			 independent advice and expertise</header>
			<subsection id="H04379E586BAD42BF9099FE93ED40E2E5"><enum>(a)</enum><header>Bar on political
			 litmus tests</header><text display-inline="yes-display-inline">Section 9 of the
			 Federal Advisory Committee Act (5 U.S.C. App.) is amended—</text>
				<paragraph id="HF4DF45AB7C034A51AA652580FAF36646"><enum>(1)</enum><text>in the section
			 heading by inserting <quote><header-in-text level="section" style="traditional">membership;</header-in-text></quote> after
			 <quote><header-in-text level="section" style="traditional">advisory
			 committees;</header-in-text></quote>;</text>
				</paragraph><paragraph id="HAB6ECECCB81D4D58839200BAC42CB982"><enum>(2)</enum><text>by redesignating
			 subsections (b) and (c) as subsections (e) and (f), respectively; and</text>
				</paragraph><paragraph id="H925808C3005441DBAFF17761A9BFD387"><enum>(3)</enum><text>by inserting after
			 subsection (a) the following:</text>
					<quoted-block id="HB34689126EED4A728AE6D69DFE798571" style="OLC">
						<subsection id="H62BE76E112C54C38A5F86B10D8EDA9AF"><enum>(b)</enum><header>Appointments
				made without regard to political affiliation or activity</header><text>All
				appointments to advisory committees shall be made without regard to political
				affiliation or political activity, unless required by Federal
				statute.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H4C10B0925C7B482389F14AFA9E8E1B40"><enum>(b)</enum><header>Minimizing
			 conflicts of interest</header><text>Section 9 of the Federal Advisory Committee
			 Act (5 U.S.C. App.) is further amended by inserting after subsection (b) (as
			 added by subsection (a)) the following:</text>
				<quoted-block id="H7031F73C498C4577AD7F60B3B5ABEAE5" style="OLC">
					<subsection id="HA3F244E4171D42D4BF0F37E7E051F7FD"><enum>(c)</enum><header>Public
				Nominations of Committee Members</header><text display-inline="yes-display-inline">Prior to appointing members to an advisory
				committee, the head of an agency shall give interested persons an opportunity
				to suggest potential committee members. The agency shall include a request for
				comments in the Federal Register notice required under subsection (a) and
				provide a mechanism for interested persons to comment through the official
				website of the agency. The agency shall consider any comments submitted under
				this subsection in selecting the members of an advisory committee.</text>
					</subsection><subsection id="H5603FA5C3D324CA9B15942386C82330C"><enum>(d)</enum><header>Designation of
				Committee Members</header>
						<paragraph id="HC498FE9280714A3CB0C65569C43E4C30"><enum>(1)</enum><text>An individual
				appointed to an advisory committee who is not a full-time or permanent
				part-time officer or employee of the Federal Government shall be designated
				as—</text>
							<subparagraph id="HB3172A632FBF4E0BB33BDAA4A5D2314B"><enum>(A)</enum><text>a special
				government employee, if the individual is providing advice based on the
				individual’s expertise or experience; or</text>
							</subparagraph><subparagraph id="HD87384593630493AA29BCC90D2021C60"><enum>(B)</enum><text>a representative,
				if the individual is representing the views of an entity or entities outside of
				the Federal Government.</text>
							</subparagraph></paragraph><paragraph id="HC53B455CC7634CC29212D44F167804DC"><enum>(2)</enum><text>An agency may not
				designate committee members as representatives to avoid subjecting them to
				Federal ethics rules and requirements.</text>
						</paragraph><paragraph id="H7AC6EB31D61C4144816C17D976306F01"><enum>(3)</enum><text>The designated
				agency ethics official for each agency shall review the members of each
				advisory committee that reports to the agency to determine whether each
				member’s designation is appropriate, and to redesignate members if appropriate.
