		<official-title>To amend title 28, United States Code, to provide for
		  reassignment of certain Federal cases upon request of a party.</official-title>

		<section display-inline="no-display-inline" id="HAF5DA04896444E85A13097DBD32F6445" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Peremptory Challenge Act of
			 2009</short-title></quote>.</text>
		</section><section id="H8350AFF20A5B40DDB9D05496FD1F17F9"><enum>2.</enum><header>Peremptory
			 challenges of judges</header>
			<subsection id="H2EE8DBC0F4D646D7BE053CA8C853E040"><enum>(a)</enum><header>In
			 general</header><text>Chapter 21 of title 28 of the United States Code is
			 amended by adding at the end the following:</text>
				<quoted-block id="H96311168F2F64EDA9D926082060040D9" style="USC">
					<section id="HBD0C2AC5EDB54610BAAD2E25A5F058B"><enum>464.</enum><header>Reassignment of
				cases upon request by a party</header>
						<subsection id="H9B45A93B9CB745DB889B8BF0C6583600"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H2C68D57FC02C46E6895E9610685B47BE"><enum>(1)</enum><text>If all parties on one
				side of a civil or criminal case to be tried in a Federal district court, the
				United States Claims Court, or a bankruptcy court file an application
				requesting the reassignment of the case, the case shall be reassigned to
				another appropriate judicial officer.</text>
							</paragraph><paragraph id="H5F3EEC53D57B4AFF955267CD82C100B1" indent="up1"><enum>(2)</enum><text>If any question arises as to which
				parties should be grouped together as a side for the purposes of this section,
				the chief judge of the court of appeals for the circuit in which the case is to
				be tried, or another judge of the court of appeals designated by the chief
				judge, shall determine that question.</text>
							</paragraph></subsection><subsection id="HE4B4A338EAA5474CA1E434F8006358CE"><enum>(b)</enum><text>An application
				under this section must be filed not later than 20 days after notice of the
				assignment of the case to an appropriate judicial officer for the purpose of
				hearing or deciding any matter, except that—</text>
							<paragraph id="H0E269C3A16B74EC18D36B3BEDEC1C0F1"><enum>(1)</enum><text>a party joined in
				a civil action after the initial filing, with the concurrence of the other
				parties on the same side, may file an application within 20 days of the service
				of the complaint on that party; and</text>
							</paragraph><paragraph id="H7958AAECE95C4A2E9783F7872970D0D2"><enum>(2)</enum><text>a party served
				with a supplemental or amended complaint or a third-party complaint in a civil
				action, with the concurrence of the other parties on the same side, may file an
				application within 20 days of service of the supplemental, amended, or
				third-party complaint on that party.</text>
							</paragraph><continuation-text continuation-text-level="subsection">However,
				no application under this section may be filed by the party or parties on a
				side in a case if any party or parties on that side have previously filed an
				application in the case.</continuation-text></subsection><subsection id="H1A73D7EDC8B24E3F007CC26EF1FBA910"><enum>(c)</enum><text>As used in this
				section, the term <quote>appropriate judicial officer</quote> means—</text>
							<paragraph id="H128962AD1FCE4ED2BF4167BF3FFC51CD"><enum>(1)</enum><text>a United States
				district court judge in a case before a United States district court;</text>
							</paragraph><paragraph id="H531876E78EA04E128DCDC357B73D4C93"><enum>(2)</enum><text>a United States
				Claims Court judge in a case before that court;</text>
							</paragraph><paragraph id="H10D405F36B33438B8900E1CC4BA3CD7C"><enum>(3)</enum><text>a United States
				bankruptcy judge in a case under title 11; and</text>
							</paragraph><paragraph id="H1491BB9DB3E2499E93ECFB49146CB4C8"><enum>(4)</enum><text>a United States
				magistrate judge in a case referred to such a magistrate
				judge.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBE352B0E43C94839995586002820E1B2"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 21 of
			 title 28, United States Code, is amended by adding at the end the following new
			 item:</text>
