				<section id="H19D9B7B5B5FC4CBF8A6959A7622ED101" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the
		<quote><short-title>United States Capitol Police
		Administrative Technical Corrections Act of 2009</short-title></quote>.</text>
				</section><section id="H2B6AD197730445919107516939769F0E"><enum>2.</enum><header>Administrative
		Authorities of the Chief of the Capitol Police</header>
					<subsection id="H06CC20F1D27445CDB954BC0F63DAD262"><enum>(a)</enum><header>Clarification of
		Certain Hiring Authorities</header>
						<paragraph id="HBE1BC78883AE47C581175069B9D3EDFF"><enum>(1)</enum><header>Chief
		Administrative Officer</header><text display-inline="yes-display-inline">Section 108(a) of the Legislative Branch
		Appropriations Act, 2001 (<external-xref legal-doc="usc" parsable-cite="usc/2/1903">2 U.S.C. 1903(a)</external-xref>) is amended to read
		as follows:</text>
							<quoted-block display-inline="no-display-inline" id="H29E75D44338C40A299E52B1AA02A82F4" style="OLC">
								<subsection id="HD54508CF11BD4858B3336D9ADB97B5B1"><enum>(a)</enum><header>Chief
		  Administrative Officer</header>
									<paragraph id="H98E57121AC2E4A1388C6FD8B0CD41865"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">There shall be within the United States
		  Capitol Police an Office of Administration, to be headed by the Chief
		  Administrative Officer, who shall report to and serve at the pleasure of the
		  Chief of the Capitol Police.</text>
									</paragraph><paragraph id="HE483F5150F194647A046460861A72FFB"><enum>(2)</enum><header>Appointment</header><text>The
		  Chief Administrative Officer shall be appointed by the Chief of the United
		  States Capitol Police, after consultation with the Capitol Police Board,
		  without regard to political affiliation and solely on the basis of fitness to
		  perform the duties of the position.</text>
									</paragraph><paragraph id="HDF02DC7020034AB8A3C63CB037ABDFAE"><enum>(3)</enum><header>Compensation</header><text display-inline="yes-display-inline">The annual rate of pay for the Chief
		  Administrative Officer shall be the amount equal to $1,000 less than the annual
		  rate of pay in effect for the Chief of the Capitol
		  Police.</text>
									</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph><paragraph id="HE3DE3A67A5BF4BB4A6C61AC50CE4EA59"><enum>(2)</enum><header>Administrative
		provisions</header><text>Section 108 of the Legislative Branch Appropriations
		Act, 2001 (<external-xref legal-doc="usc" parsable-cite="usc/2/1903">2 U.S.C.
		1903</external-xref>) is amended by striking subsection (c).</text>
						</paragraph><paragraph id="H396A269584E74CF88D2FBAF6622EF6B1"><enum>(3)</enum><header>Certifying
		officers</header><text>Section 107 of the Legislative Branch Appropriations
		Act, 2001 (<external-xref legal-doc="usc" parsable-cite="usc/2/1904">2 U.S.C.
		1904</external-xref>) is amended—</text>
							<subparagraph id="H13F1F0741AA54D70A66D2AF6A6DC92BC"><enum>(A)</enum><text>in
		subsection (a), by striking <quote>the Capitol Police Board</quote> and
		inserting <quote>the Chief of the Capitol Police</quote>; and</text>
							</subparagraph><subparagraph id="HDE91CBEAFD584202AC1157547E26CEE5"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (b)(1), by striking
		<quote>the Capitol Police Board</quote> and inserting <quote>the Chief of the
		Capitol Police</quote>.</text>
							</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H72C579DABD8445D7A47AB1DA043AEB3D"><enum>(4)</enum><header>Personnel
		Actions of the Chief of the Capitol Police</header>
							<subparagraph display-inline="no-display-inline" id="H40E344D111014491AC34549286062967"><enum>(A)</enum><header>In
		general</header><text>Section 1018(e) of the Legislative Branch Appropriations
		Act, 2003 (<external-xref legal-doc="usc" parsable-cite="usc/2/1907">2 U.S.C.
