		<section commented="no" display-inline="no-display-inline" id="H104BB40730104BF9BA5F002BDAA0BE09" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Special Inspector General for the
			 Troubled Asset Relief Program Act of 2009</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H1795677C9B814720BEE9F2DD8B4DA49" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Audit and investigation
			 authorities</header><text display-inline="no-display-inline">Section 121 of the
			 Emergency Economic Stabilization Act of 2008 (12 U.S.C. 5231) is
			 amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="HA24DE1005E0D48C092E67DA05C11AF78"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c), by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H8255980902E14042A67624E19EB3F94" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="H557F43EA5C524A53A8E3433E1B396908"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H1BBAA9A937B2496DB5612268F2F32493"><enum>(A)</enum><text display-inline="yes-display-inline">Except as provided under subparagraph (B)
				and in addition to the duties specified in paragraphs (1), (2), and (3), the
				Special Inspector General shall have the authority to conduct, supervise, and
				coordinate an audit or investigation of any action taken under this title as
				the Special Inspector General determines appropriate.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDC152610B1894483B100DF7C38A639C2" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Subparagraph (A) shall not apply to any
				action taken under section 115, 116, 117, or
				125.</text>
						</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1F3DBB4F048F465BA5C6E450EA42CE10"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H8CCD0074C6484FE0B003C9275CD2F7C4"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking
			 <quote>subsection (c)(1)</quote> and inserting <quote>subsection (c)(1) and
			 (4)</quote>; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBBBF1BD970B1426296B8397DE434EE7"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H7F0AC088635E4BDB923D811BF0007200" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="HA1717C23C6664E9CA4093D00C0DEA0CA"><enum>(3)</enum><text display-inline="yes-display-inline">The Office of the Special Inspector General
				for the Troubled Asset Relief Program shall be treated as an office included
				under section 6(e)(3) of the Inspector General Act of 1978 (5 U.S.C. App.)
				relating to the exemption from the initial determination of eligibility by the
				Attorney
				General.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="HD09351C9798944C389AE545BBC27BE8" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Personnel authorities</header><text display-inline="no-display-inline">Section 121(e) of the Emergency Economic
			 Stabilization Act of 2008 (12 U.S.C. 5231(e)) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H02C767784A86412A9E83EE43DE00FF67"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H22AC22F73C774D7099EA5D006700EAFC"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>(A)</quote> after
			 <quote>(1)</quote>; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H64A7A85DEF50454DB1C77E1304257409"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HEC1072FA7A034753AB530845746E9BC6" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="HB9535D10817F4959BD9D2C17B1C30241" indent="up2"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H3FD4B062F8FA48379F418F6B351E8E4E"><enum>(i)</enum><text display-inline="yes-display-inline">Subject to clause (ii), the Special
				Inspector General may exercise the authorities of subsections (b) through (i)
				of section 3161 of title 5, United States Code (without regard to subsection
				(a) of that section).</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HF475AA42CDB54CEA8C634C74111533DA" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">In exercising the employment authorities
				under subsection (b) of section 3161 of title 5, United States Code, as
				provided under clause (i) of this subparagraph—</text>
								<subclause commented="no" display-inline="no-display-inline" id="H68F07F7BF4764A43AC5D4D28EABF3860"><enum>(I)</enum><text display-inline="yes-display-inline">the Special Inspector General may not make
				any appointment on and after the date occurring 6 months after the date of
				enactment of the Special Inspector General for the Troubled Asset Relief
				Program Act of 2009;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="H2C4DC4926EB84209A24998F6CBAFE5E7"><enum>(II)</enum><text display-inline="yes-display-inline">paragraph (2) of that subsection (relating
				to periods of appointments) shall not apply; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="H47979C31A4C64165A7DB69CFEC95E6A"><enum>(III)</enum><text display-inline="yes-display-inline">no period of appointment may exceed the
				date on which the Office of the Special Inspector General terminates under
				subsection (k).</text>
								</subclause></clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H08830488937945DF9B00A3AE7572D2AC"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H916BC0B5DBB5443AA700A07DF8D7B5C" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="HB205B82344BE437A8026F2FD8D04B2EA" indent="up1"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H807ED6545ECC4D86BF70E27139F200BE"><enum>(A)</enum><text display-inline="yes-display-inline">Except as provided under subparagraph (B),
				if an annuitant receiving an annuity from the Civil Service Retirement and
				Disability Fund becomes employed in a position within the Office of the Special
				Inspector General for the Troubled Asset Relief Program, his annuity shall
				continue. An annuitant so reemployed shall not be considered an employee for
				purposes of chapter 83 or 84 of title 5, United States Code.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBAC7A73D95694EB8BAA598726BCCFDBA" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Subparagraph (A) shall apply to—</text>
							<clause commented="no" display-inline="no-display-inline" id="H4C00D189B9404A97AE12AFD31EBA7C3F"><enum>(i)</enum><text display-inline="yes-display-inline">not more than 25 employees at any time as
				designated by the Special Inspector General; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HEFAF45469BF24B5897445397CCB457F"><enum>(ii)</enum><text display-inline="yes-display-inline">pay periods beginning after the date of
				enactment of the Special Inspector General for the Troubled Asset Relief
				Program Act of
				2009.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H0D7D66476B554B67BC87D0579391F882" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Response to audits and cooperation and
			 coordination with other entities</header><text display-inline="no-display-inline">Section 121 of the Emergency Economic
			 Stabilization Act of 2008 (12 U.S.C. 5231) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H9EE2201432CD4684A88F407366A9D0C4"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (f), (g), and
