			 Management Assistance</header>
				<section id="HBFEAF7D442474A6B95B3B9A6748058DF"><enum>1101.</enum><header>Technical
			 assistance</header>
					<subsection id="H0AD950BCE9274585B83F53C4B569DDAE"><enum>(a)</enum><header>Technical
			 Assistance for Rural and Small Treatment Works</header><text>Section 104(b) (33
			 U.S.C. 1254(b)) is amended—</text>
						<paragraph id="HB1CBDFA74FDB410E96F2D307B9B38714"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (6);</text>

				in consultation with the State in which the assistance is provided, such
				municipalities and tribal governments in the planning, developing, and
				acquisition of financing for eligible projects described in section
				603(c);</text>
									</subparagraph><subparagraph id="H482485FC71584020A6956ADFF0B9B559"><enum>(B)</enum><text>to provide
				technical assistance and training for rural, small, and tribal publicly owned
				treatment works and decentralized wastewater treatment systems to enable such
				treatment works and systems to protect water quality and achieve and maintain
				compliance with the requirements of this Act; and</text>
									</subparagraph><subparagraph id="H6D6EA1A950CC43BA9CDB43488DF6E99C"><enum>(C)</enum><text>to disseminate
				information to rural, small, and tribal municipalities and municipalities that
				meet the affordability criteria established under section 603(i)(2) by the
				State in which the municipality is located with respect to planning, design,
				construction, and operation of publicly owned treatment works and decentralized
				wastewater treatment
				systems.</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="HBBCC5BC5E33B4714B521E13C2156D470"><enum>(b)</enum><header>Authorization of
			 Appropriations</header><text>Section 104(u) (33 U.S.C. 1254(u)) is
			 amended—</text>
						<paragraph id="H55007021389F4B3BBCFFF2D242A5CEB1"><enum>(1)</enum><text>by striking
			 <quote>and (6)</quote> and inserting <quote>(6)</quote>; and</text>
						</paragraph><paragraph id="HC4F7EE5C7EA44E3580CD42AA100604DE"><enum>(2)</enum><text>by inserting
			 before the period at the end the following: <quote>; and (7) not to exceed
			 $100,000,000 for each of fiscal years 2010 through 2014 for carrying out

				resource plan</header><text display-inline="yes-display-inline">The development
				of an integrated water resource plan for the coordinated management and
				protection of surface water, ground water, and stormwater resources on a
				watershed or subwatershed basis to meet the objectives, goals, and policies of
				this Act.</text>
									</paragraph><paragraph id="HF5D7F83B235E45CA9ECA9B8AC8A3DD0E"><enum>(5)</enum><header>Municipality-wide
				storm water management planning</header><text display-inline="yes-display-inline">The development of a municipality-wide plan
				that identifies the most effective placement of storm water technologies and
				management approaches, including green infrastructure, to reduce water quality
				impairments from storm water on a municipality-wide basis.</text>
									</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H1FBDBAEEAE134C3D8F111D49E687AD02"><enum>(b)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">The first
			 sentence of section 122(c)(1) is amended—</text>

				under this title if the project otherwise meets the requirements of subsection
				(a)(1) and meets the requirement of paragraph (3).</text>
								</paragraph><paragraph id="H5794E0C56DB1466EB75C432C0E6EEF4D"><enum>(2)</enum><header>New
				systems</header><text>Notwithstanding the requirement of subsection (a)(2)
				concerning the existence of a community as a condition of eligibility, a
				project for a new collection system to serve a community existing on January 1,
				2007, shall be eligible for a grant under this title if the project otherwise
				meets the requirements of subsection (a)(2) and meets the requirement of
				paragraph (3).</text>
								</paragraph><paragraph id="H99C5A942E1544048AABBCAEDF85A267A"><enum>(3)</enum><header>Requirement</header><text>A
				project meets the requirement of this paragraph if the purpose of the project
				is to accomplish the objectives, goals, and policies of this Act by addressing
				an adverse environmental condition existing on the date of enactment of this
				paragraph.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="H42C60F3877D64D9390EA09E687E774EF"><enum>1202.</enum><header>Treatment
			 works defined</header><text display-inline="no-display-inline">Section
			 212(2)(A) (33 U.S.C. 1292(2)(A)) is amended—</text>

			 <quote>any works, including site</quote>;</text>

			 authority for capitalization grants</header><text display-inline="no-display-inline">Section 601(a) (33 U.S.C. 1381(a)) is
			 amended by striking <quote>for providing assistance</quote> and all that
			 follows through the period at the end and inserting the following: <quote>to
			 accomplish the objectives, goals, and policies of this Act by providing
			 assistance for projects and activities identified in section
			 603(c).</quote>.</text>
				</section><section id="H995DF90934444B8D8F4A6F300347BFE1"><enum>1302.</enum><header>Capitalization
			 grant agreements</header>
					<subsection id="H75AE5604941244C1BB36DDA7EC963F2C"><enum>(a)</enum><header>Reporting
			 Infrastructure Assets</header><text>Section 602(b)(9) (33 U.S.C. 1382(b)(9)) is
			 amended by striking <quote>standards</quote> and inserting <quote>standards,
			 including standards relating to the reporting of infrastructure
			 assets</quote>.</text>
					</subsection><subsection id="H2D7C6415524C4F8B909F595763535836"><enum>(b)</enum><header>Additional
			 Requirements</header><text>Section 602(b) (33 U.S.C. 1382(b)) is
			 amended—</text>

