			 PLAN ENHANCEMENT</header>
			<section id="H8976400313AC41098FF9184409C8FC3D" section-type="subsequent-section"><enum>101.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Thrift Savings Plan Enhancement
			 Act of 2009</short-title></quote>.</text>
			</section><section id="H0C60C8FD88CD4085A38E25692023A700"><enum>102.</enum><header>Automatic
			 enrollments</header>
				<subsection id="H6DE1B5553E084A8C9E3ECA473846F8F5"><enum>(a)</enum><header>In
			 general</header><text>Section 8432(b) of title 5, United States Code, is
			 amended by striking paragraphs (2) through (4) and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="HBCE1374A0EDD42EF0074D6C7D184BA12" style="USC">
						<paragraph id="H82684F45D49648608BF781F7093EDED5" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H2D8EDBC2206043C8B0B89019CD7227AA"><enum>(A)</enum><text>The Board shall by
				regulation provide for an eligible individual to be automatically enrolled to
				make contributions under subsection (a) at the default percentage of basic
				pay.</text>
							</subparagraph><subparagraph id="HA063FE1F29214117B58E2F92F900FFE3" indent="up1"><enum>(B)</enum><text>For purposes of this paragraph, the
				default percentage shall be equal to 3 percent or such other percentage, not
				less than 2 percent nor more than 5 percent, as the Board may by regulation
				prescribe.</text>
							</subparagraph><subparagraph id="H66E88958B2FF4CC38F1F80FB23137B2E" indent="up1"><enum>(C)</enum><text>The regulations shall include
				provisions under which any individual who would otherwise be automatically
				enrolled in accordance with subparagraph (A) may—</text>
								<clause id="HFC2F461677CD449DAC0459191C6DBA8C"><enum>(i)</enum><text>modify the percentage or amount to be
				contributed pursuant to automatic enrollment, effective from the start of such
				enrollment; or</text>
								</clause><clause id="H59C11E5F578843F79FDC1EAE490759A5"><enum>(ii)</enum><text>decline automatic enrollment
				altogether.</text>
								</clause></subparagraph><subparagraph id="H606B71F5ABEB444FA5006E36751875FE" indent="up1"><enum>(D)</enum><text>For purposes of this paragraph, the
				term <term>eligible individual</term> means any individual who, after any
				regulations under subparagraph (A) first take effect, is appointed,
				transferred, or reappointed to a position in which that individual is eligible
				to contribute to the Thrift Savings Fund.</text>
							</subparagraph><subparagraph commented="no" id="HE2E44099D48140ED9C99D6F2D3763F82" indent="up1"><enum>(E)</enum><text>Sections 8351(a)(1), 8440a(a)(1),
				8440b(a)(1), 8440c(a)(1), 8440d(a)(1), and 8440e(a)(1) shall be applied in a
				manner consistent with the purposes of this
				paragraph.</text>
							</subparagraph></paragraph><after-quoted-block>.
