		<section id="H0EB5EE47D4314965A4D63E22070064B6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Veterans Education Improvement Act of
			 2009</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H6214D36170BF483CB1C75C5CE16CB8E8" section-type="subsequent-section"><enum>2.</enum><header>Use of educational
			 assistance for business courses and seminars</header>
			<subsection id="H4651F13B468F43588C483D75D1C68CC4"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Veterans Affairs shall ensure that individuals entitled to educational
			 assistance under laws administered by the Secretary are entitled to use such
			 assistance for business courses and seminars, if such courses or seminars are
			 related to the operation of a business, and for continuing education courses.
			 The Secretary shall treat the courses referred to in the preceding sentence in
			 a similar manner as licensing and certification courses.</text>
			</subsection><subsection id="HB5202868CE6642A6AD2FBA274B80029F"><enum>(b)</enum><header>Effective
			 date</header><text>Subsection (a) shall take effect on September 1,
			 2010.</text>
			</subsection></section><section display-inline="no-display-inline" id="H369F0152264D4F3ABBC473E6BCC9B29B" section-type="subsequent-section"><enum>3.</enum><header>Use of educational
			 assistance for courses taken to prepare for licensing or certification
			 tests</header>
			<subsection id="H4EA8D24DAD264DD19EE5038E84BB7844"><enum>(a)</enum><header>Basic
			 educational assistance</header><text display-inline="yes-display-inline">Section 3452(b) of title 38, United States
			 Code, is amended by inserting after the fourth sentence the following new
			 sentence: <quote>Such term also includes preparatory courses for licensing or
			 certification tests described in the preceding sentence, as designated by the
			 Secretary.</quote>.</text>
			</subsection><subsection commented="no" id="H1EE5B7E252E047AD8982A84BCE3EEA0"><enum>(b)</enum><header>Survivors’ and
			 dependents’ educational assistance</header><text display-inline="yes-display-inline">Section 3501(a)(5) of title 38, United
			 States Code, is amended by inserting after the second sentence the following
			 new sentence: <quote>Such term also includes preparatory courses for licensing
			 or certification tests described in the preceding sentence, as designated by
			 the Secretary.</quote>.</text>
			</subsection><subsection id="H872FD8051B214AD58169EF6C05A0A8ED"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by subsections (a) and (b) shall take
			 effect on September 1, 2010.</text>
			</subsection></section><section display-inline="no-display-inline" id="H06CE0769F54C406891D005964613D2A3" section-type="subsequent-section"><enum>4.</enum><header>Use of educational
			 assistance to repay Federal student loans</header>
			<subsection id="H409627F9BC394CF1AB9143E687DACB77"><enum>(a)</enum><header>Montgomery GI
			 Bill</header>
				<paragraph id="H291454F68B874EFDB52D4E1B78B6C1C4"><enum>(1)</enum><header>In
			 general</header><text>Subchapter II of chapter 30 of title 38, United States
			 Code, is amended by inserting after section 3020 the following new
			 section:</text>
					<quoted-block display-inline="no-display-inline" id="HE5B570B412A144BD877707FB17700314" style="USC">
						<section id="H536639E0EE2B4654A04D3D372788CCF4"><enum>3020A.</enum><header>Use of
				educational assistance benefits for the repayment of Federal student loans for
				certain courses of education</header>
							<subsection id="H1EB9D3B4F551443795FBA36E4500B082"><enum>(a)</enum><header>Use of
				benefits</header><text>Notwithstanding any other provision of this chapter, and
				subject to subsections (b) through (e), an individual who is serving on active
				duty and who is entitled to educational assistance under this subchapter may
				apply amounts of such educational assistance otherwise available to the
				individual to repay some or all of any Federal student loan balance owed by the
				individual for a course of education pursued by the individual.</text>
