		<official-title display="yes">To establish the Waco Mammoth National
		  Monument in the State of Texas, and for other purposes.</official-title>

		<section id="H91A5CD5D7AFD4769B974B0B55D06B203" section-type="section-one"><enum>1.</enum><header>SHORT TITLE</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Waco Mammoth National Monument
			 Establishment Act of 2009</short-title></quote>.</text>
		</section><section id="HB6AC5A866A1B463B9E5F7D7BEB179D66"><enum>2.</enum><header>FINDINGS</header><text display-inline="no-display-inline">Congress finds as follows:</text>
			<paragraph id="HB2418645D72840A095949BC9638BC9FA"><enum>(1)</enum><text>The Waco Mammoth
			 Site area is located near the confluence of the Brazos and the Bosque rivers in
			 Central Texas, near the City of Waco.</text>
			</paragraph><paragraph id="HA15DE1DC839C4A89815EB583097F8825"><enum>(2)</enum><text>Baylor University
			 has been investigating the site since 1978 after the discovery of bones
			 emerging from eroding creek banks leading to the uncovering of portions of five
			 mammoths.</text>
			</paragraph><paragraph id="HC8CA9845521741D2B5244E73B1817C64"><enum>(3)</enum><text>Several additional
			 mammoth remains have been uncovered making this the largest known concentration
			 of mammoths dying from the same event.</text>
			</paragraph><paragraph id="H122CE93928744DCE9D8E08642070BEF9"><enum>(4)</enum><text>The discoveries
			 have received international attention.</text>
			</paragraph><paragraph id="HD05B5EECA18B403F824C471EE105CBB5"><enum>(5)</enum><text>The University and
			 the City of Waco have been working together to protect the site and to develop
			 further research and educational opportunities.</text>
			</paragraph></section><section id="H099E437914084205925449AD2BC196F5"><enum>3.</enum><header>DEFINITIONS</header><text display-inline="no-display-inline">In this Act the following definitions
			 apply:</text>
			<paragraph id="HED9F5E396B5B43FDB1D099ED82E3BB40"><enum>(1)</enum><header>National
			 Monument</header><text>The term <term>national monument</term> means the Waco
			 Mammoth National Monument, established in section 4.</text>
			</paragraph><paragraph id="H0000CBB1516B4BD8AB36B0FA45FF3158"><enum>(2)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="H38AEEA2465DD44F6ADCA1D7743B86EBC"><enum>(3)</enum><header>
			 Map</header><text display-inline="yes-display-inline">The term “map” means the
			 map titled “Proposed Boundary Waco-Mammoth National Monument”, numbered
			 T21/80,000, and dated April, 2009.</text>
			</paragraph></section><section id="HB5984477C098417B8B0D2CB33962E67E"><enum>4.</enum><header>Waco Mammoth
			 National Monument, Texas</header>
			<subsection id="HFB2FE1D4CA754F36931E6C5781436B87"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established the Waco Mammoth
			 National Monument in the State of Texas, as a unit of the National Park System,
			 as generally depicted on the map.</text>
			</subsection><subsection id="HC6CDAE7A06E4427582B5535C7A6B2989"><enum>(b)</enum><header>Availability of
			 map</header><text display-inline="yes-display-inline">The map shall be on file
			 and available for public inspection in the appropriate offices of the National
			 Park Service.</text>
			</subsection></section><section id="H45E09EA851F146249BFF45216781BE4F"><enum>5.</enum><header>Administration of
			 National Monument</header>
			<subsection id="H9A049D0633CF41BFB85382F58C5EE13F"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">The Secretary shall
			 administer the national monument in accordance with this Act, the cooperative
			 agreements described in this section, and laws and regulations generally
			 applicable to units of the National Park System, including the National Park
			 Service Organic Act (39 Stat. 535,
			 <external-xref legal-doc="usc" parsable-cite="usc/16/1">16 U.S.C.