				by the State to recipients of assistance that are considered program income
				will be used for the purpose of financing the cost of administering the fund or
				financing projects or activities eligible for assistance from the fund;</text>
								</paragraph><paragraph id="H851521D40DE841CEB42FE8EA2A4ACE70"><enum>(13)</enum><text>beginning in
				fiscal year 2011, the State will include as a condition of providing assistance
				to a municipality or intermunicipal, interstate, or State agency that the
				recipient of such assistance certify, in a manner determined by the Governor of
				the State, that the recipient—</text>
									<subparagraph commented="no" id="HB12CA0B8518F41489D5A03F645BA9BC9"><enum>(A)</enum><text>has studied and
				evaluated the cost and effectiveness of the processes, materials, techniques,
				and technologies for carrying out the proposed project or activity for which
				assistance is sought under this title, and has selected, to the extent
				practicable, a project or activity that maximizes the potential for efficient
				water use, reuse, and conservation, and energy conservation, taking into
				account the cost of constructing the project or activity, the cost of operating
				and maintaining the project or activity over its life, and the cost of
				replacing the project or activity; and</text>
									</subparagraph><subparagraph commented="no" id="HAF9BBE30F47B4B0EB0D21C6132942AF4"><enum>(B)</enum><text display-inline="yes-display-inline">has considered, to the maximum extent
				practicable and as determined appropriate by the recipient, the costs and
				effectiveness of other design, management, and financing approaches for
				carrying out a project or activity for which assistance is sought under this
				title, taking into account the cost of constructing the project or activity,
				the cost of operating and maintaining the project or activity over its life,
				and the cost of replacing the project or activity;</text>
									</subparagraph></paragraph><paragraph id="H692BC9670F194725A5629C8660B8C41C"><enum>(14)</enum><text>the State will
				use at least 15 percent of the amount of each capitalization grant received by
				the State under this title after September 30, 2010, to provide assistance to
				municipalities of fewer than 10,000 individuals that meet the affordability
				criteria established by the State under section 603(i)(2) for activities
				included on the State’s priority list established under section 603(g), to the
				extent that there are sufficient applications for such assistance;</text>
								</paragraph><paragraph commented="no" id="HAD96EDAA81204EAFA4DA4E976756D8C2"><enum>(15)</enum><text>a contract to be
				carried out using funds directly made available by a capitalization grant under
				this title for program management, construction management, feasibility
				studies, preliminary engineering, design, engineering, surveying, mapping, or
				architectural related services shall be negotiated in the same manner as a
				contract for architectural and engineering services is negotiated under chapter
				11 of title 40, United States Code, or an equivalent State qualifications-based
				requirement (as determined by the Governor of the State); and</text>
								</paragraph><paragraph id="HEC406989FBB04525B0ACE0C8AEE31711"><enum>(16)</enum><text display-inline="yes-display-inline">the requirements of section 513 will apply
				to the construction of treatment works carried out in whole or in part with
				assistance made available by a State water pollution control revolving fund as
				authorized under this title, or with assistance made available under section
				205(m), or both, in the same manner as treatment works for which grants are
				made under this
				Act.</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection></section><section id="HC89A158BC5584CDEAA5F8326F74D1F47"><enum>1303.</enum><header>Water
			 pollution control revolving loan funds</header>
					<subsection id="H3C6BFF7B770147C7B6FE47ADA9E97712"><enum>(a)</enum><header>Projects and
			 Activities Eligible for Assistance</header><text>Section 603(c) (33 U.S.C.
			 1383(c)) is amended to read as follows:</text>
						<quoted-block id="HEE3B6B2A6F9F44D1AF8DC4A11B82CD5B" style="OLC">
							<subsection id="H9005C1462E7D4F25A5588333B2620139"><enum>(c)</enum><header>Projects and
				Activities Eligible for Assistance</header><text>The amounts of funds available
				to each State water pollution control revolving fund shall be used only for
				providing financial assistance—</text>
								<paragraph id="H19A1DC7A6BB24AFFBA26F256F00B8D11"><enum>(1)</enum><text>to any
				municipality or intermunicipal, interstate, or State agency for construction of
				publicly owned treatment works;</text>
								</paragraph><paragraph id="H90EBAD9ED9874F6284399FED96E046BC"><enum>(2)</enum><text>for the
				implementation of a management program established under section 319;</text>
								</paragraph><paragraph id="H333699EFEE09449D9F41CFF3FC0DD5F8"><enum>(3)</enum><text>for development
				and implementation of a conservation and management plan under section
				320;</text>
								</paragraph><paragraph id="H882CA2373BC842FD80871C83D6EAEC77"><enum>(4)</enum><text>for the
				implementation of lake protection programs and projects under section
				314;</text>
								</paragraph><paragraph id="H3469FF5B28F14E698CF313F6EF6669DE"><enum>(5)</enum><text>for repair or
				replacement of decentralized wastewater treatment systems that treat domestic
				sewage;</text>
								</paragraph><paragraph id="H9B91CD8C710E4CD083D161B16E125B9C"><enum>(6)</enum><text display-inline="yes-display-inline">for measures to manage, reduce, treat, or
				reuse municipal stormwater, agricultural stormwater, and return flows from
				irrigated agriculture;</text>
								</paragraph><paragraph id="H828DF19CE3514510B2F5786C732BC85C"><enum>(7)</enum><text>to any
				municipality or intermunicipal, interstate, or State agency for measures to
				reduce the demand for publicly owned treatment works capacity through water
				conservation, efficiency, or reuse;</text>
								</paragraph><paragraph id="HDFB422A88D484492ADA76845CECF4CD0"><enum>(8)</enum><text>for the
				development and implementation of watershed projects meeting the criteria set
				forth in section 122; and</text>
								</paragraph><paragraph id="H9A252D8657084C64B32215D7AE58117C"><enum>(9)</enum><text display-inline="yes-display-inline">to any municipality or intermunicipal,
				interstate, or State agency for measures to reduce the energy consumption needs
				for publicly owned treatment works, including the implementation of
				energy-efficient or renewable-energy generation
				technologies.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="HA28695BAEBE141958252ECC852EBDF82"><enum>(b)</enum><header>Extended
			 Repayment Period</header><text>Section 603(d)(1) (33 U.S.C. 1383(d)(1)) is
			 amended—</text>
						<paragraph id="HFA3E7FFAF3B646A9AC5F329F155DC0DB"><enum>(1)</enum><text>in subparagraph
			 (A) by striking <quote>20 years</quote> and inserting <quote>the lesser of 30
			 years or the design life of the project to be financed with the proceeds of the
			 loan</quote>; and</text>
						</paragraph><paragraph id="H105960F991BD497CA40895C62960313F"><enum>(2)</enum><text>in subparagraph
			 (B) by striking <quote>not later than 20 years after project completion</quote>
			 and inserting <quote>upon the expiration of the term of the
			 loan</quote>.</text>
						</paragraph></subsection><subsection id="H7D1928FDC6484AB9B8C51A8AAF8B20CC"><enum>(c)</enum><header>Fiscal
			 Sustainability Plan</header><text>Section 603(d)(1) (33 U.S.C. 1383(d)(1)) is
			 further amended—</text>
						<paragraph id="H6D95DB71DE3B403AB0678BEDD2C43B80"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (C);</text>
						</paragraph><paragraph id="H2F5263AE6A2941EC887EC502AC0EDB8E"><enum>(2)</enum><text>by inserting
			 <quote>and</quote> at the end of subparagraph (D); and</text>
						</paragraph><paragraph id="H6059BCEC13EB4EA893AEFD12E6A469E8"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
							<quoted-block id="HFADBB593D4044A19B8AAE12A99038C2D" style="OLC">
								<subparagraph id="H9689180634EF4A11BCF69EA93F4909D7"><enum>(E)</enum><text>for any portion of
				a treatment works proposed for repair, replacement, or expansion, and eligible
				for assistance under section 603(c)(1), the recipient of a loan will develop
				and implement a fiscal sustainability plan that includes—</text>
									<clause id="H510B30BEEE25402D880B75F11F31710E"><enum>(i)</enum><text>an
				inventory of critical assets that are a part of that portion of the treatment
				works;</text>
									</clause><clause id="H4508AA34E0DA4DCE91E6AFEFCB625A01"><enum>(ii)</enum><text>an evaluation of
				the condition and performance of inventoried assets or asset groupings;</text>
									</clause><clause id="H0D5BF451116146D1B57488F5C9FC1447"><enum>(iii)</enum><text>a certification
				that the recipient has evaluated and will be implementing water and energy
				conservation efforts as part of the plan; and</text>
									</clause><clause id="H9D2CD9948C4241928ECEE7E81E102927"><enum>(iv)</enum><text>a
				plan for maintaining, repairing, and, as necessary, replacing that portion of
				the treatment works and a plan for funding such
				activities;</text>
									</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="HDDC31CD11B9748D192F29AF52404CD7C"><enum>(d)</enum><header>Administrative
			 Expenses</header><text>Section 603(d)(7) (33 U.S.C. 1383(d)(7)) is amended by
			 inserting before the period at the end the following: <quote>, $400,000 per
			 year, or <fraction>1/5</fraction> percent per year of the current valuation of
			 the fund, whichever amount is greatest, plus the amount of any fees collected
			 by the State for such purpose regardless of the source</quote>.</text>
					</subsection><subsection id="H29BFA4CEA77E43E08EC205E1D4E7E9CC"><enum>(e)</enum><header>Technical and
			 Planning Assistance for Small Systems</header><text>Section 603(d) (33 U.S.C.
			 1383(d)) is amended—</text>
						<paragraph id="HD6B278A0448441DD8E1BB6116429F925"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (6);</text>
						</paragraph><paragraph id="HF1582A0529E445D788DC69DBBBF3C6A9"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (7) and inserting a semicolon; and</text>
						</paragraph><paragraph id="HB7ABA359C3AC45A5992671C2CD5DCAF0"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
							<quoted-block id="H05D16F12D86D495F85E44F317B0F8729" style="OLC">