							</subsection><subsection id="H493C883AE5FC4A2990015F576100061C"><enum>(b)</enum><header>Limitations on
				payments</header><paragraph commented="no" display-inline="yes-display-inline" id="HEE6DD3E3309B4028843C073054F50600"><enum>(1)</enum><text>The amount of an
				individual’s entitlement to educational assistance that the individual may
				apply to the repayment of a student loan balance under subsection (a) may not
				exceed $7,000 in any 12-month period.</text>
								</paragraph><paragraph id="HC8970367A7394141941E52D686C00411" indent="up1"><enum>(2)</enum><text>In no event shall payment of
				educational assistance under this section exceed the amount of the individual’s
				available entitlement under this chapter.</text>
								</paragraph><paragraph id="H5BEF41C183B94C388275273454E94FE0" indent="up1"><enum>(3)</enum><text>An individual entitled to educational
				assistance under this subchapter may not apply such educational assistance to
				any of the following:</text>
									<subparagraph id="H3128402454024CF0B6B1342B6D87A5F"><enum>(A)</enum><text display-inline="yes-display-inline">A
				loan made to the parents of a dependent student under section 428B of the
				Higher Education Act of 1965.</text>
									</subparagraph><subparagraph id="H4EF2C0CD68A04811A847A9D28F38A480"><enum>(B)</enum><text>A Federal Direct PLUS Loan made to the
				parents of a dependent student.</text>
									</subparagraph><subparagraph id="H5225DFAE9D2643A9B081578E92081F65"><enum>(C)</enum><text>A loan made under section 428C or
				455(g) of such Act, to the extent that such loan was used to repay—</text>
										<clause id="H18B4740786B54BED875032F4E55D1D8E"><enum>(i)</enum><text>a loan made to the parent of a
				dependent student under section 428B of such Act; or</text>
										</clause><clause id="HDBB79C1AF68540A095B5695E40C67B34"><enum>(ii)</enum><text>a Federal Direct PLUS Loan made to
				the parents of a dependent student.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="HE3D4EC84A9164CD3B6D5E201F5C7D310"><enum>(c)</enum><header>Amount of
				payments</header><text>The Secretary shall make monthly payments under this
				section in such amounts as the individual may elect for the repayment of a
				Federal student loan of such an individual.</text>
							</subsection><subsection id="HEC23C56D061945B5BA2441E9D14B8100"><enum>(d)</enum><header>Arrangements To
				make payments</header><text>The Secretary shall enter into such arrangements,
				and shall prescribe such regulations, as may be necessary to carry out this
				section.</text>
							</subsection><subsection id="HA83FD54645F44C7BB700C0E9A975DF54"><enum>(e)</enum><header>Federal student
				loan defined</header><text>In this section, the term <quote>Federal student
				loan</quote> means any loan made under title IV of the Higher Education Act of
				1965 (20 U.S.C. 1070 et
				seq.).</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H5EC7C7605A2E4666BEDA5091E8B70052"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by inserting after the item relating to section 3020 the following
			 new item:</text>

			 educational assistance program</header>
				<paragraph id="HDE570346B64B4AD7B803265EA382D5D1"><enum>(1)</enum><header>In
			 general</header><text>Subchapter II of chapter 33 of title 38, United States
			 Code, is amended by inserting after section 3319 the following new
			 section:</text>
					<quoted-block display-inline="no-display-inline" id="H1A6FB0A563BD4E5F00F70029C151216D" style="USC">
						<section id="H6AB3228A48DB4F1895D1002B38B7BE77"><enum>3320.</enum><header>Use of
				educational assistance benefits for the repayment of Federal student loans for
				certain courses of education</header>
							<subsection id="HB197CD57AE5D48ACB40094A8A224C97E"><enum>(a)</enum><header>Use of
				benefits</header><text>Notwithstanding any other provision of this chapter, and
				subject to subsections (b) through (e), an individual who is serving on active
				duty and who is entitled to educational assistance under this subchapter may
				apply amounts of such educational assistance otherwise available to the