		1907(e)</external-xref>) is amended by striking paragraph (1) and inserting the
		following:</text>
								<quoted-block display-inline="no-display-inline" id="HAA81A467835D43E287A9B5482DC6BED6" style="OLC">
									<paragraph id="H0532202456AE4F45A0960E3D030112ED"><enum>(1)</enum><header>Authority</header>
										<subparagraph id="HDE2DA759E8174CFABFEF10995287BA1E"><enum>(A)</enum><header>In
		  general</header><text>The Chief of the Capitol Police, in carrying out the
		  duties of office, is authorized to appoint, hire, suspend with or without pay,
		  discipline, discharge, and set the terms, conditions, and privileges of
		  employment of employees of the Capitol Police, subject to and in accordance
		  with applicable laws and regulations.</text>
										</subparagraph><subparagraph id="HE944998EF9B4441AAE031058EBBA3A36"><enum>(B)</enum><header>Special rule for
		  terminations</header><text display-inline="yes-display-inline">The Chief may
		  terminate an officer, member, or employee only after the Chief has provided
		  notice of the termination to the Capitol Police Board (in such manner as the
		  Board may from time to time require) and the Board has approved the
		  termination, except that if the Board has not disapproved the termination prior
		  to the expiration of the 30-day period which begins on the date the Board
		  receives the notice, the Board shall be deemed to have approved the
		  termination.</text>
										</subparagraph><subparagraph id="HF4824B3B45074176A21714A5B853563A"><enum>(C)</enum><header>Notice or
		  approval</header><text>The Chief of the Capitol Police shall provide notice or
		  receive approval, as required by the Committee on Rules and Administration of
		  the Senate and the Committee on House Administration of the House of
		  Representatives, as each Committee determines appropriate for—</text>
											<clause id="H9AC0A1A922824D4290919E30FDACFFFA"><enum>(i)</enum><text>the
		  exercise of any authority under subparagraph (A); or</text>
											</clause><clause id="H3AE06148B2964DDC818EAB0FAFC9C844"><enum>(ii)</enum><text>the
		  establishment of any new position for officers, members, or employees of the
		  Capitol Police, for reclassification of existing positions, for reorganization
		  plans, or for hiring, termination, or promotion for officers, members, or
		  employees of the Capitol
		  Police.</text>
											</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</subparagraph><subparagraph id="H086DAC9CF7FA4A1DAF4D60985F0A322A"><enum>(B)</enum><header>Technical and
		conforming amendments</header>
								<clause id="H82CDED8D40744F40B3EE85207EDD8261"><enum>(i)</enum><header>Suspension
		authority</header><text>Section 1823 of the Revised Statutes of the United
		States (<external-xref legal-doc="usc" parsable-cite="usc/2/1928">2 U.S.C.
		1928</external-xref>) is repealed.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H776E89AC85014B71B666A7ADCD29DF0A"><enum>(ii)</enum><header>Pay of members
		under suspension</header><text display-inline="yes-display-inline">The proviso
		in the Act of Mar. 3, 1875 (ch. 129; 18 Stat. 345), popularly known as the
		<quote>Legislature, Executive, and Judicial Appropriation Act, fiscal year
		1876</quote>, which is codified at
		<external-xref legal-doc="usc" parsable-cite="usc/2/1929">section
		1929</external-xref> of title 2, United States Code (2000 Editions, Supp. V),
		is repealed.</text>
								</clause></subparagraph></paragraph><paragraph id="H29F765F4B8254A509B6938AC5BEB5F7C"><enum>(5)</enum><header>Conforming
		application of Congressional Accountability Act of 1995</header>
							<subparagraph id="H4D14F2DFD6304B87AA55C880957FB7A9"><enum>(A)</enum><header>In
		general</header><text display-inline="yes-display-inline">Section 101(9)(D) of
		the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1301">2 U.S.C. 1301(9)(D)</external-xref>) is amended by
		striking <quote>the Capitol Police Board,</quote> and inserting <quote>the
		United States Capitol Police,</quote>.</text>
							</subparagraph><subparagraph id="H41692E4283FD476CA3135687424B7CDD"><enum>(B)</enum><header>No effect on
		current proceedings</header><text>Nothing in the amendment made by subparagraph
		(A) may be construed to affect any procedure initiated under title IV of the
		Congressional Accountability Act of 1995 prior to the date of the enactment of
		this Act.</text>
							</subparagraph></paragraph><paragraph id="HF8B1BC3BC1A44D418B8B6CDB1BB2722B"><enum>(6)</enum><header>No
		effect on current personnel</header><text>Nothing in the amendments made by
		this subsection may be construed to affect the status of any individual serving
		as an officer or employee of the United States Capitol Police as of the date of
		the enactment of this Act.</text>
						</paragraph></subsection><subsection id="HB756A47D654748D794F135CAF0BCA229"><enum>(b)</enum><header>Deposit of
		Reimbursements for Law Enforcement Assistance</header>
						<paragraph id="HD9FBE31FE98449CE81D05B2997D95F9B"><enum>(1)</enum><header>In
		general</header><text>Section 2802 of the Supplemental Appropriations Act, 2001
		(<external-xref legal-doc="usc" parsable-cite="usc/2/1905">2 U.S.C.
