		<section id="H5085385ADA0C4462B8CB635FAF24F206" section-type="section-one"><enum>1.</enum><header>Nonmailability of certain
			 tobacco products</header>
			<subsection id="H74C34332A2D9400EA9B56D7109006107"><enum>(a)</enum><header>In
			 General</header><text>Chapter 30 of title 39, United States Code, is amended by
			 inserting after section 3002a the following:</text>
				<quoted-block id="H01174FCA590B46F2B336FEB4402EC5E" style="USC">
					<section id="H33B45E2CB8804668007533D04719AF37"><enum>3002b.</enum><header>Nonmailability
				of certain tobacco products</header>
						<subsection id="HEF8F9F12148B44FE80741F7F2CFC6E57"><enum>(a)</enum><header>In
				General</header><text>Except as provided in subsections (g) and (h),
				cigarettes, smokeless tobacco, and roll-your-own-tobacco—</text>
							<paragraph id="H286AF83BDBA344B8A891D00EE2D7697"><enum>(1)</enum><text>are nonmailable
				matter;</text>
							</paragraph><paragraph id="H9D914033398A47D3B2D3F666EF6CB515"><enum>(2)</enum><text>shall not
				be—</text>
								<subparagraph id="H7F9776DF003A4EF99107D55F169E645D"><enum>(A)</enum><text>deposited in the
				mails; or</text>
								</subparagraph><subparagraph id="HADFEE74B5D444666ACCBFAB4E00631B"><enum>(B)</enum><text>carried or
				delivered through the mails; and</text>
								</subparagraph></paragraph><paragraph id="H00370C2DCC794D4CA70071C47FFCAA5E"><enum>(3)</enum><text>shall be disposed
				of as the Postal Service directs.</text>
							</paragraph></subsection><subsection id="HF8EA0A3C23734A5CA3846FA722C8A0AE"><enum>(b)</enum><header>Civil
				penalty</header>
							<paragraph id="HED7E0B2FD11141C48304F0840001964D"><enum>(1)</enum><header>In
				general</header><text>Any person who violates subsection (a)(2)(A) shall be
				liable to the United States for a civil penalty in an amount not to exceed
				$100,000 for each violation.</text>
							</paragraph><paragraph id="HB3C492017E234DE7AB102E135662F1F7"><enum>(2)</enum><header>Hearings</header>
								<subparagraph id="HE18E794B062041E38306E61222631CB0"><enum>(A)</enum><header>In
				general</header><text>The Postal Service may determine that a person has
				violated subsection (a)(2)(A) only after notice and an opportunity for a
				hearing. Proceedings under this paragraph shall be conducted in accordance with
				section 3001(m).</text>
								</subparagraph><subparagraph id="H4238E3115D1F4563A6E3DBAEA6B5AC9C"><enum>(B)</enum><header>Penalty
				considerations</header><text>In determining the amount of a civil penalty under
				this paragraph, the Postal Service shall consider—</text>
									<clause id="H4C42C23020894BDF98AEDE36C1D204BF"><enum>(i)</enum><text>the nature,
				circumstances, extent, and gravity of the violation;</text>
									</clause><clause id="HDC442A4076664E0CB5FC26856F485DEA"><enum>(ii)</enum><text>with respect to
				the violator, the degree of culpability, ability to pay, and any history of
				prior violations; and</text>
									</clause><clause id="H10973A5CD0024885A2A9A45CD9F6BD3C"><enum>(iii)</enum><text>such other
				matters as justice may require.</text>
									</clause></subparagraph></paragraph><paragraph id="H2DC732AC09934BC992C86054E5D4209"><enum>(3)</enum><header>Civil
				actions</header><text>The Postal Service may bring a civil action in an
				appropriate district court of the United States, in accordance with section
				409(g)(2), to enjoin violations of subsection (a)(2)(A), to collect a civil
				penalty under this section, or to seek such other relief with respect to
				violations of subsection (a)(2)(A) as the court may deem appropriate.</text>
							</paragraph><paragraph id="H91489D5E21844A3DA13202A4894535B4"><enum>(4)</enum><header>Disposition of
				amounts</header><text>Amounts received in payment of any civil penalties under
				this subsection shall be deposited as miscellaneous receipts in the Treasury of
				the United States.</text>
							</paragraph></subsection><subsection display-inline="no-display-inline" id="H5724A552CF604DE282FBAC080813A57C"><enum>(c)</enum><header>Orders</header><text display-inline="yes-display-inline">Upon evidence satisfactory to the Postal
				Service that any person is engaged in the sending of mail matter which is
				nonmailable under this section, the Postal Service may issue an order
				which—</text>
							<paragraph id="H2F93A250C89845B7A4B4D0A94BB0EB17"><enum>(1)</enum><text>directs any
				postmaster, to whom any mailing originating with such person or his
