		<section id="H63046262F822493A93DD915D2B8F16C3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Contractor Accountability
			 Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="HFC0D5F93396F48698D3BAB18AAEF56" section-type="subsequent-section"><enum>2.</enum><header>Annual report on
			 contract oversight by departments and agencies</header>
			<subsection id="HDA5070AE029E4F038D99EE9B05611628"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than April 1 of each year,
			 beginning with April 1, 2010, the head of each Federal department or agency
			 shall submit to Congress a report containing, with respect to each covered
			 contract or order awarded or issued by the agency during the year covered by
			 the report, the following:</text>
				<paragraph id="H87F76E8837D147D7BDAE1018B23F7C4C"><enum>(1)</enum><text>A
			 certification that the department or agency has exercised oversight over each
			 contract or order sufficient to ensure that each contractor is fulfilling the
			 obligations specified in the contract or order.</text>
				</paragraph><paragraph id="H7D2365A7858F44D992C12E9479AD6265"><enum>(2)</enum><text>A
			 list of the names of each contractor found by the department or agency to not
			 be fulfilling its obligations specified in the contract or order.</text>
				</paragraph></subsection><subsection id="HAD85061CF3194502A9BE346E4000DD42"><enum>(b)</enum><header>Public
			 availability</header>
				<paragraph id="H5DFDA160976F46FE86003D21293917D9"><enum>(1)</enum><text>Except as provided
			 in paragraph (2), each report submitted under subsection (a) shall be made
			 publicly available on the public Web site of the department or agency
			 submitting the report.</text>
				</paragraph><paragraph id="H7C6225531268469FB5EED3CED68E8E"><enum>(2)</enum><text>This subsection does
			 not require the public availability of information that is exempt from public
			 disclosure under section 552(b) of title 5, United States Code.</text>
				</paragraph></subsection><subsection id="HB42B66273F9A45CA823385124698649E"><enum>(c)</enum><header>GAO
			 oversight</header>
				<paragraph id="H6351E1588E2D42D8B751E288F948CA9"><enum>(1)</enum><header>Report
			 requirement</header><text>Every two years, the Comptroller General shall submit
			 to the congressional committees described in paragraph (2) a report discussing
			 the compliance by the departments and agencies with the requirements of this
			 Act.</text>
				</paragraph><paragraph id="H4F17B46D5DA14E76B98218F244E4CB24"><enum>(2)</enum><header>Committees</header><text>The
			 committees described in this paragraph are the following:</text>
					<subparagraph id="H67DF9978174041C8A78B8F409060E00"><enum>(A)</enum><text>The Committee on
			 Oversight and Government Reform of the House of Representatives and the
			 Committee on Homeland Security and Governmental Affairs of the Senate.</text>
					</subparagraph><subparagraph id="HB487BF535BCC4DF4959156A3C8C6B377"><enum>(B)</enum><text>The Committees on
			 Appropriations of the House of Representatives and the Senate.</text>
					</subparagraph><subparagraph id="H9CEF8FC1D58F4F09946C06FF7F878FE0"><enum>(C)</enum><text>Other committees
			 of jurisdiction.</text>
					</subparagraph></paragraph></subsection><subsection id="H6E8D6C4486D14D949F8E34F8AA434BB3"><enum>(d)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="HA30371ED723D4996B4F429583BE63557"><enum>(1)</enum><header>Covered contract
			 or order</header><text>The term <term>covered contract or order</term> means
			 any of the following:</text>
					<subparagraph id="HF20FF75F9F224D8CB594536671766E48"><enum>(A)</enum><text>A contract awarded
			 by a Federal department or agency in an amount greater than the simplified
			 acquisition threshold, or a subcontract in an amount greater than such
			 threshold under such a contract.</text>
					</subparagraph><subparagraph id="H4676F6BA4D324F8AB7241E91F5C21EDB"><enum>(B)</enum><text>A task or delivery
			 order issued by a Federal department or agency in an amount greater than the
			 simplified acquisition threshold.</text>
					</subparagraph></paragraph><paragraph id="H91649F38E68C4F0BA527BD8EECBDEAA6"><enum>(2)</enum><header>Simplified
			 acquisition threshold</header><text>The term <term>simplified acquisition
			 threshold</term> has the meaning provided in section 4(11) of the Office of
			 Federal Procurement Policy Act (41 U.S.C. 403(11)).</text>
				</paragraph><paragraph id="H2E2C62F23F7343AB862C0006DAFF30D"><enum>(3)</enum><header>Task or delivery
			 order</header><text>The term <term>task or delivery order</term> has the
			 meaning provided in section 303K of title III of the Federal Property and
			 Administrative Services Act of 1949 (41 U.S.C. 253k).</text>
				</paragraph></subsection></section></legis-body>