				</after-quoted-block></quoted-block>
				</subsection><subsection id="H015549D98FE84369BFBCCC3B7B4EFEE1"><enum>(b)</enum><header>Technical
			 amendment</header><text>Section 8432(b)(1) of title 5, United States Code, is
			 amended by striking the parenthetical matter in subparagraph (B).</text>
				</subsection></section><section id="HEE394C0F1DD54F5E87EF26D0B4D41D50" section-type="subsequent-section"><enum>103.</enum><header>Qualified Roth
			 contribution program</header>
				<subsection id="H7139C8A3F0A5429580F96102041FA3EB"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter III of
			 chapter 84 of title 5, United States Code, is amended by inserting after
			 section 8432c the following:</text>
					<quoted-block display-inline="no-display-inline" id="H3D481E9870FD4DD19995475856C7C533" style="USC">
						<section id="HF80F6996AC81419EB63D279C143EABB4"><enum>8432d.</enum><header>Qualified
				Roth contribution program</header>
							<subsection id="H0C97333A25914719A18246E4D2B62167"><enum>(a)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
								<paragraph id="H5C1B1FF6EF364D3E8191DAACE8F3AD2C"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>qualified Roth contribution
				program</term> means a program described in paragraph (1) of section 402A(b) of
				the Internal Revenue Code of 1986 which meets the requirements of paragraph (2)
				of such section; and</text>
								</paragraph><paragraph id="H3112B9147DB94BE5BCF34B41E095C8FF"><enum>(2)</enum><text display-inline="yes-display-inline">the terms <term>designated Roth
				contribution</term> and <term>elective deferral</term> have the meanings given
				such terms in section 402A of the Internal Revenue Code of 1986.</text>
								</paragraph></subsection><subsection id="HABBBF5B6B6714DA88C035E89C9B0BDC1"><enum>(b)</enum><header>Authority To
				establish</header><text>The Board shall by regulation provide for the inclusion
				in the Thrift Savings Plan of a qualified Roth contribution program, under such
				terms and conditions as the Board may prescribe.</text>
							</subsection><subsection id="H9FDC0202F64A47A691BF6F74529CA9F7"><enum>(c)</enum><header>Required
				provisions</header><text>The regulations under subsection (b) shall
				include—</text>
								<paragraph id="H2F6F42CB95BA440A9BDDD4B6E5111282"><enum>(1)</enum><text>provisions under
				which an election to make designated Roth contributions may be made—</text>
									<subparagraph id="H0BDD5FBD69924FCFA4DFAE9397008F17"><enum>(A)</enum><text>by any individual
				who is eligible to make contributions under section 8351, 8432(a), 8440a,
				8440b, 8440c, 8440d, or 8440e; and</text>
									</subparagraph><subparagraph id="H65F8F9AF7F6D4D87A5760060BD79EB9C"><enum>(B)</enum><text>by any individual,
				not described in subparagraph (A), who is otherwise eligible to make elective
				deferrals under the Thrift Savings Plan;</text>
									</subparagraph></paragraph><paragraph id="HAD6C41F12EBA4B11B7FC3214BCA2212D"><enum>(2)</enum><text display-inline="yes-display-inline">any provisions which may, as a result of
				enactment of this section, be necessary in order to clarify the meaning of any
				reference to an <quote>account</quote> made in section 8432(f), 8433, 8434(d),
				8435, 8437, or any other provision of law; and</text>
								</paragraph><paragraph id="H6767E02F885E403E8F7CC9276DB947D2"><enum>(3)</enum><text display-inline="yes-display-inline">any other provisions which may be necessary
				to carry out this
				section.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HA3F9A7CCE28E4417A6D5BAB842969001"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The analysis for chapter 84 of title 5, United States
			 Code, is amended by inserting after the item relating to section 8432c the
			 following:</text>

				</subsection></section><section commented="no" id="H84F12BB2C19448AB8487B3DD063EB01D"><enum>104.</enum><header>Authority to
			 establish self-directed investment window</header>
				<subsection commented="no" id="H0979F0AD62C149D8901798659E8F5F43"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 8438(b)(1) of
			 title 5, United States Code, is amended—</text>
					<paragraph commented="no" id="HFD87017919FB44C788B16F02195FDC7E"><enum>(1)</enum><text>in subparagraph
			 (D), by striking <quote>and</quote> at the end;</text>
					</paragraph><paragraph commented="no" id="HB2F37012FC834EBAAF6611AC4555549F"><enum>(2)</enum><text>in subparagraph
			 (E), by striking the period and inserting <quote>; and</quote>; and</text>