								<paragraph id="H53D37058336848E9AD4FD39749C31D7D"><enum>(8)</enum><text>to provide grants
				to owners and operators of treatment works that serve a population of 10,000 or
				fewer for obtaining technical and planning assistance and assistance in
				financial management, user fee analysis, budgeting, capital improvement
				planning, facility operation and maintenance, equipment replacement, repair
				schedules, and other activities to improve wastewater treatment plant
				management and operations, except that the total amount provided by the State
				in grants under this paragraph for a fiscal year may not exceed one percent of
				the total amount of assistance provided by the State from the fund in the
				preceding fiscal year, or 2 percent of the total amount received by the State
				in capitalization grants under this title in the preceding fiscal year,
				whichever amount is greatest; and</text>
								</paragraph><paragraph id="H49D2BA5F52204BBC9BE0BAA62906E286"><enum>(9)</enum><text>to provide grants
				to owners and operators of treatment works for conducting an assessment of the
				energy and water consumption of the treatment works, and evaluating potential
				opportunities for energy and water conservation through facility operation and
				maintenance, equipment replacement, and projects or activities that promote the
				efficient use of energy and water by the treatment works, except that the total
				amount provided by the State in grants under this paragraph for a fiscal year
				may not exceed one percent of the total amount of assistance provided by the
				State from the fund in the preceding fiscal year, or 2 percent of the total
				amount received by the State in capitalization grants under this title in the
				preceding fiscal year, whichever amount is
				greatest.</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="HE1FC921E1FCD496A83904B5ADD9C8925"><enum>(f)</enum><header>Additional
			 Subsidization</header><text>Section 603 (33 U.S.C. 1383) is amended by adding
			 at the end the following:</text>
						<quoted-block id="H65CE37DA954346CE8272E39A422CA02E" style="OLC">
							<subsection id="H045A8903BFE241F0B1D21AF33859B0A4"><enum>(i)</enum><header>Additional
				Subsidization</header>
								<paragraph id="H81E502540F1A48A985C0067C6243A14A"><enum>(1)</enum><header>In
				general</header><text>In any case in which a State provides assistance to a
				municipality or intermunicipal, interstate, or State agency under subsection
				(d), the State may provide additional subsidization, including forgiveness of
				principal and negative interest loans—</text>
									<subparagraph id="H60AAF613250543978C37E3BE615F8F6B"><enum>(A)</enum><text>to benefit a
				municipality that—</text>
										<clause id="H78325B5DC698439A81DC463B3F101817"><enum>(i)</enum><text>meets the State’s
				affordability criteria established under paragraph (2); or</text>
										</clause><clause id="H41A82EA85E3F482CA92237422151E319"><enum>(ii)</enum><text>does not meet the
				State’s affordability criteria if the recipient—</text>
											<subclause id="HEF4B7186C21B4F069CFBB8A0DDD3990F"><enum>(I)</enum><text>seeks additional
				subsidization to benefit individual ratepayers in the residential user rate
				class;</text>
											</subclause><subclause id="H1B6A073A94874AF58C64243C14E7AB12"><enum>(II)</enum><text>demonstrates to
				the State that such ratepayers will experience a significant hardship from the
				increase in rates necessary to finance the project or activity for which
				assistance is sought; and</text>
											</subclause><subclause id="H1BCB13C19284431A8DC7F6032CB81088"><enum>(III)</enum><text>ensures, as part
				of an assistance agreement between the State and the recipient, that the
				additional subsidization provided under this paragraph is directed through a
				user charge rate system (or other appropriate method) to such ratepayers;
				or</text>
											</subclause></clause></subparagraph><subparagraph commented="no" id="HF2E44563723945B0B450E3BCA5C9D627"><enum>(B)</enum><text display-inline="yes-display-inline">to implement a process, material,
				technique, or technology to address water-efficiency goals, address
				energy-efficiency goals, mitigate stormwater runoff, or encourage
				environmentally sensitive project planning, design, and construction.</text>
									</subparagraph></paragraph><paragraph id="HB6911C3A2F9B4100836A4DE04C195A2A"><enum>(2)</enum><header>Affordability
				criteria</header>
									<subparagraph id="HBB7D0F07844A4602AE36D8839ED6D31B"><enum>(A)</enum><header>Establishment</header><text display-inline="yes-display-inline">On or before September 30, 2010, and after
				providing notice and an opportunity for public comment, a State shall establish
				affordability criteria to assist in identifying municipalities that would
				experience a significant hardship raising the revenue necessary to finance a
				project or activity eligible for assistance under section 603(c)(1) if
				additional subsidization is not provided. Such criteria shall be based on
				income data, population trends, and other data determined relevant by the
				State, including whether the project or activity is to be carried out in an
				economically distressed area, as described in section 301 of the Public Works
				and Economic Development Act of 1965 (42 U.S.C. 3161).</text>
									</subparagraph><subparagraph id="H0E263E287E2443A795D35084ADC2EB8D"><enum>(B)</enum><header>Existing
				criteria</header><text>If a State has previously established, after providing
				notice and an opportunity for public comment, affordability criteria that meet
				the requirements of subparagraph (A), the State may use the criteria for the
				purposes of this subsection. For purposes of this Act, any such criteria shall
				be treated as affordability criteria established under this paragraph.</text>
									</subparagraph><subparagraph id="H7909D9362E21458A81E6D2245548D11C"><enum>(C)</enum><header>Information to
				assist states</header><text>The Administrator may publish information to assist
				States in establishing affordability criteria under subparagraph (A).</text>
									</subparagraph></paragraph><paragraph id="HB0C417B895684EAE9B453CF6EC92EFB5"><enum>(3)</enum><header>Priority</header><text>A
				State may give priority to a recipient for a project or activity eligible for
				funding under section 603(c)(1) if the recipient meets the State’s
				affordability criteria.</text>
								</paragraph><paragraph id="H05D90A5628A94B9799A06F29968DC1BE"><enum>(4)</enum><header>Set-aside</header>
									<subparagraph id="HD0326BC7B4C044A99126C1E1FD28C720"><enum>(A)</enum><header>In
				general</header><text>In any fiscal year in which the Administrator has
				available for obligation more than $1,000,000,000 for the purposes of this
				title, a State shall provide additional subsidization under this subsection in
				the amount specified in subparagraph (B) to eligible entities described in
				paragraph (1) for projects and activities identified in the State’s intended
				use plan prepared under section 606(c) to the extent that there are sufficient
				applications for such assistance.</text>
									</subparagraph><subparagraph id="H1FAA0CB489644191B1156ECC9E465C3D"><enum>(B)</enum><header>Amount</header><text>In
				a fiscal year described in subparagraph (A), a State shall set aside for
				purposes of subparagraph (A) an amount not less than 25 percent of the
				difference between—</text>
										<clause id="HC0BCA5FDB58945019E82486EE3C36E10"><enum>(i)</enum><text>the total amount
				that would have been allotted to the State under section 604 for such fiscal
				year if the amount available to the Administrator for obligation under this
				title for such fiscal year had been equal to $1,000,000,000; and</text>
										</clause><clause id="HBB35D1471ED34ECD95B28E4209DE8758"><enum>(ii)</enum><text>the total amount
				allotted to the State under section 604 for such fiscal year.</text>
										</clause></subparagraph></paragraph><paragraph id="HDDE69C221DAF43099D00E506A9075A3C"><enum>(5)</enum><header>Limitation</header><text>The
				total amount of additional subsidization provided under this subsection by a
				State may not exceed 30 percent of the total amount of capitalization grants
				received by the State under this title in fiscal years beginning after
				September 30,
				2009.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection></section><section id="HEE1C3CB5353D4B89AADF4F90E70D23C0"><enum>1304.</enum><header>Allotment of
			 funds</header>
					<subsection id="H56CCEDADF3DF44038BB94D134303031F"><enum>(a)</enum><header>In
			 General</header><text>Section 604(a) (33 U.S.C. 1384(a)) is amended to read as
			 follows:</text>
						<quoted-block id="HE46EEAE86F9A4393A791576718EFE509" style="OLC">
							<subsection id="H8851C5BD88024EB396D0F21FFDB8BFB2"><enum>(a)</enum><header>Allotments</header>
								<paragraph id="HBB4BE4CC4BA44B0198C3B693D218311B"><enum>(1)</enum><header>Fiscal years
				2010 and 2011</header><text>Sums appropriated to carry out this title for each
				of fiscal years 2010 and 2011 shall be allotted by the Administrator in
				accordance with the formula used to allot sums appropriated to carry out this
				title for fiscal year 2009.</text>
								</paragraph><paragraph id="HEB0534968C5B43BABD69176FAF34976C"><enum>(2)</enum><header>Fiscal year 2012
				and thereafter</header><text>Sums appropriated to carry out this title for
				fiscal year 2012 and each fiscal year thereafter shall be allotted by the
				Administrator as follows:</text>
									<subparagraph id="HD044BFBD8D324CCAA2002BE1CA0B9FED"><enum>(A)</enum><text>Amounts that do
				not exceed $1,350,000,000 shall be allotted in accordance with the formula
				described in paragraph (1).</text>
									</subparagraph><subparagraph id="H245B2FB9B5144573AF593FD89028EB77"><enum>(B)</enum><text>Amounts that
				exceed $1,350,000,000 shall be allotted in accordance with the formula
				developed by the Administrator under subsection
				(d).</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H404B5D1409BA420FAA6A8D133DFBF8CF"><enum>(b)</enum><header>Planning
			 Assistance</header><text>Section 604(b) (33 U.S.C. 1384(b)) is amended by
			 striking <quote>1 percent</quote> and inserting <quote>2
			 percent</quote>.</text>
					</subsection><subsection id="HEBB21A2472F3483685702F5566AFC7E4"><enum>(c)</enum><header>Formula</header><text>Section
			 604 (33 U.S.C. 1384) is amended by adding at the end the following:</text>

