		<official-title>To amend part B of title XVIII of the Social Security Act
		  to remove limiting charges under the Medicare Program for non-participating
		  physicians with beneficiary notice and to preempt State laws that prohibit
		  balance billing.</official-title>

		<section display-inline="no-display-inline" id="H3F81701A75DF49F8B9B44320C3A8426F" section-type="section-one"><enum>1.</enum><header>Removing limitations on
			 balance billing with beneficiary notice</header>
			<subsection id="H1EFAFCDAAFB9405FA613236FB2418067"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1848(g) of
			 the Social Security Act (42 U.S.C. 1395w–4(g)) is amended—</text>
				<paragraph id="H3C43FC56CD2648ECBB196E6BEA9C7C5D"><enum>(1)</enum><text>in paragraph
			 (1)(A), in the matter before clause (i), by inserting <quote>, subject to
			 subparagraph (D),</quote> after <quote>enrolled under this part</quote>;</text>
				</paragraph><paragraph id="H11A36B0425974C3997C2DF8EED2848E"><enum>(2)</enum><text>in
			 paragraph (1), by adding at the end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="HCBCDCE27EAA448A28CD5503F4BF91CDE" style="OLC">
						<subparagraph id="H26FF1000C5CC4F1B97AB0F4E0567758"><enum>(D)</enum><header>Exception</header><text display-inline="yes-display-inline">Subparagraph (A) shall not apply with
				respect to physicians’ services furnished to an individual if the individual
				furnishing such services provides the advance notice of such non-participation
				and non-acceptance of assignment under paragraph
				(8).</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H6268A52FD96C4F368B15EDFC557414C"><enum>(3)</enum><text>by
			 adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HC1DE6B1B7BFA4B159EDCD846F5B17BF" style="OLC">
						<paragraph id="H468F9E0F32AF4A67B0DA7CC322C3C3C8"><enum>(8)</enum><header>Notice of
				non-participation and non-acceptance of assignment</header><text>For purposes
				of paragraph (1)(D), the advance notice of non-participation and non-acceptance
				of assignment shall be, with respect to an item or service furnished under this
				part by (or under the supervision of) a physician, a notice (that may be in the
				form of a posting in a conspicuous place in a physician’s office or on patient
				information forms) that is posted or otherwise furnished in a manner so as to
				inform the individual receiving the item or service that—</text>
							<subparagraph id="HB390683022D147478F0541F4133953EA"><enum>(A)</enum><text>the physician
				furnishing (or supervising the furnishing of) the items or service is not a
				participating physician and does not accept assignment with respect to the
				service; and</text>
							</subparagraph><subparagraph id="H1DE31B9AF4F54F509BB30000F600BA57"><enum>(B)</enum><text display-inline="yes-display-inline">because of such non-acceptance, in the case
				of physicians’ services furnished to an individual, the charge imposed is not
				limited and may exceed the limiting charge described in paragraph
				(2).</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H4E8E6EFD7AB847E0A180502F1C40EBA9"><enum>(b)</enum><header>Conforming
			 amendment to private contract provisions</header><text>Section 1802 of such Act
			 (42 U.S.C. 1395a) is amended by adding at the end the following new
			 paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H11A915D864064E5FBD02EF9B5FEF2DDC" style="OLC">
					<paragraph id="HFC76BBB82BB7440BA82BD04209E60502"><enum>(6)</enum><header>Exception</header><text display-inline="yes-display-inline">The previous provisions of this subsection
				shall not apply to physicians’ services furnished to an individual if the
				advance notice described in section 1848(g)(8) has been
				provided.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HDCFC240486B049B297007709D74E74A1"><enum>(c)</enum><header>Conforming
			 amendment to participation provisions</header><text>Section 1842(h) of such Act
			 (42 U.S.C. 1395u) is amended by adding at the end the following new
			 paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H938172768BE540C9B2889D63CB596754" style="traditional">
					<paragraph id="H8391F74EBC8C4FD393F2046906EA399" indent="up1"><enum>(9)</enum><text>The previous provisions of this
				subsection, insofar as they limit the charges that a participating physician
				may impose, shall not apply to physicians’ services furnished to an individual
				if the advance notice described in section 1848(g)(8) has been
				provided.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF4FFD42F76284BC88BDDC1461424AC6C"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to services
			 furnished on or after the date of the enactment of this Act.</text>
			</subsection></section><section id="H95C7583277C24326A7A8967C29DB621C"><enum>2.</enum><header>Preemption of
			 State laws limiting charges for physicians’ services</header>
			<subsection id="H4DFC3E9A45234D2DADEBEAD37166B3C6"><enum>(a)</enum><header>In
			 general</header><text>No State may impose a limit on the amount of charges, in
			 relation to recognized payment amounts under any health plan or otherwise, a
			 physician (as defined in section 1861(r)(1) of the Social Security Act) may
			 impose for services furnished by the physician and any such limit is hereby
			 preempted.</text>
			</subsection><subsection id="H898217C3296C487DBBE7EE73446F1B00"><enum>(b)</enum><header>State</header><text>In
			 this section, the term <term>State</term> includes the District of Columbia,
			 Puerto Rico, the Virgin Islands, Guam, and American Samoa.</text>
