		<section id="H4D9ECD3CF97F4829A5D430A23AC8D329" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Afghanistan-Pakistan Security and
			 Prosperity Enhancement Act</short-title></quote>.</text>
		</section><section id="H38DDFFD55416460CBA4B94DBCE4DAFA6"><enum>2.</enum><header>Definitions;
			 purposes</header>
			<subsection id="HB6E9AF6083D84392942299D1141D2043"><enum>(a)</enum><header>Definitions</header><text>In
			 this Act:</text>
				<paragraph id="H3D25E5229AAB4AA6AEDDE124A4FF24F5"><enum>(1)</enum><header>Agreement on
			 Textiles and Clothing</header><text>The term <term>Agreement on Textiles and
			 Clothing</term> means the Agreement on Textiles and Clothing referred to in
			 section 101(d)(4) of the Uruguay Round Agreements Act (19 U.S.C.
			 3511(d)(4)).</text>
				</paragraph><paragraph id="H31C29CC21BB7431D95BABEE914C4B97F"><enum>(2)</enum><header>Category;
			 textile and apparel category number</header><text>The terms
			 <term>category</term> and <term>textile and apparel category number</term> mean
			 the number assigned under the U.S. Textile and Apparel Category System of the
			 Office of Textiles and Apparel of the Department of Commerce, as listed in the
			 HTS under the applicable heading or subheading (as in effect on September 1,
			 2007).</text>
				</paragraph><paragraph display-inline="no-display-inline" id="HC6091D17F8724ED5B39A0D1C186E84B3"><enum>(3)</enum><header>Core labor
			 standards</header><text>The term <term>core labor standards</term>
			 means—</text>
					<subparagraph id="H1F27C7716A9A4A199ECD91D40967AE9B"><enum>(A)</enum><text>freedom of
			 association;</text>
					</subparagraph><subparagraph id="H061ED8FE8B2642CD93A99305372999C2"><enum>(B)</enum><text display-inline="yes-display-inline">the effective recognition of the right to
			 bargain collectively;</text>
					</subparagraph><subparagraph id="H5EF39BF5AC0E442B9558F6805BD199BE"><enum>(C)</enum><text>the elimination of
			 all forms of compulsory or forced labor;</text>
					</subparagraph><subparagraph id="HC2C558B26F0848F0AC47EB23A898395C"><enum>(D)</enum><text>the effective
			 abolition of child labor and a prohibition on the worst forms of child labor;
			 and</text>
					</subparagraph><subparagraph id="HDE65BCB008C94BC59171495082706EFE"><enum>(E)</enum><text>the elimination of
			 discrimination in respect of employment and occupation.</text>
					</subparagraph></paragraph><paragraph id="HE894F3A789B14429A06E8A05DEEE9584"><enum>(4)</enum><header>Entered</header><text>The
			 term <term>entered</term> means entered, or withdrawn from warehouse for
			 consumption, in the customs territory of the United States.</text>
				</paragraph><paragraph id="H888AC5737774430DB02F2C68B87B101E"><enum>(5)</enum><header>Entity</header><text>The
			 term <term>entity</term> means—</text>
					<subparagraph id="H03B65CA413EA48C6B9911EB9DAA72438"><enum>(A)</enum><text>a natural person,
			 corporation, company, business association, partnership, society, trust, any
			 other nongovernmental entity, organization, or group, whether or not for
			 profit;</text>
					</subparagraph><subparagraph id="H2E8CB549220C410F84550A56ACF7DC6A"><enum>(B)</enum><text>any governmental
			 entity or instrumentality of a government; and</text>
					</subparagraph><subparagraph id="HFFDF1306C6FF4A2396B54295FBCEEE02"><enum>(C)</enum><text>any successor,
			 subunit, or subsidiary of any entity described in subparagraph (A) or
			 (B).</text>
					</subparagraph></paragraph><paragraph id="H31F4326AC66C4F10A76704487C1E7FB2"><enum>(6)</enum><header>HTS</header><text>The
			 term <term>HTS</term> means the Harmonized Tariff Schedule of the United
			 States.</text>
				</paragraph><paragraph id="H9F5CECD6EE32482A9C2EE4DED7463B1E"><enum>(7)</enum><header>NAFTA</header><text>The
			 term <term>NAFTA</term> means the North American Free Trade Agreement concluded
			 between the United States, Mexico, and Canada on December 17, 1992.</text>
				</paragraph><paragraph id="HBC68871BB0984FBDBD0275A1426ABEBA"><enum>(8)</enum><header>Reconstruction
			 Opportunity Zone</header><text>The term <term>Reconstruction Opportunity
			 Zone</term> means any area that—</text>
					<subparagraph id="H1E6029D644FF4DA5A876F90267FF11E2"><enum>(A)</enum><text>solely encompasses
			 portions of the territory of—</text>
						<clause id="H9273F93A7A634529A96B8234F71E1FE4"><enum>(i)</enum><text>Afghanistan;
			 or</text>
						</clause><clause commented="no" id="HECF7D278B92E42C4BE35C608C6513A37"><enum>(ii)</enum><text>1 or more of the
			 following areas of Pakistan:</text>
							<subclause id="H8ABEB5A8E1DA475D8E6A1C2BF4E11C28"><enum>(I)</enum><text>the Federally
			 Administered Tribal Areas;</text>
							</subclause><subclause id="H50FF4EA359434B88AE3419898704C3C2"><enum>(II)</enum><text>areas of
			 Pakistan-administered Kashmir that the President determines were harmed by the
			 earthquake of October 8, 2005;</text>
							</subclause><subclause id="H7945A20FEE1D4DFCAC94A967BCE4DF7D"><enum>(III)</enum><text>areas of
			 Baluchistan that are within 100 miles of Pakistan’s border with Afghanistan;
			 and</text>
							</subclause><subclause id="HD55C074818F140B19039B36507037044"><enum>(IV)</enum><text>the North West
			 Frontier Province;</text>
							</subclause></clause></subparagraph><subparagraph id="H8AD3577C68984242AEE8E7922E58D8C9"><enum>(B)</enum><text>has been
			 designated by the competent authorities in Afghanistan or Pakistan, as the case
			 may be, as an area in which merchandise may be introduced without payment of
			 duty or excise tax; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6C5C873272B64E06AAC498BEC25DF035"><enum>(C)</enum><text>has been
			 designated by the President as a Reconstruction Opportunity Zone pursuant to
			 section 3(a).</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H11C90F89B3064DDCAD953D826E1EF542"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of this Act are—</text>
				<paragraph id="H7B1C3486357446F0955A48B9089CFA4E"><enum>(1)</enum><text>to stimulate
			 economic activity and development in Afghanistan and the border region of
			 Pakistan, critical fronts in the struggle against violent extremism;</text>
				</paragraph><paragraph id="HACFA4ED27F7A45E883C8F2F36AEC5175"><enum>(2)</enum><text>to reflect the
			 strong support that the United States has pledged to Afghanistan and Pakistan
			 for their sustained commitment in the global war on terrorism;</text>
				</paragraph><paragraph id="HE6D1B84C577045D089AEA82126B1DF39"><enum>(3)</enum><text>to support the
			 3-pronged United States strategy in Afghanistan and the border region of
			 Pakistan that leverages political, military, and economic tools, with
			 Reconstruction Opportunity Zones as a critical part of the economic component
			 of that strategy; and</text>
				</paragraph><paragraph id="H97E8DBD020B5403FAFDD790A535D2ECA"><enum>(4)</enum><text display-inline="yes-display-inline">to offer a vital opportunity to improve
			 livelihoods of indigenous populations of Reconstruction Opportunity Zones,
			 promote good governance, improve economic and commercial ties between the
			 people of Afghanistan and Pakistan, and extend and strengthen the Governments
			 of Afghanistan and Pakistan.</text>
				</paragraph></subsection></section><section id="H0767C4E0EB4E49BAB3CFB7D7CD675CBE"><enum>3.</enum><header>Designation of
			 Reconstruction Opportunity Zones</header>
			<subsection id="HADD5BC066CEE4879A6BEE743656AD549"><enum>(a)</enum><header>Authority To
			 designate</header><text>The President is authorized to designate an area within
			 Afghanistan or Pakistan described in section 2(a)(8) (A) and (B) as a
			 Reconstruction Opportunity Zone if the President determines that—</text>
				<paragraph id="HFCD398C6B47B45879CA3C5A1FFD0A347"><enum>(1)</enum><text>Afghanistan or
			 Pakistan, as the case may be, meets the eligibility criteria set forth in
			 subsection (b);</text>
				</paragraph><paragraph id="H9B03981AEC704F9F82250B178C954123"><enum>(2)</enum><text>Afghanistan or
			 Pakistan, as the case may be, meets the eligibility criteria set forth in
			 subsection (c) of section 502 of the Trade Act of 1974 (19 U.S.C. 2462(c)) for
			 designation as a beneficiary developing country under that section and is not
			 ineligible under subsection (b) of such section; and</text>
				</paragraph><paragraph id="HF7DDB8AECE7F4860BDEE76B68A30EB8E"><enum>(3)</enum><text>designation of the
			 area as a Reconstruction Opportunity Zone is appropriate taking into account
			 the factors listed in subsection (c).</text>
				</paragraph></subsection><subsection id="H673B976615D946BFA17719383CCF4099"><enum>(b)</enum><header>Eligibility
			 criteria</header><text>Afghanistan or Pakistan, as the case may be, meets the
			 eligibility criteria set forth in this subsection if that country—</text>
				<paragraph id="HF284C65DC35A436AABA8154AE72608A6"><enum>(1)</enum><text>has established,
			 or is making continual progress toward establishing—</text>
					<subparagraph id="H496895F1FEF54373B1CBCD0F1153EA35"><enum>(A)</enum><text>a market-based
			 economy that protects private property rights, incorporates an open rules-based
			 trading system, and minimizes government interference in the economy through
			 measures such as price controls, subsidies, and government ownership of
			 economic assets;</text>
					</subparagraph><subparagraph id="H1860A3C0CA3641C5957B8ED2508D3385"><enum>(B)</enum><text>the rule of law,
			 political pluralism, and the right to due process, a fair trial, and equal
			 protection under the law;</text>
					</subparagraph><subparagraph id="H62E16E19C161457E8D86B04E2A46325A"><enum>(C)</enum><text>economic policies
			 to—</text>
						<clause id="H7D3F331032B841359B01559C14276F93"><enum>(i)</enum><text>reduce
			 poverty;</text>