			 plan</header>
					<subsection id="HD66FECC63C774A619C276BC174092514"><enum>(a)</enum><header>Integrated
			 Priority List</header><text>Section 603(g) (33 U.S.C. 1383(g)) is amended to
			 read as follows:</text>
						<quoted-block id="HEA5F81A80DD247A5939D2348AE851D47" style="OLC">
							<subsection id="H3ED22C276D00468E831D81F1DF4AC65A"><enum>(g)</enum><header>Priority
				List</header>
								<paragraph id="HAFAD870A847F44A69FB05E1A19C3F419"><enum>(1)</enum><header>In
				general</header><text>For fiscal year 2011 and each fiscal year thereafter, a
				State shall establish or update a list of projects and activities for which
				assistance is sought from the State’s water pollution control revolving fund.
				Such projects and activities shall be listed in priority order based on the
				methodology established under paragraph (2). The State may provide financial
				assistance from the State’s water pollution control revolving fund only with
				respect to a project or activity included on such list. In the case of projects
				and activities eligible for assistance under section 603(c)(2), the State may
				include a category or subcategory of nonpoint sources of pollution on such list
				in lieu of a specific project or activity.</text>
								</paragraph><paragraph id="HE3D7E57410A54D93862326580ED230FB"><enum>(2)</enum><header>Methodology</header>
									<subparagraph id="HB7B74DF30F794A41886C07FD5A66E88E"><enum>(A)</enum><header>In
				general</header><text>Not later than 1 year after the date of enactment of this
				paragraph, and after providing notice and opportunity for public comment, each
				State (acting through the State’s water quality management agency and other
				appropriate agencies of the State) shall establish a methodology for developing
				a priority list under paragraph (1).</text>
									</subparagraph><subparagraph id="H7AA42686C8714A7B9B7EB673722C82D9"><enum>(B)</enum><header>Priority for
				projects and activities that achieve greatest water quality
				improvement</header><text display-inline="yes-display-inline">In developing the
				methodology, the State shall seek to achieve the greatest degree of water
				quality improvement, taking into consideration the requirements of section
				602(b)(5) and section 603(i)(3), whether such water quality improvements would
				be realized without assistance under this title, and whether the proposed
				projects and activities would address water quality impairments associated with
				existing treatment works.</text>
									</subparagraph><subparagraph id="H92472AE46806411382E3DF03635BDA19"><enum>(C)</enum><header>Considerations
				in selecting projects and activities</header><text>In determining which
				projects and activities will achieve the greatest degree of water quality
				improvement, the State shall consider—</text>
										<clause id="H42459E02FA924732BDC3CD11303D4F42"><enum>(i)</enum><text>information
				developed by the State under sections 303(d) and 305(b);</text>
										</clause><clause id="HB6209500A1194CAA86B1FC2E8AD15E92"><enum>(ii)</enum><text>the State’s
				continuing planning process developed under section 303(e);</text>
										</clause><clause id="HB9778D4C509C4B778139FE85168ED936"><enum>(iii)</enum><text>the State’s
				management program developed under section 319; and</text>
										</clause><clause id="H90D370B1C1BF4C6795822BE24CAEA307"><enum>(iv)</enum><text>conservation and
				management plans developed under section 320.</text>
										</clause></subparagraph><subparagraph id="HD0FB2EDEF0E84E63A1362C648694D6ED"><enum>(D)</enum><header>Nonpoint
				sources</header><text>For categories or subcategories of nonpoint sources of
				pollution that a State may include on its priority list under paragraph (1),
				the State shall consider the cumulative water quality improvements associated
				with projects or activities in such categories or subcategories.</text>
									</subparagraph><subparagraph id="HEEEA0312989949B9ABCBD0969B4F8FE2"><enum>(E)</enum><header>Existing
				methodologies</header><text>If a State has previously developed, after
				providing notice and an opportunity for public comment, a methodology that
				meets the requirements of this paragraph, the State may use the methodology for
				the purposes of this
				subsection.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H24966A36E39B45C08F92B4AED5C2D49B"><enum>(b)</enum><header>Intended Use
			 Plan</header><text>Section 606(c) (33 U.S.C. 1386(c)) is amended—</text>
						<paragraph id="H120C6963B71D48B5939BFCD5AB7B8189"><enum>(1)</enum><text>in the matter
			 preceding paragraph (1) by striking <quote>each State shall annually
			 prepare</quote> and inserting <quote>each State (acting through the State’s