					</paragraph><paragraph commented="no" id="H7513A813C9BB4E6D80606B088B1EDE40"><enum>(3)</enum><text>by adding after
			 subparagraph (E) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H81618421BC30467B99ACF5182CA33300" style="USC">
							<subparagraph commented="no" id="H56F09C8EBC574480B1664041ADA877DD"><enum>(F)</enum><text display-inline="yes-display-inline">a self-directed investment window, if the
				Board authorizes such window under paragraph
				(5).</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" id="H915259B8B93A4FF4BACCD0E68F2924E9"><enum>(b)</enum><header>Requirements</header><text>Section
			 8438(b) of title 5, United States Code, is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="HAC558D8704CA4AFC9C592EFDCCF27793" style="USC">
						<paragraph commented="no" id="HCDC265B90CC144209EE7E99BB85C4F00" indent="up1"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HD3461F068F844DDF81B58C468813EC1"><enum>(A)</enum><text display-inline="yes-display-inline">The Board may authorize the addition of a
				self-directed investment window under the Thrift Savings Plan if the Board
				determines that such addition would be in the best interests of
				participants.</text>
							</subparagraph><subparagraph id="HB4141681668049BE87FA5110DEBFF300" indent="up1"><enum>(B)</enum><text>The self-directed investment window
				shall be limited to—</text>
								<clause id="HFA99B11CCD554FDB91877C703375BE63"><enum>(i)</enum><text>low-cost, passively-managed index
				funds that offer diversification benefits; and</text>
								</clause><clause id="H6F58725F99584F6D9899179577B523B4"><enum>(ii)</enum><text>other investment options, if the
				Board determines the options to be appropriate retirement investment vehicles
				for participants.</text>
								</clause></subparagraph><subparagraph id="H2BA75620056144D6AF5FF000A6F96CF" indent="up1"><enum>(C)</enum><text>The Board shall ensure that any
				administrative expenses related to use of the self-directed investment window
				are borne solely by the participants who use such window.</text>
							</subparagraph><subparagraph id="HC5CA298D744F4FCB95943800F1E2F385" indent="up1"><enum>(D)</enum><text>The Board may establish such other
				terms and conditions for the self-directed investment window as the Board
				considers appropriate to protect the interests of participants, including
				requirements relating to risk disclosure.</text>
							</subparagraph><subparagraph id="HE2801CB33D0142EBB59FFD0072229E4B" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">The Board shall consult with the Employee
				Thrift Advisory Council (established under section 8473) before establishing
				any self-directed investment
				window.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H46CF8BD87B5B4328A1E3428DF131873"><enum>105.</enum><header>Reporting
			 requirements</header>
				<subsection id="H55F83989BB924286AE7020556B095E8D"><enum>(a)</enum><header>Annual
			 report</header><text display-inline="yes-display-inline">The Board shall, not
			 later than June 30 of each year, submit to Congress an annual report on the
			 operations of the Thrift Savings Plan. Such report shall include, for the prior
			 calendar year, information on the number of participants as of the last day of
			 such prior calendar year, the median balance in participants’ accounts as of
			 such last day, demographic information on participants, the percentage
			 allocation of amounts among investment funds or options, the status of the
			 development and implementation of the self-directed investment window, the
			 diversity demographics of any company, investment adviser, or other entity
			 retained to invest and manage the assets of the Thrift Savings Fund, and such
			 other information as the Board considers appropriate. A copy of each annual
			 report under this subsection shall be made available to the public through an
			 Internet website.</text>
				</subsection><subsection id="HF569FBF42D77468FB300F19351A38E1E"><enum>(b)</enum><header>Reporting of
			 fees and other information</header>
					<paragraph id="H275BD6C7BA8E4ED78F6256EEAAB06C52"><enum>(1)</enum><header>In
			 general</header><text>The Board shall include in the periodic statements
			 provided to participants under section 8439(c) the amount of the investment
			 management fees, administrative expenses, and any other fees or expenses paid
			 with respect to each investment fund and option under the Thrift Savings Plan.