				individual to repay some or all of any Federal student loan balance owed by the
				individual for a course of education pursued by the individual.</text>
							</subsection><subsection id="H6BC3EAAFA1A0414C8688DD00A6A6C8E0"><enum>(b)</enum><header>Limitations on
				payments</header>
								<paragraph display-inline="no-display-inline" id="HF9CF7674616D4A9DA72F285DC1481DDE"><enum>(1)</enum><header>Limitation on
				amount in any 12-month period</header><text>The amount of an individual’s
				entitlement to educational assistance that the individual may apply to the
				repayment of a student loan balance under subsection (a) may not exceed $6,000
				in any 12-month period.</text>
								</paragraph><paragraph id="H4D9533F2F7FF455283AF7B28A741F5D8"><enum>(2)</enum><header>Limitation on
				total amount</header><text>In no event shall payment of educational assistance
				under this section exceed the amount of the individual’s available entitlement
				under this chapter.</text>
								</paragraph><paragraph id="HA2084AA2915D48D89257F1A3AC43844"><enum>(3)</enum><header>Prohibition on
				use for certain loans</header><text>An individual entitled to educational
				assistance under this subchapter may not apply such educational assistance to
				any of the following:</text>
									<subparagraph id="H3979048CF67D4D6C9DBCE969D907516"><enum>(A)</enum><text display-inline="yes-display-inline">A loan made to the parents of a dependent
				student under section 428B of the Higher Education Act of 1965.</text>
									</subparagraph><subparagraph id="H89D4F2A939D341498824BD3036C70077"><enum>(B)</enum><text>A Federal Direct
				PLUS Loan made to the parents of a dependent student.</text>
									</subparagraph><subparagraph id="HD42F927070D54123A796AE001909AFE"><enum>(C)</enum><text>A loan made under
				section 428C or 455(g) of such Act, to the extent that such loan was used to
				repay—</text>
										<clause id="H4EA7C3D79C9D49DEBC422991D139BAA3"><enum>(i)</enum><text>a
				loan made to the parent of a dependent student under section 428B of such Act;
				or</text>
										</clause><clause id="HC4F70AD72C234394AA001D344F578151"><enum>(ii)</enum><text>a
				Federal Direct PLUS Loan made to the parents of a dependent student.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="H5D8D08D2E099402EB85F76413B00DC5"><enum>(c)</enum><header>Amount of
				payments</header><text>The Secretary shall make monthly payments under this
				section in such amounts as the individual may elect for the repayment of a
				Federal student loan of such an individual.</text>
							</subsection><subsection id="H128960D6A89D487FADD0432DE53CD84F"><enum>(d)</enum><header>Arrangements To
				make payments</header><text>The Secretary shall enter into such arrangements,
				and shall prescribe such regulations, as may be necessary to carry out this
				section.</text>
							</subsection><subsection id="H91E4AEEFB9814EE3BF64983B46E3AE43"><enum>(e)</enum><header>Federal student

			 withdraw election not to enroll in educational assistance program</header>
			<subsection id="H5E2F1CD54CA84063B898A959E98B96B9"><enum>(a)</enum><header>Basic
			 educational assistance for active duty service</header>
				<paragraph id="H678CC1963C114EC8802629A792DDA2BC"><enum>(1)</enum><header>Opportunity to
			 withdraw</header><text>Subsection (c) of section 3011 of title 38, United
			 States Code, is amended by adding at the end the following new
			 paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HDAC0AB789566465F00A7C4F1F47DDCAF" style="USC">
						<paragraph display-inline="no-display-inline" id="HB25921B8C96449BBBB9134ADDC42445E" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">An individual who makes an election not to
				receive educational assistance under paragraph (1) may withdraw that election
				at any time and, after making such withdrawal, shall be entitled to educational
				assistance under this chapter in the same manner as if the individual had never
				made that election, if, at the time the individual makes such withdrawal, the
