<official-title>To amend the Controlled Substances Act to provide for take-back disposal of controlled substances in certain instances, and for other purposes.</official-title>

<section id="HFBCE58DDD8504C1BBAD047891104644D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Secure and Responsible Drug Disposal Act of 2009</short-title></quote>.</text></section> 
<section id="H70CFBFF8B09B41B20034EA704FF3DBF"><enum>2.</enum><header>Delivery of controlled substances by ultimate users for disposal</header> 
<subsection id="H1222EFB7DB0746779B2911005EAF34B7"><enum>(a)</enum><header>Regulatory authority</header><text display-inline="yes-display-inline">Section 302 of the Controlled Substances Act (21 U.S.C. 822) is amended by adding at the end the following:</text> 
<quoted-block style="other" id="H5957B4D969594A989E20E6678300E58" display-inline="no-display-inline" other-style="archaic"> 
<subsection id="H65ECBEC2B01B4980B005C3244E2B97D0"><enum>(g)</enum> 
<paragraph id="H9CD413022E1C499BA3F3E2F19F652DCD" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">An ultimate user who has lawfully obtained a controlled substance in accordance with this title may, without being registered, deliver the controlled substance to another person for the purpose of disposal of the controlled substance if—</text> 
<subparagraph id="H248CEBE4A9C14016B08F365B62FD59C" indent="up1"><enum>(A)</enum><text>the person receiving the controlled substance is authorized under this title to engage in such activity; and</text></subparagraph> 
<subparagraph id="H0CF25A0B6F274B02A9C33381BCA28B00" indent="up1"><enum>(B)</enum><text>the disposal takes place in accordance with regulations issued by the Attorney General to prevent diversion of controlled substances.</text></subparagraph></paragraph> 
<paragraph id="HF8EE85627681404495A0B6B92D00A444" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Attorney General may, by regulation, authorize long-term care facilities, as defined by the Attorney General by regulation, to dispose of controlled substances on behalf of ultimate users in a manner that the Attorney General determines will provide effective controls against diversion and be consistent with the public health and safety.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H55A9AD15AB504371B670CCC25897CA40"><enum>(b)</enum><header>Conforming amendment</header><text>Section 308(b) of the Controlled Substances Act (21 U.S.C. 828(b)) is amended—</text> 
<paragraph id="HA5BBAD121A2046C0BFE67000F9FA2EFD"><enum>(1)</enum><text>by striking the period at the end of paragraph (2) and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="H2E0C314B61844E138F7CB3FD678F85CE"><enum>(2)</enum><text>by adding at the end the following:</text>

<paragraph id="H723139DE7FD64FD7906CEC56CEDD28F8"><enum>(3)</enum><text display-inline="yes-display-inline">the delivery of such a substance for the purpose of disposal by an ultimate user or long-term care facility acting in accordance with section 302(g) of this title.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section>