						</clause><clause id="H63C4AE9B73534F4F94F06658854274B4"><enum>(ii)</enum><text>increase the
			 availability of health care and educational opportunities;</text>
						</clause><clause id="H7B1D693DA95F4EBBA47E2A6B1C4E2C58"><enum>(iii)</enum><text>expand physical
			 infrastructure;</text>
						</clause><clause id="H57F22576DF794C66B7ED959D6364C4CE"><enum>(iv)</enum><text>promote the
			 development of private enterprise; and</text>
						</clause><clause id="H5A4EF6360F204AFE972D02D5AA3DA773"><enum>(v)</enum><text>encourage the
			 formation of capital markets through microcredit or other programs;</text>
						</clause></subparagraph><subparagraph id="H42DFF62705D74F0ABE0818ABE6D13E06"><enum>(D)</enum><text>a system to combat
			 corruption and bribery, such as ratifying and implementing the United Nations
			 Convention Against Corruption; and</text>
					</subparagraph><subparagraph display-inline="no-display-inline" id="HB8DF5C2623C44047BAE5C7DD8BBE2ECB"><enum>(E)</enum><text>protection of core
			 labor standards;</text>
					</subparagraph></paragraph><paragraph id="HD3013E78B0774C13B41EDB9D69940994"><enum>(2)</enum><text>is eliminating or
			 has eliminated barriers to trade and investment, including by—</text>
					<subparagraph id="HAFF07EC6F9A140169AA60539BB27620A"><enum>(A)</enum><text>providing national
			 treatment and measures to create an environment conducive to domestic and
			 foreign investment;</text>
					</subparagraph><subparagraph id="HA79D44E0F242486390C1B70FC3C21078"><enum>(B)</enum><text>protecting
			 intellectual property; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5D03D84B6DB34BECA75A690DD112850F"><enum>(C)</enum><text>resolving
			 bilateral trade and investment disputes;</text>
					</subparagraph></paragraph><paragraph id="H9795C3717DCA4AA095DA82064D00265E"><enum>(3)</enum><text>does not engage in
			 activities that undermine United States national security or foreign policy
			 interests;</text>
				</paragraph><paragraph id="H2AC5A664677A41ED8A207BF495902A81"><enum>(4)</enum><text>does not engage in
			 gross violations of internationally recognized human rights;</text>
				</paragraph><paragraph id="H7FB93A7672F54DAFA9C5C6728B612FE2"><enum>(5)</enum><text>does not provide
			 support for acts of international terrorism; and</text>
				</paragraph><paragraph id="HBD7027E41BA8409F8B66FE9B02A5C3DE"><enum>(6)</enum><text>cooperates in
			 international efforts to eliminate human rights violations and terrorist
			 activities.</text>
				</paragraph></subsection><subsection id="H0F782F63A7DC421FB4D8B41450438D8F"><enum>(c)</enum><header>Additional
			 factors</header><text>In determining whether to designate an area in
			 Afghanistan or Pakistan as a Reconstruction Opportunity Zone, the President
			 shall take into account—</text>
				<paragraph id="HC03BBD5A71784EDA9EABCA3EC9B235A2"><enum>(1)</enum><text>an expression by
			 the government of the country of its desire to have a particular area
			 designated as a Reconstruction Opportunity Zone under this Act;</text>
				</paragraph><paragraph id="H94303184D6A94BFEA2023C8A72217118"><enum>(2)</enum><text>whether the
			 government of the country has provided the United States with a monitoring and
			 enforcement plan outlining specific steps the country will take to cooperate
			 with the United States to—</text>
					<subparagraph id="HD794116848234B95958D729E03C08F0C"><enum>(A)</enum><text>facilitate
			 legitimate cross-border commerce;</text>
					</subparagraph><subparagraph id="H6D237A84BE034D14A48352883B579D7C"><enum>(B)</enum><text>ensure that
			 articles for which duty-free treatment is sought pursuant to this Act satisfy
			 the applicable rules of origin described in section 4 (c) and (d) or section 5
			 (c) and (d), whichever is applicable; and</text>
					</subparagraph><subparagraph id="H056A8CD9E58847D89C96283F84DBBFA1"><enum>(C)</enum><text>prevent unlawful
			 transshipment, as described in section 6(b)(4).</text>
					</subparagraph></paragraph><paragraph id="H43014F640FF84EDAA5A6FB7971E12A98"><enum>(3)</enum><text>the potential for
			 such designation to create local employment and to promote local and regional
			 economic development;</text>
				</paragraph><paragraph id="HD1A8C3A1D1934F54B7E31A613CC570A2"><enum>(4)</enum><text>the physical
			 security of the proposed Reconstruction Opportunity Zone;</text>
				</paragraph><paragraph id="H2FE43A62AA044B0FA58652ED303B9B10"><enum>(5)</enum><text>the economic
			 viability of the proposed Reconstruction Opportunity Zone, including—</text>
					<subparagraph id="HA87326F88F7C4C348862196724AF2EF1"><enum>(A)</enum><text>whether there are
			 commitments to finance economic activity proposed for the Reconstruction
			 Opportunity Zone; and</text>
					</subparagraph><subparagraph id="H2817B297F16E46BCAC673458948285C4"><enum>(B)</enum><text>whether there is
			 existing or planned infrastructure for power, water, transportation, and
			 communications in the area;</text>
					</subparagraph></paragraph><paragraph id="HB4812AD456F646B1A886D67F200ABBD0"><enum>(6)</enum><text>whether such
			 designation would be compatible with and contribute to the foreign policy and
			 national security objectives of the United States, taking into account the
			 information provided under subsection (d); and</text>
				</paragraph><paragraph id="H3E5909482B04422699F9746B88772835"><enum>(7)</enum><text>the views of
			 interested persons submitted pursuant to subsection (e).</text>
				</paragraph></subsection><subsection id="H5ECE51668C7A4CC884EB43AB4247FA9E"><enum>(d)</enum><header>Information
			 relating to compatibility with and contribution to foreign policy and national
			 security objectives of the United States</header><text>In determining whether
			 designation of a Reconstruction Opportunity Zone would be compatible with and
			 contribute to the foreign policy and national security objectives of the United
			 States in accordance with subsection (c)(6), the President shall take into
			 account whether Afghanistan or Pakistan, as the case may be, has provided the
			 United States with a plan outlining specific steps it will take to verify the
			 ownership and nature of the activities of entities to be located in the
			 proposed Reconstruction Opportunity Zone. The specific steps outlined in a
			 country’s plan shall include a mechanism to annually register each entity by a
			 competent authority of the country and—</text>
				<paragraph id="H16D6B56E7F244AF796068A6A4D5B24EF"><enum>(1)</enum><text>to collect from
			 each entity operating in, or proposing to operate in, a Reconstruction
			 Opportunity Zone, information including—</text>
					<subparagraph id="H2731D7830A81412297743DD4EBA4E13E"><enum>(A)</enum><text>the name and
			 address of the entity;</text>
					</subparagraph><subparagraph id="H25D002310A854CBFBE6191E21C5A7654"><enum>(B)</enum><text>the name and
			 location of all facilities owned or operated by the entity that are operating
			 in or proposed to be operating in a Reconstruction Opportunity Zone;</text>
					</subparagraph><subparagraph id="H548E57FE570246D18824818016798277"><enum>(C)</enum><text>the name,
			 nationality, date and place of birth, and position title of each person who is
			 an owner, director, or officer of the entity; and</text>
					</subparagraph><subparagraph id="H55C2CCEE1AAB460E96E0DD33E6232DD9"><enum>(D)</enum><text>the nature of the
			 activities of each entity;</text>
					</subparagraph></paragraph><paragraph id="HAF3C49A3EE184E71B8B41C78B2110481"><enum>(2)</enum><text>to update the
			 information required under paragraph (1) as changes occur; and</text>
				</paragraph><paragraph id="H7FE8EC6B4CAA412FA34065347E2C4A68"><enum>(3)</enum><text>to provide such
			 information promptly to the Secretary of State.</text>
				</paragraph></subsection><subsection id="H0ED07A227215411D9E8943AD86824BDC"><enum>(e)</enum><header>Opportunity for
			 public comment</header><text>Before the President designates an area as a
			 Reconstruction Opportunity Zone pursuant to subsection (a), the President shall
			 afford an opportunity for interested persons to submit their views concerning
			 the designation.</text>
			</subsection><subsection id="HF00019A6DB7D473C8EE8A7B60A0F0FC5"><enum>(f)</enum><header>Notification to
			 Congress</header><text>Before the President designates an area as a
			 Reconstruction Opportunity Zone pursuant to subsection (a), the President shall
			 notify Congress of the President’s intention to make the designation, together
			 with the reasons for making the designation.</text>
			</subsection></section><section id="H8BF29E31127544F4A4B9910F10D039EB"><enum>4.</enum><header>Duty-free
			 treatment for certain nontextile and nonapparel articles</header>
			<subsection id="H973A631B25E24E5A91139B57E33F4713"><enum>(a)</enum><header>In
			 general</header><text>The President is authorized to proclaim duty-free
			 treatment for—</text>
				<paragraph id="H89224518233446F3A6C1D11D7B060E6F"><enum>(1)</enum><text>any article from a
			 Reconstruction Opportunity Zone that the President has designated as an
			 eligible article under section 503(a)(1)(A) of the Trade Act of 1974 (19 U.S.C.
			 2463(a)(1)(A));</text>
				</paragraph><paragraph id="HAEA72195945E424BB9D3DA7EEF45CDFC"><enum>(2)</enum><text>any article from a
			 Reconstruction Opportunity Zone located in Afghanistan that the President has
			 designated as an eligible article under section 503(a)(1)(B) of the Trade Act
			 of 1974 (19 U.S.C. 2463(a)(1)(B)); or</text>
				</paragraph><paragraph id="HF842EB457F82459798B4A9028FAF2B6E"><enum>(3)</enum><text>any article from a
			 Reconstruction Opportunity Zone that is not a textile or apparel article,
			 regardless of whether the article has been designated as an eligible article
			 under section 503(a)(1)(A) or (B) of the Trade Act of 1974 (19 U.S.C.