		1905</external-xref>) is amended—</text>
							<subparagraph id="H6358E0C3BEA84BDF9BE0B9C60BA83BA4"><enum>(A)</enum><text>in
		subsection (a)(1), by striking <quote>Capitol Police Board</quote> each place
		it appears and inserting <quote>United States Capitol Police</quote>;
		and</text>
							</subparagraph><subparagraph id="H07ADC8D0451E49949EC917320C917F94"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (a)(2), by striking
		<quote>Capitol Police Board</quote> and inserting <quote>Chief of the United
		States Capitol Police</quote>.</text>
							</subparagraph></paragraph><paragraph id="H6E86A3D23A994BA09643405323D5E6CF"><enum>(2)</enum><header>Effective
		date</header><text>The amendments made by paragraph (1) shall take effect as if
		included in the enactment of the Supplemental Appropriations Act, 2001.</text>
						</paragraph></subsection><subsection id="H1279CCA5C9014F338B08357DCB456C01"><enum>(c)</enum><header>Prior Notice To
		Authorizing Committees of Deployment Outside Jurisdiction</header><text>Section
		1007(a)(1) of the Legislative Branch Appropriations Act, 2005 (<external-xref legal-doc="usc" parsable-cite="usc/2/1978">2 U.S.C. 1978(a)(1)</external-xref>)
		is amended by striking <quote>prior notification to</quote> and inserting the
		following: <quote>prior notification to the Committee on House Administration
		of the House of Representatives, the Committee on Rules and Administration of
		the Senate, and</quote>.</text>
					</subsection><subsection id="H8271E65EF8044F86A1E992DE7E42A32D"><enum>(d)</enum><header>Advance payments
		for subscription services</header>
						<paragraph id="H5E5815C5A6914D69A410B8E9A83AADB6"><enum>(1)</enum><header>In
		general</header><text>Section 1002 of the Legislative Branch Appropriations
		Act, 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/161">Public Law 110–161</external-xref>;
		<external-xref legal-doc="usc" parsable-cite="usc/2/1981">2 U.S.C.
		1981</external-xref>) is amended by inserting <quote>the Committee on House
		Administration of the House of Representatives, and the Committee on Rules and
		Administration of the Senate</quote> after <quote>the Senate,</quote>.</text>
						</paragraph><paragraph id="H3E7CA16B59C940D58A502058212EC7F8"><enum>(2)</enum><header>Effective date
		and application</header><text>The amendment made by this subsection shall take
		effect 30 days after the date of enactment of this Act and apply to payments
		made on or after that effective date.</text>
						</paragraph></subsection></section><section id="HF2A86E08887C4FC280FA4B7AC5476907"><enum>3.</enum><header>General Counsel
		to the Chief of Police and the United States Capitol Police</header>
					<subsection id="H27638FA36F154CA6B64AE22C874DD648"><enum>(a)</enum><header>Appointment and
		Service</header>
						<paragraph id="H17A186719AA7449DA67329EE91C8BB34"><enum>(1)</enum><header>In
		general</header><text display-inline="yes-display-inline">There shall be within
		the United States Capitol Police the General Counsel to the Chief of Police and
		the United States Capitol Police (in this subsection referred to as the
		<quote>General Counsel</quote>), who shall report to and serve at the pleasure
		of the Chief of the United States Capitol Police.</text>
						</paragraph><paragraph id="H24D48F729F974D89B279A4DB68D83B51"><enum>(2)</enum><header>Appointment</header><text display-inline="yes-display-inline">The General Counsel shall be appointed by
		the Chief of the Capitol Police in accordance with section 1018(e)(1) of the
		Legislative Branch Appropriations Act, 2003 (<external-xref legal-doc="usc" parsable-cite="usc/2/1907">2 U.S.C. 1907(e)(1)</external-xref>) (as amended by
		section 2(a)(4)), after consultation with the Capitol Police Board, without
		regard to political affiliation and solely on the basis of fitness to perform
		the duties of the position.</text>
						</paragraph><paragraph id="H094B60170324486FA0A3160F0DDFF25E"><enum>(3)</enum><header>Compensation</header>
							<subparagraph id="H55EBED459E3A483CA7C18B7CA9191CF8"><enum>(A)</enum><header>In
		general</header><text>Subject to subparagraph (B), the annual rate of pay for
		the General Counsel shall be fixed by the Chief of the Capitol Police.</text>
							</subparagraph><subparagraph id="HE46C9514EEE5441A908122251B50CB40"><enum>(B)</enum><header>Limitation</header><text>The
		annual rate of pay for the General Counsel may not exceed an annual rate equal
		to $1,000 less than the annual rate of pay in effect for the Chief of the
		Capitol Police.</text>
							</subparagraph></paragraph><paragraph id="HB0AE618CE04E42A3A495D8AC5E593B12"><enum>(4)</enum><header>Technical and