				The designated agency ethics official shall certify to the head of the agency
				that such review has been made—</text>
							<subparagraph id="H8BC999CB321F44C3A2867FFA699A0BD5"><enum>(A)</enum><text>following the
				initial appointment of members; and</text>
							</subparagraph><subparagraph id="H1634AD93DECC4393A6E52B6578477468"><enum>(B)</enum><text>at the time a
				committee’s charter is renewed, or, in the case of a committee with an
				indefinite charter, every 2 years.</text>
							</subparagraph></paragraph><paragraph id="H8CB7B2ED8185446AB4A55DA4D87AE20A"><enum>(4)</enum><text>The head of each
				agency shall inform each individual appointed to an advisory committee that
				reports to the agency whether the individual is appointed as a special
				government employee or as a representative. The agency head shall provide each
				committee member with an explanation of the differences between special
				government employees and representatives and a summary of applicable ethics
				requirements. The agency head, acting through the designated agency ethics
				official, shall obtain signed and dated written confirmation from each
				committee member that the member received and reviewed the information required
				by this paragraph.</text>
						</paragraph><paragraph id="H958B9B1568C04A72A3CE85B4C0F66A4C"><enum>(5)</enum><text>The Director of
				the Office of Government Ethics shall provide guidance to agencies on what to
				include in the summary of ethics requirements required by paragraph (4).</text>
						</paragraph><paragraph id="H3AECF9E8FFF84152AC01158EE85DCC5C"><enum>(6)</enum><text>The head of each
				agency shall, to the extent practicable, develop and implement strategies to
				minimize the need for written determinations under
				<external-xref legal-doc="usc" parsable-cite="usc/18/208">section
				208(b)(1)</external-xref> of title 18, United States Code. Strategies may
				include such efforts as improving outreach efforts to potential committee
				members and seeking public input on potential committee
				members.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8DA00B9CC9CD424582B76EDFDF4B8122"><enum>(c)</enum><header>Regulations
			 implementing FACA</header><text>Section 7(c) of the Federal Advisory Committee
			 Act (5 U.S.C. App.) is amended by inserting after <quote>(c)</quote> the
			 following: <quote>The Administrator shall promulgate regulations as necessary
			 to implement this Act.</quote>.</text>
			</subsection></section><section id="H8B9A9F13356744228E562933062072C7"><enum>3.</enum><header>Preventing
			 efforts to circumvent the Federal Advisory Committee Act and public
			 disclosure</header>
			<subsection display-inline="no-display-inline" id="HA4FD7FCED5164C35A2B72BB12D0F0171"><enum>(a)</enum><header>De facto
			 members</header><text display-inline="yes-display-inline">Section 4 of the
			 Federal Advisory Committee Act (5 U.S.C. App.) is amended by adding at the end
			 the following:</text>
				<quoted-block id="H1460F86A77E249278D2A5F4310029E9D">
					<subsection id="H6EB165B76DB74140B19C66BAB4B9F0B3"><enum>(d)</enum><header>Treatment of
				individual as member</header><text>An individual who is not a full-time or
				permanent part-time officer or employee of the Federal Government shall be
				regarded as a member of a committee if the individual regularly attends and
				fully participates in committee meetings as if the individual were a member,
				even if the individual does not have the right to vote or veto the advice or
				recommendations of the advisory
				committee.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8945835C87144F3084B0BF811DE41EEE"><enum>(b)</enum><header>Subcommittees</header><text display-inline="yes-display-inline">Section 4 of the Federal Advisory Committee
			 Act (5 U.S.C. App.) is amended by striking subsection (a) and inserting the
			 following:</text>
				<quoted-block id="HD0A3C07F53634DC2A0E7DB35EA66711C" style="OLC">
					<subsection id="H9B3E5C0D7828445FA6B6EFA671CDD626"><enum>(a)</enum><header>Application</header><text display-inline="yes-display-inline">The provisions of this Act or of any rule,
				order, or regulation promulgated under this Act shall apply to each advisory
				committee, including any subcommittee or subgroup thereof, except to the extent
				that any Act of Congress establishing any such advisory committee specifically
				provides otherwise. Any subcommittee or subgroup that reports to a parent
				committee established under section 9(a) is not required to comply with section
				9(f). In this subsection, the term <term>subgroup</term> includes any working
				group, task force, or other entity formed for the purpose of assisting the
				committee or any subcommittee of the committee in its
