF664B3464E92007706DD97ED6" commented="no"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the effective date of this subsection, the Secretary shall develop and publish guidance to schools and local educational agencies participating in the school lunch program under this Act to assist such schools and local educational agencies in meeting the requirements of this subsection.</text></subparagraph> 
<subparagraph id="HFE9D8736FCBC44E1AB54902B1636F6FC" commented="no"><enum>(B)</enum><header>Updates</header><text>The Secretary shall update such guidance as necessary.</text></subparagraph></paragraph> 
<paragraph id="H763B5E0923AA44F09ECA42B15B26E0EE"><enum>(6)</enum><header>Liability</header><text>Any school or local educational agency making donations pursuant to this subsection shall be exempt from civil and criminal liability to the extent provided under the Bill Emerson Good Samaritan Food Donation Act (42 U.S.C. 1791).</text></paragraph> 
<paragraph id="H97BBC6846DAD41F1B729D6134C721F6F"><enum>(7)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text> 
<subparagraph id="H1CBE941443F844BC8B24DA78D2E6477"><enum>(A)</enum><header>Eligible local food banks or charitable organizations</header><text>The phrase <quote>eligible local food banks or charitable organizations</quote> means any food bank or charitable organization which is exempt from tax under section 501(c)(3) of the Internal Revenue Code of 1986 (26 U.S.C. 501(c)(3)).</text></subparagraph> 
<subparagraph id="H2AED0C12238E42F5BE1DD0061998FAE4"><enum>(B)</enum><header>Local government</header><text display-inline="yes-display-inline">The term <quote>local government</quote> means a city, county, township, or other general-purpose political subdivision of a State.</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H569B4FA63911499F8457541319729F24"><enum>3.</enum><header>Effective Date</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect not later than July 1 of the year of the enactment of this Act.</text> </section>