				representative is tendered for transmission through the mails (other than a
				mailing that consists only of one or more sealed letters), to refuse to accept
				any such mailing, unless such person or his representative first establishes to
				the satisfaction of the postmaster that the mailing does not contain any matter
				which is nonmailable under this section; and</text>
							</paragraph><paragraph commented="no" id="HED4953DD90AE4C5CAD935BE4590080A5"><enum>(2)</enum><text display-inline="yes-display-inline">requires the person or his representative
				to cease and desist from mailing any mail matter which is nonmailable under
				this section.</text>
							</paragraph></subsection><subsection id="H5B77AFFCD3824490AE5F67738D92F527"><enum>(d)</enum><header>Prima facie
				evidence</header><text>For the purposes of this section, prima facie evidence
				that a person is engaged in the mailing of matter which is nonmailable under
				this section may include a statement on a publicly available website, or an
				advertisement, by any person that such person will mail matter which is
				nonmailable under this section in return for payment or other
				consideration.</text>
						</subsection><subsection id="H5CE3098092B14DE4B8171D67C41FC61C"><enum>(e)</enum><header>Coordination of
				efforts</header><text display-inline="yes-display-inline">In the enforcement of
				this section, the Postal Service shall cooperate with, and coordinate its
				efforts with related activities of, any other Federal agency or any State or
				local government, whenever appropriate.</text>
						</subsection><subsection id="H118EB7DEEBA2439EA671BEA5834937FA"><enum>(f)</enum><header>Actions by
				States relating to certain tobacco products</header>
							<paragraph id="H98D0E367865C43629BC2860091C6DCCF"><enum>(1)</enum><header>Authority of
				States</header><text>Whenever the attorney general of a State has reason to
				believe that any person has engaged or is engaging in mailings to residents of
				that State in violation of subsection (a)(2)(A), the State may bring, in an
				appropriate district court of the United States, a civil action—</text>
								<subparagraph id="H4E95E4578F9845539B3591FEE1C441D6"><enum>(A)</enum><text>to enjoin such
				mailings;</text>
								</subparagraph><subparagraph id="H6290228A2AEC47D884F3897F7033DA36"><enum>(B)</enum><text>to carry out
				paragraphs (1) and (4) of subsection (b) with respect to such mailings;
				or</text>
								</subparagraph><subparagraph id="H794B3F8240F7403CBE3D2B6CFD00F36F"><enum>(C)</enum><text>to carry out
				subparagraphs (A) and (B).</text>
								</subparagraph><continuation-text continuation-text-level="paragraph">In the
				course of any such action, the State may seek damages equal to the amount of
				any unpaid taxes on tobacco products mailed in violation of subsection
				(a)(2)(A) to residents of the State and such other relief as the court may deem
				appropriate.</continuation-text></paragraph><paragraph id="HB324331DBB3840C28F31249CF7D15704"><enum>(2)</enum><header>Rights of the
				Postal Service</header><text>The State shall serve prior written notice of any
				action under paragraph (1) upon the Postal Service and provide the Postal
				Service with a copy of its complaint, except in any case in which such prior
				notice is not feasible, in which case the State shall serve such notice
				immediately upon instituting such action. The Postal Service, in accordance
				with section 409(g)(2), shall have the right (A) to intervene in the action,
				(B) upon so intervening, to be heard on all matters arising therein, and (C) to
				file petitions for appeal.</text>
							</paragraph><paragraph id="HFA1B5AE05BF94239B99FEF820071CB4F"><enum>(3)</enum><header>Effect on State
				court proceedings</header><text>Nothing contained in this section shall be
				considered to prohibit an authorized State official from proceeding in State
				court on the basis of an alleged violation of any general civil or criminal
				statute of such State.</text>
							</paragraph><paragraph id="H0BD5C124931B48E9BF7892B43376C2DE"><enum>(4)</enum><header>Limitation</header><text display-inline="yes-display-inline">Whenever the Postal Service institutes a
				civil action under subsection (a)(3) for a violation of subsection (a)(2)(A),
				no State may, during the pendency of such action, institute a separate civil
				action for any violation of subsection (a)(2)(A) against any defendant named in