				individual is serving on active duty as a member of the Armed
				Forces.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HC752289245564E1F9D533CC67EC3B58F"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Paragraph (1) of such subsection is amended in the
			 third sentence by striking <quote>Any individual</quote> and inserting
			 <quote>Except as provided in paragraph (4), any individual</quote>.</text>
				</paragraph></subsection><subsection id="HF9F25676C3894AF99CB5EE2B6C82BFFC"><enum>(b)</enum><header>Basic
			 educational assistance for service in the Selected Reserve</header>
				<paragraph id="HF0D782A3D0444B8DBA60AEE69B55114D"><enum>(1)</enum><header>Opportunity to
			 withdraw</header><text>Subsection (d) of section 3012 of title 38, United
			 States Code, is amended by adding at the end the following new
			 paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HB7979DC41BAB437E8F91EE125D073871" style="USC">
						<paragraph display-inline="no-display-inline" id="H48FFD5405C334E1EA0861EF5AAEA5462" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">An individual who makes an election not to
				receive educational assistance under paragraph (1) may withdraw that election
				at any time and, after making such withdrawal, shall be entitled to educational
				assistance under this chapter in the same manner as if the individual had never
				made that election, if, at the time the individual makes such withdrawal, the
				individual is serving on active duty as a member of the Armed
				Forces.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H69C95210E3D149F7923E578F004B469F"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Paragraph (1) of such subsection is amended in the
			 third sentence by striking <quote>Any individual</quote> and inserting
			 <quote>Except as provided in paragraph (4), any individual</quote>.</text>
				</paragraph></subsection><subsection id="HC4E5096DA2D74E258349698185F535A0"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by subsections (a) and (b) shall take
			 effect on September 1, 2010, and shall apply with respect to an individual who
			 is serving on active duty as a member of the Armed Forces on or after that
			 date.</text>
			</subsection></section><section display-inline="no-display-inline" id="H880C3A1925E343F8B3A513E8E39F86CC" section-type="subsequent-section"><enum>6.</enum><header>Extension of increase
			 in benefit for certain individuals pursuing apprenticeships or on-job
			 training</header>
			<subsection id="H6455D437374F4215B98F76B7FD703C29"><enum>(a)</enum><header>Members of the
			 Selected Reserve</header><text display-inline="yes-display-inline">Subsection
			 (d) of section 103 of the Veterans Earn and Learn Act of 2004 (Public Law
			 108–454; 38 U.S.C. 3032 note) is amended by striking <quote>January 1,
			 2008</quote> and inserting <quote>January 1, 2014</quote>.</text>
			</subsection><subsection id="H94755FFD43164C92ACEBF2A809839309"><enum>(b)</enum><header>Survivors and
			 dependents</header><text display-inline="yes-display-inline">Subsection (c) of
			 such section is amended by striking <quote>January 1, 2008</quote> and
			 inserting <quote>January 1, 2014</quote>.</text>
			</subsection><subsection id="HD172E924F22A4F79A2FF007F8F624E00"><enum>(c)</enum><header>Certain other
			 individuals</header><text display-inline="yes-display-inline">Subsection (a) of
			 such section is amended by striking <quote>January 1, 2008</quote> and
			 inserting <quote>January 1, 2014</quote>.</text>

			 educational assistance benefits for veterans discharged from active duty with
			 general discharge</header>
			<subsection id="H1A741AFA11594B968B2FFE4ED85C5E3F"><enum>(a)</enum><header>Montgomery GI
			 Bill</header>
				<paragraph id="H87D5B9CD7CFD44499F6CB57657BE6F14"><enum>(1)</enum><header>Active duty
			 service</header><text>Section 3011(a)(3)(B) of title 38, United States Code, is
			 amended by inserting <quote>or a general discharge (under honorable
			 conditions)</quote> before the period at the end.</text>
				</paragraph><paragraph id="H815936BDE2DE4CF1BB2EDE53BF204687"><enum>(2)</enum><header>Service in