			 2463(a)(1) (A) or (B)), if, after receiving the advice of the International
			 Trade Commission pursuant to subsection (b), the President determines that such
			 article is not import-sensitive in the context of imports from a Reconstruction
			 Opportunity Zone.</text>
				</paragraph></subsection><subsection id="HE4897ED2102940789289049A6F192F0C"><enum>(b)</enum><header>Advice
			 concerning certain eligible articles</header><text>Before proclaiming duty-free
			 treatment for an article pursuant to subsection (a)(3), the President shall
			 publish in the Federal Register and provide the International Trade Commission
			 a list of articles which may be considered for such treatment. The provisions
			 of sections 131 through 134 of the Trade Act of 1974 (19 U.S.C. 2151 through
			 2154) shall apply to any designation under subsection (a)(3) in the same manner
			 as such sections apply to action taken under section 123 of the Trade Act of
			 1974 (19 U.S.C. 2133) regarding a proposed trade agreement.</text>
			</subsection><subsection id="H9550D49EF8C142FBA422532C05953469"><enum>(c)</enum><header>General rules of
			 origin</header>
				<paragraph id="HD1E9E9F1E3C7459C8CABA606CCBFC76D"><enum>(1)</enum><header>In
			 general</header><text>The duty-free treatment proclaimed with respect to an
			 article described in paragraph (1) or (3) of subsection (a) shall apply to any
			 article subject to such proclamation which is the growth, product, or
			 manufacture of 1 or more Reconstruction Opportunity Zones if—</text>
					<subparagraph id="HD8E910622A2442CFB0E666B265D57DF5"><enum>(A)</enum><text>that article is
			 imported directly from a Reconstruction Opportunity Zone into the customs
			 territory of the United States; and</text>
					</subparagraph><subparagraph id="H578602C7FF0E4BE29DCEA9B434B21DDE"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H9063323DD48D4F6B9F081907E69768AE"><enum>(i)</enum><text>with respect to an
			 article that is an article of a Reconstruction Opportunity Zone in Pakistan,
			 the sum of—</text>
							<subclause id="H390D95109FAA4247AC85BFA0F3D523C7" indent="up1"><enum>(I)</enum><text>the cost or value of the materials
			 produced in 1 or more Reconstruction Opportunity Zones in Pakistan or
			 Afghanistan,</text>
							</subclause><subclause id="HC2CDAB160C564206A18883112CF23A25" indent="up1"><enum>(II)</enum><text>the direct costs of processing
			 operations performed in 1 or more Reconstruction Opportunity Zones in Pakistan
			 or Afghanistan, and</text>
							</subclause><subclause id="H5D63E3BA5AF9438091C0BC9BFADAEF83" indent="up1"><enum>(III)</enum><text>the cost or value of materials produced
			 in the United States, determined in accordance with paragraph (2),</text>
							</subclause><continuation-text continuation-text-level="clause" indent="subparagraph">is not less than 35 percent of the appraised value
			 of the article at the time it is entered into the United States; or</continuation-text></clause><clause id="HC6BEAE4EA5304B26BB84E931385182CF" indent="up1"><enum>(ii)</enum><text>with respect to an article that is
			 an article of a Reconstruction Opportunity Zone in Afghanistan, the sum
			 of—</text>
							<subclause id="H304EA95ED1F7426D928B74CAF8991F2B"><enum>(I)</enum><text>the cost or value of the materials
			 produced in 1 or more Reconstruction Opportunity Zones in Pakistan or
			 Afghanistan,</text>
							</subclause><subclause id="HF6FA05EC62E24F59BA9869FA14A7E622"><enum>(II)</enum><text>the cost or value of the materials
			 produced in 1 or more countries that are members of the South Asian Association
			 for Regional Cooperation,</text>
							</subclause><subclause id="HB529157BF6E84AC0921E59A0600318EB"><enum>(III)</enum><text>the direct costs of processing
			 operations performed in 1 or more Reconstruction Opportunity Zones in Pakistan
			 or Afghanistan, and</text>
							</subclause><subclause id="H89DFAA3BEEDB4046927E1DAB0E18FE46"><enum>(IV)</enum><text>the cost or value of materials produced
			 in the United States, determined in accordance with paragraph (2),</text>
							</subclause><continuation-text continuation-text-level="clause" indent="subparagraph">is not less than 35 percent of the appraised value
			 of the article at the time it is entered into the United States.</continuation-text></clause></subparagraph></paragraph><paragraph id="HFD67D6DB03FB4B2393290F00E2FFEB92"><enum>(2)</enum><header>Determination of
			 35 percent for articles from reconstruction opportunity zones in Pakistan and
			 Afghanistan</header><text>If the cost or value of materials produced in the
			 customs territory of the United States is included with respect to an article
			 described in paragraph (1)(B), for purposes of determining the 35-percent
			 appraised value requirement under clause (i) or (ii) of paragraph (1)(B), not
			 more than 15 percent of the appraised value of the article at the time the
			 article is entered into the United States may be attributable to the cost or
			 value of such United States materials.</text>
				</paragraph></subsection><subsection id="H159EBB20869742D889F99E13342C045F"><enum>(d)</enum><header>Rules of origin
			 for certain articles of Reconstruction Opportunity Zones in
			 afghanistan</header>
				<paragraph id="H6F2BA50F30DB4516B4C4DA01C81B7648"><enum>(1)</enum><header>In
			 general</header><text>The duty-free treatment proclaimed with respect to an
			 article described in paragraph (2) of subsection (a) shall apply to any article
			 subject to such proclamation which is the growth, product, or manufacture of 1
			 or more Reconstruction Opportunity Zones in Afghanistan if—</text>
					<subparagraph id="H613DC46DCF8542209D1EB1847CC85607"><enum>(A)</enum><text>that article is
			 imported directly from a Reconstruction Opportunity Zone in Afghanistan into
			 the customs territory of the United States; and</text>
					</subparagraph><subparagraph id="HDB4A2E94849141F8B5988EDEF1C6BC76"><enum>(B)</enum><text>with respect to
			 that article, the sum of—</text>
						<clause id="H5CA6D2884E934774B563B596070ACC41"><enum>(i)</enum><text>the
			 cost or value of the materials produced in 1 or more Reconstruction Opportunity
			 Zones in Afghanistan,</text>
						</clause><clause id="H0FC9E36CB0EC42E19E0D8F61FC40F9FC"><enum>(ii)</enum><text>the
			 cost or value of the materials produced in 1 or more countries that are members
			 of the South Asian Association for Regional Cooperation,</text>
						</clause><clause id="HBE7EBFB831724C6BA5A0197E88845BE3"><enum>(iii)</enum><text>the direct costs
			 of processing operations performed in 1 or more Reconstruction Opportunity
			 Zones in Afghanistan, and</text>
						</clause><clause id="H495279E5ABB14784B63BFF94746DD113"><enum>(iv)</enum><text>the
			 cost or value of materials produced in the United States, determined in
			 accordance with paragraph (2),</text>
						</clause><continuation-text continuation-text-level="subparagraph">is not
			 less than 35 percent of the appraised value of the product at the time it is
			 entered into the United States.</continuation-text></subparagraph></paragraph><paragraph id="HAA02C7DC65024766BBD4816BCECFBB44"><enum>(2)</enum><header>Determination of
			 35 percent for articles from reconstruction opportunity zones in pakistan and
			 afghanistan</header><text>If the cost or value of materials produced in the
			 customs territory of the United States is included with respect to an article
			 described in paragraph (1)(B), for purposes of determining the 35-percent
			 appraised value requirement under paragraph (1)(B), not more than 15 percent of
			 the appraised value of the article at the time the article is entered into the
			 United States may be attributable to the cost or value of such United States
			 materials.</text>
				</paragraph></subsection><subsection id="H9723BF54C3114A738E106166C2F0DFA2"><enum>(e)</enum><header>Exclusions</header><text>An
			 article shall not be treated as the growth, product, or manufacture of 1 or
			 more Reconstruction Opportunity Zones, and no material shall be included for
			 purposes of determining the 35-percent appraised value requirement under
			 subsection (c)(1) or (d)(1), by virtue of having merely undergone—</text>
				<paragraph id="H87FECB77CB4C4C65B01D1B2979DF6108"><enum>(1)</enum><text>simple combining
			 or packaging operations; or</text>
				</paragraph><paragraph id="H60055144C555499A886427597B21FC32"><enum>(2)</enum><text>mere dilution with
			 water or with another substance that does not materially alter the
			 characteristics of the article or material.</text>
				</paragraph></subsection><subsection id="HD550E75139574D11B180130C0C92815A"><enum>(f)</enum><header>Direct costs of
			 processing operations</header>
				<paragraph id="H2F2A072611624C559EFB68B94CCA671C"><enum>(1)</enum><header>In
			 general</header><text>As used in subsections (c)(1)(B)(i)(II),
			 (c)(1)(B)(ii)(III), and (d)(1)(B)(iii), the term <term>direct costs of
			 processing operations</term> includes, but is not limited to—</text>
					<subparagraph id="H844F33A09B9C43ED898E2316B81F39CA"><enum>(A)</enum><text>all actual labor
			 costs involved in the growth, production, manufacture, or assembly of the
			 article, including—</text>
						<clause id="H837D3726B9454817AFB32FD4E61E52D4"><enum>(i)</enum><text>fringe
			 benefits;</text>
						</clause><clause id="H0E105DD448564165B1726CFB4EC29BE0"><enum>(ii)</enum><text>on-the-job
			 training; and</text>
						</clause><clause id="H976FAB9D705F4F5FBCA3CFD7BFE68ABB"><enum>(iii)</enum><text>costs of
			 engineering, supervisory, quality control, and similar personnel; and</text>
						</clause></subparagraph><subparagraph id="H82AE7A0C4E0F4784BAA63160F21D28EA"><enum>(B)</enum><text>dies, molds,
			 tooling, and depreciation on machinery and equipment which are allocable to the
			 article.</text>
					</subparagraph></paragraph><paragraph id="H46607D4070AC4274AB5F3D666A6B404D"><enum>(2)</enum><header>Excluded
			 costs</header><text>As used in subsections (c)(1)(B)(i)(II),
			 (c)(1)(B)(ii)(III), and (d)(1)(B)(iii), the term <term>direct costs of
			 processing operations</term> does not include costs which are not directly
			 attributable to the article or are not costs of manufacturing the article, such
			 as—</text>