				the Postal Service’s complaint.</text>
							</paragraph></subsection><subsection commented="no" id="HD5B2FDF9AA6E4CC48BE69E13E8D34174"><enum>(g)</enum><header>Mailings between
				legal tobacco industry businesses and government agencies</header>
							<paragraph commented="no" id="HE9C1D3E631DA43D5AB229003685D0402"><enum>(1)</enum><header>In
				general</header><text>Tobacco products otherwise made nonmailable by subsection
				(a) may, beginning on the effective date of regulations prescribed under
				paragraph (2), be mailed—</text>
								<subparagraph commented="no" id="HA54C0C8BE8714B6EA11BBF7C110081DF"><enum>(A)</enum><text>for business
				purposes between businesses that—</text>
									<clause commented="no" id="H1DB40768CA0148319991D405F4D4363B"><enum>(i)</enum><text>have all
				government licenses or permits that are required in order to do business; and</text>
									</clause><clause commented="no" id="H18E5A2F6AFDE4AE3A68B89798043BE2C"><enum>(ii)</enum><text>are engaged in
				tobacco product manufacturing, distribution, wholesale, export, import,
				testing, investigation, or research; or</text>
									</clause></subparagraph><subparagraph commented="no" id="H336394318D8E44DC910021C11C84934C"><enum>(B)</enum><text>for regulatory
				purposes between any business described in subparagraph (A) and any government
				agency.</text>
								</subparagraph></paragraph><paragraph commented="no" id="HA5B31744A93C47A98CD94BD9EADB38B0"><enum>(2)</enum><header>Regulations</header><text>The
				Postal Service may prescribe regulations governing mailings under this
				subsection, including regulations to carry out the following:</text>
								<subparagraph commented="no" id="H6F2400CE09ED41E48F3003C59E983BB3"><enum>(A)</enum><text display-inline="yes-display-inline">The Postal Service shall verify that any
				person depositing any otherwise nonmailable tobacco product into the mails
				under this subsection is a business or government agency permitted to make such
				mailing under this subsection.</text>
								</subparagraph><subparagraph commented="no" id="H55727C1E96244FE1BA00CB9DDEABF291"><enum>(B)</enum><text display-inline="yes-display-inline">The Postal Service shall ensure that any
				recipient of any otherwise nonmailable tobacco product sent through the mails
				under this subsection is a business or government agency permitted to receive
				such mailing under this subsection.</text>
								</subparagraph><subparagraph commented="no" id="H1CEF571DBE3A4A2B9994FA05D4D45B01"><enum>(C)</enum><text display-inline="yes-display-inline">The mailing shall be sent using a method
				that provides for the tracking and confirmation of delivery.</text>
								</subparagraph><subparagraph commented="no" id="HE8A78100B5E04B2A94DE00BF61BB2172"><enum>(D)</enum><text display-inline="yes-display-inline">The identity of the business or government
				agency from which the mailing is sent, and the identity of the business or
				government agency to which the mailing is sent, shall be clearly set forth on
				the envelope or outside cover or wrapper in which such mailing is sent, and all
				of that information shall, for a period of at least 3 years from the date of
				the mailing, be kept in Postal Service records and made available to persons
				enforcing subsection (a)(2)(A).</text>
								</subparagraph><subparagraph commented="no" id="HBB9C8CFF1EF342969600611E5F972198"><enum>(E)</enum><text display-inline="yes-display-inline">The mailing shall be marked with a Postal
				Service label or marking that makes it clear that such mailing—</text>
									<clause commented="no" id="H468D1DC37E944624B6674465FE8059EC"><enum>(i)</enum><text>is a permissible
				mailing of otherwise nonmailable tobacco products; and</text>
									</clause><clause commented="no" id="HAEE384F49ECA43A4B8CBE0B91007034D"><enum>(ii)</enum><text>may be delivered
				only to a business described in paragraph (1)(A) or a government employee or
				entity.</text>
									</clause></subparagraph><subparagraph commented="no" id="HC5DFCE9F48AC4754B722EFF21C1D7775"><enum>(F)</enum><text display-inline="yes-display-inline">The mailing shall be delivered only to a
				verified employee or agent of the recipient business or government agency,
				who—</text>
									<clause id="H0E203F239BDB4DB39791BEB63057D6DC"><enum>(i)</enum><text>has been duly
				authorized to accept such mailing; and</text>
									</clause><clause id="H3D92BF5996594B58B5BE666C02ABAE48"><enum>(ii)</enum><text>shall be required