			 Any such statement shall also provide a statement notifying participants as to
			 how they may access the annual report described in subsection (a), as well as
			 any other information concerning the Thrift Savings Plan that might be
			 useful.</text>
					</paragraph><paragraph id="H13D2DBDD74914198AEA6BBC81C49A195"><enum>(2)</enum><header>Use of
			 estimates</header><text>For purposes of providing the information required
			 under this subsection, the Executive Director may provide a reasonable and
			 representative estimate of any fees or expenses described in paragraph (1) and
			 shall indicate any such estimate as being such an estimate. Any such estimate
			 shall be based on the previous year’s experience.</text>
					</paragraph></subsection><subsection commented="no" id="HFE6BFDA223264AB2B018CD4289FBD8C0"><enum>(c)</enum><header>Definitions</header><text>For
			 purposes of this section—</text>
					<paragraph commented="no" id="H47AEF9017E714925982500C723895640"><enum>(1)</enum><text>the term
			 <term>Board</term> has the meaning given such term by 8401(5) of title 5,
			 United States Code;</text>
					</paragraph><paragraph commented="no" id="H288E6168DD244750942D5FF523DD19EE"><enum>(2)</enum><text>the term
			 <term>participant</term> has the meaning given such term by section 8471(3) of
			 title 5, United States Code; and</text>
					</paragraph><paragraph commented="no" id="HAC7230FE76BB4D19BCD4128752D858C8"><enum>(3)</enum><text>the term
			 <term>account</term> means an account established under section 8439 of title
			 5, United States Code.</text>
					</paragraph></subsection></section><section display-inline="no-display-inline" id="H8C7B18C37B464B7D82B2C418E20379B0" section-type="subsequent-section"><enum>106.</enum><header>Acknowledgement of
			 risk</header>
				<subsection id="HB1D670C644A74988B0C466A2BA26CDF6"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 8439(d) of
			 title 5, United States Code, is amended—</text>
					<paragraph id="HFEE9BDA862D04513B2969B97CB0004C0"><enum>(1)</enum><text>by striking the
			 matter after <quote>who elects to invest in</quote> and before <quote>shall
			 sign an acknowledgement</quote> and inserting <quote>any investment fund or
			 option under this chapter, other than the Government Securities Investment
			 Fund,</quote>; and</text>
					</paragraph><paragraph id="H34F0C3183A1544B3875C1587BDB299E3"><enum>(2)</enum><text>by striking
			 <quote>either such Fund</quote> and inserting <quote>any such fund or
			 option</quote>.</text>
					</paragraph></subsection><subsection display-inline="no-display-inline" id="H0B5791BB2513492893C45BA0FCFA3500"><enum>(b)</enum><header>Coordination
			 with provisions relating to investments in the absence of an
			 election</header><text>Subsection (d) of section 8439 of title 5, United States
			 Code (as amended by subsection (a)) is further amended—</text>
					<paragraph id="H1FF4A4B2CA394AA7B98756827973A4FA"><enum>(1)</enum><text>by redesignating
			 subsection (d) as subsection (d)(1); and</text>
					</paragraph><paragraph id="H66B6F09B8D8D48978B19FAC5326DF6E0"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="HBF759AF7F0C74A25858190E410003420" style="USC">
							<paragraph commented="no" id="H44C8BFD4837C41B7AC89443EEDA9DA5" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H700110051E9F42D085395D2BC5F1C386"><enum>(A)</enum><text>In the case of an
				investment made under section 8438(c)(2) in any fund or option to which
				paragraph (1) would otherwise apply, the participant involved shall, for
				purposes of this subsection, be deemed—</text>
									<clause commented="no" id="H51A48ACC385145AAA50042F6675446EE" indent="up1"><enum>(i)</enum><text>to have elected to invest in such fund
				or option; and</text>
									</clause><clause commented="no" id="H826FD8A6F37742B195063E58DB4EBB8" indent="up1"><enum>(ii)</enum><text>to have executed the acknowledgement
				required under paragraph (1).</text>
									</clause></subparagraph><subparagraph id="H489444586D1242D4B43BCD551EBAA4C6" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="HAEB132E1215F47098EED244288EE38B4"><enum>(i)</enum><text>The Executive Director
				shall prescribe regulations under which written notice shall be provided to a
				participant whenever an investment is made under section 8438(c)(2)(B) on
				behalf of such participant in the absence of an affirmative election described
				in section 8438(c)(1).</text>
									</clause><clause id="HF6343918269C452780D05F76A30017FC" indent="up1"><enum>(ii)</enum><text>The regulations shall ensure that
				any such notice shall be provided to the participant within 7 calendar days