				work.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H76F74043C2074F20A5F19C2DD55C0B9E"><enum>(c)</enum><header>Committees
			 created under contract</header><text>Section 3(2) of the Federal Advisory
			 Committee Act (5 U.S.C. App.) is amended in the matter following subparagraph
			 (C) by adding at the end the following: <quote>An advisory committee is
			 considered to be established by an agency, agencies, or the President if it is
			 formed, created, or organized under contract, other transactional authority,
			 cooperative agreement, grant, or otherwise at the request or direction of an
			 agency, agencies, or the President.</quote>.</text>
			</subsection><subsection id="H478F210F607743D2A07B90EED46444E4"><enum>(d)</enum><header>Advisory
			 committees containing special government employees</header><text>Section 4 of
			 the Federal Advisory Committee Act (5 U.S.C. App.) is further amended by adding
			 at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H1672CB3B546D495F9B2728BB23EEF17F" style="OLC">
					<subsection id="HB235E00573F149E59AC2787C9351061C"><enum>(e)</enum><header>Special
				government employees</header><text display-inline="yes-display-inline">Committee members appointed as special
				government employees shall not be considered full-time or permanent part-time
				officers or employees of the Federal Government for purposes of determining the
				applicability of this Act under section
				3(2).</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="H4DFCA42CBE814B7797E511BDBBE7D535"><enum>4.</enum><header>Increasing
			 transparency of advisory committees</header>
			<subsection id="H5252C20011A747128A96C4F198258595"><enum>(a)</enum><header>Information
			 requirement</header><text display-inline="yes-display-inline">Section 11 of the
			 Federal Advisory Committee Act (5 U.S.C. App.) is amended—</text>
				<paragraph id="H7695DDD457264282B80734E58D1F1142"><enum>(1)</enum><text>by striking the
			 section designation and heading and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HEA8BE71A4BD6407086256C111548EC07" style="OLC">
						<section id="H2783A6C728224C359231637AEF883071"><enum>11.</enum><header>Disclosure of
				information</header>
						</section><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H05D68DAE86F34914961841E293E0293B"><enum>(2)</enum><text>by redesignating
			 subsection (a) as subsection (d) and in that subsection—</text>
					<subparagraph id="HF6E8E3E5DA6443FEBFD9B01996C4B030"><enum>(A)</enum><text>by inserting the
			 following subsection heading: <quote><header-in-text level="subsection" style="OLC">Availability of Paper Copies of
			 Transcripts.—</header-in-text></quote>; and</text>
					</subparagraph><subparagraph id="H5B192D31053846E1B46CFCB7C8931359"><enum>(B)</enum><text>by inserting after
			 <quote>duplication,</quote> the following: <quote>paper </quote>;</text>
					</subparagraph></paragraph><paragraph id="H50FD8B8431844FC4B9229A3529CF5B94"><enum>(3)</enum><text>by striking
			 <quote>(b)</quote> and inserting <quote>(e)
			 <header-in-text level="subsection" style="OLC">Agency proceeding
			 defined</header-in-text>.—</quote>; and</text>
				</paragraph><paragraph id="H7A5E95596D074E30A66702EB0810DC6D"><enum>(4)</enum><text>by inserting
			 before subsection (d), as redesignated by paragraph (2), the following new
			 subsections:</text>
					<quoted-block display-inline="no-display-inline" id="HA322663387754951B574F5DDD44BB17E" style="OLC">
						<subsection id="H700041B348AC41C480E3FCFB65CBE666"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">With respect to each
				advisory committee, the head of the agency to which the advisory committee
				reports shall make publicly available in accordance with subsection (b) the
				following information:</text>
							<paragraph id="H359617B6E8084D37AEDC5B18BDD0A1AC"><enum>(1)</enum><text>The charter of the
				advisory committee.</text>
							</paragraph><paragraph id="HF080730AF8F94957AD789D900107A028"><enum>(2)</enum><text>A description of
				the process used to establish and appoint the members of the advisory
				committee, including the following:</text>
								<subparagraph id="H172EA3BE93054E27862B985C1C997DF5"><enum>(A)</enum><text>The process for
				identifying prospective members.</text>
								</subparagraph><subparagraph id="HCC2558CEEB1F410CA58569FF5F83D8DA"><enum>(B)</enum><text>The process of
				selecting members for balance of viewpoints or expertise.</text>
								</subparagraph><subparagraph id="HA536B7C2DD6A4FB296633BC8870867A1"><enum>(C)</enum><text display-inline="yes-display-inline">The reason each member was appointed to the
				committee.</text>
								</subparagraph><subparagraph id="HA2E61D73278142CCB9E193DA5F977914"><enum>(D)</enum><text>A justification of
				the need for representative members, if any.</text>