			 Selected Reserve</header><text display-inline="yes-display-inline">Section
			 3012(a)(3)(A) of such title is amended by inserting <quote>or a general
			 discharge (under honorable conditions)</quote> before the semicolon.</text>
				</paragraph></subsection><subsection id="H91AE8842ED7C4ECD82BAA7009519E788"><enum>(b)</enum><header>Post-9–11
			 educational assistance program</header><text display-inline="yes-display-inline">Section 3311(c)(1) of such title is amended
			 by inserting <quote>or a general discharge (under honorable conditions)</quote>
			 before the period at the end.</text>
			</subsection><subsection id="HBAE98540542D41AEA612B86DDC027CAF"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 subsections (a) and (b) shall apply with respect to an individual who is
			 discharged from service in the Armed Forces on or after September 1,
			 2010.</text>
			</subsection></section><section id="H586F38D4FAB34C4B8902B61E0000725D"><enum>8.</enum><header>Increase in
			 amount of reporting fee payable to educational institutions that enroll
			 veterans receiving educational assistance</header>
			<subsection id="H44EB848823654BCFBA90D24528305E1D"><enum>(a)</enum><header>Increase in
			 amount of fee</header><text display-inline="yes-display-inline">Subsection (c)
			 of section 3684 of title 38, United States Code, is amended—</text>
				<paragraph id="H7E36B586BF9D4C84937CD7A5FEC8FA4D"><enum>(1)</enum><text>by striking
			 <quote>$7</quote> and inserting <quote>$21</quote>; and</text>
				</paragraph><paragraph id="HC679261738B149FAB628D6565C474F18"><enum>(2)</enum><text>by striking
			 <quote>$11</quote> and inserting <quote>$21</quote>.</text>
				</paragraph></subsection><subsection id="HC4B30B97FC3041F992DF27C5EEFE0784"><enum>(b)</enum><header>Technical
			 correction</header><text>Subsection (a) of such section is amended by striking
			 the second comma after <quote>34</quote>.</text>
			</subsection><subsection id="H62DE380BA4FD4B1F00B843E61011F100"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by subsections (a) and (b) shall take
			 effect on September 1, 2010.</text>
			</subsection></section><section id="H4C153947867946E2B3A6D4674F2F9863" section-type="subsequent-section"><enum>9.</enum><header>Provision of
			 additional areas of work-study for veterans</header>
			<subsection id="H439893E68FC04E8082A9292873E9EC76"><enum>(a)</enum><header>In
			 general</header><text>Subsection (a)(4) of section 3485 of title 38, United
			 States Code, is amended by adding at the end the following new
			 subparagraph:</text>
				<quoted-block id="H577F200110B34999982B85CD71CA35E1" style="USC">
					<subparagraph id="HD13E0B3E967C46A9A9B25B5471A8EA00" indent="up1"><enum>(G)</enum><text>The provision of placement services
				described in section 3104(a)(5) of this title at an educational institution
				carried out under the supervision of a Department
				employee.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H157494FF3748426D902C43A924E48496"><enum>(b)</enum><header>Work study for
			 students enrolled on half-time basis</header><text>Subsection (b) of such
			 section is amended—</text>
				<paragraph id="H22DD8DA50C734BBCA5FF376050877F18"><enum>(1)</enum><text>in the first
			 sentence, by striking <quote>three-quarters</quote> and inserting
			 <quote>half</quote>; and</text>
				</paragraph><paragraph id="HC2056F3F754544D59FD945F0E7E789D7"><enum>(2)</enum><text>in the third
			 sentence, by striking <quote>three-quarter-time</quote> and inserting
			 <quote>half-time</quote>.</text>
				</paragraph></subsection><subsection id="H0DDFE0BAEC5F4EF4AF5C3477AAAC2D65"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply with respect
			 to agreements entered into under section 3485 of title 38, United States Code,
			 on or after September 1, 2010.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H444C43775A8B4D379645D5F343C85F6" section-type="subsequent-section"><enum>10.</enum><header>5-year pilot program
			 for on-campus work-study positions</header>
			<subsection commented="no" id="H1004B11D14DA4634AA711CE6FA449FD"><enum>(a)</enum><header>Establishment of