			 Provision</header><text>Before completion of a priority list based on a
			 methodology established under section 603(g) of the
			 <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name>
			 (as amended by this section), a State shall continue to comply with the
			 requirements of sections 603(g) and 606(c) of such Act, as in effect on the day
			 before the date of enactment of this Act.</text>
					</subsection></section><section display-inline="no-display-inline" id="H5F54080575DC494CB247FB34EAF54BFB"><enum>1306.</enum><header>Annual
			 Reports</header><text display-inline="no-display-inline">Section 606(d) (33
			 U.S.C. 1386(d)) is amended—</text>

				types of such projects and activities;</text>
								</subparagraph><subparagraph id="H36ED034293ED4FC288EF98BBC307EA8A"><enum>(C)</enum><text display-inline="yes-display-inline">an estimate of the number of jobs created
				through carrying out such projects and activities;</text>
								</subparagraph><subparagraph id="HDF233767964D4A858AA1498DCE642A15"><enum>(D)</enum><text>an assessment of
				the progress made toward meeting the goals and purposes of this Act through
				such projects and activities; and</text>
								</subparagraph><subparagraph id="HFEFB7D53A0CC4EDE96BEE4E6ABA5B9D4"><enum>(E)</enum><text>any additional
				information that the Administrator considers
				appropriate.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="HA2B5350B8FA74C51BFF036AA325F7C98"><enum>1307.</enum><header>Technical
			 assistance; requirements for use of American materials</header><text display-inline="no-display-inline">Title VI (33 U.S.C. 1381 et seq.) is
			 amended—</text>

			 section 607 as section 609; and</text>

				Procedures</header><text>Not later than 1 year after the date of enactment of
				this section, the Administrator shall assist the States in establishing
				simplified procedures for treatment works to obtain assistance under this
				title.</text>
								</subsection><subsection id="H4B214186691146FFAF230D9EB1E7E781"><enum>(b)</enum><header>Publication of
				Manual</header><text>Not later than 2 years after the date of the enactment of
				this section, and after providing notice and opportunity for public comment,
				the Administrator shall publish a manual to assist treatment works in obtaining
				assistance under this title and publish in the Federal Register notice of the
				availability of the manual.</text>
								</subsection><subsection id="H0E6C31FDB2DA41CBBC3275536BABB5EB"><enum>(c)</enum><header>Compliance
				criteria</header><text>At the request of any State, the Administrator, after
				providing notice and an opportunity for public comment, shall assist in the
				development of criteria for a State to determine compliance with the conditions
				of funding assistance established under sections 602(b)(13) and
				603(d)(1)(E).</text>
								</subsection></section><section commented="no" id="H8228F23460584BCB8D425557E21486E9"><enum>608.</enum><header>Requirements
				for use of American materials</header>
								<subsection commented="no" id="HBCB843DC021340C2BB7FA675BC772900"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of law, none of the funds made available by a State water
				pollution control revolving fund as authorized under this title may be used for
				the construction of treatment works unless the steel, iron, and manufactured
				goods used in such treatment works are produced in the United States.</text>
								</subsection><subsection commented="no" id="H0745214F90644C93BB00F3FA19E36EEB"><enum>(b)</enum><header>Exceptions</header><text>Subsection
				(a) shall not apply in any case in which the Administrator (in consultation
				with the Governor of the State) finds that—</text>
									<paragraph commented="no" id="H314318E46EA945DDA6C3E8515E601FCE"><enum>(1)</enum><text>applying
				subsection (a) would be inconsistent with the public interest;</text>
									</paragraph><paragraph commented="no" id="HD5604B80E3E74E559D0D24935338DA98"><enum>(2)</enum><text>steel, iron, and
				manufactured goods are not produced in the United States in sufficient and
				reasonably available quantities and of a satisfactory quality; or</text>
									</paragraph><paragraph commented="no" id="HF3C82188C58440EB8C0F6343C98F86D0"><enum>(3)</enum><text>inclusion of
				steel, iron, and manufactured goods produced in the United States will increase
				the cost of the overall project by more than 25 percent.</text>
									</paragraph></subsection><subsection id="HC2DC561180AA4398819B47EA316DFA02"><enum>(c)</enum><header>Public
				notification and written justification for waiver</header><text>If the
				Administrator determines that it is necessary to waive the application of
				subsection (a) based on a finding under subsection (b), the Administrator
				shall—</text>
									<paragraph id="H760FA5B10F0A4DC39D8EE54AB3E9A797"><enum>(1)</enum><text>not less than 15
				days prior to waiving application of subsection (a), provide public notice and
				the opportunity to comment on the Administrator’s intent to issue such waiver;
				and</text>
									</paragraph><paragraph id="HEC2666E313B64F89A3103347F3D6A194"><enum>(2)</enum><text>upon issuing such
				waiver, publish in the Federal Register a detailed written justification as to
				why the provision is being waived.</text>
									</paragraph></subsection><subsection id="H188FF8646FD0488FB3E10BC5769643EF"><enum>(d)</enum><header>Consistency with
				international agreements</header><text>This section shall be applied in a
				manner consistent with United States obligations under international
				agreements.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="H40B8D33B69B44C2F97548042517E289D"><enum>1308.</enum><header>Authorization

			 general</header><text>The Administrator of the Environmental Protection Agency
			 shall conduct a study of wastewater treatment facilities that discharge into
			 the Rio Grande River and develop recommendations for improving monitoring,
			 information sharing, and cooperation between the United States and
			 Mexico.</text>
						</paragraph><paragraph id="H4BEEFA3645434E88A08A7D686B31F2A4"><enum>(2)</enum><header>Consultation</header><text>The
			 Administrator shall conduct the study in consultation with the Secretary of
			 State, appropriate representatives of the Mexican government, and the
			 International Boundary Waters Commission.</text>
						</paragraph><paragraph commented="no" id="H2CC35ED8172B43B9BBC88B7E2C1B8165"><enum>(3)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 12 months after the date of
			 enactment of this Act, the Administrator shall submit to Congress a report on
			 the results of the study, together with the recommendations developed under
			 paragraph (1).</text>
						</paragraph></subsection><subsection id="H69DC3F0A5B014D6E947B0BFF60A43F30"><enum>(b)</enum><header>Study of water
			 infrastructure along the United States-Mexico border</header>
						<paragraph id="H84198007C0794E43894532C8082F5239"><enum>(1)</enum><header>Study</header><text>The
			 Comptroller General shall conduct a study on water infrastructure along the
			 border between the United States and Mexico to augment current studies relating
			 to colonias development.</text>
						</paragraph><paragraph id="HCEDA891BD4D0410385E44E1CFD128334"><enum>(2)</enum><header>Contents</header><text>In
			 conducting the study, the Comptroller General shall examine the comprehensive
			 planning needs relating to water and wastewater infrastructure for colonias
			 along the border between the United States and Mexico.</text>

			 later than 12 months after the date of enactment of this Act, the Comptroller

			 Source Projects</header>

				<subsection id="HEF3E34791FBF4753B9DB8ED6F900B71D"><enum>(a)</enum><header>Selection of

			 Requirements</header><text>Section 221(e) (33 U.S.C. 1301(e)) is amended to
			 read as follows:</text>

				energy efficiency improvements, and other environmentally innovative

				</after-quoted-block></quoted-block>
				</subsection><subsection display-inline="no-display-inline" id="HFF9AFC4DB40C4A0C8496707ED6F11FB1"><enum>(c)</enum><header>Allocation of
			 funds</header><text>Section 221(g) of such Act (33 U.S.C. 1301(g)) is amended
			 to read as follows:</text>

						<subsection id="H9C3EA1E57E27467FAE6FDF7AB0713271"><enum>(g)</enum><header>Allocation of
				funds</header>