								</subparagraph></paragraph><paragraph id="H57FB23A01EBF49CFAC7461C66AF4BDD9"><enum>(3)</enum><text display-inline="yes-display-inline">A list of all current members, including,
				for each member, the following:</text>
								<subparagraph id="H4F7E52521B3C45BDABBDAAC842FCB332"><enum>(A)</enum><text>The name of any
				person or entity that nominated the member.</text>
								</subparagraph><subparagraph id="H526A70C231D1400AAB05C020EB9209DD"><enum>(B)</enum><text>Whether the member
				is designated as a special government employee or a representative.</text>
								</subparagraph><subparagraph id="H20FC9516DF38433BA3AA46D893B17271"><enum>(C)</enum><text>In the case of a
				representative, the individuals or entity whose viewpoint the member
				represents.</text>
								</subparagraph></paragraph><paragraph id="H6B86ECF39E4845AEAD1EA082856B441B"><enum>(4)</enum><text display-inline="yes-display-inline">A list of all members designated as special
				government employees for whom written certifications were made under
				<external-xref legal-doc="usc" parsable-cite="usc/18/208">section
				208(b)</external-xref> of title 18, United States Code, a copy of each such
				certification, a summary description of the conflict necessitating the
				certification, and the reason for granting the certification.</text>
							</paragraph><paragraph id="HD4CDA864A6254849B96CE248AB800CD4"><enum>(5)</enum><text display-inline="yes-display-inline">Any recusal agreement made by a member or
				any recusal known to the agency that occurs during the course of a meeting or
				other work of the committee.</text>
							</paragraph><paragraph id="HF9BADD2FDAA84847BC47E261FC56A5F0"><enum>(6)</enum><text display-inline="yes-display-inline">A summary of the process used by the
				advisory committee for making decisions.</text>
							</paragraph><paragraph id="HC7A33DA3D2B14BFEB0CEC53B293CFA42"><enum>(7)</enum><text>Transcripts or
				audio or video recordings of all meetings of the committee.</text>
							</paragraph><paragraph id="H548207C8A7AD4FEA8A7D7C9CE4CC1C8A"><enum>(8)</enum><text>Any written
				determination by the President or the head of the agency to which the advisory
				committee reports, pursuant to section 10(d), to close a meeting or any portion
				of a meeting and the reasons for such determination.</text>
							</paragraph><paragraph id="H6F2FE3AC7EF744E2A1EE16D42826AC62"><enum>(9)</enum><text>Notices of future
				meetings of the committee.</text>
							</paragraph><paragraph id="HAD758423A1B44F7CAC043C4A55FB7262"><enum>(10)</enum><text display-inline="yes-display-inline">Any additional information considered
				relevant by the head of the agency to which the advisory committee
				reports.</text>
							</paragraph></subsection><subsection id="HA01B231392FC45C197853FF5C7D6E8C0"><enum>(b)</enum><header> Manner of
				disclosure</header>
							<paragraph id="H0797FCE965354A99A7FC3B76514DD9E2"><enum>(1)</enum><text display-inline="yes-display-inline">Except as provided in paragraph (2), the
				head of an agency shall make the information required to be disclosed under
				this section available electronically on the official public internet site of
				the agency at least 15 calendar days before each meeting of an advisory
				committee. If the head of the agency determines that such timing is not
				practicable for any required information, he shall make the information
				available as soon as practicable but no later than 48 hours before the next
				meeting of the committee. An agency may withhold from disclosure any
				information that would be exempt from disclosure under
				<external-xref legal-doc="usc" parsable-cite="usc/5/552">section
				552</external-xref> of title 5, United States Code.</text>
							</paragraph><paragraph id="H1F255EA08D834963BC48057635BAEE97"><enum>(2)</enum><text display-inline="yes-display-inline">The head of an agency shall make available
				electronically, on the official public internet site of the agency, a
				transcript or audio or video recording of each advisory committee meeting as
				required by subsection (a)(6) not later than 30 calendar days after the
				meeting.</text>
							</paragraph></subsection><subsection id="HF81EA33523E44F54A3988F800E55E40B"><enum>(c)</enum><header>Provision of
				information by Administrator of General Services</header><text>The
				Administrator of General Services shall provide, on the official public
				internet site of the General Services Administration, electronic access to the
				information made available by each agency under this
				section.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H994AA2561FD7456C93C4D9A830E8D827"><enum>(b)</enum><header>Charter
			 filing</header><text display-inline="yes-display-inline">Section 9(f) of the
			 Federal Advisory Committee Act (5 U.S.C. App.), as redesignated by section 2,
			 is amended—</text>