			 (h) as subsections (i), (j), and (k), respectively; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1BA87E75593C4A7493C87FDAB1364DF"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (e) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H3BFF5F5AF7124B73AFA309E56EFF8CD" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="H09A6E970EA95432DA72D2714476267B5"><enum>(f)</enum><header display-inline="yes-display-inline">Corrective responses to audit
				problems</header><text display-inline="yes-display-inline">The Secretary
				shall—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H26AC60D77A7F465694F8417D2D5FF37" indent="up1"><enum>(1)</enum><text display-inline="yes-display-inline">take action to address deficiencies
				identified by a report or investigation of the Special Inspector General or
				other auditor engaged by the TARP; or</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE6BEE6102FB749BBBA3709B235556D67" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">certify to appropriate committees of
				Congress that no action is necessary or appropriate.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H03C6E1AAD5144DAA85FF5F1BF426B1A"><enum>(g)</enum><header display-inline="yes-display-inline">Cooperation and coordination with other
				entities</header><text display-inline="yes-display-inline">In carrying out the
				duties, responsibilities, and authorities of the Special Inspector General
				under this section, the Special Inspector General shall work with each of the
				following entities, with a view toward avoiding duplication of effort and
				ensuring comprehensive oversight of the Troubled Asset Relief Program through
				effective cooperation and coordination:</text>
						<paragraph commented="no" display-inline="no-display-inline" id="HBE33864FC0704E68A3A6418B0053272F"><enum>(1)</enum><text display-inline="yes-display-inline">The Inspector General of the Department of
				Treasury.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H513865C9C1704CF2AF9DF6B6F0476C41"><enum>(2)</enum><text display-inline="yes-display-inline">The Inspector General of the Federal
				Deposit Insurance Corporation.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCAD7F687BA5749C7B534300490A5AD37"><enum>(3)</enum><text display-inline="yes-display-inline">The Inspector General of the Securities and
				Exchange Commission.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC7730F3930A34BDFB2D43C233E86A244"><enum>(4)</enum><text display-inline="yes-display-inline">The Inspector General of the Federal
				Reserve Board.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0BDDC27054D74564851786A53ED6AB42"><enum>(5)</enum><text display-inline="yes-display-inline">The Inspector General of the Federal
				Housing Finance Board.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9E86D3F9A41747FB9C0998CC17C6D038"><enum>(6)</enum><text display-inline="yes-display-inline">The Inspector General of any other entity
				as appropriate.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H21D66D4E71BE44F59B6BAF6B68CEA73C"><enum>(h)</enum><header display-inline="yes-display-inline">Council of the Inspectors General on
				Integrity and Efficiency</header><text display-inline="yes-display-inline">The
				Special Inspector General shall be a member of the Council of the Inspectors
				General on Integrity and Efficiency established under section 11 of the
				Inspector General Act of 1978 (5 U.S.C. App.) until the date of termination of
				the Office of the Special Inspector General for the Troubled Asset Relief
				Program.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H9D09AB3EE7D442EEAD5FAE67EB8BD7E3" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Reporting Requirements</header><text display-inline="no-display-inline">Subsection (i) (as so redesignated by
			 section 4) of section 121 of the Emergency Economic Stabilization Act of 2008
			 (12 U.S.C. 5231) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H894D526319064241B48FC3BD7D916FD"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking the first
			 sentence and inserting <quote>Not later than 60 days after the confirmation of
			 the Special Inspector General, and not later than 30 days following the end of
			 each fiscal quarter, the Special Inspector General shall submit to the
			 appropriate committees of Congress a report summarizing the activities of the
			 Special Inspector General during that fiscal quarter.</quote>;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8FA7B7ABDDC4459E8BF07811A5A5C94F"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (2) and (3) as
			 paragraphs (3) and (4), respectively;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8D069C760AB24FE793D6BF97DEAB981B"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (1) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H7D31CADEBF0B488282D185843E252CAE" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="H5255F352A96F44F2A788E6CD04E8A1CE" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Not later than September 1, 2009, the
				Special Inspector General shall submit a report to Congress assessing use of
				any funds, to the extent practical, received by a financial institution under
				the TARP and make the report available to the public, including posting the
				report on the home page of the website of the Special Inspector General within
				24 hours after the submission of the
				report.</text>
					</paragraph><after-quoted-block>; and
				</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF0AB05D5F6C746E7806D80A9E015CA23"><enum>(4)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD12629F6B30D423BA2EF45ABF7DF72CF" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="H4074F53F2C5E4E31BD64376FEE12DBC" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">Except as provided under paragraph (3), all
				reports submitted under this subsection shall be available to the
				public.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H5D6329E8F1A9435181EEDD35AA5D40E4" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Funding of the Office of the Special
			 Inspector General</header><text display-inline="no-display-inline">Subsection
			 (j)(1) (as so redesignated by section 4) of section 121 of the Emergency
			 Economic Stabilization Act of 2008 (12 U.S.C. 5231) is amended by inserting
			 before the period at the end the following: <quote>, not later than 7 days
			 after the date of enactment of the Special Inspector General for the Troubled
			 Asset Relief Program Act of 2009</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H570D50D31C2845D2BEDEC61880D8CA46" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Council of the Inspectors General on
			 Integrity and Efficiency</header><text display-inline="no-display-inline">The
			 Special Inspector General for Iraq Reconstruction and the Special Inspector
			 General for Afghanistan Reconstruction shall be a members of the Council of the
			 Inspectors General on Integrity and Efficiency established under section 11 of
			 the Inspector General Act of 1978 (5 U.S.C. App.) until the date of termination
			 of the Office of the Special Inspector General for Iraq Reconstruction and the
			 Office of the Special Inspector General for Afghanistan Reconstruction,
			 respectively.</text>