				to sign for the mailing.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" id="HBE205F32F7BE4AA58487056792C6B972"><enum>(3)</enum><header>Rule of
				construction</header><text>Nothing in this subsection shall be considered to
				subject a government agency or any government employee or agent to any penalty
				or other restriction in connection with any mailing made by such employee or
				agent, acting within the scope of his employment or agency.</text>
							</paragraph></subsection><subsection id="H4D4231DA534F4F1D9658921D1F643CF5"><enum>(h)</enum><header>Mailings between
				individuals</header>
							<paragraph id="H780BAC4AEFBD42E4B039207F32FA013D"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Tobacco products
				otherwise made nonmailable by subsection (a) may be mailed between individuals
				(other than in any of the circumstances to which subsection (g) applies), for
				non-moneymaking purposes, beginning on the effective date of regulations
				prescribed under paragraph (2).</text>
							</paragraph><paragraph id="H0900EE4F1DC545CEA900A8DB33366097"><enum>(2)</enum><header>Regulations</header><text>The
				Postal Service may prescribe regulations establishing the standards and
				requirements which shall govern all mailings under this subsection, including
				regulations to carry out the following:</text>
								<subparagraph id="H2696AF0AA25B49868CF9DBE77EFD4416"><enum>(A)</enum><text display-inline="yes-display-inline">The Postal Service shall verify that the
				person depositing the otherwise nonmailable tobacco product into the mails is
				properly identified on the return address of the mailing.</text>
								</subparagraph><subparagraph id="HDD9E753D10DA4CC9A7DD68BB53A8BBCB"><enum>(B)</enum><text display-inline="yes-display-inline">The Postal Service shall require the person
				depositing the otherwise nonmailable tobacco product into the mails to affirm
				that the recipient is an individual who is of legal age to purchase tobacco
				products.</text>
								</subparagraph><subparagraph id="H832DCDAC21ED41D9895155A6BFAE4600"><enum>(C)</enum><text display-inline="yes-display-inline">The Postal Service shall require the person
				depositing the otherwise nonmailable tobacco product into the mails to affirm
				that the product is not being sent for moneymaking purposes.</text>
								</subparagraph><subparagraph id="H15D7EE1A9C5D445782CCB6DFC66203C2"><enum>(D)</enum><text display-inline="yes-display-inline">The mailing shall weigh not more than 10
				ounces.</text>
								</subparagraph><subparagraph id="H5962DAAFA60B4F1CA9A93E00A4D43EB6"><enum>(E)</enum><text display-inline="yes-display-inline">The mailing shall be sent using a method
				that provides for the tracking and confirmation of delivery.</text>
								</subparagraph><subparagraph id="H78700508F78C4BE29B75A579D28CDC00"><enum>(F)</enum><text display-inline="yes-display-inline">The Postal Service shall deliver the
				mailing only to the verified recipient (as described in subparagraph (B)) at
				the recipient’s address, including an Air/Army Postal Office (APO) or Fleet
				Postal Office (FPO) address.</text>
								</subparagraph></paragraph></subsection><subsection id="H40CBE5828FF24564A1EC59102DD88323"><enum>(i)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
							<paragraph id="H464CEBC37FEE4D47A75C4F76DE3B9160"><enum>(1)</enum><text>the terms
				<term>cigarette</term> and <term>roll-your-own-tobacco</term> have the meanings
				given them by section 5702 of the Internal Revenue Code of 1986;</text>
							</paragraph><paragraph id="HB4F7BD33E68841B7A919C929FE0838C"><enum>(2)</enum><text>the term
				<term>smokeless tobacco</term> has the meaning given such term by section 2341
				of title 18; and</text>
							</paragraph><paragraph id="H6C57058088CC44928187AB8303F9D911"><enum>(3)</enum><text>the term
				<term>State</term> includes the District of Columbia, the Commonwealth of
				Puerto Rico, the Virgin Islands, American Samoa, Guam, and the Commonwealth of
				the Northern Mariana
				Islands.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8E0DCCF04C014901BB7BA13F4E25A69E"><enum>(b)</enum><header>Administrative
			 subpoenas</header><text>Section 3016(a) of title 39, United States Code, is
			 amended in paragraphs (1)(A) and (2) by inserting <quote>3002b or</quote>
			 before <quote>3005(a)</quote>.</text>
			</subsection><subsection id="HC6352FF67DF9487FB4005339EC488C71"><enum>(c)</enum><header>Enforcement of
