<legis-type>AN ACT</legis-type> 
<official-title display="yes">To direct the exchange of certain land in Grand, San Juan, and Uintah Counties, Utah, and for other purposes.</official-title>

<section id="H24F9B5EA912A456CA099F22E07524D87" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Utah Recreational Land Exchange Act of 2009</short-title></quote>.</text></section> 
<section id="H336C2C4D216D40EC83F100CBE51B9EE8"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H4CC38F75FD9B4F77A18CB9BC12071FDE"><enum>(1)</enum><header>Federal land</header><text>The term <quote>Federal land</quote> means the land located in Grand, San Juan, and Uintah Counties, Utah, that is identified on the maps as—</text> 
<subparagraph id="H78458EFB5B04464282AD9B72CF3366D2"><enum>(A)</enum><text><quote>BLM Subsurface only Proposed for Transfer to State Trust Lands</quote>;</text></subparagraph> 
<subparagraph id="H668620409A0E467A8510EFCCCD7FFA60"><enum>(B)</enum><text><quote>BLM Surface only Proposed for Transfer to State Trust Lands</quote>; and</text></subparagraph> 
<subparagraph id="H72E0C60D725D421597175870D32E95C2"><enum>(C)</enum><text><quote>BLM Lands Proposed for Transfer to State Trust Lands</quote>.</text></subparagraph></paragraph> 
<paragraph id="HA1BCA187D8D74F91A75EBE0D0CD1BD97"><enum>(2)</enum><header>Grand county map</header><text>The term <quote>Grand County Map</quote> means the map prepared by the Bureau of Land Management entitled <quote>Utah Recreational Land Exchange Act Grand County</quote>, dated May 14, 2009, and relating to the exchange of Federal land and non-Federal land in Grand and San Juan Counties, Utah.</text></paragraph> 
<paragraph id="HEACDB00FD89C4D29B98C1BDB0CE86DD7"><enum>(3)</enum><header>Maps</header><text>The term <quote>maps</quote> means the Grand County Map and the Uintah County Map.</text></paragraph> 
<paragraph id="H7B40BB75710742DEB13F30BF33A08B53"><enum>(4)</enum><header>Non-federal land</header><text>The term <quote>non-Federal land</quote> means the land in Grand, San Juan, and Uintah Counties, Utah, that is identified on the maps as—</text> 
<subparagraph id="H61F93ECA85A045DFA78C031E7652C57B"><enum>(A)</enum><text><quote>State Trust Land Proposed for Transfer to BLM</quote>; and</text></subparagraph> 
<subparagraph id="HB5605007C96A4019971F13B3087C2754"><enum>(B)</enum><text><quote>State Trust Minerals Proposed for Transfer to BLM</quote>.</text></subparagraph></paragraph> 
<paragraph id="H46E951A0B66E4AC492C6E094CA26F1BB"><enum>(5)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior.</text></paragraph> 
<paragraph id="H2FBBB0F2BE7147E59A2833D3289C8F91"><enum>(6)</enum><header>State</header><text>The term <quote>State</quote> means the State of Utah, as trustee under the Utah State School and Institutional Trust Lands Management Act (Utah Code Ann. 53C–1–101 et seq.).</text></paragraph> 
<paragraph id="HAA4DC4239FDB4CA9B013DD0ACE2AA312"><enum>(7)</enum><header>Uintah county map</header><text>The term <quote>Uintah County Map</quote> means the map prepared by the Bureau of Land Management entitled <quote>Utah Recreational Land Exchange Act Uintah County</quote>, dated May 14, 2009, and relating to the exchange of Federal land and non-Federal land in Uintah County, Utah.</text></paragraph></section> 
<section id="H227E4BDD10804D1FBCF0554B8450897B"><enum>3.</enum><header>Exchange of land</header> 
<subsection id="HA1F74F4A9C054774B3B4DC5E32A5A6D9"><enum>(a)</enum><header>In general</header><text>If the State offers to convey to the United States title to the non-Federal land, the Secretary shall—</text> 
<paragraph id="H0BD3E14DBB714EB9AF1D7E1C4D96F957"><enum>(1)</enum><text>accept the offer; and</text></paragraph> 
<paragraph id="H78EE53AD8EDE48FA84D9959636905DF9"><enum>(2)</enum><text>on receipt of all right, title, and interest of the State in and to the non-Federal land, convey to the State all right, title, and interest of the United States in and to the Federal land.</text></paragraph></subsection> 