				after the effective date of the default election.</text>
									</clause></subparagraph><subparagraph id="HDFE0EE46C0804F75884527E8B001C45" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">For purposes of this paragraph, the term
				<term>participant</term> has the meaning given such term by section
				8471(3).</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" id="H1C5D77634EA14C829585CEE747E3C8A5"><enum>(c)</enum><header>Coordination
			 with provisions relating to fiduciary responsibilities, liabilities, and
			 penalties</header><text>Section 8477(e)(1)(C) of title 5, United States Code,
			 is amended—</text>
					<paragraph id="HEE3091FDBEFD4D0BA77E54E8A9BC54B9"><enum>(1)</enum><text>by redesignating
			 subparagraph (C) as subparagraph (C)(i); and</text>
					</paragraph><paragraph id="H7831C39A97034032A401D9ADA8846C4"><enum>(2)</enum><text>by
			 adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H887572F331EC464C9229CDD8B26F2872" style="USC">
							<clause id="H2AA7E17C4F114695BAF3C6CA2B6051D6" indent="up3"><enum>(ii)</enum><text display-inline="yes-display-inline">A fiduciary shall not be liable under
				subparagraph (A), and no civil action may be brought against a
				fiduciary—</text>
								<subclause id="HB8A9115679E7425081AC62641D2CB634"><enum>(I)</enum><text>for providing for the automatic
				enrollment of a participant in accordance with section 8432(b)(2)(A);</text>
								</subclause><subclause id="H2AB52F81A0BA42B1B818AB92A87804C5"><enum>(II)</enum><text>for enrolling a participant in a
				default investment fund in accordance with section 8438(c)(2)(B); or</text>
								</subclause><subclause id="H80A06DFE8075448AAA53D8329E1DE77D"><enum>(III)</enum><text>for allowing a participant to invest
				through the self-directed investment window or for establishing restrictions
				applicable to participants’ ability to invest through the self-directed
				investment
				window.</text>
								</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section id="HBB80FB40F9344D1EB02192B168ACE500"><enum>107.</enum><header>Credit for
			 unused sick leave</header>
				<subsection id="H83D866CCC5E24C7CA7D62974B49F84EB"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 8415 of title
			 5, United States Code, is amended—</text>
					<paragraph id="HCE5F57B9E14144769735703BF1DD0099"><enum>(1)</enum><text>by redesignating
			 the second subsection (k) and subsection (l) as subsections (l) and (m),
			 respectively; and</text>
					</paragraph><paragraph id="HF42DBE8A8C0346EB814C3B7C007D8BBB"><enum>(2)</enum><text>in subsection (l)
			 (as so redesignated by paragraph (1))—</text>
						<subparagraph id="HFA60DF44CDE84E54B3ED5C1C24384CF1"><enum>(A)</enum><text>by striking
			 <quote>(l) In computing</quote> and inserting <quote>(l)(1) In
			 computing</quote>; and</text>
						</subparagraph><subparagraph id="H056F5C1FEDB74D0989D8B0AD40007667"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
							<quoted-block display-inline="no-display-inline" id="H42F3B8A4480648BBB9C3E8D3DF009E88" style="USC">
								<paragraph id="HFAAA8D4DB3044560A8AAA641F62824ED" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Except as provided in paragraph (1), in
				computing an annuity under this subchapter, the total service of an employee
				who retires on an immediate annuity or who dies leaving a survivor or survivors
				entitled to annuity includes the days of unused sick leave to his credit under
				a formal leave system, except that these days will not be counted in
				determining average pay or annuity eligibility under this subchapter. For
				purposes of this subsection, in the case of any such employee who is excepted
				from subchapter I of chapter 63 under section 6301(2)(x)–(xiii), the days of
				unused sick leave to his credit include any unused sick leave standing to his
				credit when he was excepted from such
				subchapter.</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection id="H1B5EF627F8FF43F980EAAA00E38D6DE8"><enum>(b)</enum><header>Exception from
			 deposit requirement</header><text>Section 8422(d)(2) of title 5, United States
			 Code, is amended by striking <quote>section 8415(k)</quote> and inserting
			 <quote>paragraph (1) or (2) of section 8415(l)</quote>.</text>
				</subsection><subsection commented="no" id="HBED84543BCDB4418BDCF25FD1B7B056C"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply with respect
			 to annuities computed based on separations occurring on or after the date of
			 enactment of this Act.</text>
				</subsection></section></title><title id="HBA66E4D06D07404D9255E9C310F370EF"><enum>II</enum><header>Computation of