					<subparagraph id="H004A856C2EF04100A50FD10AF5760BB1"><enum>(A)</enum><text>profit; and</text>
					</subparagraph><subparagraph id="H5D672C875DF647B69550081DCDAEF539"><enum>(B)</enum><text>general expenses
			 of doing business which are either not allocable to the article or are not
			 related to the growth, production, manufacture, or assembly of the article,
			 such as administrative salaries, casualty and liability insurance, advertising,
			 and salesmen’s salaries, commissions, or expenses.</text>
					</subparagraph></paragraph></subsection><subsection id="H308F300EBD814161B99CF4BA2E05CD66"><enum>(g)</enum><header>Regulations</header><text>The
			 Secretary of the Treasury, after consultation with the United States Trade
			 Representative, shall prescribe such regulations as may be necessary to carry
			 out this section. The regulations may provide that, in order for an article to
			 be eligible for duty-free treatment under this section, the article—</text>
				<paragraph id="HC3711E7477E0415BB6DF8795C1D2C20D"><enum>(1)</enum><text>shall be wholly
			 the growth, product, or manufacture of 1 or more Reconstruction Opportunity
			 Zones; or</text>
				</paragraph><paragraph id="HE87559EDAD134311999EDBA2213BA76B"><enum>(2)</enum><text>shall be a new or
			 different article of commerce which has been grown, produced, or manufactured
			 in 1 or more Reconstruction Opportunity Zones.</text>
				</paragraph></subsection></section><section id="HD5A948ACD86C4033A811E0619FBDBC58"><enum>5.</enum><header>Duty-free
			 treatment for certain textile and apparel articles</header>
			<subsection id="H012299C2E6CF4BD1819F6C9BCA4864E7"><enum>(a)</enum><header> Duty-free
			 treatment</header><text>The President is authorized to proclaim duty-free
			 treatment for any textile or apparel article described in subsection (b),
			 if—</text>
				<paragraph id="HBD2FE2CAC9B84B34A3E2E533736D81CB"><enum>(1)</enum><text>the article is a
			 covered article described in subsection (b); and</text>
				</paragraph><paragraph id="H1DED96156AA0406A8A7CD86AE4A64810"><enum>(2)</enum><text>the President
			 determines that the country in which the Reconstruction Opportunity Zone is
			 located has satisfied the requirements set forth in section 6.</text>
				</paragraph></subsection><subsection id="HD8A9007FBE0043948E9B9E03741D9450"><enum>(b)</enum><header>Covered
			 articles</header><text>A covered article described in this subsection is an
			 article in 1 of the following categories:<italic></italic></text>
				<paragraph commented="no" id="H7D68548E003F497C8C8ECD6B2CDE3A82"><enum>(1)</enum><header>Articles of
			 Reconstruction Opportunity Zones</header><text>An article that is the product
			 of 1 or more Reconstruction Opportunity Zones and falls within the scope of 1
			 of the following textile and apparel category numbers, as set forth in the HTS
			 (as in effect on September 1, 2007):</text>

			 in subsection (b) only if the article is imported directly into the customs
			 territory of the United States from a Reconstruction Opportunity Zone
			 and—</text>
					<subparagraph id="HE0C6A14D2944494F9CC0116123A7C47E"><enum>(A)</enum><text>the article is
			 wholly the growth, product, or manufacture of 1 or more Reconstruction
			 Opportunity Zones;</text>

			 yarn, thread, twine, cordage, rope, cable, or braiding, and—</text>

			 articles</header><text>Notwithstanding paragraph (1)(D) and except as provided

			 paragraph, a textile or apparel article that is wholly formed on seamless
			 knitting machines or by hand-knitting in 1 or more Reconstruction Opportunity
			 Zones shall be considered to meet the rules of origin of this
			 subsection.</text>
					</subparagraph><subparagraph id="HBE68C187BC8245CD90DA53152CA37503"><enum>(C)</enum><header>Certain dyed and
			 printed textiles and textile articles</header><text>Notwithstanding paragraph
			 (1)(D), an article classifiable under subheading 6117.10, 6213.00, 6214.00,
			 6302.22, 6302.29, 6302.52, 6302.53, 6302.59, 6302.92, 6302.93, 6302.99,
			 6303.92, 6303.99, 6304.19, 6304.93, 6304.99, 9404.90.85, or 9404.90.95 of the
			 HTS, except for an article classifiable under 1 of such subheadings as of
			 cotton or of wool or consisting of fiber blends containing 16 percent or more
			 by weight of cotton, shall be considered to meet the rules of origin of this
			 subsection if the fabric in the article is both dyed and printed in 1 or more
			 Reconstruction Opportunity Zones, and such dyeing and printing is accompanied
			 by 2 or more of the following finishing operations: bleaching, shrinking,
			 fulling, napping, decating, permanent stiffening, weighting, permanent
			 embossing, or moireing.</text>
					</subparagraph><subparagraph id="H756C145C7B83450D98C8A82340F7AB0D"><enum>(D)</enum><header>Fabrics of silk,
			 cotton, man-made fiber, or vegetable fiber</header><text>Notwithstanding
			 paragraph (1)(C), a fabric classifiable under the HTS as of silk, cotton,
			 man-made fiber, or vegetable fiber shall be considered to meet the rules of
			 origin of this subsection if the fabric is both dyed and printed in 1 or more
			 Reconstruction Opportunity Zones, and such dyeing and printing is accompanied
			 by 2 or more of the following finishing operations: bleaching, shrinking,
			 fulling, napping, decating, permanent stiffening, weighting, permanent
			 embossing, or moireing.</text>
					</subparagraph></paragraph></subsection><subsection id="H3CEE9703AEF04B6CA610ECE3AC96E0F7"><enum>(d)</enum><header>Rules of origin
			 for covered articles that are products of 1 or more Reconstruction Opportunity
			 Zones in afghanistan</header>
				<paragraph id="HEDB32F4D7DE14C83916A09BF4F5E4762"><enum>(1)</enum><header>General
			 rules</header><text>Duty-free treatment may be proclaimed for an article listed
			 in paragraph (2) of subsection (b) only if the article is imported directly
			 into the customs territory of the United States from a Reconstruction
			 Opportunity Zone in Afghanistan and—</text>
					<subparagraph id="H7A6105E029B342848231D330D641CF9C"><enum>(A)</enum><text>the article is
			 wholly the growth, product, or manufacture of 1 or more Reconstruction
			 Opportunity Zones in Afghanistan,</text>
					</subparagraph><subparagraph id="H1E8767041A5D4193B508CA0E944DD154"><enum>(B)</enum><text>the article is a
			 yarn, thread, twine, cordage, rope, cable, or braiding, and—</text>
						<clause id="HA571098B0F6449BE86DA067054C60A6D"><enum>(i)</enum><text>the
			 constituent staple fibers are spun in, or</text>
						</clause><clause id="H9FDF117DC51F48E2A2ECF470449F5ED3"><enum>(ii)</enum><text>the
			 continuous filament fiber is extruded in,</text>
						</clause><continuation-text continuation-text-level="subparagraph">1 or more
			 Reconstruction Opportunity Zones in Afghanistan;</continuation-text></subparagraph><subparagraph id="HA103522E69DF414C9E3D8FB929295338"><enum>(C)</enum><text>the article is a
			 fabric, including a fabric classifiable under chapter 59 of the HTS, and the
			 constituent fibers, filaments, or yarns are woven, knitted, needled, tufted,
			 felted, entangled, or transformed by any other fabric-making process in 1 or
			 more Reconstruction Opportunity Zones in Afghanistan; or</text>
					</subparagraph><subparagraph id="H05639EF534584624A59C0B31831758D4"><enum>(D)</enum><text>the article is any
			 other textile or apparel article that is cut (or knit-to-shape) and sewn or
			 otherwise assembled in 1 or more Reconstruction Opportunity Zones in
			 Afghanistan from its component pieces.</text>
					</subparagraph></paragraph><paragraph id="H72E84B9FC1904F4E95925FF82F3A78FE"><enum>(2)</enum><header>Special
			 rules</header>
					<subparagraph commented="no" id="H73F4AD93D8764A3F969309BDC02B1B09"><enum>(A)</enum><header>Certain made-up
			 articles, textile articles in the piece, and certain other textiles and textile
			 articles</header><text>Notwithstanding paragraph (1)(D) and except as provided
			 in subparagraphs (C) and (D) of this paragraph, subparagraph (A), (B), or (C)
			 of paragraph (1), as appropriate, shall determine whether a good that is
			 classifiable under 1 of the following headings or subheadings of the HTS shall
			 be considered to meet the rules of origin of this subsection: 5609, 5807, 5811,
			 6209.20.50.40, 6213, 6214, 6301, 6302, 6303, 6304, 6305, 6306, 6307.10,
			 6307.90, 6308, and 9404.90.</text>
					</subparagraph><subparagraph id="HA070766975C24732AC8E2B7EEDAF6EB4"><enum>(B)</enum><header>Certain
			 knit-to-shape textiles and textile articles</header><text>Notwithstanding
			 paragraph (1)(D) and except as provided in subparagraphs (C) and (D) of this
			 paragraph, a textile or apparel article that is wholly formed on seamless
			 knitting machines or by hand-knitting in 1 or more Reconstruction Opportunity
			 Zones in Afghanistan shall be considered to meet the rules of origin of this
			 subsection.</text>
					</subparagraph><subparagraph id="H40AE34403C6848339447E80EB493E779"><enum>(C)</enum><header>Certain dyed and
			 printed textiles and textile articles</header><text>Notwithstanding paragraph
			 (1)(D), an article classifiable under subheading 6117.10, 6213.00, 6214.00,
			 6302.22, 6302.29, 6302.52, 6302.53, 6302.59, 6302.92, 6302.93, 6302.99,
			 6303.92, 6303.99, 6304.19, 6304.93, 6304.99, 9404.90.85, or 9404.90.95 of the
			 HTS, except for an article classifiable under 1 of such subheadings as of
			 cotton or of wool or consisting of fiber blends containing 16 percent or more
			 by weight of cotton, shall be considered to meet the rules of origin of this
			 subsection if the fabric in the article is both dyed and printed in 1 or more
			 Reconstruction Opportunity Zones in Afghanistan, and such dyeing and printing
			 is accompanied by 2 or more of the following finishing operations: bleaching,
			 shrinking, fulling, napping, decating, permanent stiffening, weighting,
			 permanent embossing, or moireing.</text>
					</subparagraph><subparagraph id="H26BA7815E0684BF18F7173830E149608"><enum>(D)</enum><header>Fabrics of silk,
			 cotton, man-made fiber or vegetable fiber</header><text>Notwithstanding
			 paragraph (1)(C), a fabric classifiable under the HTS as of silk, cotton,
			 man-made fiber, or vegetable fiber shall be considered to meet the rules of
			 origin of this subsection if the fabric is both dyed and printed in 1 or more