<subsection id="HF5046540C7CC4CE180A76469E8A03416"><enum>(b)</enum><header>Conditions</header><text>The exchange authorized under subsection (a) shall be subject to—</text> 
<paragraph id="H15BCFFB7FF6B4049888E691AB615238A"><enum>(1)</enum><text>valid existing rights;</text></paragraph> 
<paragraph id="H7D85D41DF527444DAD6EDD22C4ECD40F"><enum>(2)</enum><text>except as otherwise provided by this section—</text> 
<subparagraph id="HF547900A7D344AF7A9058FDFB9B15935"><enum>(A)</enum><text>section 206 of the Federal Land Policy and Management Act of 1976 (43 U.S.C. 1716); and</text></subparagraph> 
<subparagraph id="H96A57B8923904252B87FB82B2864B974"><enum>(B)</enum><text>any other applicable laws;</text></subparagraph></paragraph> 
<paragraph id="HC0F220BDF4AF49DE8733972984950334" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">all costs of land exchanges under this Act, including but not limited to appraisals, surveys, and related costs, shall be paid equally by the Secretary and the State; and </text></paragraph> 
<paragraph id="HED234912441E4832B47957F0F527A1BD"><enum>(4)</enum><text>any additional terms and conditions that the Secretary and the State mutually determine to be appropriate.</text></paragraph></subsection> 
<subsection id="H814D7B33B68749F995A5D43DAD9AF01B"><enum>(c)</enum><header>Title approval</header><text>Title to the Federal land and non-Federal land to be exchanged under this section shall be in a format acceptable to the Secretary and the State.</text></subsection> 
<subsection id="HEFC95F5F08EE4195A5647ADC830013FC"><enum>(d)</enum><header>Appraisals</header> 
<paragraph id="H417CE0A6E1C2408CA7212C7FBA26F9B5"><enum>(1)</enum><header>In general</header><text>The value of the Federal land and the non-Federal land shall be determined by appraisals conducted by 1 or more independent appraisers selected jointly by the Secretary and the State.</text></paragraph> 
<paragraph id="H42EB327878FF426394818B969D2414B5"><enum>(2)</enum><header>Applicable law</header><text>The appraisals conducted under paragraph (1) shall be conducted in accordance with section 206 of the Federal Land Policy and Management Act of 1976 (43 U.S.C. 1716).</text></paragraph> 
<paragraph id="HB183BD566A3F4636868F45CCC968B0C2"><enum>(3)</enum><header>Approval</header><text>The appraisals conducted under paragraph (1) shall be submitted to the Secretary and the State for approval.</text></paragraph> 
<paragraph id="H17EE710606AB4A6CA3CFEFDE18B4295F"><enum>(4)</enum><header>Adjustment</header> 
<subparagraph id="HF2A4094FA97C4CCBB87EF6DAF7C9CCDE"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If value is attributed to any parcel of Federal land because of the presence of minerals subject to leasing under the Mineral Leasing Act (30 U.S.C. 181 et seq.), the value of the parcel (as otherwise established under this subsection) shall be reduced by the estimated value of the payments that would have been made to the State of Utah from bonuses, rentals, and royalties that the United States would have received if such minerals were leased pursuant to the Mineral Leasing Act (30 U.S.C. 181 et seq.).</text></subparagraph> 
<subparagraph id="H728FB662D60343179604C4D5F1CFA43B"><enum>(B)</enum><header>Limitation</header><text>An adjustment under subparagraph (A) shall not be considered as a property right of the State.</text></subparagraph></paragraph> 
<paragraph id="HA7B5A1228AD84E31A578B02F7CAA06E1"><enum>(5)</enum><header>Availability of appraisals</header> 
<subparagraph id="HE2C877B318574D9EBA1364706BB26068"><enum>(A)</enum><header>In general</header><text>All final appraisals, appraisal reviews, and determinations of value for land to be exchanged under this section shall be available for public review at the Utah State Office of the Bureau of Land Management at least 30 days before the conveyance of the applicable parcels.</text></subparagraph> 
<subparagraph id="H310A79D7EB634D54B9E306D684BC58C1"><enum>(B)</enum><header>Publication</header><text>The Secretary or the State, as applicable, shall publish in a newspaper of general circulation in Salt Lake County, Utah, a notice that the appraisals are available for public inspection.</text></subparagraph></paragraph></subsection> 
