		<official-title>To amend the Federal Food, Drug, and Cosmetic Act with
		  respect to the distribution of the drug dextromethorphan, and for other
		  purposes.</official-title>

		<section id="HE1C8959EAC564C8CA1A94C9BA351ACB0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Dextromethorphan Distribution Act of
			 2009</short-title></quote>.</text>
		</section><section id="HD4EA939C79FF4BA6A43461C206B4A192"><enum>2.</enum><header>Restrictions on
			 distribution of bulk dextromethorphan</header><text display-inline="no-display-inline">The Federal Food, Drug, and Cosmetic Act (21
			 U.S.C. 321 et seq.) is amended—</text>
			<paragraph id="HB61435D2FFDE483A860D9078395FC798"><enum>(1)</enum><text>in section 501, by
			 inserting at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HC260FE834BC7437BB63002780D7E4A18" style="OLC">
					<subsection id="H27BE6980B7CC4DB38A42DE9BB2BE6D1C"><enum>(j)</enum><text display-inline="yes-display-inline">If it is unfinished dextromethorphan and is
				possessed, received, or distributed in violation of section
				506D.</text>
					</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H2003A17D966C4FF2BBF6B0140F1301BE"><enum>(2)</enum><text>by inserting after
			 section 506C the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD42258E12AF84694A39A89D8C5860165" style="OLC">
					<section id="HFBAD6C693E464F36B2E481AE9B4CC160"><enum>506D.</enum><header>Restrictions
				on distribution of bulk dextromethorphan</header>
						<subsection id="HF28EDA96AE5F4F3A963F1B2CAA02E735"><enum>(a)</enum><header>Restrictions</header><text display-inline="yes-display-inline">No person shall—</text>
							<paragraph id="H448AB10DB60C4E1F9DFB69D0829DD231"><enum>(1)</enum><text display-inline="yes-display-inline">possess or receive unfinished
				dextromethorphan, unless the person is registered under section 510 or
				otherwise registered, licensed, or approved pursuant to Federal or State law to
				engage in the practice of pharmacy, pharmaceutical production, or manufacture
				or distribution of drug ingredients; or</text>
							</paragraph><paragraph id="H62BE8358F9AE40EF97011C2FA4CFA133"><enum>(2)</enum><text display-inline="yes-display-inline">distribute unfinished dextromethorphan to
				any person other than a person registered under section 510 or otherwise
				registered, licensed, or approved pursuant to Federal or State law to engage in
				the practice of pharmacy, pharmaceutical production, or manufacture or
				distribution of drug ingredients.</text>
							</paragraph></subsection><subsection id="H6C1F4CD7AE014CA2B3A12C42D4F4998B"><enum>(b)</enum><header>Exception for
				common carriers</header><text display-inline="yes-display-inline">This section
				does not apply to a common carrier that possesses, receives, or distributes
				unfinished dextromethorphan for purposes of distributing such unfinished
				dextromethorphan between persons described in subsection (a) as registered,
				licensed, or approved.</text>
						</subsection><subsection id="HCD5994DAD90046EA90F470E5CBFB4CE2"><enum>(c)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="H00FA7E8C77F04166BD9E8E9E159106AC"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>common carrier</term> means
				any person that holds itself out to the general public as a provider for hire
				of the transportation by water, land, or air of merchandise, whether or not the
				person actually operates the vessel, vehicle, or aircraft by which the
				transportation is provided, between a port or place and a port or place in the
				United States.</text>
							</paragraph><paragraph id="HBCA6B7D509FC4A4B94C541EA817BAC56"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>unfinished
				dextromethorphan</term> means dextromethorphan that is not contained in a drug
				that is in finished dosage
				form.</text>