			 Reconstruction Opportunity Zones in Afghanistan, and such dyeing and printing
			 is accompanied by 2 or more of the following finishing operations: bleaching,
			 shrinking, fulling, napping, decating, permanent stiffening, weighting,
			 permanent embossing, or moireing.</text>
					</subparagraph></paragraph></subsection><subsection id="HC222C11065F3400B97470974A8A3E9D3"><enum>(e)</enum><header>Regulations</header><text>The
			 Secretary of the Treasury, after consultation with the United States Trade
			 Representative, shall prescribe such regulations as may be necessary to carry
			 out this section.</text>
			</subsection></section><section id="HAD062DC3B7FA49E2B6CF2AFF973AD31F"><enum>6.</enum><header>Protections
			 against unlawful transshipment</header>
			<subsection id="H038AED94F58A4C76868D45AF6C3CB4AD"><enum>(a)</enum><header>Duty-free
			 treatment conditioned on enforcement measures</header>
				<paragraph id="HB3AA465ADF5F463FAE524F6F0C0BAFAB"><enum>(1)</enum><header>In
			 general</header><text>The duty-free treatment described in section 5 shall not
			 be provided to covered articles that are imported from a Reconstruction
			 Opportunity Zone in a country unless the President determines that country
			 meets the following criteria:</text>
					<subparagraph id="HF5056D7F2C28474AB3B2CF40D84F1017"><enum>(A)</enum><text>The country has
			 adopted an effective visa or electronic certification system, domestic laws,
			 and enforcement procedures applicable to covered articles to prevent unlawful
			 transshipment of the articles and the use of false documents relating to the
			 importation of the articles into the United States.</text>
					</subparagraph><subparagraph id="HED6E7655293040FEB7F1F0B9D63DF707"><enum>(B)</enum><text>The country has
			 enacted legislation or promulgated regulations that would permit U.S. Customs
			 and Border Protection verification teams to have the access necessary to
			 investigate thoroughly allegations of unlawful transshipment through such
			 country.</text>
					</subparagraph><subparagraph id="H0F4D9E2310FF4AAC910B6D4F31822003"><enum>(C)</enum><text>The country agrees
			 to provide U.S. Customs and Border Protection with a monthly report on
			 shipments of covered articles from each facility engaged in the production of
			 those articles in a Reconstruction Opportunity Zone in that country.</text>
					</subparagraph><subparagraph id="H1526A2D5BF4E48C39374DD5DC021D138"><enum>(D)</enum><text>The country will
			 cooperate fully with the United States to address and take action necessary to
			 prevent circumvention, as described in article 5 of the Agreement on Textiles
			 and Clothing.</text>
					</subparagraph><subparagraph id="HC2C12FAB68674DF9BEF14B934520B950"><enum>(E)</enum><text>The country agrees
			 to require each entity engaged in the production or manufacture of a covered
			 article in a Reconstruction Opportunity Zone in that country to register with
			 the competent government authority, to provide that authority with the
			 following information, and to update that information as changes occur:</text>
						<clause id="HA332028DCA264E919ED89615DF51C7ED"><enum>(i)</enum><text>The
			 name and address of the entity, including the location of all textile or
			 apparel facilities owned or operated by that entity in Afghanistan or
			 Pakistan.</text>
						</clause><clause id="HEE3C661CB833442496C5841F94472111"><enum>(ii)</enum><text>The
			 telephone number, facsimile number, and electronic mail address of the
			 entity.</text>
						</clause><clause id="H425D9B6BA4944D0D8D54F761FC6AE1E8"><enum>(iii)</enum><text>The names and
			 nationalities of the owners, directors, and corporate officers, and their
			 positions within the entity.</text>
						</clause><clause id="H5693DF7554F54C28A977E158C3EEF847"><enum>(iv)</enum><text>The
			 number of employees the entity employs and their occupations.</text>
						</clause><clause id="HFDDEF69F80E944D4A8F40F2405BE5BC7"><enum>(v)</enum><text>A
			 general description of the covered articles the entity produces and the
			 entity's production capacity.</text>
						</clause><clause id="H232EA26EC7A64A098731585E0A76463E"><enum>(vi)</enum><text>The
			 number and type of machines the entity uses to produce textile or apparel
			 articles at each facility.</text>
						</clause><clause id="HA005BBB4E1FC4F408E802C3A93D2EB64"><enum>(vii)</enum><text>The approximate
			 number of hours the machines operate per week.</text>
						</clause><clause id="H90A1B95084864CBCBC5B6FB3E291E2E8"><enum>(viii)</enum><text>The identity of
			 any supplier to the entity of textile or apparel goods, or fabrics, yarns, or
			 fibers used in the production of textile or apparel goods.</text>
						</clause><clause id="HE536D9C372234165A0A95A164CB2020D"><enum>(ix)</enum><text>The
			 name of, and contact information for, each of the entity’s customers in the
			 United States.</text>
						</clause></subparagraph><subparagraph id="H756D7BAF43ED4B61A3AB5393C9540019"><enum>(F)</enum><text>The country agrees
			 to provide to U.S. Customs and Border Protection on a timely basis all of the
			 information received by the competent government authority in accordance with
			 subparagraph (E) and to provide U.S. Customs and Border Protection with an
			 annual update of that information.</text>
					</subparagraph><subparagraph id="HCD82CF26F2C8413B994134A801BD8864"><enum>(G)</enum><text>The country agrees
			 to require that all producers and exporters of covered articles in a
			 Reconstruction Opportunity Zone in that country maintain complete records of
			 the production and the export of covered articles, including materials used in
			 the production, for at least 5 years after the production or export (as the
			 case may be).</text>
					</subparagraph><subparagraph id="H42A265A3F8324A79A9AD02A1EC6EE839"><enum>(H)</enum><text>The country agrees
			 to provide, on a timely basis, at the request of U.S. Customs and Border
			 Protection, documentation establishing the eligibility of covered articles for
			 duty-free treatment under section 5.</text>
					</subparagraph></paragraph><paragraph id="H02ACF54D9CF541989633351EBBBC34F5"><enum>(2)</enum><header>Documentation
			 establishing eligibility of articles for duty-free treatment</header><text>For
			 purposes of paragraph (1)(H), documentation establishing the eligibility of a
			 covered article for duty-free treatment under section 5 includes documentation
			 such as production records, information relating to the place of production,
			 the number and identification of the types of machinery used in production, the
			 number of workers employed in production, and certification from both the
			 manufacturer and the exporter.</text>
				</paragraph></subsection><subsection id="HDD8249F147654D4D9BF62D1D9017D935"><enum>(b)</enum><header>Customs
			 procedures and enforcement</header>
				<paragraph id="H12042CAAD2A04F30BB32E69B053B503C"><enum>(1)</enum><header>In
			 general</header>
					<subparagraph id="HE1B360B63F83485582D91D29D333609E"><enum>(A)</enum><header>Regulations</header><text>The
			 Secretary of the Treasury, after consultation with the United States Trade
			 Representative, shall promulgate regulations setting forth customs procedures
			 similar in all material respects to the requirements of article 502(1) of the
			 NAFTA as implemented pursuant to United States law, which shall apply to any
			 importer that claims duty-free treatment for an article under section 5.</text>
					</subparagraph><subparagraph id="H63143C97BF8C4C41841B6CE69C5A5AB9"><enum>(B)</enum><header>Determination</header><text>In
			 order for articles produced in a Reconstruction Opportunity Zone to qualify for
			 the duty-free treatment under section 5, there shall be in effect a
			 determination by the President that Afghanistan or Pakistan, as the case may
			 be—</text>
						<clause id="H53D17DB3185C422B87E39EE33FBF7CCA"><enum>(i)</enum><text>has
			 implemented and follows, or</text>
						</clause><clause id="H63A05D8E7E4742E394387197AD89A916"><enum>(ii)</enum><text>is
			 making substantial progress toward implementing and following,</text>
						</clause><continuation-text continuation-text-level="subparagraph">procedures and requirements
			 similar in all material respects to the relevant procedures and requirements
			 under chapter 5 of the NAFTA.</continuation-text></subparagraph></paragraph><paragraph commented="no" id="H0B0CD8A24DD145CD9AA26CBC4D633755"><enum>(2)</enum><header>Certificate of
			 origin</header><text display-inline="yes-display-inline">A certificate of
			 origin that otherwise would be required pursuant to the provisions of paragraph
			 (1) shall not be required in the case of an article imported under section 5 if
			 such certificate of origin would not be required under article 503 of the
			 NAFTA, as implemented pursuant to United States law, if the article were
			 imported from Mexico.</text>
				</paragraph><paragraph id="H98D9B23B5CF042EC9FE85973DF7035A6"><enum>(3)</enum><header>Penalties</header><text>If
			 the President determines, based on sufficient evidence, that an entity has
			 engaged in unlawful transshipment described in paragraph (4), the President
			 shall deny for a period of 5 years beginning on the date of the determination
			 all benefits under section 5 to the entity, any successor of the entity, and
			 any other entity owned, operated, or controlled by the principals of the
			 entity.</text>
				</paragraph><paragraph id="HDF32920E0ED24FD986A43F04258265D5"><enum>(4)</enum><header>Unlawful
			 transshipment described</header><text>For purposes of this section, unlawful
			 transshipment occurs when duty-free treatment for a covered article has been
			 claimed on the basis of material false information concerning the country of
			 origin, manufacture, processing, or assembly of the article or any of its
			 components. For purposes of the preceding sentence, false information is
			 material if disclosure of the true information would mean or would have meant
			 that the article is or was ineligible for duty-free treatment under section
			 5.</text>
				</paragraph><paragraph commented="no" id="HD26DB12DD731436CB0A38B0435994B7B"><enum>(5)</enum><header>Monitoring and
			 reports to congress</header><text display-inline="yes-display-inline">U.S.
