<section id="H22B865C492FD44289CD6B34F85C6D951" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Multiple Peril Insurance Act of 2009</short-title></quote>.</text> </section>

<section id="H358B590752E44D86AD10A311A6BCCBB3" section-type="subsequent-section"><enum>2.</enum><header>Coverage for windstorms</header><text display-inline="no-display-inline">Section 1304 of the National Flood Insurance Act of 1968 (42 U.S.C. 4011) is amended—</text> 

<paragraph id="H3EBE8C3F27454051BDC8F7FE012FFC07"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d); and</text> </paragraph>

<paragraph id="H879BF597B47448958E8118F4B2B26600"><enum>(2)</enum><text>by inserting after subsection (b) the following new subsection:</text>

<subsection id="HAAFA15D2390544D9880044AEC324A7E9"><enum>(c)</enum><header>Multiperil coverage for damage from flood or windstorm and separate coverage for windstorm</header> 

<paragraph id="H9946ADB8165344A4A04234B2EA90B05C"><enum>(1)</enum><header>In general</header><text>The national flood insurance program established pursuant to subsection (a) shall enable the purchase of the following coverages:</text> 

<subparagraph id="H0161C7659EDF45E098F3DB9F0D900B7"><enum>(A)</enum><header>Multiperil coverage</header><text>Optional insurance against loss resulting from physical damage to or loss of real property or personal property related thereto located in the United States arising from any flood or windstorm, subject to the limitations in this subsection and section 1306(b); and</text> </subparagraph>

<subparagraph id="HBCC295DE2A36427B9CD9F63C64397D28"><enum>(B)</enum><header>Separate windstorm coverage</header><text display-inline="yes-display-inline">Optional insurance against loss resulting from physical damage to or loss of real property or personal property related thereto located in the United States arising from any windstorm, subject to the limitations in this subsection and section 1306(b).</text> </subparagraph></paragraph>

<paragraph id="H0A3BF5D80F9B4B81ADEE008014B5D0A5"><enum>(2)</enum><header>Community participation requirement</header><text display-inline="yes-display-inline">Multiperil coverage pursuant to paragraph (1)(A) and windstorm coverage pursuant to paragraph (1)(B) may not be provided in any area (or subdivision thereof) unless an appropriate public body shall have adopted adequate mitigation measures (with effective enforcement provisions) which the Director finds are consistent with the criteria for construction described in the International Code Council building codes relating to wind mitigation.</text> </paragraph>

<paragraph id="HD15548F074DB4E329DA30DDCAEDF40"><enum>(3)</enum><header>Relationship to flood insurance coverage</header> 

<subparagraph id="HE4F927F22CA64D8AB777B080E769D72D"><enum>(A)</enum><header>Prohibition against duplicative coverage</header><text>Multiperil coverage pursuant to paragraph (1)(A) may not be provided with respect to any structure (or the personal property related thereto) for any period during which such structure is covered, at any time, by flood insurance coverage made available under this title.</text> </subparagraph>

<subparagraph commented="no" id="H28363F1D75574E2F90951386C56BADC8"><enum>(B)</enum><header>Requirement to maintain flood insurance coverage</header><text display-inline="yes-display-inline">Windstorm coverage pursuant to paragraph (1)(B) may be provided only with respect to a structure (and the personal property related thereto) that is covered by flood insurance coverage made available under this title and only during the period that such structure (and personal property) are so covered.</text> </subparagraph></paragraph>

<paragraph id="HA11B1B58C5F24FF2A375EA4BC50276D"><enum>(4)</enum><header>Nature of coverage</header> 

<subparagraph id="HAEE23F9F2FFF466B8C24B8F873BE475"><enum>(A)</enum><header>Multiperil coverage</header><text display-inline="yes-display-inline">Multiperil coverage pursuant to paragraph (1)(A) shall—</text> 