		conforming amendment</header><text>House Resolution 661, Ninety-fifth Congress,
		agreed to July 29, 1977, as enacted into permanent law by section 111 of the
		Legislative Branch Appropriation Act, 1979 (<external-xref legal-doc="usc" parsable-cite="usc/2/1901">2 U.S.C. 1901</external-xref> note) is
		repealed.</text>
						</paragraph><paragraph id="HE53BCB4274784E039676C810CB0C0D2A"><enum>(5)</enum><header>No
		effect on current General Counsel</header><text>Nothing in this subsection or
		the amendments made by this subsection may be construed to affect the status of
		the individual serving as the General Counsel to the Chief of Police and the
		United States Capitol Police as of the date of the enactment of this
		Act.</text>
						</paragraph></subsection><subsection id="HB5A5D32530CA42E68ED003B27A0AFD89"><enum>(b)</enum><header>Legal
		Representation Authority</header>
						<paragraph id="H45FDF1D6BD73498B86295DA0F160A6DE"><enum>(1)</enum><header>In
		general</header><text>Section 1002(a)(2)(A) of the Legislative Branch
		Appropriations Act, 2004 (<external-xref legal-doc="usc" parsable-cite="usc/2/1908">2 U.S.C. 1908(a)(2)(A)</external-xref>) is amended
		by striking <quote>the General Counsel for the United States Capitol Police
		Board and the Chief of the Capitol Police</quote> and inserting <quote>the
		General Counsel to the Chief of Police and the United States Capitol
		Police</quote>.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H56AA222CABBD41DCB6DCFC6C797329F1"><enum>(2)</enum><header>No effect on
		current proceedings</header><text display-inline="yes-display-inline">Nothing
		in the amendment made by paragraph (1) may be construed to affect the authority
		of any individual to enter an appearance in any proceeding before any court of
		the United States or of any State or political subdivision thereof which is
		initiated prior to the date of the enactment of this Act.</text>
						</paragraph></subsection></section><section id="H70864B80EEAC498485D1E32E0DB00A34"><enum>4.</enum><header>Employment
		Counsel to the Chief of Police and the United States Capitol Police</header>
					<subsection id="HC73AEECD8686405DAD273955277F4DD6"><enum>(a)</enum><header>Legal
		Representation Authority</header>
						<paragraph id="H78C9DAD868B844A4996A55C37301099F"><enum>(1)</enum><header>In
		general</header><text>Section 1002(a)(2)(B) of the Legislative Branch
		Appropriations Act, 2004 (<external-xref legal-doc="usc" parsable-cite="usc/2/1908">2 U.S.C. 1908(a)(2)(B)</external-xref>) is amended
		by striking <quote>the Employment Counsel for the United States Capitol Police
		Board and the United States Capitol Police</quote> and inserting <quote>the
		Employment Counsel to the Chief of Police and the United States Capitol
		Police</quote>.</text>
						</paragraph><paragraph id="HA2E78E9E9B27482FB470BE70D1053473"><enum>(2)</enum><header>No
		effect on current proceedings</header><text display-inline="yes-display-inline">Nothing in the amendment made by paragraph
		(1) may be construed to affect the authority of any individual to enter an
		appearance in any proceeding before any court of the United States or of any
		State or political subdivision thereof which is initiated prior to the date of
		the enactment of this Act.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H704C29E499804580BA25AFB736C44383"><enum>(b)</enum><header>No effect on
		current Employment Counsel</header><text>Nothing in this section or the
		amendments made by this section may be construed to affect the status of the
		individual serving as the Employment Counsel to the Chief of Police and the
		United States Capitol Police as of the date of the enactment of this
		Act.</text>
					</subsection></section><section id="HFE06DC03395F4A51B36062EB20542D3D"><enum>5.</enum><header>Clarification of
		Authorities Regarding Certain Personnel Benefits</header>
					<subsection id="H9923778157364C5D8D01529EFF5B3646"><enum>(a)</enum><header>No
		Lump-Sum Payment Permitted for Unused Compensatory Time</header>
						<paragraph id="H388180F1588A4A97B42D22EAF3054F37"><enum>(1)</enum><header>In
		general</header><text display-inline="yes-display-inline">No officer or
		employee of the United States Capitol Police whose service with the United
		States Capitol Police is terminated may receive any lump-sum payment with
		respect to accrued compensatory time off, except to the extent permitted under
		section 203(c)(4) of the Congressional Accountability Act of 1995
		(<external-xref legal-doc="usc" parsable-cite="usc/2/1313">2 U.S.C.