			 certain annuities based on part-time service</header>
			<section display-inline="no-display-inline" id="HC3ABB72BD334445E91C9BC5CE9BCD71" section-type="subsequent-section"><enum>201.</enum><header>Computation of
			 certain annuities based on part-time service</header><text display-inline="no-display-inline">Section 8339(p) of title 5, United States
			 Code, is amended by adding at the end the following:</text>
				<quoted-block id="H221D4E6872F4442DB5C352C08FB7D777">
					<paragraph id="H573C2F80642A4C0A87A0159DFCADD782" indent="up1"><enum>(3)</enum><text>In the administration of paragraph
				(1)—</text>
						<subparagraph id="HC2942F6A212C4866925CD669F199EB92"><enum>(A)</enum><text>subparagraph (A) of such paragraph
				shall apply with respect to service performed before, on, or after April 7,
				1986; and</text>
						</subparagraph><subparagraph id="H02D6C0334A614B7CB7227B08CE13AE7"><enum>(B)</enum><text>subparagraph (B) of such
				paragraph—</text>
							<clause id="H2D1B43C16B25484F873B004064EC003C"><enum>(i)</enum><text>shall apply with respect to that
				portion of any annuity which is attributable to service performed on or after
				April 7, 1986; and</text>
							</clause><clause id="HAD3FD5EB92FF4C32A3C94B00C4AAD0CF"><enum>(ii)</enum><text>shall not apply with respect to
				that portion of any annuity which is attributable to service performed before
				April 7,
				1986.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H40A0A1071A2041B89EEF5B72B1A20437"><enum>202.</enum><header>Applicability</header><text display-inline="no-display-inline">The amendment made by section 201 shall be
			 effective with respect to any annuity, entitlement to which is based on a
			 separation from service occurring on or after the date of enactment of this
			 Act.</text>
			</section></title><title id="HC80F4AD60DF94216B53383B136B096D4"><enum>III</enum><header>Retirement
			 Credit For Service of Certain Employees Transferred From District of Columbia
			 Service to Federal Service</header>
			<section display-inline="no-display-inline" id="H2758361F4FB247C5003D5ED439EF4900" section-type="subsequent-section"><enum>301.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>District of Columbia Court,
			 Offender Supervision, Parole, and Public Defender Employees Equity Act of
			 2009</short-title></quote>.</text>
			</section><section id="H9FAD6BDED77C4216BA83AB48B78E1A3"><enum>302.</enum><header>Retirement
			 Credit For Service of Certain Employees Transferred From District of Columbia
			 Service to Federal Service</header>
				<subsection id="H2C1005E23CC74839A4C28B74C7579600"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">Any individual who is
			 treated as an employee of the Federal government for purposes of chapter 83 or
			 chapter 84 of title 5, United States Code, on or after the date of enactment of
			 this Act who performed qualifying District of Columbia service shall be
			 entitled to have such service included in calculating the individual’s
			 creditable service under sections 8332 or 8411 of title 5, United States Code,
			 but only for purposes of the following provisions of such title:</text>
					<paragraph id="H0FC5FAA27DB046E5BCC1B9998606DF4F"><enum>(1)</enum><text>Sections 8333 and
			 8410 (relating to eligibility for annuity).</text>
					</paragraph><paragraph id="H3BE7C71ED2FE401B9CC6F7BD3EDB00EE"><enum>(2)</enum><text>Sections 8336
			 (other than subsections (d), (h), and (p) thereof) and 8412 (relating to
			 immediate retirement).</text>
					</paragraph><paragraph id="HBA930A29B00E484CA9912FBB5DD915C9"><enum>(3)</enum><text>Sections 8338 and
			 8413 (relating to deferred retirement).</text>
					</paragraph><paragraph id="H62BAE457E15F47EBA92B1D419286102B"><enum>(4)</enum><text>Sections 8336(d),
			 8336(h), 8336(p), and 8414 (relating to early retirement).</text>
					</paragraph><paragraph id="H2EE83391A83345CCBEB6FB00357FECC8"><enum>(5)</enum><text>Section 8341 and
			 subchapter IV of chapter 84 (relating to survivor annuities).</text>
					</paragraph><paragraph id="H595909A01D504316923B9D3DE2F8C4AA"><enum>(6)</enum><text>Section 8337 and
			 subchapter V of chapter 84 (relating to disability benefits).</text>
					</paragraph></subsection><subsection id="HFEE69359B8D04AAAA93483D1DA19CFD"><enum>(b)</enum><header>Treatment of
			 Detention Officer Service as Law Enforcement Officer Service</header><text>Any
			 portion of an individual’s qualifying District of Columbia service which
			 consisted of service as a detention officer under section 2604(2) of the
			 District of Columbia Government Comprehensive Merit Personnel Act of 1978 (sec.