			 1</external-xref>).</text>
			</subsection><subsection id="H2AEBBBAE1B484958A6900770ECB0341D"><enum>(b)</enum><header>Cooperative
			 agreements</header><text>The Secretary may enter into cooperative agreements
			 for the management of the national monument with Baylor University and City of
			 Waco, pursuant to the National Park Service General Authorities Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/16/1a">16 U.S.C.
			 1a–2(1)</external-xref>).</text>
			</subsection></section><section id="H59F6E66465D440E88DC801B6538E7CB4"><enum>6.</enum><header>Acquisition of
			 property and boundary management</header>
			<subsection id="HBF833A49F260447B9EC9DEDAB318AC2F"><enum>(a)</enum><header>Acquisition of
			 property</header><text display-inline="yes-display-inline">The Secretary is
			 authorized to acquire from willing sellers lands, or interests in lands, within
			 the proposed boundary of the national monument necessary for effective
			 management.</text>
			</subsection><subsection id="H1E0922F1349040B2B156FD84F28CD5CA"><enum>(b)</enum><header>Conditions</header><text display-inline="yes-display-inline">Lands identified in subsection (a) may be
			 acquired—</text>
				<paragraph id="H8B1BFAD551294D80B87BBA4134E26BBF"><enum>(1)</enum><text>by donation,
			 purchase with donated or appropriated funds, transfer from another Federal
			 agency, or by exchange; and</text>
				</paragraph><paragraph id="HD3AF70E189264A2C8FB32EF022EFC62E"><enum>(2)</enum><text>in the case of
			 lands owned by the State of Texas, or a political subdivision thereof, or
			 Baylor University only by donation or exchange.</text>
				</paragraph></subsection></section><section id="H4E95719B36834FFC8825CF4D28C46C5B"><enum>7.</enum><header>Construction of
			 facilities on Nonfederal lands</header>
			<subsection id="H853BAFA3CABF43C18878DE946141922B"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">The Secretary is
			 authorized, subject to the appropriation of necessary funds, to construct
			 essential administrative or visitor use facilities on non-Federal lands within
			 the national monument.</text>
			</subsection><subsection id="HEE8A118DEA1243A69067414B10EEDA92"><enum>(b)</enum><header>Other
			 funding</header><text>In addition to the use of Federal funds authorized in
			 subsection (a), the Secretary may use donated funds, property, and services to
			 carry out this section.</text>
			</subsection></section><section id="H5ED4312C2B734CACAE11AF8056FA6B82"><enum>8.</enum><header>General
			 Management plan</header>
			<subsection id="H655A7A7031CA405DA55B6DC0BC9E692B"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">Not later than three
			 years after the date on which funds are made available to carry out this Act,
			 the Secretary, in consultation with Baylor University and City of Waco, shall
			 prepare a management plan for the national monument.</text>
			</subsection><subsection id="H407B701A215541ACB9817D90D37D5585"><enum>(b)</enum><header>Inclusions</header><text>The
			 management plan shall include, at a minimum—</text>
				<paragraph id="HEF93E8885E674C31BADCFFDE3D2F88A5"><enum>(1)</enum><text>measures for the
			 preservation of the resources of the national monument;</text>
				</paragraph><paragraph id="H876B7CA2837B4AE790407EE444AEAE99"><enum>(2)</enum><text>requirements for
			 the type and extent of development and use of the national monument;</text>
				</paragraph><paragraph id="H36C89543DC724232A051C8E7BCD1A0C4"><enum>(3)</enum><text>identification of
			 visitor carrying capacities for national monument; and</text>
				</paragraph><paragraph id="H30AFD42C01E44791A20671C51D634DEE"><enum>(4)</enum><text>opportunities for
			 involvement by Baylor University, the City of Waco, the State of Texas, and
			 other local and national entities in the formulation of educational programs
			 for the national monu-<linebreak></linebreak><pagebreak></pagebreak>ment and for developing and
			 supporting the national monument.</text>
				</paragraph></subsection></section></legis-body>