<subsection id="HF43295E62E2942F29FC1F75B6A229AFD"><enum>(e)</enum><header>Conveyance of Parcels in Phases</header> 
<paragraph id="H38AA163CC59F450DB3B2A86519523A65"><enum>(1)</enum><header>In general</header><text>Notwithstanding that appraisals for all of the parcels of Federal land and non-Federal land may not have been approved under subsection (d)(3), parcels of the Federal land and non-Federal land may be exchanged under subsection (a) in 3 phases beginning on the date on which the appraised values of the parcels included in the applicable phase are approved under this subsection.</text></paragraph> 
<paragraph id="HB10ECCDA60C449DD95DFAA35135BD831"><enum>(2)</enum><header>Phases</header><text>The 3 phases referred to in paragraph (1) are—</text> 
<subparagraph id="HCD9956AC08F74555AD57C909F0C36431"><enum>(A)</enum><text>phase 1, consisting of the non-Federal land identified as <quote>phase one</quote> land on the Grand County Map;</text></subparagraph> 
<subparagraph id="HF0C227FC309747A089B966FC6F00BA38"><enum>(B)</enum><text>phase 2, consisting of the non-Federal land identified as <quote>phase two</quote> land on the Grand County Map and the Uintah County Map; and</text></subparagraph> 
<subparagraph id="HF34DF181E3CE46E1BD241CEABC922ACF"><enum>(C)</enum><text>phase 3, consisting of any remaining non-Federal land that is not identified as <quote>phase one</quote> land or <quote>phase two</quote> land on the Grand County Map or the Uintah County Map.</text></subparagraph></paragraph> 
<paragraph id="H99374F840F37451888BF02E7E5294EF9"><enum>(3)</enum><header>No agreement on exchange</header><text>If agreement has not been reached with respect to the exchange of an individual parcel of Federal land or non-Federal land, the Secretary and the State may agree to set aside the individual parcel to allow the exchange of the other parcels of Federal land and non-Federal land to proceed.</text></paragraph> 
<paragraph id="H3E7EE518BF9F453B8F8B7403DDA18713"><enum>(4)</enum><header>Timing</header><text>It is the intent of Congress that at least the first phase of the exchange of land authorized by subsection (a) be completed not later than 360 days after the date on which the State makes the Secretary an offer to convey the non-Federal land under that subsection.</text></paragraph></subsection> 
<subsection id="HAEDB99B9AB3D481B8EDBDC1605F60580"><enum>(f)</enum><header>Reservation of Interest in Oil Shale</header> 
<paragraph id="H05D69E36441A4D688B71FC32568F5CDD"><enum>(1)</enum><header>In general</header><text>With respect to Federal land that contains oil shale resources, the Secretary shall reserve an interest in the portion of the mineral estate that contains the oil shale resources.</text></paragraph> 
<paragraph id="H2512E559780342DB9656F53EC74C2FBE"><enum>(2)</enum><header>Extent of interest</header><text>The interest reserved by the United States under paragraph (1) shall consist of—</text> 
<subparagraph id="H799A7C7C3E6B49219455B1EDB2D74536"><enum>(A)</enum><text>50 percent of any bonus bid or other payment received by the State as consideration for securing any lease or authorization to develop oil shale resources;</text></subparagraph> 
<subparagraph id="HC0ED98D5C65A4C8CA024B6D671E13C1C"><enum>(B)</enum><text>the amount that would have been received by the Federal Government under the applicable royalty rate if the oil shale resources had been retained in Federal ownership; and</text></subparagraph> 
<subparagraph id="HF0E02AB3D3F74E83BA6C47A648E42823"><enum>(C)</enum><text>50 percent of any other payment received by the State pursuant to any lease or authorization to develop the oil shale resources.</text></subparagraph></paragraph> 
<paragraph id="H727BDEA4E65F4742980DE755405BF48B"><enum>(3)</enum><header>Payment</header><text>Any amounts due under paragraph (2) shall be paid by the State to the United States not less than quarterly.</text></paragraph> 