				2010</header><text>Subject to subsection (h), the Administrator shall use the
				amounts appropriated to carry out this section for fiscal year 2010 for making
				grants to municipalities and municipal entities under subsection (a)(2) in
				accordance with the criteria set forth in subsection (b).</text>
							</paragraph><paragraph id="H444B6B7AC45C479FAA8CF409BDFDB8AE"><enum>(2)</enum><header>Fiscal year 2011
				and thereafter</header><text>Subject to subsection (h), the Administrator shall
				use the amounts appropriated to carry out this section for fiscal year 2011 and
				each fiscal year thereafter for making grants to States under subsection (a)(1)
				in accordance with a formula to be established by the Administrator, after
				providing notice and an opportunity for public comment, that allocates to each
				State a proportional share of such amounts based on the total needs of the
				State for municipal combined sewer overflow controls and sanitary sewer
				overflow controls identified in the most recent survey conducted pursuant to
				section
				516.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HF4189278EB1941FD99EA5BFCE5421A4C"><enum>(d)</enum><header>Reports</header><text>The
			 first sentence of section 221(i) (33 U.S.C. 1301(i)) is amended by striking
			 <quote>2003</quote> and inserting <quote>2012</quote>.</text>
				</subsection></section></title><title id="HABA40BA36C3E48F49D91C24785CE2870"><enum>IV</enum><header>Monitoring,
			 Reporting, and Public Notification of Sewer Overflows</header>
			<section id="H599A09BEFCD14898BC4994BBFC1F1666"><enum>4001.</enum><header>Monitoring,
			 reporting, and public notification of sewer overflows</header><text display-inline="no-display-inline">Section 402 (33 U.S.C. 1342) is amended by
			 adding at the end the following:</text>
				<quoted-block id="HC4B71CA4EF5C4FB6A7EC5918D73F36C9" style="OLC">
					<subsection id="H3E1766ACEE6F4F6C9D97E257E1AA27B1"><enum>(s)</enum><header>Sewer Overflow
				Monitoring, Reporting, and Notifications</header>
						<paragraph id="HF133D811611D40549EEDF0288FC2086F"><enum>(1)</enum><header>General
				requirements</header><text>After the last day of the 180-day period beginning
				on the date on which regulations are issued under paragraph (4), a permit
				issued, renewed, or modified under this section by the Administrator or the
				State, as the case may be, for a publicly owned treatment works shall require,
				at a minimum, beginning on the date of the issuance, modification, or renewal,
				that the owner or operator of the treatment works—</text>
							<subparagraph id="H375B8B06C6D74E77BBF03282DB180CD1"><enum>(A)</enum><text>institute and
				utilize a feasible methodology, technology, or management program for
				monitoring sewer overflows to alert the owner or operator to the occurrence of
				a sewer overflow in a timely manner;</text>
							</subparagraph><subparagraph id="HB81DDF87CE9747B5937C16C1A9A8C510"><enum>(B)</enum><text>in the case of a
				sewer overflow that has the potential to affect human health, notify the public
				of the overflow as soon as practicable but not later than 24 hours after the
				time the owner or operator knows of the overflow;</text>
							</subparagraph><subparagraph id="H0B30A30F3F3C464D995F59A879ADDEAB"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of a sewer overflow that may
				imminently and substantially endanger human health, notify public health
				authorities and other affected entities, such as public water systems, of the
				overflow immediately after the owner or operator knows of the overflow;</text>
							</subparagraph><subparagraph id="HD0E01A67315140CFACCD6E5838110FBF"><enum>(D)</enum><text display-inline="yes-display-inline">report each sewer overflow on its discharge
				monitoring report to the Administrator or the State, as the case may be, by
				describing—</text>
								<clause id="HADDB218D93BE41F292410E332779C32D"><enum>(i)</enum><text>the magnitude,
				duration, and suspected cause of the overflow;</text>
								</clause><clause id="HAEB54B45CED941D2A5B2E7F0E0988429"><enum>(ii)</enum><text>the steps taken
				or planned to reduce, eliminate, or prevent recurrence of the overflow;
				and</text>
								</clause><clause id="HF2C242313CEE4FC1A437C98F5BCC65C7"><enum>(iii)</enum><text>the steps taken
				or planned to mitigate the impact of the overflow; and</text>
								</clause></subparagraph><subparagraph id="H18F90CC68125464695F90E84AE3C9EE1"><enum>(E)</enum><text display-inline="yes-display-inline">annually report to the Administrator or the
				State, as the case may be, the total number of sewer overflows in a calendar
				year, including—</text>
								<clause id="HFD096DC44D264FE9B0CA940A87C1565C"><enum>(i)</enum><text>the details of how
				much wastewater was released per incident;</text>
								</clause><clause id="H482563B2B5054976BC50C226C71ED9C4"><enum>(ii)</enum><text>the duration of
				each sewer overflow;</text>
								</clause><clause id="HFD3F5E0AD5CD42ABAAE49845B46898E6"><enum>(iii)</enum><text>the location of
				the overflow and any potentially affected receiving waters;</text>
								</clause><clause id="H60F2D59622B04292B84881F4775B1EB8"><enum>(iv)</enum><text>the responses
				taken to clean up the overflow; and</text>
								</clause><clause id="H1A6AF699BB524E44A48CB0CCDA0327D8"><enum>(v)</enum><text>the actions taken
				to mitigate impacts and avoid further sewer overflows at the site.</text>
								</clause></subparagraph></paragraph><paragraph id="H1452AC6C462644189D89049CEB086EED"><enum>(2)</enum><header>Exceptions</header>
							<subparagraph id="H22CA4D39821943F187064BF2CEABF708"><enum>(A)</enum><header>Notification
				requirements</header><text>The notification requirements of paragraphs (1)(B)
				and (1)(C) shall not apply to a sewer overflow that is a wastewater backup into
				a single-family residence.</text>
							</subparagraph><subparagraph id="H20B86582A5AA4170A5BBEC7AC8D9E72F"><enum>(B)</enum><header>Reporting
				requirements</header><text>The reporting requirements of paragraphs (1)(D) and
				(1)(E) shall not apply to a sewer overflow that is a release of wastewater that
				occurs in the course of maintenance of the treatment works, is managed
				consistently with the treatment works’ best management practices, and is
				intended to prevent sewer overflows.</text>
							</subparagraph></paragraph><paragraph id="HD84444F357224B3BBFD3B15EDDB359C6"><enum>(3)</enum><header>Report to
				EPA</header><text>Each State shall provide to the Administrator annually a
				summary of sewer overflows that occurred in the State.</text>
						</paragraph><paragraph id="HB525AEE68A6F4B108B176882E11B03F8"><enum>(4)</enum><header>Rulemaking by
				EPA</header><text>Not later than one year after the date of enactment of this
				subsection, the Administrator, after providing notice and an opportunity for
				public comment, shall issue regulations to implement this subsection, including
				regulations to—</text>
							<subparagraph id="H6511961C9FD14BA3979200ABF171C2A9"><enum>(A)</enum><text>establish a set of
				criteria to guide the owner or operator of a publicly owned treatment works
				in—</text>
								<clause id="HB3C83049EF6F4AC2A0EF4B322DFCB535"><enum>(i)</enum><text>assessing whether
				a sewer overflow has the potential to affect human health or may imminently and
				substantially endanger human health; and</text>
								</clause><clause id="HDD7D0B5E21514E5285846B80860C2C32"><enum>(ii)</enum><text>developing
				communication measures that are sufficient to give notice under paragraphs
				(1)(B) and (1)(C); and</text>
								</clause></subparagraph><subparagraph id="HB41A1FA341FC402E851E68011CCFB9B7"><enum>(B)</enum><text>define the terms
				<term>feasible</term> and <term>timely</term> as such terms apply to paragraph
				(1)(A), including site specific conditions.</text>
							</subparagraph></paragraph><paragraph id="H0A929C7EBDCB43518F8AC0BACDE1D4C8"><enum>(5)</enum><header>Approval of
				State notification programs</header>
							<subparagraph id="H04C9471239994DA4B0A3B0A911143EF7"><enum>(A)</enum><header>Requests for
				approval</header>
								<clause id="H9943E81AFEDF40C4B40FAD6DBE5427CC"><enum>(i)</enum><header>In
				general</header><text>After the date of issuance of regulations under paragraph
				(4), a State may submit to the Administrator evidence that the State has in
				place a legally enforceable notification program that is substantially
				equivalent to or exceeds the requirements of paragraphs (1)(B) and
				(1)(C).</text>
								</clause><clause id="HE2BC930EB3594CCD8A8978FEB7CA65BD"><enum>(ii)</enum><header>Program review
				and authorization</header><text>If the evidence submitted by a State under
				clause (i) shows the notification program of the State to be substantially
				equivalent to or exceeds the requirements of paragraphs (1)(B) and (1)(C), the
				Administrator shall authorize the State to carry out such program instead of
				the requirements of paragraphs (1)(B) and (1)(C).</text>
								</clause><clause id="H4E09E8BB851242F198AC16C99C47571B"><enum>(iii)</enum><header>Factors for
				determining substantial equivalency</header><text>In carrying out a review of a
				State notification program under clause (ii), the Administrator shall take into
				account the scope of sewer overflows for which notification is required, the
				length of time during which notification must be made, the scope of persons who
				must be notified of sewer overflows, the scope of enforcement activities
				ensuring that notifications of sewer overflows are made, and such other factors
				as the Administrator considers appropriate.</text>
								</clause></subparagraph><subparagraph id="H46151EEB21744852B804FDE29FF7593A"><enum>(B)</enum><header>Review
				period</header><text display-inline="yes-display-inline">If a State submits
				evidence with respect to a notification program under subparagraph (A)(i) on or
				before the last day of the 30-day period beginning on the date of issuance of
				regulations under paragraph (4), the requirements of paragraphs (1)(B) and
				(1)(C) shall not begin to apply to a publicly owned treatment works located in
				the State until the date on which the Administrator completes a review of the
				notification program under subparagraph (A)(ii).</text>
							</subparagraph><subparagraph id="HD339617771124C2EAC490A6B70B5F243"><enum>(C)</enum><header>Withdrawal of
				authorization</header><text>If the Administrator, after conducting a public
				hearing, determines that a State is not administering and enforcing a State
				notification program authorized under subparagraph (A)(ii) in accordance with
				the requirements of this paragraph, the Administrator shall so notify the State
				and, if appropriate corrective action is not taken within a reasonable time,
				not to exceed 90 days, the Administrator shall withdraw authorization of such
				program and enforce the requirements of paragraphs (1)(B) and (1)(C) with
				respect to the State.</text>
							</subparagraph></paragraph><paragraph id="HBBF5DEDE033C4079B7B9DEE7607BC462"><enum>(6)</enum><header>Special rules
				concerning application of notification requirements</header><text>After the
				last day of the 30-day period beginning on the date of issuance of regulations
				under paragraph (4), the requirements of paragraphs (1)(B) and (1)(C)
				shall—</text>
							<subparagraph id="H7E05D71F47D94CFBB79EC5B19147EA28"><enum>(A)</enum><text>apply to the owner
				or operator of a publicly owned treatment works and be subject to enforcement
				under section 309, and</text>
							</subparagraph><subparagraph id="H6D77D8B29C904B35B12D6158AC2C8D28"><enum>(B)</enum><text display-inline="yes-display-inline">supersede any notification requirements
				contained in a permit issued under this section for the treatment works to the
				extent that the notification requirements are less stringent than the
				notification requirements of paragraphs (1)(B) and (1)(C),</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">until such
				date as a permit is issued, renewed, or modified under this section for the
				treatment works in accordance with paragraph (1).</continuation-text></paragraph><paragraph id="HE7536BD8578C4E95B1DE1551A4649E4D"><enum>(7)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection, the following
				definitions apply:</text>
							<subparagraph display-inline="no-display-inline" id="H7F25103F872047559CDAA5BE6D243452"><enum>(A)</enum><header>Sanitary sewer
				overflow</header><text>The term <term>sanitary sewer overflow</term> means an
				overflow, spill, release, or diversion of wastewater from a sanitary sewer
				system. Such term does not include municipal combined sewer overflows or other
				discharges from the combined portion of a municipal combined storm and sanitary
				sewer system and does not include wastewater backups into buildings caused by a
				blockage or other malfunction of a building lateral that is privately owned.
				Such term includes overflows or releases of wastewater that reach waters of the
				United States, overflows or releases of wastewater in the United States that do
				not reach waters of the United States, and wastewater backups into buildings
				that are caused by blockages or flow conditions in a sanitary sewer other than
				a building lateral.</text>
							</subparagraph><subparagraph id="HC198C157AE5C4E32AC2F1D039D6D79BA"><enum>(B)</enum><header>Sewer
				overflow</header><text display-inline="yes-display-inline">The term <term>sewer
				overflow</term> means a sanitary sewer overflow or a municipal combined sewer
				overflow.</text>
							</subparagraph><subparagraph id="HDD355532B1EC4B21AB6AD56A76B32DBC"><enum>(C)</enum><header>Single-family
				residence</header><text display-inline="yes-display-inline">The term
				<term>single-family residence</term> means an individual dwelling unit,
				including an apartment, condominium, house, or dormitory. Such term does not
				include the common areas of a multi-dwelling
				structure.</text>