			 Postal Service orders</header><text>Section 3012 of title 39, United States
			 Code, is amended—</text>
				<paragraph id="H487089C0F7A74514AC7186B0304E9DAC"><enum>(1)</enum><text>in subsection (b),
			 by striking <quote>or (d)</quote> each place it appears and inserting
			 <quote>(d), or (e)</quote>;</text>
				</paragraph><paragraph id="H21EAB2138C42451DB666967FE3FA0855"><enum>(2)</enum><text>by redesignating
			 subsections (e) and (f) as subsections (f) and (g), respectively; and</text>
				</paragraph><paragraph id="HF9641815E0C542FF9581721E04FA1DA9"><enum>(3)</enum><text>by inserting after
			 subsection (d) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H86B041ABE86545FDA47B2454D3162F2D" style="USC">
						<subsection id="H3E38F7ED95324B46B3684F211FA6EE1C"><enum>(e)</enum><text display-inline="yes-display-inline">Any person who fails to comply with an
				order issued under section 3002b(c)(2) shall be liable to the United States for
				a civil penalty—</text>
							<paragraph id="H6C2C701BDD5340EBBB76ADE837FA5505"><enum>(1)</enum><text display-inline="yes-display-inline">not to exceed $10,000 for each mailing of
				fewer than 10 pieces;</text>
							</paragraph><paragraph id="H8E4A58620985439C9CCD8495B32D4399"><enum>(2)</enum><text display-inline="yes-display-inline">not to exceed $50,000 for each mailing of
				10 to 50 pieces; and</text>
							</paragraph><paragraph id="HE17DFCA55DE242D48D15ACB45F0EF06"><enum>(3)</enum><text>not to exceed
				$100,000 for each mailing of more than 50
				pieces.</text>
							</paragraph></subsection><after-quoted-block>; and
				</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H89941665204E4A7683EF66E46DD2BAE"><enum>(4)</enum><text>in
			 subsection (g) (as so redesignated by paragraph (2)), by inserting
			 <quote>3002b(c)(2) or</quote> before <quote>3005</quote> each place it appears.</text>
				</paragraph></subsection><subsection id="H6157C96AD6FE4671B4D2B1C225848ED"><enum>(d)</enum><header>Semiannual
			 reports</header><text>Section 3013 of title 39, United States Code, is
			 amended—</text>
				<paragraph id="H181E073A56504E35A9001FDC81C219E9"><enum>(1)</enum><text>in paragraph (1),
			 by inserting <quote>3002b(b) or</quote> before <quote>3005</quote>;</text>
				</paragraph><paragraph id="H0F35B3256B884E159007F91776D2C753"><enum>(2)</enum><text>in paragraph (2),
			 by inserting <quote>3002b(c) or</quote> before <quote>3005(e)</quote>;
			 and</text>
				</paragraph><paragraph id="H76A7858E684542ECB2BB005C2E83F61C"><enum>(3)</enum><text>in paragraph (3),
			 by striking <quote>section 3007 of this title</quote> and inserting
			 <quote>section 3002b(c) or section 3007, respectively,</quote>.</text>
				</paragraph></subsection><subsection id="H600A2F8625204B9FB48C683E56AF43C5"><enum>(e)</enum><header>Clerical
			 amendment</header><text>The table of sections for chapter 30 of title 39,
			 United States Code, is amended by inserting after the item relating to section
			 3002a the following:</text>

					</toc>

			</subsection><subsection id="H8F3FD3E2068A4E2E9FE7EE54C445CE87"><enum>(f)</enum><header>Effective
			 dates</header>
				<paragraph id="H5CA623416B2941D99C217FAB7CBB7E3F"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the amendments made
			 by this section shall take effect on the 60th day after the date of the
			 enactment of this Act, and shall apply with respect to any mail matter mailed
			 on or after such 60th day.</text>
				</paragraph><paragraph id="H60A8552FA7BB41EC8C711700CBD5B79"><enum>(2)</enum><header>Semiannual
			 reports</header><text>The amendments made by subsection (d) shall apply
			 beginning with the report submitted for the reporting period in which occurs
			 the 60th day after the date of the enactment of this Act.</text>
				</paragraph></subsection></section><section id="H285E14944D634ABD94C25321596328FD"><enum>2.</enum><header>Technical
			 correction</header>
			<subsection id="H8850B0A3E3C147C2B942557D12F59271"><enum>(a)</enum><header>In
			 general</header><text>Sections 3007(a)(1), 3012(b)(1), and 3018(f)(1) of title
			 39, United States Code, are amended by striking <quote>409(d)</quote> and
			 inserting <quote>409(g)(2)</quote>.</text>
			</subsection><subsection id="H4FB2F98E188547CCBCCE62C2A0065CD"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall take effect as
			 if included in the enactment of the Postal Accountability and Enhancement Act
			 (Public Law 109–435).</text>