<paragraph id="HC4A94CAC561D4FC0AE22B1EDF4F41A96"><enum>(4)</enum><header>No Obligation to Lease</header><text>The State shall not be obligated to lease or otherwise develop oil shale resources in which the United States retains an interest under this subsection.</text></paragraph> 
<paragraph id="H610D78CD389F44789E8304FD58F94F97"><enum>(5)</enum><header>Valuation</header><text>Federal land in which the Secretary reserves an interest under this subsection shall be appraised—</text> 
<subparagraph id="H6E95BDED434C4CFFADBCF832606AC44A"><enum>(A)</enum><text>without regard to the presence of oil shale; and</text></subparagraph> 
<subparagraph id="HC4E1DFDEDA25441EB25CE43E294AEAE2"><enum>(B)</enum><text>in accordance with subsection (d).</text></subparagraph></paragraph></subsection> 
<subsection id="H7158E6E947B647A28C8424AFBA33A369"><enum>(g)</enum><header>Withdrawal of federal land prior to exchange</header><text>Subject to valid existing rights, during the period beginning on the date of enactment of this Act and ending on the earlier of the date that the Federal land is removed from the exchange or the date on which the Federal land is conveyed under this Act, the Federal land is withdrawn from—</text> 
<paragraph id="H8377603795D2475FA6C21FA592755346"><enum>(1)</enum><text>disposition (other than disposition under section 4) under the public land laws;</text></paragraph> 
<paragraph id="HF3485C95788A411894C77D1527C4B178"><enum>(2)</enum><text>location, entry, and patent under the mining laws; and</text></paragraph> 
<paragraph id="H1624263CF7D5403EBA24AFBC0BF943EC"><enum>(3)</enum><text>the operation of—</text> 
<subparagraph id="H42D08113ADEB4FB38970F384C04F76CE"><enum>(A)</enum><text>the mineral leasing laws;</text></subparagraph> 
<subparagraph id="HA8C4B005D54C4D12BD6D1D96A747728A"><enum>(B)</enum><text>the Geothermal Steam Act of 1970 (30 U.S.C. 1001 et seq.); and</text></subparagraph> 
<subparagraph id="H5AAB0E7086224502A9C541C9FBFF0DD6"><enum>(C)</enum><text>the first section of the Act of July 31, 1947 (commonly known as the <quote>Materials Act of 1947</quote>) (30 U.S.C. 601).</text></subparagraph></paragraph></subsection> 
<subsection id="HAEF6AB111F3A4B9BACA64F3851BA9477"><enum>(h)</enum><header>Appurtenant water rights</header><text>Any conveyance of a parcel of Federal land or non-Federal land under this Act shall include the conveyance of water rights appurtenant to the parcel conveyed.</text></subsection> 
<subsection id="HFA1566576CE84B489DF6755AA6E5D279"><enum>(i)</enum><header>Equal value exchange</header> 
<paragraph id="H236E6DA8D4E8467C9C739BE9C3BD7BFC"><enum>(1)</enum><header>In general</header><text>The value of the Federal land and non-Federal land to be exchanged under this Act—</text> 
<subparagraph id="HAFB724DB664740259ED02FFBFC5ABF93"><enum>(A)</enum><text>shall be equal; or</text></subparagraph> 
<subparagraph id="H37298313983247678FDA86855E198E91"><enum>(B)</enum><text>shall be made equal in accordance with paragraph (2).</text></subparagraph></paragraph> 
<paragraph id="H3A48D60209CD47CCB626531A97008493"><enum>(2)</enum><header>Equalization</header> 
<subparagraph id="H11E4C928227D40F9A2D15EC9B4CBD892"><enum>(A)</enum><header>Surplus of Federal land</header><text display-inline="yes-display-inline">If the value of the Federal land exceeds the value of the non-Federal land, the value of the Federal land and non-Federal land shall be equalized, as determined to be appropriate and acceptable by the Secretary and the State, by one or more of the following:</text> 
<clause id="HAC93D51559C74C7D903F8612536777AA"><enum>(i)</enum><text>By reducing the acreage of the Federal land to be conveyed.</text></clause> 
<clause id="H43817D3151A44117A500CA913EB2B4E4"><enum>(ii)</enum><text>By adding additional State land to the non-Federal land to be conveyed.</text></clause> 
<clause id="H34A64A063243417AAC037FA57EEA3401"><enum>(iii)</enum><text display-inline="yes-display-inline">Consistent with section 206(b) of the Federal Land Policy and Management Act (43 U.S.C. 1716), by cash equalization of not more than 5 percent of the total value of the lands or interests in lands to be transferred out of Federal ownership.</text></clause></subparagraph> 