				<subsection id="HEFB31E71F403403DA9F7B4C5116C9B81"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Administrator of the Environmental
			 Protection Agency, in consultation with the Secretary of State and the
			 Government of Canada, shall conduct a study of the condition of wastewater
			 treatment facilities located in the United States and Canada that discharge
			 into the Great Lakes.</text>
				</subsection><subsection id="HAF3762766608470986E4D6C4B300332A"><enum>(b)</enum><header>Contents</header><text>In
			 conducting the study, the Administrator shall—</text>
					<paragraph id="H6AF6BC8D2B234043B5F7FDC8D8FB5DBC"><enum>(1)</enum><text>determine the
			 effect that such treatment facilities have on the water quality of the Great
			 Lakes; and</text>
					</paragraph><paragraph id="H85E6D4B86D78448A9E6C8BEFD500C9DD"><enum>(2)</enum><text>develop
			 recommendations—</text>
						<subparagraph id="H94E00C4D28E94CC7AF17163753157592"><enum>(A)</enum><text>to improve water
			 quality monitoring by the operators of such treatment facilities;</text>
						</subparagraph><subparagraph id="H614F1389A50E42ADB62D2543D4A35C6D"><enum>(B)</enum><text>to establish a
			 protocol for improved notification and information sharing between the United
			 States and Canada; and</text>
						</subparagraph><subparagraph id="H942631A04C1046ED9332445666157FA6"><enum>(C)</enum><text>to promote
			 cooperation between the United States and Canada to prevent the discharge of
			 untreated and undertreated wastewater into the Great Lakes.</text>
						</subparagraph></paragraph></subsection><subsection id="H75D3DD80A2664E02B0B0A542CE0D1E2B"><enum>(c)</enum><header>Consultation</header><text>In
			 conducting the study, the Administrator shall consult with the International
			 Joint Commission.</text>
				</subsection><subsection id="H2F6CEBC5E29548E9BD48B12BA03B0FAD"><enum>(d)</enum><header>Report</header><text>Not
			 later than 12 months after the date of enactment of this Act, the Administrator
			 shall submit to Congress a report on the results of the study, together with
			 the recommendations developed under subsection (b)(2).</text>
				</subsection></section></title><title id="HE971271F3526492DB50CD4BF33072C48"><enum>VI</enum><header>Pharmaceuticals
			 and personal care products</header>
			<section display-inline="no-display-inline" id="HF34F1AA8FA4B4C2493F512E2C15393F8" section-type="subsequent-section"><enum>6001.</enum><header>Presence of
			 pharmaceuticals and personal care products in waters of the United
			 States</header><text display-inline="no-display-inline">Section 104 (33 U.S.C.
			 1254) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H4EFA2FC427604136A24725749B838133" style="OLC">
					<subsection id="H79968319AB1D4EFE9BC86F28B98B1205"><enum>(w)</enum><header>Presence of
				pharmaceuticals and personal care products in waters of the United
				States</header>
						<paragraph id="H40419B0CF1D04FFBBBE8786161A78CA4"><enum>(1)</enum><header>Study</header><text display-inline="yes-display-inline">The Administrator, in consultation with
				appropriate Federal agencies (including the National Institute of Environmental
				Health Sciences), shall conduct a study on the presence of pharmaceuticals and
				personal care products (in this subsection referred to as <quote>PPCPs</quote>)
				in the waters of the United States.</text>
						</paragraph><paragraph id="H642206767378480F8FADFD183E67B722"><enum>(2)</enum><header>Contents</header><text>In
				conducting the study under paragraph (1), the Administrator shall—</text>
							<subparagraph id="H3DD8821ECA174BDDA6B3B59EF2AEE634"><enum>(A)</enum><text>identify PPCPs
				that have been detected in the waters of the United States and the levels at
				which such PPCPs have been detected;</text>
							</subparagraph><subparagraph id="H5321E5BE66C64F4ABB205498D50CF379"><enum>(B)</enum><text>identify the
				sources of PPCPs in the waters of the United States, including point sources
				and nonpoint sources of PPCP contamination; and</text>
							</subparagraph><subparagraph id="H512061E6DD1C44D9B2352647B2DBC379"><enum>(C)</enum><text>identify methods
				to control, limit, treat, or prevent PPCPs in the waters of the United
				States.</text>
							</subparagraph></paragraph><paragraph id="HC235401B902247D8A0AC6E6D40369D6B"><enum>(3)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 12 months after the date of
				enactment of this subsection, the Administrator shall submit to Congress a
				report on the results of the study conducted under this subsection, including
				the potential effects of PPCPs in the waters of the United States on human
				health and aquatic wildlife.</text>
						</paragraph><paragraph id="H75A29F04937A42279C985B9C86E1B0D4"><enum>(4)</enum><header>Pharmaceuticals
				and personal care products defined</header><text>In this subsection, the terms
				<quote>pharmaceuticals and personal care products</quote> and
				<quote>PPCPs</quote> mean products used by individuals for personal health or
				cosmetic reasons or used to enhance growth or health of
				livestock.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title id="HA904B0C0CF7E4CC8A1D26EEC8FBF20E8"><enum>VII</enum><header>Miscellaneous</header>
			<section id="HD459C127290042A7B66E05EAB912C192"><enum>7001.</enum><header>Task force on
			 proper disposal of unused pharmaceuticals</header>
				<subsection id="HA884C95C6809488DAD1F442FF73C1CAB"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In furtherance of the
			 national goals and policies set forth in section 101 of the Federal Water
			 Pollution Control Act (33 U.S.C. 1251), the Administrator of the Environmental
			 Protection Agency (in this Act referred to as the <quote>Administrator</quote>)
			 shall convene a task force (in this Act referred to as the <quote>task
			 force</quote>) to develop—</text>
					<paragraph id="H0CB346E020174744AE409F99FF3D1B24"><enum>(1)</enum><text>recommendations on
			 the proper disposal of unused pharmaceuticals by consumers, health care
			 providers, and others, which recommendations shall—</text>
						<subparagraph id="HEC5D210252394C62A58E2C7F21B6C45F"><enum>(A)</enum><text display-inline="yes-display-inline">be calculated to prevent or reduce the
			 detrimental effects on the environment and human health caused by introducing
			 unused pharmaceuticals, directly or indirectly, into water systems; and</text>
						</subparagraph><subparagraph id="HB807FA5C45FA4622AE9D1BBFE27A6645"><enum>(B)</enum><text display-inline="yes-display-inline">provide for limiting the disposal of unused
			 pharmaceuticals through treatment works in accordance with the Federal Water
			 Pollution Control Act (33 U.S.C. 1251 et seq.); and</text>
						</subparagraph></paragraph><paragraph id="H1C01999A46CE40A5A511D89B0DE8E244"><enum>(2)</enum><text>a
			 strategy for the Federal Government to educate the public on such
			 recommendations.</text>
					</paragraph></subsection><subsection id="H68DFE0E7F35E4C569E5D06007DF165D5"><enum>(b)</enum><header>Membership</header><text>The
			 task force shall be composed of—</text>
					<paragraph id="H720042C0910645B38F273ADE33098105"><enum>(1)</enum><text>the Administrator
			 (or the Administrator’s designee), who shall serve as the Chair of the task
			 force;</text>
					</paragraph><paragraph id="HA1E0ABADB1AF42AFA416901B80C73E3F"><enum>(2)</enum><text>the Commissioner
			 of Food and Drugs (or the Commissioner’s designee); and</text>
					</paragraph><paragraph id="H7FB134794C044C7C936520D24800A710"><enum>(3)</enum><text>such other members
			 as the Administrator may appoint.</text>
					</paragraph></subsection><subsection id="H0E76171B78D54A22B20C5D9977264541"><enum>(c)</enum><header>Report</header><text>Not
			 later than 1 year after the date of the enactment of this Act, the task force
			 shall submit a report to the Congress containing the recommendations and
			 strategy required by subsection (a).</text>
				</subsection><subsection id="HA683D9C10FD64A59A47CF9D8EEAB3AC1"><enum>(d)</enum><header>Staff of Federal
			 agencies</header><text display-inline="yes-display-inline">Upon request of the
			 task force, the head of any department or agency of the United States may
			 detail any of the personnel of that department or agency to the task force to
			 assist in carrying out its duties under this section.</text>
				</subsection><subsection id="H611A623686754FDFBA6ADA5CE97B1BD8"><enum>(e)</enum><header>Termination</header><text>The
			 task force shall terminate 180 days after submitting the report required by
			 subsection (c).</text>
				</subsection></section></title><title id="HE418F31561F64FF3BC82D8CC287B377A"><enum>VIII</enum><header>OMB
			 Study</header>
			<section display-inline="no-display-inline" id="H6128BDB967BB42ABB0A3B3DDEF788C09" section-type="subsequent-section"><enum>8001.</enum><header>Evaluation using
			 program assessment rating tool</header>
				<subsection id="HEC692C8B9EBB4760BAFE554BBD6B1479"><enum>(a)</enum><header>Study</header><text>The
			 Director of the Office of Management and Budget shall conduct a study to
			 evaluate the programs authorized by this Act, including the amendments made by
			 this Act, under the Program Assessment Rating Tool (PART) or a successor
			 performance assessment tool that is developed by the Office of Management and
			 Budget.</text>
				</subsection><subsection id="H3AA9569D43AB4A32B69083AE90BDFFA6"><enum>(b)</enum><header>Report</header><text>The
			 Director shall transmit to Congress a report on the results of the
			 study.</text>
				</subsection></section></title><title id="H4B6BD190BAE7476B87CF8BCE29C84156"><enum>IX</enum><header>Chesapeake Bay
			 Accountability and Recovery</header>
			<section id="H43243D8D28664017BB05CBE98A9585D4" section-type="subsequent-section"><enum>9001.</enum><header>Chesapeake Bay
			 Crosscut Budget</header>
				<subsection id="HBA23FDE61BD94549A54F9D4D7F66DFDC"><enum>(a)</enum><header>Crosscut
			 Budget</header><text display-inline="yes-display-inline">The Director, in
			 consultation with the Chesapeake Executive Council, the chief executive of each
			 Chesapeake Bay State, and the Chesapeake Bay Commission, shall submit to
			 Congress a financial report containing—</text>
					<paragraph id="HBF40EC2755C748CFA7A7B7001F1C7696"><enum>(1)</enum><text>an interagency
			 crosscut budget that displays—</text>
						<subparagraph id="H72C308AF8CD5473D939B384BFD7CF846"><enum>(A)</enum><text>the proposed
			 funding for any Federal restoration activity to be carried out in the
			 succeeding fiscal year, including any planned interagency or intra-agency
			 transfer, for each of the Federal agencies that carry out restoration
			 activities;</text>
						</subparagraph><subparagraph id="H12581AD873484BB9B20D5AB191F8B682"><enum>(B)</enum><text display-inline="yes-display-inline">to the extent that information is
			 available, the estimated funding for any State restoration activity to be
			 carried out in the succeeding fiscal year;</text>
						</subparagraph><subparagraph id="H1057E0ED466E436AB9B239479C231DD4"><enum>(C)</enum><text display-inline="yes-display-inline">all expenditures for Federal restoration
			 activities from the preceding 3 fiscal years, the current fiscal year, and the
			 succeeding fiscal year; and</text>
						</subparagraph><subparagraph id="H02AC00780AE2430D9DE403632EBD1268"><enum>(D)</enum><text display-inline="yes-display-inline">all expenditures, to the extent that
			 information is available, for State restoration activities during the
			 equivalent time period described in
			 <internal-xref idref="H1057E0ED466E436AB9B239479C231DD4" legis-path="2.(a)(1)(C)">subparagraph (C)</internal-xref>;</text>
						</subparagraph></paragraph><paragraph id="H67A5CB1249894ED2ADB0CC27E64D3C8E"><enum>(2)</enum><text>a
			 detailed accounting of all funds received and obligated by all Federal agencies
			 for restoration activities during the current and preceding fiscal years,