		1313(c)(4)</external-xref>).</text>
						</paragraph><paragraph display-inline="no-display-inline" id="H64A2A859439846899A30699E343B06E9"><enum>(2)</enum><header>Repeal of
		related obsolete provisions</header>
							<subparagraph display-inline="no-display-inline" id="HBCA05D658B16480DBFB902143534D6FC"><enum>(A)</enum><header>Overtime pay
		disbursed by House</header><text display-inline="yes-display-inline">Section 3
		of House Resolution 449, Ninety-second Congress, agreed to June 2, 1971, as
		enacted into permanent law by chapter IV of the Supplemental Appropriations
		Act, 1972 (85 Stat. 636) (<external-xref legal-doc="usc" parsable-cite="usc/2/1924">2 U.S.C. 1924</external-xref>), together with any
		other provision of law which relates to compensatory time for the Capitol
		Police which is codified at
		<external-xref legal-doc="usc" parsable-cite="usc/2/1924">section
		1924</external-xref> of title 2, United States Code (2000 Editions, Supp. V),
		is repealed.</text>
							</subparagraph><subparagraph id="HBA4A8EF3FCC14700AB9C77488516FD6B"><enum>(B)</enum><header>Overtime pay
		disbursed by Senate</header><text>The last full paragraph under the heading
		<quote>Administrative Provisions</quote> in the appropriation for the Senate in
		the Legislative Branch Appropriations Act, 1972 (85 Stat. 130) (<external-xref legal-doc="usc" parsable-cite="usc/2/1925">2 U.S.C. 1925</external-xref>) is
		repealed.</text>
							</subparagraph></paragraph></subsection><subsection id="H236E77E021984078BCF3AC53E4010B11"><enum>(b)</enum><header>Overtime
		Compensation for Officers and Employees Exempt from Fair Labor Standards Act of
		1938</header>
						<paragraph id="H9C8B922EA07C4F879460881EEC7E1A5E"><enum>(1)</enum><header>Criteria under
		which compensation permitted</header><text display-inline="yes-display-inline">The Chief of the Capitol Police may provide
		for the compensation of overtime work of exempt individuals which is performed
		on or after the date of the enactment of this Act, in the form of additional
		pay or compensatory time off, only if—</text>
							<subparagraph id="H7A35FF38B14F420AA46A6D60E3CAEB89"><enum>(A)</enum><text>the overtime work
		is carried out in connection with special circumstances, as determined by the
		Chief;</text>
							</subparagraph><subparagraph id="H18AD3697EDC24E7EA288017510235936"><enum>(B)</enum><text>the Chief has
		established a monetary value for the overtime work performed by such
		individual; and</text>
							</subparagraph><subparagraph id="H7B2F730C8526471F852B8207C9886E32"><enum>(C)</enum><text display-inline="yes-display-inline">the sum of the total amount of the
		compensation paid to the individual for the overtime work (as determined on the
		basis of the monetary value established under subparagraph (B)) and the total
		regular compensation paid to the individual with respect to the pay period
		involved may not exceed an amount equal to the cap on the aggregate amount of
		annual compensation that may be paid to the individual under applicable law
		during the year in which the pay period occurs, as allocated on a per pay
		period basis consistent with premium pay regulations of the Capitol Police
		Board.</text>
							</subparagraph></paragraph><paragraph id="H90F204763ED448F0B55714460FFAACCD"><enum>(2)</enum><header>Exempt
		individuals defined</header><text>In this subsection, an <term>exempt
		individual</term> is an officer or employee of the United States Capitol
		Police—</text>
							<subparagraph id="HA52993167AA54CE2B6D30FA44F9CAFEB"><enum>(A)</enum><text display-inline="yes-display-inline">who is classified under regulations issued
		pursuant to section 203 of the Congressional Accountability Act of 1995
		(<external-xref legal-doc="usc" parsable-cite="usc/2/1313">2 U.S.C.