<subparagraph id="HC9E61593EE49407CA253908B9030B617"><enum>(B)</enum><header>Surplus of non-Federal land</header><text display-inline="yes-display-inline">If the value of the non-Federal land exceeds the value of the Federal land, the value of the Federal land and non-Federal land shall be equalized, as determined to be appropriate and acceptable by the Secretary and the State, by one or both of the following:</text> 
<clause id="H0FA3CE5BA5124159A1E08B51C547D0A9"><enum>(i)</enum><text display-inline="yes-display-inline">By reducing the acreage of the non-Federal land to be conveyed.</text></clause> 
<clause id="H28B7642F1E144315A17091F2934CCBA0"><enum>(ii)</enum><text display-inline="yes-display-inline">Consistent with section 206(b) of the Federal Land Policy and Management Act (43 U.S.C. 1716), by cash equalization of not more than 5 percent of the total value of the lands or interests in lands to be transferred out of Federal ownership.</text></clause></subparagraph></paragraph> 
<paragraph id="HD857B1D558714C75AE1764FCED7E8D9A"><enum>(3)</enum><header>Notice and public inspection</header> 
<subparagraph id="HB803A7E2DFAE4EB38C05C5812E9E990F"><enum>(A)</enum><header>In general</header><text>If the Secretary and the State determine to add or remove land from the exchange, the Secretary or the State shall—</text> 
<clause id="H2F92912822514DD69D83EB6FC40DD983"><enum>(i)</enum><text>publish in a newspaper of general circulation in Salt Lake County, Utah, a notice that identifies when and where a revised exchange map will be available for public inspection; and</text></clause> 
<clause id="H120C4913938243E2A2EB7DD03ABCFA49"><enum>(ii)</enum><text>transmit to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate a copy of the revised exchange map.</text></clause></subparagraph> 
<subparagraph id="HD9CA3D647CD846AAA53775705F4AA8EA"><enum>(B)</enum><header>Limitation</header><text>The Secretary and the State shall not add or remove land from the exchange until at least 30 days after the date on which the notice is published under subparagraph (A)(i) and the map is transmitted under subparagraph (A)(ii).</text></subparagraph></paragraph></subsection></section> 
<section id="HB3994FFE53CE45F89A5D15442334A9A1"><enum>4.</enum><header>Status and management of land after exchange</header> 
<subsection id="HCCB55FA02809451FA49A785AF90EF83F"><enum>(a)</enum><header>Administration of Non-Federal Land</header> 
<paragraph id="HDBE63BBA6FD84F12BCAF45CD311262EC"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2) and in accordance with section 206(c) of the Federal Land Policy and Management Act of 1976 (43 U.S.C. 1716(c)), the non-Federal land acquired by the United States under this Act shall become part of, and be managed as part of, the Federal administrative unit or area in which the land is located.</text></paragraph> 
<paragraph id="H92BC2CB495FC48C49B3A7B5EB50BCC3B" display-inline="no-display-inline"><enum>(2)</enum><header>Withdrawal Parcels</header><text display-inline="yes-display-inline">Any non-Federal land acquired by the United States under this Act identified on the maps as <quote>Withdrawal Parcels</quote> is withdrawn from the operation of the mineral leasing and mineral material disposal laws.</text></paragraph> 
<paragraph id="H8700F2596ED74B92B8E49257067960BD"><enum>(3)</enum><header>Receipts</header> 
<subparagraph id="H473178DCCE3642EDB23AF9D000FA7AD7"><enum>(A)</enum><header>In general</header><text>Any mineral receipts derived from the non-Federal land acquired under this Act shall be paid into the general fund of the Treasury.</text></subparagraph> 
<subparagraph id="H70B6FE4D0CF6474AA9F9E9082DF53B76"><enum>(B)</enum><header>Applicable law</header><text>Mineral receipts from the non-Federal land acquired under this Act shall not be subject to section 35 of the Mineral Leasing Act (30 U.S.C. 191).</text></subparagraph></paragraph></subsection> 
<subsection id="HBEE835F22A224E6BB635242757311E5D"><enum>(b)</enum><header>Grazing Permits</header> 