			 Customs and Border Protection shall monitor and the Commissioner responsible
			 for U.S. Customs and Border Protection shall submit to Congress, not later than
			 March 31 of each year, a report on the effectiveness of the visa or electronic
			 certification systems and the implementation of legislation and regulations
			 described in subsection (a) and on measures taken by Afghanistan and Pakistan
			 to prevent circumvention as described in article 5 of the Agreement on Textile
			 and Clothing.</text>
				</paragraph></subsection><subsection commented="no" id="H8CA411324E5140B49725910E99C4976A"><enum>(c)</enum><header>Additional
			 customs enforcement</header><text display-inline="yes-display-inline">U.S.
			 Customs and Border Protection shall—</text>
				<paragraph commented="no" id="H366B289FA1AF45F0B992958148276D11"><enum>(1)</enum><text>make available
			 technical assistance to Afghanistan and Pakistan—</text>
					<subparagraph commented="no" id="HEFEB19EF151B4AA0BD5B7F69AFAC7086"><enum>(A)</enum><text>in the development
			 and implementation of visa or electronic certification systems, legislation,
			 and regulations described in subsection (a)(1)(A) and (B); and</text>
					</subparagraph><subparagraph commented="no" id="H3E96DE6F54934CF693E16D5B5EF04681"><enum>(B)</enum><text>to train their
			 officials in anti-transshipment enforcement;</text>
					</subparagraph></paragraph><paragraph commented="no" id="HC77A6BE1D2234505BBBE2CA9457CA68F"><enum>(2)</enum><text>send production
			 verification teams to Afghanistan and Pakistan as necessary; and</text>
				</paragraph><paragraph commented="no" id="H3B5AB89C525643B6964C8E4DAC6706D0"><enum>(3)</enum><text>to the extent
			 feasible, place Afghanistan and Pakistan on the Electronic Visa (ELVIS) program
			 or relevant e-certification program.</text>
				</paragraph></subsection><subsection commented="no" id="HB54D86699744448AAF2A7CD1044B3230"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">To carry out
			 subsection (c), there are authorized to be appropriated to U.S. Customs and
			 Border Protection $10,000,000 for each of the fiscal years 2010 through
			 2023.</text>
			</subsection></section><section display-inline="no-display-inline" id="H99CD53280F0D40D990D860D98ABEAD38"><enum>7.</enum><header>Technical
			 assistance, capacity building, compliance assessment, and remediation
			 program</header>
			<subsection id="H796007A455B149ADBD7E15434C77B360"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph id="H46369B1121EF447FB9E7D1F44067638A"><enum>(1)</enum><header>Appropriate
			 congressional committees</header><text display-inline="yes-display-inline">The
			 term <term>appropriate congressional committees</term> means the Committee on
			 Finance of the Senate and the Committee on Ways and Means of the House of
			 Representatives.</text>
				</paragraph><paragraph commented="no" id="H366E459462DB43478DA90C2DAA7D5767"><enum>(2)</enum><header>Textile or
			 apparel exporting enterprise</header><text>The term <term>textile or apparel
			 exporting enterprise</term> means a producer of textile or apparel articles
			 that is located in a Reconstruction Opportunity Zone and is seeking or
			 receiving any benefits under section 5.</text>
				</paragraph></subsection><subsection id="H5C208FD446E047DFAC27215D0EA79D96"><enum>(b)</enum><header>Eligibility</header>
				<paragraph id="HFE4CF0FF707443BDB59E1495BBB991C8"><enum>(1)</enum><header>Presidential
			 certification of compliance by Afghanistan or Pakistan with
			 requirements</header><text display-inline="yes-display-inline">Upon the
			 expiration of the 16-month period beginning on the date on which the President
			 notifies Congress of the President’s intention to designate an area within
			 Afghanistan or Pakistan, as the case may be, as a Reconstruction Opportunity
			 Zone under section 3, each Reconstruction Opportunity Zone in Afghanistan or
			 Pakistan, as the case may be, shall continue to receive duty-free treatment
			 under this Act only if the President determines and certifies to Congress that
			 Afghanistan or Pakistan, as the case may be—</text>
					<subparagraph id="H49D62CA40E864E0C8D074FB09D342CA2"><enum>(A)</enum><text>has implemented
			 the requirements set forth in subsections (c) and (d); and</text>
					</subparagraph><subparagraph id="H4987A83B36204ED0B5920561FB20A533"><enum>(B)</enum><text display-inline="yes-display-inline">has agreed to require textile or apparel
			 exporting enterprises to participate in the program described in subsection (d)
			 and has developed a system to ensure participation in such program by such
			 enterprises, including by developing and maintaining the registry described in
			 subsection (c)(2)(A).</text>
					</subparagraph></paragraph><paragraph id="H3285AC5BF5184D8FAD34C0C34071D204"><enum>(2)</enum><header>Extension</header><text display-inline="yes-display-inline">The President may extend the period for
			 compliance by Afghanistan or Pakistan under paragraph (1) if the
			 President—</text>
					<subparagraph id="H9BE9D29E7874411293AB4ACC738CC026"><enum>(A)</enum><text display-inline="yes-display-inline">determines that Afghanistan or Pakistan, as
			 the case may be, has made a good faith effort toward such compliance and has
			 agreed to take additional steps to come into full compliance that are
			 satisfactory to the President; and</text>
					</subparagraph><subparagraph commented="no" id="HFC1E6E2270EF473DAEB81B30A394EEE9"><enum>(B)</enum><text display-inline="yes-display-inline">provides to the appropriate congressional
			 committees, not later than 6 months after the last day of the 16-month period
			 specified in paragraph (1), and every 6 months thereafter, a report identifying
			 the steps that Afghanistan or Pakistan, as the case may be, has agreed to take
			 to come into full compliance and the progress made over the preceding 6-month
			 period in implementing such steps.</text>
					</subparagraph></paragraph><paragraph id="HF6EC2F87EB2747049D5676D24B4D7CC6"><enum>(3)</enum><header>Continuing
			 compliance</header>
					<subparagraph id="HB9E74F9CC2564FFA9CF8E35ABF9340B5"><enum>(A)</enum><header>Termination of
			 preferential treatment</header><text display-inline="yes-display-inline">If,
			 after making a certification under paragraph (1), the President determines that
			 Afghanistan or Pakistan is no longer meeting the requirements set forth in
			 paragraph (1), the President shall terminate the eligibility of Afghanistan or
			 Pakistan, as the case may be, provided under section 3(b), unless the President
			 determines, after consulting with the appropriate congressional committees,
			 that meeting such requirements is not practicable because of extraordinary
			 circumstances existing in Afghanistan or Pakistan, as the case may be, when the
			 determination is made.</text>
					</subparagraph><subparagraph id="H625D6A6919C146C5A20B0B13AD3B1F7B"><enum>(B)</enum><header>Subsequent
			 compliance</header><text display-inline="yes-display-inline">If the President,
			 after terminating eligibility of Afghanistan or Pakistan, as the case may be,
			 under subparagraph (A), determines that Afghanistan or Pakistan, as the case
			 may be, is meeting the requirements set forth in paragraph (1), the President
			 shall reinstate the eligibility of Afghanistan or Pakistan, as the case may be,
			 under section 3(b).</text>
					</subparagraph></paragraph></subsection><subsection id="H441D1F28407F4807980BF2A977421D7F"><enum>(c)</enum><header>Labor
			 official</header>
				<paragraph id="HC0A43800678B4569805E5FACC656A5A4"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The requirement under
			 this subsection is that Afghanistan or Pakistan, as the case may be, has
			 designated a labor official within the national government that—</text>
					<subparagraph id="H1E849918D8C349B9A486FDC9912DA457"><enum>(A)</enum><text display-inline="yes-display-inline">reports directly to the President of
			 Afghanistan or Pakistan, as the case may be;</text>
					</subparagraph><subparagraph id="H0CE43440177543F9A8D6EC0E8E5E8064"><enum>(B)</enum><text display-inline="yes-display-inline">is chosen by the President of Afghanistan
			 or Pakistan, as the case may be, in consultation with labor unions and industry
			 associations; and</text>
					</subparagraph><subparagraph id="H5872B61E6ABC4A6191D8BE73DE98A8ED"><enum>(C)</enum><text>is vested with the
			 authority to perform the functions described in paragraph (2).</text>
					</subparagraph></paragraph><paragraph id="HECCD356174464FA28A0ED945673FD501"><enum>(2)</enum><header>Functions</header><text display-inline="yes-display-inline">The functions of the labor official shall
			 include—</text>
					<subparagraph id="H4D2B2DF23DE044BB855AC20AA11D5D26"><enum>(A)</enum><text display-inline="yes-display-inline">developing and maintaining a registry of
			 textile or apparel exporting enterprises, and developing, in consultation and
			 coordination with any other appropriate officials of the Government of
			 Afghanistan or Pakistan, as the case may be, a system to ensure participation
			 by such enterprises in the program described in subsection (d);</text>
					</subparagraph><subparagraph id="HFD45E382FAD047C9ADD01B7FEED53752"><enum>(B)</enum><text>overseeing the
			 implementation of the program described in subsection (d);</text>
					</subparagraph><subparagraph id="HC5417FED85C84296A3284292740BFF4D"><enum>(C)</enum><text display-inline="yes-display-inline">receiving and investigating comments from
			 any interested party regarding the conditions described in subsection (d)(2) in
			 facilities of textile or apparel exporting enterprises listed in the registry
			 described in subparagraph (A) and, where appropriate, referring such comments
			 or the result of such investigations to the appropriate authorities of
			 Afghanistan or Pakistan, as the case may be, or to the entity operating the
			 program described in subsection (d);</text>
					</subparagraph><subparagraph id="HAA856CEB678643D4B93DCC0F019B9B47"><enum>(D)</enum><text display-inline="yes-display-inline">assisting, in consultation and coordination
			 with any other appropriate authorities Afghanistan or Pakistan, as the case may
			 be, textile or apparel exporting enterprises listed in the registry described
			 in subparagraph (A) in meeting the conditions set forth in subsection (d)(2);
			 and</text>