			 pilot program</header><text display-inline="yes-display-inline">Beginning not
			 later than two years after the date of the enactment of this Act, the Secretary
			 of Veterans Affairs shall conduct a five-year pilot project to test the
			 feasibility and advisability of expanding the scope of qualifying work-study
			 activities under subsection (a)(4) of section 3485 of title 38, United States
			 Code, including work-study positions available on site at educational
			 institutions.</text>
			</subsection><subsection commented="no" id="HC80064A3B4B848A6AC9DC458EAFAB97E"><enum>(b)</enum><header>Type of
			 work-study positions</header><text>The work-study positions referred to in
			 subsection (a) may include positions in academic departments (including
			 positions as tutors or research, teaching, and lab assistants) and in student
			 services (including positions in career centers and financial aid, campus
			 orientation, cashiers, admissions, records, and registration offices).</text>
			</subsection><subsection commented="no" id="HC6D4F390AC364174BD1810554347DDB8"><enum>(c)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary shall prescribe regulations
			 to carry out the pilot project under this section, including regulations
			 providing for the supervision of work-study positions referred to in subsection
			 (a) by appropriate personnel.</text>
			</subsection><subsection commented="no" id="HA72015E2F0AF4A8E94E4ABAD80CF1CDA"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to the
			 Secretary $10,000,000 for each of the fiscal years during which the Secretary
			 carries out the pilot project under this section.</text>
			</subsection></section><section display-inline="no-display-inline" id="H3EBCABE37B104361B1424D4B99A60043" section-type="subsequent-section"><enum>11.</enum><header>Modification of
			 advance payment of initial educational assistance or subsistence
			 allowance</header>
			<subsection id="H63771EC5847A467FA39530EDD2CCECFE"><enum>(a)</enum><header>Modification</header><text display-inline="yes-display-inline">Section 3680(d)(2) of title 38, United
			 States Code, is amended by inserting after the third sentence the following new
			 sentence: <quote>For purposes of the entitlement to educational assistance of
			 the veteran or person receiving an advance payment under this subsection, the
			 advance payment shall be charged against the final month of the entitlement of
			 the person or veteran and, if necessary, the penultimate such month. In no
			 event may any veteran or person receive more than one advance payment under
			 this subsection during any academic year.</quote>.</text>
			</subsection><subsection id="H266D88C4624B4DB2A8999E535B2D43C8"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 subsection (a) shall apply with respect to an advance payment of educational
			 assistance made on or after September 1, 2010.</text>
			</subsection></section><section display-inline="no-display-inline" id="H654F49EC9F0F4B7581B7AA84C1C1FE9" section-type="subsequent-section"><enum>12.</enum><header>Consideration of
			 additional contributions and payments in calculating entitlement charge for
			 certain programs of education</header>
			<subsection id="H81A5DEFFAEBA4ED500C1B2A7AC15FF00"><enum>(a)</enum><header>Tuition
			 assistance</header><text display-inline="yes-display-inline">Section
			 3014(b)(2)(C) of title 38, United States Code, is amended by striking <quote>or
			 (e)(1) of section 3015 of this title,</quote> and inserting <quote>(e)(1), or
			 (g) of section 3015 of this title, or section 16131(I) of title
			 10,</quote>.</text>
			</subsection><subsection id="H76DA8ED1CB584ADEBDF59999E350823F"><enum>(b)</enum><header>Flight
			 training</header><text display-inline="yes-display-inline">Section 3032(e)(3)
			 of such title is amended by striking <quote>or (e)(1) of section 3015 of this
			 title,</quote> and inserting <quote>(e)(1), or (g) of section 3015 of this
			 title, or section 16131(I) of title 10,</quote>.</text>