				<paragraph id="H25174D3ECE304B4E806FEBA0F7E1BF13"><enum>(1)</enum><text>by striking
			 <quote>with (1) the Administrator,</quote> and all that follows through
			 <quote>, or</quote> and inserting <quote>(1) with the Administrator
			 and</quote>;</text>
				</paragraph><paragraph id="H00BFDCC7E58345A89524C43533C7B0F9"><enum>(2)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (I);</text>
				</paragraph><paragraph id="HD94E6169FB77417FB3307FEBC174D6B7"><enum>(3)</enum><text>by striking the
			 period and inserting a semicolon at the end of subparagraph (J); and</text>
				</paragraph><paragraph id="HBB5F78280B7C401397E84434D1412F34"><enum>(4)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 subparagraphs:</text>
					<quoted-block display-inline="no-display-inline" id="HBE81CA6D7249431EBE8E68CAAF2A5D8D" style="OLC">
						<subparagraph id="H636A011E2FCE4856AE35350A76746C1F" indent="up1"><enum>(K)</enum><text display-inline="yes-display-inline">the authority under which the committee is
				established;</text>
						</subparagraph><subparagraph id="H0BB3D64562B34E7E999BF418AC4450BD" indent="up1"><enum>(L)</enum><text display-inline="yes-display-inline">the estimated number of members and a
				description of the expertise needed to carry out the objectives of the
				committee;</text>
						</subparagraph><subparagraph id="HDF85D47F81074F46BD377F5DC3613F70" indent="up1"><enum>(M)</enum><text>a description of whether the committee
				will be composed of special government employees, representatives, or members
				from both categories; and</text>
						</subparagraph><subparagraph id="HE68112EFACD24297A3BDB29C954D5F07" indent="up1"><enum>(N)</enum><text>whether the committee has the
				authority to create subcommittees and if so, the agency official authorized to
				exercise such
				authority.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H166E7DE5CE724DF8A0D5655E78BDCBE9"><enum>5.</enum><header>Comptroller
			 General review and reports</header>
			<subsection id="HF5EA49EA1DD84AAFBD2BB3EFD919B3C5"><enum>(a)</enum><header>Review</header><text display-inline="yes-display-inline">The Comptroller General of the United
			 States shall review compliance by agencies with the Federal Advisory Committee
			 Act, as amended by this Act, including whether agencies are appropriately
			 appointing advisory committee members as either special government employees or
			 representatives.</text>
			</subsection><subsection id="H29104DA2D7E74142A6E03E70E08C235B"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">The Comptroller General shall submit to the
			 committees described in subsection (c) two reports on the results of the
			 review, as follows:</text>
				<paragraph id="H6F822148197143F6B0D238EC101E9D1A"><enum>(1)</enum><text>The first report
			 shall be submitted not later than one year after the date of promulgation of
			 regulations under section 2.</text>
				</paragraph><paragraph id="H7CD71D4E79D246D5914D84C10E269D94"><enum>(2)</enum><text>The second report
			 shall be submitted not later than five years after such date of promulgation of
			 regulations.</text>

			 committees described in this subsection are the Committee on Oversight and
			 Government Reform of the House of Representatives and the Committee on Homeland
			 Security and Governmental Affairs of the Senate.</text>
			</subsection></section><section id="H62F37C056D934F25A992BC3BCC119869"><enum>6.</enum><header>Application of
			 Federal Advisory Committee Act to Trade Advisory Committees</header><text display-inline="no-display-inline">Section 135(f)(2)(A) of the Trade Act of
			 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2155">19 U.S.C.
			 2155</external-xref>) is amended by striking <quote>subsection (a) and (b) of
			 sections 10 and 11 of the Federal Advisory Committee Act</quote> and inserting
			 <quote>subsections (a) and (b) of section 10 and subsections (a)(7), (a)(8),
			 (a)(9), (d), and (e) of section 11 of the Federal Advisory Committee
			 Act</quote>.</text>
		</section><section id="HB479C46B5B3942D9B063F3DFCE40E7E3"><enum>7.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 3 of the Federal Advisory Committee
			 Act (5 U.S.C. App.) is amended by adding at the end the following new
			 paragraph:</text>
			<quoted-block id="H70E08A9F19B94B09A5846C26F69DF422" style="OLC">
				<paragraph id="HF6D41E53706F4109983FEC3485AEA2CA"><enum>(5)</enum><text>The term
				<term>special Government employee</term> has the same meaning as in
				<external-xref legal-doc="usc" parsable-cite="usc/18/202">section
				202(a)</external-xref> of title 18, United States
				Code.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H1D121737EBA646C7977E081A86435155"><enum>8.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act shall take
			 effect 30 days after the date of the enactment of this Act.</text>