			 1–626.04(2), D.C. Official Code) shall be treated as service as a law
			 enforcement officer under sections 8331(20) or 8401(17) of title 5, United
			 States Code, for purposes of applying subsection (a) with respect to the
			 individual.</text>
				</subsection><subsection display-inline="no-display-inline" id="H0105C5154C6D43C4802FD700D6A837BB"><enum>(c)</enum><header>Service Not
			 Included in Computing Amount of Any Annuity</header><text>Qualifying District
			 of Columbia service shall not be taken into account for purposes of computing
			 the amount of any benefit payable out of the Civil Service Retirement and
			 Disability Fund.</text>
				</subsection></section><section id="HE55EC2E637614B5A965EF8A22D3FDC1D"><enum>303.</enum><header>Qualifying
			 District of Columbia Service Defined</header><text display-inline="no-display-inline">In this title, <quote>qualifying District of
			 Columbia service</quote> means any of the following:</text>
				<paragraph id="H103F76ACCC674548888197B5AA0988F1"><enum>(1)</enum><text>Service performed
			 by an individual as a nonjudicial employee of the District of Columbia
			 courts—</text>
					<subparagraph id="H3AD4EFF044B64D10AD6CC9A100ACA536"><enum>(A)</enum><text>which was
			 performed prior to the effective date of the amendments made by section
			 11246(b) of the Balanced Budget Act of 1997; and</text>
					</subparagraph><subparagraph id="H2750B21A0E12403F92646C51C04CB5F8"><enum>(B)</enum><text>for which the
			 individual did not ever receive credit under the provisions of subchapter III
			 of chapter 83 or chapter 84 of title 5, United States Code (other than by
			 virtue of section 8331(1)(iv) of such title).</text>
					</subparagraph></paragraph><paragraph id="HFD9D09BB2B8A4963BA5BC6683F5C94C"><enum>(2)</enum><text>Service performed
			 by an individual as an employee of an entity of the District of Columbia
			 government whose functions were transferred to the Pretrial Services, Parole,
			 Adult Supervision, and Offender Supervision Trustee under section 11232 of the
			 Balanced Budget Act of 1997—</text>
					<subparagraph id="H241F94678E6046FC8379110985E17737"><enum>(A)</enum><text>which was
			 performed prior to the effective date of the individual’s coverage as an
			 employee of the Federal Government under section 11232(f) of such Act;
			 and</text>
					</subparagraph><subparagraph id="H2FECB50311BC49EF9906522183C04B2"><enum>(B)</enum><text display-inline="yes-display-inline">for which the individual did not ever
			 receive credit under the provisions of subchapter III of chapter 83 or chapter
			 84 of title 5, United States Code (other than by virtue of section 8331(1)(iv)
			 of such title).</text>
					</subparagraph></paragraph><paragraph id="H9BFE6013FE7D4FF89BA9B2EB926DB837"><enum>(3)</enum><text>Service performed
			 by an individual as an employee of the District of Columbia Public Defender
			 Service—</text>
					<subparagraph id="H012E2355F081485398213BE24220812"><enum>(A)</enum><text>which was performed
			 prior to the effective date of the amendments made by section 7(e) of the
			 District of Columbia Courts and Justice Technical Corrections Act of 1998;
			 and</text>
					</subparagraph><subparagraph id="H4086842E98B74F7BBB271DA7344700E"><enum>(B)</enum><text display-inline="yes-display-inline">for which the individual did not ever
			 receive credit under the provisions of subchapter III of chapter 83 or chapter
			 84 of title 5, United States Code (other than by virtue of section 8331(1)(iv)
			 of such title).</text>
					</subparagraph></paragraph><paragraph id="H91841BAE50AB4011B6ABA9D2E6F6E673"><enum>(4)</enum><text display-inline="yes-display-inline">In the case of an individual who was an
			 employee of the District of Columbia Department of Corrections who was
			 separated from service as a result of the closing of the Lorton Correctional
			 Complex and who was appointed to a position with the Bureau of Prisons, the
			 District of Columbia courts, the Pretrial Services, Parole, Adult Supervision,