<paragraph id="HE4EC50E55B4A4E8590966CDF6AD58CF9"><enum>(1)</enum><header>In general</header><text>If land conveyed under this Act is subject to a lease, permit, or contract for the grazing of domestic livestock in effect on the date of acquisition, the Secretary and the State shall allow the grazing to continue for the remainder of the term of the lease, permit, or contract, subject to the related terms and conditions of user agreements, including permitted stocking rates, grazing fee levels, access rights, and ownership and use of range improvements.</text></paragraph> 
<paragraph id="HB3708C3BA4C84B9AA14F1F0CA1E8CC5D"><enum>(2)</enum><header>Renewal</header><text>To the extent allowed by Federal or State law, on expiration of any grazing lease, permit, or contract described in paragraph (1), the holder of the lease, permit, or contract shall be entitled to a preference right to renew the lease, permit, or contract.</text></paragraph> 
<paragraph id="HE45097C4A0E446F8AC39D52171A73309"><enum>(3)</enum><header>Cancellation</header> 
<subparagraph id="HEE68CFCC02AF42858DB8027E453E89FE"><enum>(A)</enum><header>In general</header><text>Nothing in this Act prevents the Secretary or the State from canceling or modifying a grazing permit, lease, or contract if the land subject to the permit, lease, or contract is sold, conveyed, transferred, or leased for nongrazing purposes by the Secretary or the State.</text></subparagraph> 
<subparagraph id="HE608517C37AB455B8C28AE7A9A07A736"><enum>(B)</enum><header>Limitation</header><text>Except to the extent reasonably necessary to accommodate surface operations in support of mineral development, the Secretary or the State shall not cancel or modify a grazing permit, lease, or contract because the land subject to the permit, lease, or contract has been leased for mineral development.</text></subparagraph></paragraph> 
<paragraph id="H7669D9751D824D52989204FF8A279E07"><enum>(4)</enum><header>Base properties</header><text>If land conveyed by the State under this Act is used by a grazing permittee or lessee to meet the base property requirements for a Federal grazing permit or lease, the land shall continue to qualify as a base property for the remaining term of the lease or permit and the term of any renewal or extension of the lease or permit.</text></paragraph></subsection> 
<subsection id="H1ED8E73EED5E4FE3B28D4500E7258A54"><enum>(c)</enum><header>Hazardous Materials</header> 
<paragraph id="H64452EBC9EC04D6AAE2FBF46A1F8D0E6"><enum>(1)</enum><header>In general</header><text>The Secretary and, as a condition of the exchange, the State shall make available for review and inspection any record relating to hazardous materials on the land to be exchanged under this Act.</text></paragraph> 
<paragraph id="H6076BCD637D94F91B37ECBC416FC4B7C"><enum>(2)</enum><header>Costs</header><text>The costs of remedial actions relating to hazardous materials on land acquired under this Act shall be paid by those entities responsible for the costs under applicable law.</text></paragraph></subsection> 
<subsection id="H8AA49307FB604BCD9B3519F5EF664F3C"><enum>(d)</enum><header>Easement</header><text>The conveyance of Federal land in sec. 33, T. 4 S., R. 24 E., and sec. 4, T. 5 S., R. 24 E., of the Salt Lake Meridian, shall be subject to a 1,000 foot wide scenic easement and a 200 foot wide road right-of-way previously granted to the National Park Service for the Dinosaur National Monument, as described in Land Withdrawal No. U–0141143, pursuant to the Act of September 8, 1960 (74 Stat. 857,861).</text></subsection></section> 
<section id="H1CA0C4B070C24E24BE6B8EA937D637EA" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header>Termination of authority</header><text display-inline="no-display-inline">The provisions of this Act shall terminate 5 years after the date of enactment.</text></section> 
<section id="H628C7B846DFF4CF99B370D2687039B07"><enum>6.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as are necessary to carry out this Act.</text></section>