<clause id="H18A884FB4C904058BC21DD28346900B8"><enum>(i)</enum><text>cover losses only from physical damage resulting from flooding or windstorm; and</text> </clause>

<clause id="HABCD70847827431B91F31803C4291C71"><enum>(ii)</enum><text>provide for approval and payment of claims under such coverage upon proof that such loss must have resulted from either windstorm or flooding, but shall not require for approval and payment of a claim that the specific cause of the loss, whether windstorm or flooding, be distinguished or identified.</text> </clause></subparagraph>

<subparagraph id="HA7A8406621EE4502BD1D0881C2B1F407"><enum>(B)</enum><header>Separate windstorm coverage</header><text>Windstorm coverage pursuant to paragraph (1)(B) shall—</text> 

<clause id="H9463229BEF714C1798F359A7497BEBC3"><enum>(i)</enum><text>cover losses only from physical damage resulting from windstorm; and</text> </clause>

<clause id="H10A0D53787C54C62947350C1B76D052"><enum>(ii)</enum><text>provide for approval and payment of claims under such coverage or under the flood insurance coverage required to be maintained under paragraph (3)(B) upon a determination that such loss from windstorm or flooding, respectively, but shall not require for approval and payment of a claim that the insured distinguish or identify the specific cause of the loss, whether windstorm or flooding.</text> </clause></subparagraph></paragraph>

<paragraph id="H1BC5E4376985440D80C867C54DDAC212"><enum>(5)</enum><header>Actuarial rates</header><text>Multiperil coverage pursuant to paragraph (1)(A) and windstorm coverage pursuant to paragraph (1)(B) shall be made available for purchase for a property only at chargeable risk premium rates that, based on consideration of the risks involved and accepted actuarial principles, and including operating costs and allowance and administrative expenses, are required in order to make such coverage available on an actuarial basis for the type and class of properties covered.</text> </paragraph>

<paragraph id="HCEAFFAFC55874C44B173F4CD741E915"><enum>(6)</enum><header>Terms of coverage</header><text>The Director shall, after consultation with persons and entities referred to in section 1306(a), provide by regulation for the general terms and conditions of insurability applicable to properties eligible for multiperil coverage pursuant to paragraph (1)(A) and such terms and conditions applicable to properties eligible for windstorm coverage pursuant to paragraph (1)(B), subject to the provisions of this subsection, including—</text> 

<subparagraph id="H8BD6ACC82A5A4A3E8CA20000CBCBD444"><enum>(A)</enum><text>the types, classes, and locations of any such properties which shall be eligible for such coverages, which shall include residential and nonresidential properties;</text> </subparagraph>

<subparagraph id="H7310E016DE67472EBDD090A1FF9C0600"><enum>(B)</enum><text>subject to paragraph (7), the nature and limits of loss or damage in any areas (or subdivisions thereof) which may be covered by such coverages;</text> </subparagraph>

<subparagraph id="H699825A13487442FB9572642956200D6"><enum>(C)</enum><text>the classification, limitation, and rejection of any risks which may be advisable;</text> </subparagraph>

<subparagraph id="HBBDB39E215FB4EBBA5AC36DB66107D56"><enum>(D)</enum><text>appropriate minimum premiums;</text> </subparagraph>

<subparagraph id="HEE40F6C0F19B414D834E54146761D555"><enum>(E)</enum><text>appropriate loss deductibles; and</text> </subparagraph>

<subparagraph id="H84681FBDC5984F7F00AEE547009060E"><enum>(F)</enum><text>any other terms and conditions relating to insurance coverage or exclusion that may be necessary to carry out this subsection.</text> </subparagraph></paragraph>

<paragraph id="H73B3CDB6BA954998B9501D634B88B861"><enum>(7)</enum><header>Limitations on amount of coverage</header> 

<subparagraph id="HCA6525C3520F423380213E47A3973651"><enum>(A)</enum><header>Multiperil coverage</header><text>The regulations issued pursuant to paragraph (6) shall provide that the aggregate liability under multiperil coverage made available under this subsection shall not exceed the lesser of the replacement cost for covered losses or the following amounts, as applicable:</text> 