			 and Offender Supervision Trustee, the United States Parole Commission, or the
			 District of Columbia Public Defender Service, service performed by the
			 individual as an employee of the District of Columbia Department of
			 Corrections—</text>
					<subparagraph id="H182222D004684989AB36A9B00C70194"><enum>(A)</enum><text>which was performed
			 prior to the effective date of the individual’s coverage as an employee of the
			 Federal Government; and</text>
					</subparagraph><subparagraph id="H5A4B422DA02D4003AABD07DF003BAB29"><enum>(B)</enum><text>for which the
			 individual did not ever receive credit under the provisions of subchapter III
			 of chapter 83 or chapter 84 of title 5, United States Code (other than by
			 virtue of section 8331(1)(iv) of such title).</text>
					</subparagraph></paragraph></section><section id="HFAB034F52837439EB4A577F42C3A265"><enum>304.</enum><header>Certification of
			 Service</header><text display-inline="no-display-inline">The Office of
			 Personnel Management shall accept the certification of the appropriate
			 personnel official of the government of the District of Columbia or other
			 independent employing entity concerning whether an individual performed
			 qualifying District of Columbia service and the length of the period of such
			 service the individual performed.</text>
			</section></title><title id="H1A81DFF88D1F4140948C911F423262D9"><enum>IV</enum><header>Distributions
			 From Governmental Retirement Plans For Health and Long-Term Care
			 Insurance</header>
			<section id="H7804D1E68C154308BA2EF2FC1CFF1862" section-type="subsequent-section"><enum>401.</enum><header>Distributions from
			 governmental retirement plans for health and long-term care insurance for
			 Federal annuitants and members and former members of the Armed Forces of the
			 United States</header>
				<subsection id="HC4BCE6D21E004BE78FD300B352261861"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (l) of
			 section 402 of the Internal Revenue Code (relating to distributions from
			 governmental plans for health and long-term care insurance) is amended by
			 inserting <quote>, a Federal annuitant, or a member or former member of the
			 uniformed services of the United States</quote> after <quote>eligible retired
			 public safety officer</quote>.</text>
				</subsection><subsection id="HD7D78F4027414B11A52F5E1810221CCB"><enum>(b)</enum><header>Definitions</header><text>Paragraph
			 (4) of section 402(l) of such Code (relating to definitions) is amended by
			 adding at the end the following new subparagraphs:</text>
					<quoted-block id="HB8468303B39C49C89F80392EBA13EA80" style="OLC">
						<subparagraph id="HBC56A92DCF1342678D81AD126D105679"><enum>(E)</enum><header>Federal
				annuitant</header><text>The term <term>Federal annuitant</term> means an
				annuitant, as defined by paragraph (3) of section 8901 of title 5, United
				States Code.</text>
						</subparagraph><subparagraph id="H3E04812DAB17423995A41BF5C1833479"><enum>(F)</enum><header>Member or former
				member of the uniformed services of the United States</header><text>The term
				<term>member or former member of the uniformed services of the United
				States</term> shall have the same meaning given such term in chapter 55 of
				title 10, United States
				Code.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H675DCB1E8AF24E9B9F745A2D7463F5D9"><enum>(c)</enum><header>Conforming
			 amendments</header><text display-inline="yes-display-inline">Paragraphs (3)(B)
			 and (4)(D) of section 402(l) of such Code are each amended by inserting
			 <quote>, Federal annuitant, or member or former member of the uniformed
			 services of the United States, as the case may be,</quote> after
			 <quote>eligible retired public safety officer</quote> both places it
			 appears.</text>
				</subsection><subsection id="HFA03FAD9926D43EA905367474E12E865"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to
			 distributions in taxable years beginning after December 31, 2008.</text>