			 including the identification of funds which were transferred to a Chesapeake
			 Bay State for restoration activities;</text>
					</paragraph><paragraph id="H4C5B08ADE85F41B6B3A644E9D6C54299"><enum>(3)</enum><text>to the extent that
			 information is available, a detailed accounting from each State of all funds
			 received and obligated from a Federal agency for restoration activities during
			 the current and preceding fiscal years; and</text>
					</paragraph><paragraph id="H3EC629E0A95D424ABE73F8B957244902"><enum>(4)</enum><text>a
			 description of each of the proposed Federal and State restoration activities to
			 be carried out in the succeeding fiscal year (corresponding to those activities
			 listed in subparagraphs (A) and (B) of paragraph (1)), including the—</text>
						<subparagraph id="H28F7A2E2BA014793BB844A7B1A2ADB85"><enum>(A)</enum><text>project
			 description;</text>
						</subparagraph><subparagraph id="HB899B0D635394FD49849AF5DE55BAE90"><enum>(B)</enum><text>current status of
			 the project;</text>
						</subparagraph><subparagraph id="H13A4AD44505D4836AD3B69FA35681F41"><enum>(C)</enum><text display-inline="yes-display-inline">Federal or State statutory or regulatory
			 authority, programs, or responsible agencies;</text>
						</subparagraph><subparagraph id="H882BEF9CA9EB423486F334B91DEF29AA"><enum>(D)</enum><text>authorization
			 level for appropriations;</text>
						</subparagraph><subparagraph id="H64662FD34094466E9121C1BDDEAFA2AB"><enum>(E)</enum><text>project timeline,
			 including benchmarks;</text>
						</subparagraph><subparagraph id="HC493E21925C94A82AAC59685BBB2D6AC"><enum>(F)</enum><text>references to
			 project documents;</text>
						</subparagraph><subparagraph id="H42A02150A80E4DEEBC77DEA83CBB80EC"><enum>(G)</enum><text>descriptions of
			 risks and uncertainties of project implementation;</text>
						</subparagraph><subparagraph id="HC919569E6B574EBCAB15F0FF7C3D7F3F"><enum>(H)</enum><text>adaptive
			 management actions or framework;</text>
						</subparagraph><subparagraph id="HE5F88D511CD348329684B5A07A85B80C"><enum>(I)</enum><text>coordinating
			 entities;</text>
						</subparagraph><subparagraph id="H75F4E58034D9452A96F2B6D8D58E5EC8"><enum>(J)</enum><text>funding history;</text>
						</subparagraph><subparagraph id="H2D99CB12ADE046DE8A0A7D8E1C08F348"><enum>(K)</enum><text>cost-sharing;
			 and</text>
						</subparagraph><subparagraph id="HB4F465C40B494AB78CE7D6D245073E9D"><enum>(L)</enum><text display-inline="yes-display-inline">alignment with existing Chesapeake Bay
			 Agreement and Chesapeake Executive Council goals and priorities.</text>
						</subparagraph></paragraph></subsection><subsection id="H62F1DEBE8ADB4F7D9757C2FC9135A249"><enum>(b)</enum><header>Minimum funding
			 levels</header><text>The Director shall only describe restoration activities in
			 the report required under
			 <internal-xref idref="HBA23FDE61BD94549A54F9D4D7F66DFDC" legis-path="2.(a)">subsection (a)</internal-xref> that—</text>
					<paragraph id="HFE43D3CF62384741A5D2998322BCC580"><enum>(1)</enum><text>for Federal
			 restoration activities, have funding amounts greater than or equal to $100,000;
			 and</text>
					</paragraph><paragraph id="HF9F4F103284A49178F1D4E7BF4C33A18"><enum>(2)</enum><text>for State
			 restoration activities, have funding amounts greater than or equal to
			 $50,000.</text>
					</paragraph></subsection><subsection id="H5BE087B67E0C4FEB84538026EF34C833"><enum>(c)</enum><header>Deadline</header><text display-inline="yes-display-inline">The Director shall submit to Congress the
			 report required by
			 <internal-xref idref="HBA23FDE61BD94549A54F9D4D7F66DFDC" legis-path="2.(a)">subsection (a)</internal-xref> not later than 30 days after
			 the submission by the President of the President’s annual budget to
			 Congress.</text>
				</subsection><subsection id="H84E1B81A1A924A1AA9BF80D16223AAEC"><enum>(d)</enum><header>Report</header><text>Copies
			 of the financial report required by
			 <internal-xref idref="HBA23FDE61BD94549A54F9D4D7F66DFDC" legis-path="2.(a)">subsection (a)</internal-xref> shall be submitted to the
			 Committees on Appropriations, Natural Resources, Energy and Commerce, and
			 Transportation and Infrastructure of the House of Representatives and the
			 Committees on Appropriations, Environment and Public Works, and Commerce,
			 Science, and Transportation of the Senate.</text>
				</subsection><subsection id="H9DE476930E7147AC922A16DDFE529430"><enum>(e)</enum><header>Effective
			 Date</header><text>This section shall apply beginning with the first fiscal
			 year after the date of enactment of this Act for which the President submits a
			 budget to Congress.</text>
				</subsection></section><section id="HBA2477EC6F8C447E994AD06E30A59F97"><enum>9002.</enum><header>Adaptive
			 Management Plan</header>
				<subsection id="HE45B7203462E42E49CA5BFA0B69537B0"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 1 year
			 after the date of enactment of this Act, the Administrator, in consultation
			 with other Federal and State agencies, shall develop an adaptive management
			 plan for restoration activities that includes—</text>
					<paragraph id="H27E3FA2DBA2144E0990DB1BB6DE4B2C1"><enum>(1)</enum><text display-inline="yes-display-inline">definition of specific and measurable
			 objectives to improve water quality;</text>
					</paragraph><paragraph id="HD257ECC8035D4789AE660DDFB8C2A342"><enum>(2)</enum><text display-inline="yes-display-inline">a process for stakeholder
			 participation;</text>
					</paragraph><paragraph id="H3DB5FC2FAE114DB2ACF657B781919A82"><enum>(3)</enum><text display-inline="yes-display-inline">monitoring, modeling, experimentation, and
			 other research and evaluation practices;</text>
					</paragraph><paragraph id="HC214EDC5D1864096A21C00BE3F6F9CE7"><enum>(4)</enum><text display-inline="yes-display-inline">a process for modification of restoration
			 activities that have not attained or will not attain the specific and
			 measurable objectives set forth under
			 <internal-xref idref="H27E3FA2DBA2144E0990DB1BB6DE4B2C1" legis-path="3.(a)(1)">paragraph (1)</internal-xref>; and</text>
					</paragraph><paragraph id="H3147421B18A44A55A67D5CD66AED25BE"><enum>(5)</enum><text display-inline="yes-display-inline">a process for prioritizing restoration
			 activities and programs to which adaptive management shall be applied.</text>
					</paragraph></subsection><subsection id="HB22646F05647458F968FFD5560512950"><enum>(b)</enum><header>Implementation</header><text>The
			 Administrator shall implement the adaptive management plan developed under
			 <internal-xref idref="HE45B7203462E42E49CA5BFA0B69537B0" legis-path="3.(a)">subsection (a)</internal-xref>.</text>
				</subsection><subsection id="HB6C303E41748423EAB1677AE315E0BD3"><enum>(c)</enum><header>Updates</header><text>The
			 Administrator shall update the adaptive management plan developed under
			 <internal-xref idref="HE45B7203462E42E49CA5BFA0B69537B0" legis-path="3.(a)">subsection (a)</internal-xref> every 3 years.</text>
				</subsection><subsection id="H4C69C6A12FB04285AE29FF486F32F13F"><enum>(d)</enum><header>Report to
			 Congress</header>
					<paragraph id="H7A8595815321497EBB9DFDFA3785699A"><enum>(1)</enum><header>In
			 general</header><text>Not later than 60 days after the end of a fiscal year,
			 the Administrator shall transmit to Congress an annual report on the
			 implementation of the adaptive management plan required under this section for
			 such fiscal year.</text>
					</paragraph><paragraph id="H15741D3EA85F4756B7FAEFFD8D9CAE2E"><enum>(2)</enum><header>Contents</header><text>The
			 report required under paragraph (1) shall contain information about the
			 application of adaptive management to restoration activities and programs,
			 including programmatic and project level changes implemented through the
			 process of adaptive management.</text>
					</paragraph><paragraph id="H74F1ED1F8CEF40D9828BD6B856D3F423"><enum>(3)</enum><header>Effective
			 date</header><text>Paragraph (1) shall apply to the first fiscal year that
			 begins after the date of enactment of this Act.</text>
					</paragraph></subsection></section><section id="HF1907B725BCD4E039B68834688148D85"><enum>9003.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title, the following definitions
			 apply:</text>
				<paragraph id="HF90B0E20469D4F71A18CB474258275C5"><enum>(1)</enum><header>Adaptive
			 Management</header><text display-inline="yes-display-inline">The term
			 <quote>adaptive management</quote> means a management technique in which
			 project and program decisions are made as part of an ongoing science-based
			 process. Adaptive management involves testing, monitoring, and evaluating
			 applied strategies and incorporating new knowledge into programs and
			 restoration activities that are based on scientific findings and the needs of
			 society. Results are used to modify management policy, strategies, practices,
			 programs, and restoration activities.</text>
				</paragraph><paragraph id="HAD9B3D2F9B8E46A6AE255CAA61339410"><enum>(2)</enum><header>Administrator</header><text>The
			 term <quote>Administrator</quote> means the Administrator of the Environmental
			 Protection Agency.</text>
				</paragraph><paragraph id="H17283EEE28244E1C88190212F5F93407"><enum>(3)</enum><header>Chesapeake Bay
			 State</header><text display-inline="yes-display-inline">The term
			 <quote>Chesapeake Bay State</quote> or <quote>State</quote> means the States of
			 Maryland, West Virginia, Delaware, and New York, the Commonwealths of Virginia
			 and Pennsylvania, and the District of Columbia.</text>
				</paragraph><paragraph id="HBA7214EB9FFD4067BBAD2B4F7CD8ACFD"><enum>(4)</enum><header>Chesapeake Bay
			 Watershed</header><text>The term <quote>Chesapeake Bay watershed</quote> means
			 the Chesapeake Bay and the geographic area, as determined by the Secretary of
			 the Interior, consisting of 36 tributary basins, within the Chesapeake Bay
			 States, through which precipitation drains into the Chesapeake Bay.</text>
				</paragraph><paragraph id="HD94B1B7316A04AE6B1A2086274B5EFF4"><enum>(5)</enum><header>Chief
			 Executive</header><text>The term <quote>chief executive</quote> means, in the
			 case of a State or Commonwealth, the Governor of each such State or
			 Commonwealth and, in the case of the District of Columbia, the Mayor of the
			 District of Columbia.</text>
				</paragraph><paragraph id="HF6B4B1AA630149D8B6B8F497B713BECA"><enum>(6)</enum><header>Director</header><text>The
			 term <quote>Director</quote> means the Director of the Office of Management and
			 Budget.</text>
				</paragraph><paragraph id="H521FB1C584F74872B785B0D6E67A2BA9"><enum>(7)</enum><header>Restoration
			 Activities</header><text>The term <quote>restoration activities</quote> means
			 any Federal or State programs or projects that directly or indirectly protect,
			 conserve, or restore water quality in the Chesapeake Bay watershed, including
			 programs or projects that promote responsible land use, stewardship, and
			 community engagement in the Chesapeake Bay watershed. Restoration activities
			 may be categorized as follows:</text>
					<subparagraph id="HC01A09FA659441B2B22F925B2075015D"><enum>(A)</enum><text>Physical
			 restoration.</text>
					</subparagraph><subparagraph id="HA2CC5478333F4A20965C100C2992CBD1"><enum>(B)</enum><text>Planning.</text>
					</subparagraph><subparagraph id="H26A11CE37E324944AC096C9EB631B020"><enum>(C)</enum><text>Feasibility
			 studies.</text>
					</subparagraph><subparagraph id="H6ABD5CCDEDB3463ABC1906A4CD371BCA"><enum>(D)</enum><text>Scientific
			 research.</text>
					</subparagraph><subparagraph id="H42C8753763024C568BD5B9F54F7F2F86"><enum>(E)</enum><text>Monitoring.</text>
					</subparagraph><subparagraph id="H70E678C3F35542B48947FA4670396E94"><enum>(F)</enum><text>Education.</text>
					</subparagraph><subparagraph id="H12445B2B80BF4210AB257AEBAA0D231F"><enum>(G)</enum><text>Infrastructure
			 Development.</text>