		1313</external-xref>) as exempt from the application of the rights and
		protections established by subsections (a)(1) and (d) of section 6, section 7,
		and section 12(c) of the Fair Labor Standards Act of 1938 (29 U.S.C. 206 (a)(1)
		and (d), 207, 212(c)); or</text>
							</subparagraph><subparagraph id="HDBAAD665E69E4344B9DDAE8A906C3F3A"><enum>(B)</enum><text>whose annual rate
		of pay is not established specifically under any law.</text>
							</subparagraph></paragraph><paragraph id="H9A093CB037C04738B8DB34F06C7772BA"><enum>(3)</enum><header>Conforming
		amendment</header>
							<subparagraph id="HB612892C7640470FAA89BC4D15A28EFC"><enum>(A)</enum><header>In
		general</header><text>Section 1009 of the Legislative Branch Appropriations

		repealed.</text>
							</subparagraph><subparagraph id="HB6DF9D4F352C4B3B8155CD796DC1FC56"><enum>(B)</enum><header>Effective
		date</header><text>The amendment made by subparagraph (A) shall take effect as
		if included in the enactment of the Legislative Branch Appropriations Act,
		2003, except that the amendment shall not apply with respect to any overtime
		work performed prior to the date of the enactment of this Act.</text>
							</subparagraph></paragraph></subsection></section><section id="H477138C06C9B4AA09FDF01F39989B13C"><enum>6.</enum><header>Other
		Miscellaneous Technical Corrections</header>
					<subsection id="HCF0F19C7F660454080982A60D914CD6C"><enum>(a)</enum><header>Repeal of
		Obsolete Procedures for Initial Appointment of Chief Administrative
		Officer</header><text>Section 108 of the Legislative Branch Appropriations Act,
		2001 (<external-xref legal-doc="usc" parsable-cite="usc/2/1903">2 U.S.C.
		1903</external-xref>) is amended by striking subsections (d) through
		(g).</text>
					</subsection><subsection id="H8A7EC1602A7E4E398E6C388CDB38109F"><enum>(b)</enum><header>Repeal of
		Requirement that Officers Purchase Own Uniforms</header><text>Section 1825 of
		the Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/2/1943">2 U.S.C. 1943</external-xref>) is repealed.</text>
					</subsection><subsection id="HB12EDF9752B34EE2B0061BBD163324C9"><enum>(c)</enum><header>Repeal of
		References to Officers and Privates in Authorities Relating to House and Senate
		Office Buildings</header>
						<paragraph id="H59B06F126D01480894557383B627A097"><enum>(1)</enum><header>House office
		buildings</header><text display-inline="yes-display-inline">The item relating
		to <quote>House of Representatives Office Building</quote> in the Act entitled
		<quote>An Act making appropriations for sundry civil expenses of the Government
		for the fiscal year ending June thirtieth, nineteen hundred and eight, and for
		other purposes</quote>, approved March 4, 1907 (34 Stat. 1365;
		<external-xref legal-doc="usc" parsable-cite="usc/2/2001">2 U.S.C.
		2001</external-xref>), is amended by striking <quote>other than officers and
		privates of the Capitol police</quote> each place it appears and inserting
		<quote>other than the United States Capitol Police</quote>.</text>
						</paragraph><paragraph id="H77646E81F08D435BA448A7DF5E59FC53"><enum>(2)</enum><header>Senate office
		buildings</header><text display-inline="yes-display-inline">The item relating
		to <quote>Senate Office Building</quote> in the Legislative Branch
		Appropriation Act, 1943 (56 Stat. 343;
		<external-xref legal-doc="usc" parsable-cite="usc/2/2023">2 U.S.C.