<clause id="H56545D543A07466F8CEC566D6D52316F"><enum>(i)</enum><header>Residential structures</header><text display-inline="yes-display-inline">In the case of residential properties, which shall include structures containing multiple dwelling units that are made available for occupancy by rental (notwithstanding any treatment or classification of such properties for purposes of section 1306(b))—</text> 

<subclause id="H6AB4EB18B9E54893827E80C2AB734C19"><enum>(I)</enum><text>for any single-family dwelling, $500,000;</text> </subclause>

<subclause id="H422EDBC426324B62822CC34E1B250E9"><enum>(II)</enum><text display-inline="yes-display-inline">for any structure containing more than one dwelling unit, $500,000 for each separate dwelling unit in the structure, which limit, in the case of such a structure containing multiple dwelling units that are made available for occupancy by rental, shall be applied so as to enable any insured or applicant for insurance to receive coverage for the structure up to a total amount that is equal to the product of the total number of such rental dwelling units in such property and the maximum coverage limit per dwelling unit specified in this clause; and</text> </subclause>

<subclause id="HE6F27C65A8224C15B906DC86BFC99D62"><enum>(III)</enum><text>$150,000 per dwelling unit for—</text> 

<item id="H6E3DA57E9EB4490096EF59AC34DC636F"><enum>(aa)</enum><text>any contents related to such unit; and</text> </item>

<item id="HBA29994547314A11A7DA1D835ED78EA5"><enum>(bb)</enum><text>any necessary increases in living expenses incurred by the insured when losses from flooding or windstorm make the residence unfit to live in.</text> </item></subclause></clause>

<clause id="HC2737FB3753D4E9BB7A8F894ACA9CAC"><enum>(ii)</enum><header>Nonresidential properties</header><text display-inline="yes-display-inline">In the case of nonresidential properties (including church properties)—</text> 

<subclause id="H490442278411475CB7464F94ED6CB431"><enum>(I)</enum><text>$1,000,000 for any single structure; and</text> </subclause>

<subclause id="HE0CB0BF5BE4C4198868D7C2570189343"><enum>(II)</enum><text>$750,000 for—</text> 

<item id="H3D2F43B733484145B4CDE22E52EEABB7"><enum>(aa)</enum><text>any contents related to such structure; and</text> </item>

<item id="HFE260221213447CA823CF72589EFD946"><enum>(bb)</enum><text>in the case of any nonresidential property that is a business property, any losses resulting from any partial or total interruption of the insured’s business caused by damage to, or loss of, such property from flooding or windstorm, except that for purposes of such coverage, losses shall be determined based on the profits the covered business would have earned, based on previous financial records, had the flood or windstorm not occurred.</text> </item></subclause></clause></subparagraph>

<subparagraph id="H89616D049B764C14BCDD526300B81017"><enum>(B)</enum><header>Separate windstorm coverage</header><text display-inline="yes-display-inline">The regulations issued pursuant to paragraph (6) shall provide that windstorm coverage pursuant to paragraph (1)(B) for a property shall not exceed the amount such that the aggregate liability under flood insurance coverage required to be maintained under paragraph (3)(B) for the property and such windstorm coverage for the property does not exceed the applicable coverage limit for the property set forth in subparagraph (A) of this paragraph.</text> </subparagraph></paragraph>

<paragraph id="H6F20F3E762B84E2D9C72EE705016B00"><enum>(8)</enum><header>Effective Date</header><text>This subsection shall take effect on, and shall apply beginning on, the expiration of the 6-month period that begins on the date of the enactment of the <short-title>Multiple Peril Insurance Act of 2009</short-title>.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>

<section id="H21287099284C4A19B5E66674C1B483EE"><enum>3.</enum><header>Prohibition against duplicative coverage</header><text display-inline="no-display-inline">The National Flood Insurance Act of 1968 is amended by inserting after section 1313 (42 U.S.C. 4020) the following new section:</text> 