			</subsection><subsection id="H904C0F8B1A0D447EB7A136C4F7A29975"><enum>(c)</enum><header>Licensing and
			 certification tests</header><text display-inline="yes-display-inline">Section
			 3032(f)(2) of such title is amended by striking <quote>or (e)(1) of section
			 3015 of this title,</quote> and inserting <quote>(e)(1), or (g) of section 3015
			 of this title, or section 16131(I) of title 10,</quote>.</text>
			</subsection></section><section id="H6A5F7F7F9B9245E5B26D94F6CA4920D9"><enum>13.</enum><header>Accelerated
			 payment of educational assistance</header>
			<subsection id="HADBB06FE1CC64A3BA8A61094AC7C1905"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 33 of title
			 38, United States Code, as amended by section 4, is further amended by
			 inserting after section 3320, as added by section 4, the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="H5633332C8A6943EAA783E05634001F68" style="USC">
					<section id="H9A0063D25545478B95D92900004384CD"><enum>3320A.</enum><header>Accelerated
				payment of educational assistance</header>
						<subsection id="H6C238CB729E94DB1B1551521E6C7CB5B"><enum>(a)</enum><header>Payment on
				Accelerated Basis</header><text>The educational assistance allowance payable
				under this chapter with respect to an eligible person described in subsection
				(b) may, upon the election of such eligible person, be paid on an accelerated
				basis in accordance with this section.</text>
						</subsection><subsection id="HEE8D11FD33EF45C3ADED289B8EC169C8"><enum>(b)</enum><header>Eligible
				person</header><text>An eligible person described in this subsection is a
				member of a reserve component entitled to educational assistance under this
				chapter who is—</text>
							<paragraph id="H674C92D9BA304427BBD3BD9C5004AABD"><enum>(1)</enum><text>enrolled in an
				approved program of education not exceeding two years in duration and not
				leading to an associate, bachelors, masters, or other degree, subject to
				subsection (g); and</text>
							</paragraph><paragraph id="H6486BBE2A5954FBBAFC5099F5B39F9CF"><enum>(2)</enum><text>charged tuition
				and fees for the program of education that, when divided by the number of
				months (and fractions thereof) in the enrollment period, exceeds the amount
				equal to 200 percent of the monthly rate of educational assistance allowance
				otherwise payable with respect to the person under section 3313 of this
				title.</text>
							</paragraph></subsection><subsection id="HC1780C2E22F04AC1A0144D396306B000"><enum>(c)</enum><header>Amount of
				Accelerated Payment</header>
							<paragraph display-inline="no-display-inline" id="H610AE90E518A4DE5002EA5EF446F8292"><enum>(1)</enum><header>Amount</header><text>The
				amount of the accelerated payment of educational assistance payable with
				respect to an eligible person making an election under subsection (a) for a
				program of education shall be the lesser of—</text>
								<subparagraph id="HE1461B91B6014F8BAD241DF8C6AF4739"><enum>(A)</enum><text>the amount equal
				to 60 percent of the established charges for the program of education;
				or</text>
								</subparagraph><subparagraph id="HEDB5452FED5D48A0A31CA4FBC1431495"><enum>(B)</enum><text>the aggregate
				amount of educational assistance allowance to which the person remains entitled
				under this chapter at the time of the payment.</text>
								</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H4DC35BB9CB974A0D92BFD939095F7D1D"><enum>(2)</enum><header>Established
				charges</header>
								<subparagraph display-inline="no-display-inline" id="HB98A3472C712436D99A0A94C2160021"><enum>(A)</enum><header>Definition</header><text>In
				this subsection, except as provided in subparagraph (B), the term
				<term>established charges</term>, in the case of a program of education, means
				the actual charges (as determined pursuant to regulations prescribed by the
				Secretary of Veterans Affairs) for tuition and fees which similarly
				circumstanced individuals who are not eligible for benefits under this chapter
				and who are enrolled in the program of education would be required to pay.