		2023</external-xref>) is amended by striking <quote>other than for officers and
		privates of the Capitol Police</quote> each place it appears and inserting
		<quote>other than for the United States Capitol Police</quote>.</text>
						</paragraph></subsection><subsection id="H0C7166CB48534D2788CB728AA0F27253"><enum>(d)</enum><header>Clarification of
		Applicability of U.S. Capitol Police and Library of Congress Police Merger
		Implementation Act of 2007</header>
						<paragraph id="HDCE717F9EAC241948CCCF43A916EE4DC"><enum>(1)</enum><header>Repeal of
		duplicate provisions</header><text display-inline="yes-display-inline">Effective as if included in the enactment
		of the Legislative Branch Appropriations Act, 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/161">Public Law
		110–161</external-xref>), section 1004 of such Act is repealed, and any
		provision of law amended or repealed by such section is restored or revived to
		read as if such section had not been enacted into law.</text>
						</paragraph><paragraph id="HE99A8CB1FA84486D944C9E273C37BE19"><enum>(2)</enum><header>No
		effect on other Act</header><text>Nothing in paragraph (1) may be construed to
		prevent the enactment or implementation of any provision of the U.S. Capitol
		Police and Library of Congress Police Merger Implementation Act of 2007
		(<external-xref legal-doc="public-law" parsable-cite="pl/110/178">Public Law
		110–178</external-xref>), including any provision of such Act that amends or
		repeals a provision of law which is restored or revived pursuant to paragraph
		(1).</text>
						</paragraph></subsection><subsection id="HC39D0EEF91E24D59A5E2D02855F34A63"><enum>(e)</enum><header>Authority of
		Chief of Police</header>
						<paragraph display-inline="no-display-inline" id="HC941F05A553A4EA4A82D71B6FC8B2AC4"><enum>(1)</enum><header>Repeal of
		certain provisions codified in title 2, United States Code</header><text display-inline="yes-display-inline">The provisions appearing in the first
		paragraph under the heading <quote>Capitol Police</quote> in the Act of April
		28, 1902 (ch. 594; 32 Stat. 124), and the provisions appearing in the first
		paragraph under the heading <quote>Capitol Police</quote> in title I of the
		Legislative and Judiciary Appropriation Act, 1944 (ch. 173; 57 Stat. 230),
		insofar as all of those provisions are related to the sentence <quote>The
		captain and lieutenants shall be selected jointly by the Sergeant at Arms of
		the Senate and the Sergeant at Arms of the House of Representatives; and
		one-half of the privates shall be selected by the Sergeant at Arms of the
		Senate and one-half by the Sergeant at Arms of the House of
		Representatives.</quote>, which appears in 2 U.S.C. 1901 (2000 Edition, Supp.
		V), are repealed.</text>
						</paragraph><paragraph id="H408CD11827D7421B8BC96E28674901F1"><enum>(2)</enum><header>Restoration of
		repealed provision</header><text display-inline="yes-display-inline">Section
		1018(h)(1) of the Legislative Branch Appropriations Act, 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/7">Public Law
		108–7</external-xref>, div. H, title I, 117 Stat. 368) is repealed, and the
		sentence <quote>The Capitol Police shall be headed by a Chief who shall be
		appointed by the Capitol Police Board and shall serve at the pleasure of the
		Board.</quote>, which was repealed by such section, is restored to appear at
		the end of section 1821 of the Revised Statutes of the United States
		(<external-xref legal-doc="usc" parsable-cite="usc/2/1901">2 U.S.C.