<quoted-block display-inline="no-display-inline" id="H2A202B81AFE941D1A8EB874FC413161F" style="traditional"> 

<section display-inline="no-display-inline" id="H158DEF7C8CD242D19BF44CB9DD744784"><enum>1314.</enum><header>Prohibition against duplicative coverage</header><text display-inline="yes-display-inline">Flood insurance under this title may not be provided with respect to any structure (or the personal property related thereto) for any period during which such structure is covered, at any time, by multiperil insurance coverage made available pursuant to section 1304(c)(1)(A).</text> </section><after-quoted-block>.</after-quoted-block></quoted-block> </section>

<section id="HBD37F055A9E941D28100E05940FE4754"><enum>4.</enum><header>Compliance with State and local law</header><text display-inline="no-display-inline">Section 1316 of the National Flood Insurance Act of 1968 (42 U.S.C. 4023) is amended—</text> 

<paragraph id="H228027AFC7774A16BC69B9D64E41B0EA"><enum>(1)</enum><text>by inserting <quote>(a) <header-in-text level="subsection" style="OLC">Flood protection measures</header-in-text>.—</quote> before <quote>No new</quote>; and</text> </paragraph>

<paragraph id="HF9ED937880894EB68073AEF5000212D6"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> 

<quoted-block display-inline="no-display-inline" id="H89822A0A2D5D497FAB388FE26B4D2BF7" style="OLC"> 

<subsection id="HE4D84B5F531C4C95AF8FE6EDE6906560"><enum>(b)</enum><header>Windstorm protection measures</header><text>No new multiperil coverage shall be provided under section 1304(c) for any property that the Director finds has been declared by a duly constituted State or local zoning authority, or other authorized public body to be in violation of State or local laws, regulations, or ordinances, which are intended to reduce damage caused by windstorms.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>

<section id="H8A4A1FBC444047FD87F7D300AB9C005C"><enum>5.</enum><header>Criteria for land management and use</header><text display-inline="no-display-inline">Section 1361 of the National Flood Insurance Act of 1968 (42 U.S.C. 4102) is amended by adding at the end the following new subsection:</text>

<subsection id="HF8800BC425E14C8CB56C79308EE69833"><enum>(d)</enum><header>Windstorms</header> 

<paragraph id="HA615F4FA2019400EBED483DC10005307"><enum>(1)</enum><header>Studies and investigations</header><text>The Director shall carry out studies and investigations under this section to determine appropriate measures in wind events as to wind hazard prevention, and may enter into contracts, agreements, and other appropriate arrangements to carry out such activities. Such studies and investigations shall include laws, regulations, and ordinance relating to the orderly development and use of areas subject to damage from windstorm risks, and zoning building codes, building permits, and subdivision and other building restrictions for such areas.</text> </paragraph>

<paragraph id="H89C2435E69964E649C1D7C2EECF09F4"><enum>(2)</enum><header>Coordination with State and local governments</header><text>The Director shall work closely with and provide any necessary technical assistance to State, interstate, and local governmental agencies, to encourage the application of measures identified pursuant to paragraph (1) and the adoption and enforcement of such measures.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>

<section id="H037B66CE2F134450BD08B9AB6700F639"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 1370 of the National Flood Insurance Act of 1968 (42 U.S.C. 4121) is amended—</text> 

<paragraph id="H4EA56F13C2FB4A109E4E767ED60AD89"><enum>(1)</enum><text>in paragraph (14), by striking <quote>and</quote> at the end;</text> </paragraph>

<paragraph id="H5347312562F54572989DD97D28B309D4"><enum>(2)</enum><text>in paragraph (15) by striking the period at the end and inserting <quote>; and</quote>; and</text> </paragraph>

<paragraph id="H6F4F254AFCC24BF3AACCE0A5B0BAA3D6"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>
