		<official-title>To reauthorize community development block grants, and
		  for other purposes.</official-title>

		<section id="HD6250E758C5A4144920000612E4668A7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Affordable Housing and Community
			 Development Act of 2009</short-title></quote>.</text>
		</section><section id="H492FC36738224EA09D878DC93C4618BA"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
			<paragraph id="HB523376D880A480594BEABFFE9FB3FE"><enum>(1)</enum><text display-inline="yes-display-inline">The community development block grant
			 program was originally authorized under title I of the Housing and Community
			 Development Act of 1974.</text>
			</paragraph><paragraph id="HB79B7610F823448989BDEA2C8719A8B2"><enum>(2)</enum><text>The program
			 provides annual grants on a formula basis to entitlement cities and counties to
			 develop viable urban communities by providing decent housing and a suitable
			 living environment, and by expanding economic opportunities, principally for
			 low- and moderate-income persons.</text>
			</paragraph><paragraph id="HEAEEDAD88BB349DABF5D585EDD191CAC"><enum>(3)</enum><text>The program has
			 assisted millions of persons through the funding of housing, public services,
			 public facilities, and economic development activities.</text>
			</paragraph><paragraph id="H2119FBE299E145F6A0C6F2BFB75F434"><enum>(4)</enum><text>The program has
			 been underfunded, particularly in the previous 8 years.</text>
			</paragraph></section><section id="HFE6411640B2C41FF876FC4C47D267200"><enum>3.</enum><header>Community
			 Development Block Grants</header>
			<subsection id="H522598402CE241BFB4CEB4F02F1DD64"><enum>(a)</enum><header>Reauthorization</header><text display-inline="yes-display-inline">Section 103 of the Housing and Community
			 Development Act of 1974 (42 U.S.C. 5303) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H44F42B702D4A4C4F9307CE126F89A0EB" style="OLC">
					<section id="H625803229AC64B52821594C08C608BEF"><enum>103.</enum><header>Grants to
				States, units of general local government and Indian tribes;
				authorizations</header>
						<subsection commented="no" id="HB1C78D864D5D49159210E3B8FC9D26F5"><enum>(a)</enum><header>Authorizations
				of Appropriations</header>
							<paragraph commented="no" id="H7C8DDAAAEBB740AFBA3F4FEE52489CDA"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary is authorized to make grants
				to States, units of general local government, and Indian tribes to carry out
				activities in accordance with the provisions of this chapter. For purposes of
				assistance under section 106 of this title, there are authorized to be
				appropriated—</text>
								<subparagraph commented="no" id="HFB1887B56FDF4F2088C9267779829F00"><enum>(A)</enum><text display-inline="yes-display-inline">$8,000,000,000 for fiscal year 2011, as
				such amount is adjusted by application of the inflation index established under
				subsection (b); and</text>
								</subparagraph><subparagraph commented="no" id="HFFAD42DA14404BDCAFECD9B18B3EF08E"><enum>(B)</enum><text display-inline="yes-display-inline">for fiscal year 2012 and each fiscal year
				thereafter, the amount authorized in the preceding year, as adjusted based on
				the index established under subsection (b).</text>
								</subparagraph></paragraph><paragraph commented="no" id="HDC30CC014C904EA2B561C6E948D04380"><enum>(2)</enum><text>Any amounts
				appropriated pursuant to the authorization under this section shall remain
				available until expended.</text>
							</paragraph></subsection><subsection id="H08946E52508F4B6C8F275E8E43C7CA00"><enum>(b)</enum><header>Inflation
				Index</header><text display-inline="yes-display-inline">Not later than
				September 30, 2010, the Secretary shall conduct a study to determine
				appropriate factors on which to base an inflation index, taking into
				consideration the activities conducted pursuant to the provisions of this title
				and the costs associated with such activities, and establish such index based
				on such factors. The Secretary shall consult with grant recipients under this
				title and appropriate organizations and entities representing such grant
				recipients in conducting such study and establishing such an index.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE06F57F57D7842D2BC7D223B9626C6E6"><enum>(b)</enum><header>Technical
			 Assistance Funding for grant recipients</header><text display-inline="yes-display-inline">Section 105 of the Housing and Community
			 Development Act of 1974 (42 U.S.C. 5305) is amended by adding at the end the
			 following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H9873C90E13F74157B154D9593E1C939C" style="OLC">
					<subsection id="HBFB80EE5B9864655A3162E90972EE2D0"><enum>(i)</enum><header>Technical
				Assistance for grant recipients</header>
						<paragraph id="H3E43969AC07543BD8BF84D5CA4F14C04"><enum>(1)</enum><header>Authorization
				for additional funding for technical assistance</header><text display-inline="yes-display-inline">There is authorized to be appropriated to
				the Secretary $5,000,000 for fiscal year 2011 and each fiscal year thereafter
				for technical assistance described in paragraph (2) and training for grant
				recipients.</text>
						</paragraph><paragraph id="H038ED274654442F0B03DEE48A956C098"><enum>(2)</enum><header>Use of
				funds</header><text>Funds provided pursuant to the authorization under
				paragraph (1) shall be used to provide ongoing technical assistance and
				training to grant recipients to assist such recipients in carrying out the
				requirements of this
				title.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE946AB9B809C48E68712398F61987448"><enum>(c)</enum><header>Furthering fair
			 housing activities as Direct Program Costs</header><text display-inline="yes-display-inline">Section 104 of the Housing and Community
			 Development Act of 1974 (42 U.S.C. 5304) is amended by adding at the end the
			 following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H7C3EF7FBBD574A70BEB3CDD35E7E7F75" style="OLC">
					<subsection id="HE991299C7A594A23B95CBD22A5DE7195"><enum>(n)</enum><header>Furthering fair
				housing</header><text display-inline="yes-display-inline">Costs of any activity
				that a grant recipient certifies as affirmatively furthering fair housing shall
				not be considered an expenditure for planning or program administrative costs
				for purposes of this title.</text>