					</subparagraph><subparagraph commented="no" id="HAA3E5CBB99844097AADCD41B0A1CDE02"><enum>(E)</enum><text display-inline="yes-display-inline">coordinating, with the assistance of the
			 entity operating the program described in subsection (d), a tripartite
			 committee comprised of appropriate representatives of government agencies,
			 employers, and workers, as well as other relevant interested parties, for the
			 purposes of evaluating progress in implementing the program described in
			 subsection (d), and consulting on improving core labor standards and working
			 conditions in the textile and apparel sector in Afghanistan or Pakistan, as the
			 case may be, and on other matters of common concern relating to such core labor
			 standards and working conditions.</text>
					</subparagraph></paragraph></subsection><subsection id="HD7904C70481B497EB8E5711D6F2DC7A9"><enum>(d)</enum><header>Technical
			 assistance, capacity building, compliance assessment, and remediation
			 program</header>
				<paragraph id="H9053A8022BD14449A3E34C74DC4D1FB0"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The requirement under
			 this subsection is that Afghanistan or Pakistan, as the case may be, in
			 cooperation with the International Labor Organization, has established a
			 program meeting the requirements under paragraph (3)—</text>
					<subparagraph id="H2FEA12518B9E4FDF8F62D049F24261AA"><enum>(A)</enum><text display-inline="yes-display-inline">to assess compliance by textile or apparel
			 exporting enterprises listed in the registry described in subsection (c)(2)(A)
			 with the conditions set forth in paragraph (2) and to assist such enterprises
			 in meeting such conditions; and</text>
					</subparagraph><subparagraph id="H649382BE3B7840A681747578E37120F3"><enum>(B)</enum><text display-inline="yes-display-inline">to provide assistance to improve the
			 capacity of the Government of Afghanistan or Pakistan, as the case may
			 be—</text>
						<clause id="H8F03789A29684CEAA628381609DB7BB6"><enum>(i)</enum><text display-inline="yes-display-inline">to inspect facilities of textile or apparel
			 exporting enterprises listed in the registry described in subsection (c)(2)(A);
			 and</text>
						</clause><clause id="H9EFBDD6174054171955853A54DF115A6"><enum>(ii)</enum><text>to
			 enforce national labor laws and resolve labor disputes, including through
			 measures described in paragraph (5).</text>
						</clause></subparagraph></paragraph><paragraph id="HC9C917097CBA46FA8E7825501BCA8138"><enum>(2)</enum><header>Conditions
			 described</header><text>The conditions referred to in paragraph (1) are—</text>
					<subparagraph id="H4BB1684D5E9E4F4EB4D09FCA36AA1135"><enum>(A)</enum><text>compliance with
			 core labor standards; and</text>
					</subparagraph><subparagraph id="H62D9C0572A7C48C4BF323726A8B71D1A"><enum>(B)</enum><text display-inline="yes-display-inline">compliance with the labor laws of
			 Afghanistan or Pakistan, as the case may be, that relate directly to core labor
			 standards and to ensuring acceptable conditions of work with respect to minimum
			 wages, hours of work, and occupational health and safety.</text>
					</subparagraph></paragraph><paragraph id="H0EDAB12DC962422E86C3A57E176B4D24"><enum>(3)</enum><header>Requirements</header><text display-inline="yes-display-inline">The requirements for the program are that
			 the program—</text>
					<subparagraph id="HEBBAD56E916A4F8086D310EF20E6090C"><enum>(A)</enum><text>be operated by the
			 International Labor Organization (or any subdivision, instrumentality, or
			 designee thereof), which prepares the annual reports described in paragraph
			 (4);</text>
					</subparagraph><subparagraph id="HC990F94CBB494CC887729CAFDE99E9AA"><enum>(B)</enum><text display-inline="yes-display-inline">be developed through a participatory
			 process that includes the labor official described in subsection (c) of
			 Afghanistan or Pakistan, as the case may be, and appropriate representatives of
			 government agencies, employers, and workers;</text>
					</subparagraph><subparagraph id="H925F8BF10D3A4E54B54B0B1915DA929A"><enum>(C)</enum><text display-inline="yes-display-inline">assess compliance by each textile or
			 apparel exporting enterprise listed in the registry described in subsection
			 (c)(2)(A) with the conditions set forth in paragraph (2) and identify any
			 deficiencies by such enterprise with respect to meeting such conditions,
			 including by—</text>
						<clause id="H26B54D78BC6946529D398B5A0FB98AA5"><enum>(i)</enum><text>conducting site
			 visits to facilities of the enterprise;</text>
						</clause><clause id="H75E99BF0ECE840F1A99FC0B73A467211"><enum>(ii)</enum><text>conducting
			 confidential interviews with workers and management of the facilities of the
			 enterprise; and</text>
						</clause><clause id="H2FA2701A1EEB49189EA764F10DB82480"><enum>(iii)</enum><text>providing to
			 management and workers, and where applicable, worker organizations in the
			 enterprise, on a confidential basis—</text>
							<subclause id="HFAF6B9B6FA314DB3BA3E9C2E108ECF91"><enum>(I)</enum><text>the results of the
			 assessment carried out under this subparagraph; and</text>
							</subclause><subclause id="HA324BB92769C452FA09BDAFCFA5184D1"><enum>(II)</enum><text>specific
			 suggestions for remediating any such deficiencies;</text>
							</subclause></clause></subparagraph><subparagraph id="H509DE6D7F6DA4021831591ADC277C966"><enum>(D)</enum><text>assist the textile
			 or apparel exporting enterprise in remediating any deficiencies identified
			 under subparagraph (C);</text>
					</subparagraph><subparagraph id="H47AE5E01BFA04B4A81B3D149265DD270"><enum>(E)</enum><text>conduct prompt
			 follow-up site visits to the facilities of the textile or apparel exporting
			 enterprise to assess progress on remediation of any deficiencies identified
			 under subparagraph (C); and</text>
					</subparagraph><subparagraph id="HC54327672A444B119526E70701EF1524"><enum>(F)</enum><text>provide training
			 to workers and management of the textile or apparel exporting enterprise, and
			 where appropriate, to other persons or entities, to promote compliance with
			 paragraph (2).</text>
					</subparagraph></paragraph><paragraph id="H5FAB8D2279FF4231841EE72F00BBCD98"><enum>(4)</enum><header>Annual
			 report</header><text display-inline="yes-display-inline">The annual reports
			 referred to in paragraph (3)(A) are a report, by the entity operating the
			 program, that is published (and available to the public in a readily accessible
			 manner) on an annual basis, beginning 1 year after Afghanistan or Pakistan, as
			 the case may be, has implemented the program under this subsection, covering
			 the preceding 1-year period, and that includes the following:</text>
					<subparagraph id="HCB4E806B07E042DD8FF38AE5B66868A5"><enum>(A)</enum><text display-inline="yes-display-inline">The name of each textile or apparel
			 exporting enterprise listed in the registry described in subsection (c)(2)(A)
			 that has been identified as having met the conditions under paragraph
			 (2).</text>
					</subparagraph><subparagraph id="HFB2CADD70DF64104917D025A2C3F5074"><enum>(B)</enum><text display-inline="yes-display-inline">The name of each textile or apparel
			 exporting enterprise listed in the registry described in subsection (c)(2)(A)
			 that has been identified as having deficiencies with respect to the conditions
			 under paragraph (2), and has failed to remedy such deficiencies.</text>
					</subparagraph><subparagraph id="H948C3D9DF70F406998A75032B5B9814E"><enum>(C)</enum><text>For each textile
			 or apparel exporting enterprise listed under subparagraph (B)—</text>
						<clause id="H7671115BFFD44D4EBFCE7384F55AD2EA"><enum>(i)</enum><text>a
			 description of the deficiencies found to exist and the specific suggestions for
			 remediating such deficiencies made by the entity operating the program;</text>
						</clause><clause id="H7D634BF9C4F0438C81977769AD327FFA"><enum>(ii)</enum><text>a
			 description of the efforts by the enterprise to remediate the deficiencies,
			 including a description of assistance provided by any entity to assist in such
			 remediation; and</text>
						</clause><clause id="H6A57BA473FCB493C9008F7CDB77D4525"><enum>(iii)</enum><text>with respect to
			 deficiencies that have not been remediated, the amount of time that has elapsed
			 since the deficiencies were first identified in a report under this
			 subparagraph.</text>
						</clause></subparagraph><subparagraph id="HC8D8113D680C4118B63B286EFD49B555"><enum>(D)</enum><text>For each textile
			 or apparel exporting enterprise identified as having deficiencies with respect
			 to the conditions described under paragraph (2) in a prior report under this
			 paragraph, a description of the progress made in remediating such deficiencies
			 since the submission of the prior report, and an assessment of whether any
			 aspect of such deficiencies persists.</text>
					</subparagraph></paragraph><paragraph id="H323242B3072543EF9B1B25F86B83AD0B"><enum>(5)</enum><header>Capacity
			 building</header><text display-inline="yes-display-inline">The assistance to
			 the Government of Afghanistan or Pakistan referred to in paragraph (1)(B) shall
			 include programs—</text>
					<subparagraph id="H025380DC13EF4CEAA291CD1503004424"><enum>(A)</enum><text display-inline="yes-display-inline">to review the labor laws and regulations of
			 Afghanistan or Pakistan, as the case may be, and to develop and implement
			 strategies for improving labor laws and regulations;</text>
					</subparagraph><subparagraph id="H2A6F5E68299E43BEB507F0B58F6B1DFD"><enum>(B)</enum><text>to develop
			 additional strategies for facilitating protection of core labor standards and
			 providing acceptable conditions of work with respect to minimum wages, hours of
			 work, and occupational safety and health, including through legal, regulatory,
			 and institutional reform;</text>
					</subparagraph><subparagraph commented="no" id="H06712A45F04545709531AFA5EE82D0B0"><enum>(C)</enum><text display-inline="yes-display-inline">to increase awareness of core labor
			 standards and national labor laws;</text>
					</subparagraph><subparagraph id="H7095E635D0674D1B8F1BDD506380DEF1"><enum>(D)</enum><text display-inline="yes-display-inline">to promote consultation and cooperation
			 between government representatives, employers, worker representatives, and
			 United States importers on matters relating to core labor standards and
			 national labor laws;</text>