				Established charges shall be determined on the following basis:</text>
									<clause id="H444287EAC867483A972078B9AEEB7E20"><enum>(i)</enum><text>In
				the case of an individual enrolled in a program of education offered on a term,
				quarter, or semester basis, the tuition and fees charged the individual for the
				term, quarter, or semester.</text>
									</clause><clause id="H6F481A4062F249E6B3DC5C009E2C3344"><enum>(ii)</enum><text>In the case of an
				individual enrolled in a program of education not offered on a term, quarter,
				or semester basis, the tuition and fees charged the individual for the entire
				program of education.</text>
									</clause></subparagraph><subparagraph id="H6E682224C8DA48069753D6A4860489D2" indent="up1"><enum>(B)</enum><header>Exception</header><text>In this
				subsection, the term <term>established charges</term> does not include any fees
				or payments attributable to the purchase of a vehicle.</text>
								</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HC858C5D42A024FDF8732272DDE1CDE21"><enum>(3)</enum><header>Certification by
				educational institution</header><text>The educational institution providing the
				program of education for which an accelerated payment of educational assistance
				allowance is elected by an eligible person under subsection (a) shall certify
				to the Secretary of Veterans Affairs the amount of the established charges for
				the program of education.</text>
							</paragraph></subsection><subsection id="HFC1346CABB214FA298A06B00DF64664"><enum>(d)</enum><header>Time of
				Payment</header><text>An accelerated payment of educational assistance
				allowance made with respect to an eligible person under this section for a
				program of education shall be made not later than the last day of the month
				immediately following the month in which the Secretary of Veterans Affairs
				receives a certification from the educational institution regarding—</text>
							<paragraph id="HDD9E8D27634A4FBB83D774CFD99247E9"><enum>(1)</enum><text>the person's
				enrollment in and pursuit of the program of education; and</text>
							</paragraph><paragraph id="H0678F1AE568C4E2CBDF4F43E1F0055BC"><enum>(2)</enum><text>the amount of the
				established charges for the program of education.</text>
							</paragraph></subsection><subsection display-inline="no-display-inline" id="H0A5144FA69244FB8ACDEB188400E040"><enum>(e)</enum><header>Charge against
				entitlement</header><text>For each accelerated payment of educational
				assistance allowance made with respect to an eligible person under this
				section, the person’s entitlement to educational assistance under this chapter
				shall be charged the number of months (and any fraction thereof) determined by
				dividing the amount of the accelerated payment by the full-time monthly rate of
				educational assistance allowance otherwise payable with respect to the person
				under section 3313 of this title as of the beginning date of the enrollment
				period for the program of education for which the accelerated payment is
				made.</text>
						</subsection><subsection id="H4CE093F683E3418BB0D6C900CB48D1FB"><enum>(f)</enum><header>Regulations</header><text>The
				Secretary shall prescribe regulations to carry out this section. The
				regulations shall include requirements, conditions, and methods for the
				request, issuance, delivery, certification of receipt and use, and recovery of
				overpayment of an accelerated payment of educational assistance allowance under
				this section. The regulations may include such elements of the regulations
				prescribed under section 3014A of this title as the Secretary of Veterans
				Affairs considers appropriate for purposes of this section.</text>
						</subsection><subsection id="HDA7F093B552E452EBCA100E6C90011DB"><enum>(g)</enum><header>Limitation</header><text>The
				aggregate amount of educational assistance payable under this section in any
				fiscal year for enrollments covered by subsection (b)(1) may not exceed
				$3,000,000.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3BBC0DCB9D7C4164862E084788429695"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by inserting after the item relating to section 3320 the following
			 new item:</text>