		1901</external-xref>).</text>
						</paragraph><paragraph id="H58C3762693C6493C8948254400DD5C68"><enum>(3)</enum><header>Conforming
		amendment</header><text display-inline="yes-display-inline">The first sentence
		of section 1821 of the Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/2/1901">2 U.S.C. 1901</external-xref>) is
		amended by striking <quote>, the members of which shall be appointed by the
		Sergeants-at-Arms of the two Houses and the Architect of the Capitol
		Extension</quote>.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAEDD57061A544CB3B87EB33D59BE715B"><enum>(4)</enum><header>Effective
		date</header><text>The amendments made by this subsection shall take effect as
		if included in the enactment of the Legislative Branch Appropriations Act,
		2003.</text>
						</paragraph></subsection></section><section id="id8918F95C1E1E4511AA329DA39DDADAEF"><enum>7.</enum><header>Treatment of
		Capitol Police employees as congressional employees</header>
					<subsection id="id4C9F77CBB0B14DAF909BC3505FFDC3E6"><enum>(a)</enum><header>Definition of
		congressional employee</header><text display-inline="yes-display-inline">Section 2107(4) of title 5, United States
		Code, is amended by inserting <quote>or employee</quote> after
		<quote>member</quote>.</text>
					</subsection><subsection commented="no" id="idDDAFA949D1FB43B3BA0E797E948F6C53"><enum>(b)</enum><header>Dual pay and
		dual employment</header>
						<paragraph commented="no" id="id9BA0C3AE884A4C92818AC6F3BBC9ED89"><enum>(1)</enum><header>Definition of
		agency in the legislative branch</header><text>Section 5531(4) of title 5,
		United States Code, is amended by striking <quote>and the Congressional Budget
		Office</quote> and inserting <quote>the Congressional Budget Office, and the
		United States Capitol Police</quote>.</text>
						</paragraph><paragraph commented="no" id="id5A8A86B0066D4554B2345D28D1B76C65"><enum>(2)</enum><header>Dual
		pay</header><text>Section 5533 of title 5, United States Code, is
		amended—</text>
							<subparagraph commented="no" id="id4006BEF9F6B2433BB2E307F35A992411"><enum>(A)</enum><text>in subsection
		(c)—</text>
								<clause commented="no" id="idC7850B31BFB1423F841B7B66603E4454"><enum>(i)</enum><text>in paragraph (1),
		by striking <quote>or the Chief Administrative Officer of the House of
		Representatives</quote> and inserting <quote>, the Chief Administrative Officer
		of the House of Representatives, or the Chief of the Capitol Police</quote>;
		and</text>
								</clause><clause commented="no" id="idE7270CEB2B064A8AA8D4F8D1BE52F4EA"><enum>(ii)</enum><text>in paragraph
		(2), by inserting <quote>or the Chief of the Capitol Police</quote> after
		<quote>House of Representatives</quote>; and</text>

		Police</quote>.</text>
						</paragraph><paragraph commented="no" id="idDF0D100C43304D3FBE3A627983E33CF6"><enum>(2)</enum><header>Fees for
		service</header><text>Section 5537(a) of title 5, United States Code, is
		amended by striking <quote>or the Chief Administrative Officer of the House of
		Representatives</quote> and inserting <quote>, the Chief Administrative Officer
		of the House of Representatives, or the Chief of the Capitol
		Police</quote>.</text>
						</paragraph></subsection><subsection id="idA784B1B954344F7DAEC64C3D0D7FA8E5"><enum>(d)</enum><header>Effective
		date</header><text>The amendments made by this section shall take effect as
		though enacted as part of section 1018 of the Legislative Branch Appropriations
		Act, 2003 (2 U.S.C. 1907).</text>
					</subsection></section><section id="id23CE97A5FC1B4E2894BFE291474E5252"><enum>8.</enum><header>Law
		enforcement authority of Sergeant-at-Arms and Doorkeeper of the Senate</header>
					<subsection id="id55434D616E7340239DAB81067B9D1817"><enum>(a)</enum><header>In
		general</header><text>The Sergeant-at-Arms and Doorkeeper of the Senate shall
		have the same law enforcement authority, including the authority to carry
		firearms, as a member of the Capitol Police. The law enforcement authority
		under the preceding sentence shall be subject to the requirement that the
		Sergeant-at-Arms and Doorkeeper of the Senate have the qualifications specified
		in subsection (b).</text>
					</subsection><subsection id="id4D5DC6E46A47444BB4851EF9452A7AED"><enum>(b)</enum><header>Qualifications</header><text>The
		qualifications referred to in subsection (a) are the following:</text>
						<paragraph id="IDe5a61a5801914f278b4b1ce788309ba5"><enum>(1)</enum><text>A
		minimum of 5 years of experience as a law enforcement officer before beginning
		service as the Sergeant-at-Arms and Doorkeeper of the Senate.</text>
						</paragraph><paragraph id="ID2a5b78571ca243308999f3ea4ae812d5"><enum>(2)</enum><text>Current
		certification in the use of firearms by the appropriate Federal law enforcement
		entity or an equivalent non-Federal entity.</text>
						</paragraph><paragraph id="ID48278d2582254d0ba9b152ed061312d1"><enum>(3)</enum><text>Any
		other firearms qualification required for members of the Capitol Police.</text>
						</paragraph></subsection><subsection id="ID1b5e43ef684b48e6a66160ea68631411"><enum>(c)</enum><header>Regulations</header><text>The
		Committee on Rules and Administration of the Senate shall have authority to
		prescribe regulations to carry out this section.</text>