					</subparagraph><subparagraph id="H0AB950C9D77F41AB98BC054FAAB2E17D"><enum>(E)</enum><text display-inline="yes-display-inline">to assist the labor official of Afghanistan
			 or Pakistan, as the case may be, designated pursuant to subsection (c) in
			 establishing and coordinating operation of the committee described in
			 subsection (c)(2)(E);</text>
					</subparagraph><subparagraph id="H13BD357C7C1C49F8B6437B348FC81458"><enum>(F)</enum><text display-inline="yes-display-inline">to assist worker representatives in more
			 fully and effectively advocating on behalf of their members; and</text>
					</subparagraph><subparagraph id="H14DF0C088EFC467E9BCD22A405CF0077"><enum>(G)</enum><text>to provide
			 on-the-job training and technical assistance to labor inspectors, judicial
			 officers, and other relevant personnel to build their capacity to enforce
			 national labor laws and resolve labor disputes.</text>
					</subparagraph></paragraph></subsection><subsection id="H2405C41ED6D443F0B800AE866E861E5C"><enum>(e)</enum><header>Compliance with
			 eligibility criteria</header>
				<paragraph id="H7AC2943858D84F059A469F80829419BF"><enum>(1)</enum><header>Country
			 compliance with core labor standards eligibility criteria</header><text>In
			 making a determination of whether Afghanistan or Pakistan is meeting the
			 requirement set forth in section 3(b)(1)(E) relating to core labor standards,
			 the President shall consider the reports produced under subsection
			 (d)(4).</text>
				</paragraph><paragraph id="HEAABBD8F4B5B41958D3A759CDCCB11AD"><enum>(2)</enum><header>Enterprise
			 eligibility</header>
					<subparagraph id="HA31979A44B0A418B9F4E5BD861A01E2E"><enum>(A)</enum><header>Identification
			 of producers</header><text display-inline="yes-display-inline">Beginning 2
			 years after the President makes the certification under subsection (b)(1), the
			 President shall identify on a biennial basis whether a textile or apparel
			 exporting enterprise listed in the registry described in subsection (c)(2)(A)
			 has failed to comply with core labor standards and with the labor laws of
			 Afghanistan or Pakistan, as the case may be, that directly relate to and are
			 consistent with core labor standards.</text>
					</subparagraph><subparagraph id="H4E70B2A06D5C4A6B96007F1482E21A42"><enum>(B)</enum><header>Assistance to
			 enterprises; withdrawal, etc., of preferential treatment</header><text display-inline="yes-display-inline">For each textile or apparel exporting
			 enterprise that the President identifies under subparagraph (A), the President
			 shall seek to assist such enterprise in coming into compliance with core labor
			 standards and with the labor laws of Afghanistan or Pakistan, as the case may
			 be, that directly relate to and are consistent with core labor standards. If
			 such efforts fail, the President shall withdraw, suspend, or limit the
			 application of preferential treatment under section 5 to articles of such
			 enterprise.</text>
					</subparagraph><subparagraph id="HA0E76F70303E479A8F83CE9729DA6FC7"><enum>(C)</enum><header>Reinstating
			 preferential treatment</header><text display-inline="yes-display-inline">If the
			 President, after withdrawing, suspending, or limiting the application of
			 preferential treatment under subparagraph (B) to articles of a textile or
			 apparel exporting enterprise, determines that such enterprise is complying with
			 core labor standards and with the labor laws of Afghanistan or Pakistan, as the
			 case may be, that directly relate to and are consistent with core labor
			 standards, the President shall reinstate the application of preferential
			 treatment under section 5 to the articles of the enterprise.</text>
					</subparagraph><subparagraph id="HF126867E513B4680BEC9A216BCF963D3"><enum>(D)</enum><header>Consideration of
			 reports</header><text display-inline="yes-display-inline">In making the
			 identification under subparagraph (A) and the determination under subparagraph
			 (C), the President shall consider the reports made available under subsection
			 (d)(4).</text>
					</subparagraph></paragraph></subsection><subsection id="H69D06FDCBB0847BA9092970C4D90E7C3"><enum>(f)</enum><header>Reports by the
			 president</header>
				<paragraph id="H9BE5C62DDF104EE5BED85B398D3C23FC"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than one
			 year after the date of the enactment of this Act, and annually thereafter, the
			 President shall transmit to the appropriate congressional committees a report
			 on the implementation of this section during the preceding 1-year
			 period.</text>
				</paragraph><paragraph id="H4982B42BF07B449BB4808EFAC7D86A1E"><enum>(2)</enum><header>Matters to be
			 included</header><text>Each report required by paragraph (1) shall include the
			 following:</text>
					<subparagraph id="H1E9F0ED7C55B45EEB96021F82B7B34A1"><enum>(A)</enum><text>An explanation of
			 the efforts of Afghanistan and Pakistan, the President, and the International
			 Labor Organization to carry out this section.</text>
					</subparagraph><subparagraph id="HD59E7E04402B4E1A997F9D4740C455D3"><enum>(B)</enum><text>A summary of each
			 report produced under subsection (d)(4) during the preceding 1-year period and
			 a summary of the findings contained in such report.</text>
					</subparagraph><subparagraph id="H3CF2448901554CA39262830BF1380151"><enum>(C)</enum><text display-inline="yes-display-inline">Identifications made under subsection
			 (e)(2)(A) and determinations made under subsection (e)(2)(C).</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="H5FD66A6D9ACF4354A47BCB24E9563F71"><enum>(g)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to carry out this section $20,000,000 for the
			 period beginning on October 1, 2009, and ending on September 30, 2014.</text>
			</subsection></section><section id="H1E0126F0ACCD4E13BD832F38A136CCA5"><enum>8.</enum><header>Petition
			 process</header><text display-inline="no-display-inline">Any interested party
			 may file a request to have the status of Afghanistan or Pakistan reviewed with
			 respect to the eligibility requirements listed in this Act, and the President
			 shall provide for this purpose the same procedures as those that are provided
			 for reviewing the status of eligible beneficiary developing countries with
			 respect to the designation criteria listed in subsections (b) and (c) of
			 section 502 of the Trade Act of 1974 (19 U.S.C. 2642 (b) and (c)).</text>
		</section><section id="HE918FF63F9394AC3ADDA2C3FD2BD7FE9"><enum>9.</enum><header>Limitations on
			 providing duty-free treatment</header>
			<subsection id="HC9489F7764A3494CB58065C11EAEB016"><enum>(a)</enum><header>In
			 general</header>
				<paragraph id="H6975F2D8ECCC4C06A1075271731D0159"><enum>(1)</enum><header>Proclamation</header><text>Except
			 as provided in paragraph (2), and subject to subsection (b) and the conditions
			 described in sections 3 through 7, the President shall exercise the President’s
			 authority under this Act, and the President shall proclaim any duty-free
			 treatment pursuant to that authority.</text>
				</paragraph><paragraph id="H9E7586306D1B40E893858070546B18A2"><enum>(2)</enum><header>Waiver</header><text>The
			 President may waive the application of duty-free treatment under this Act with
			 respect to Reconstruction Opportunity Zones in Afghanistan and Pakistan or
			 enterprises receiving benefits under section 4 or 5 if the President determines
			 that providing such treatment is inconsistent with the national interests of
			 the United States. In making such determination, the President shall
			 consider—</text>
					<subparagraph id="H534197012E174767A1EF21F28FE4641B"><enum>(A)</enum><text>obligations of the
			 United States under international agreements;</text>
					</subparagraph><subparagraph id="H0C25663376EF4EB896BE2106048422ED"><enum>(B)</enum><text>the national
			 economic interests of the United States; and</text>
					</subparagraph><subparagraph id="HE80A6D2D90AB4784A43FCC39737ADD4C"><enum>(C)</enum><text>the foreign policy
			 interests of the United States, including the economic development of
			 Afghanistan and the border region of Pakistan.</text>
					</subparagraph></paragraph></subsection><subsection id="HC4C299E10E5E4CC0B254284E057F93A0"><enum>(b)</enum><header>Withdrawal,
			 suspension, or limitation of duty-free treatment</header><text display-inline="yes-display-inline">The President may withdraw, suspend, or
			 limit the application of the duty-free treatment proclaimed under this Act. In
			 taking any action to withdraw, suspend, or limit duty-free treatment with
			 respect to Reconstruction Opportunity Zones in Afghanistan and Pakistan or
			 enterprises receiving benefits under section 4 or 5, the President shall
			 consider the factors set forth in section 3 (b) and (c) of this Act, and
			 section 502 (b) and (c) of the Trade Act of 1974 (19 U.S.C. 2462 (b) and (c)).
			 In taking any action to withdraw, suspend, or limit duty-free treatment with
			 respect to enterprises receiving benefits under section 4 or 5, the President
			 shall consider the information described in section 3(d) relating to
			 verification of the ownership and nature of the activities of such enterprises
			 and any other relevant information the President determines to be
			 appropriate.</text>
			</subsection><subsection id="HC8F6E0F1EA6845138A80003B211AA434"><enum>(c)</enum><header>Notice to
			 Congress</header><text>The President shall advise Congress—</text>
				<paragraph commented="no" id="H0DA943528EB9425DB41EBABBD6C77AE3"><enum>(1)</enum><text display-inline="yes-display-inline">of any action the President takes to
			 withdraw, suspend, or limit the application of duty-free treatment with respect
			 to Reconstruction Opportunity Zones in Afghanistan or Pakistan or enterprises
			 receiving benefits under section 4 or 5; and</text>
				</paragraph><paragraph id="HF1338C856B684EB6939DB44884E33FC5"><enum>(2)</enum><text>if either
			 Afghanistan or Pakistan fails to adequately take the actions described in
			 section 3 (b) and (c) of this Act or section 502 (b) and (c) of the Trade Act
			 of 1974.</text>
				</paragraph></subsection></section><section id="H05EA2055459147E6B36F2BA686F81E96"><enum>10.</enum><header>Termination of
			 benefits</header><text display-inline="no-display-inline">Duty-free treatment
			 provided under this Act shall remain in effect through September 30,
			 2024.</text>
