		<section id="HCE987C75A116464B88F23BF22D2CE8A7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Homebuyer Tax Credit Act of
			 2009</short-title></quote>.</text>
		</section><section id="HBE98CBA5A0804D64958BFD871F99F2A2" section-type="subsequent-section"><enum>2.</enum><header>Credit for certain
			 home purchases</header>
			<subsection id="HC0E1502190124C4EBBCFCDD549E0A5A4"><enum>(a)</enum><header>Allowance of
			 credit</header><text>Subpart A of part IV of subchapter A of chapter 1 of the
			 Internal Revenue Code of 1986 is amended by inserting after section 25D the
			 following new section:</text>

					<section id="HD9240DA9F1CB4A028EFE9765DC8BC06"><enum>25E.</enum><header>Credit for
				certain home purchases</header>
						<subsection id="H54203D9D399745529501366998D3BC70"><enum>(a)</enum><header>Allowance of
				credit</header>
							<paragraph id="HF1B8F4326160455CBF00C4D53DBC757F"><enum>(1)</enum><header>In
				general</header><text>In the case of an individual who is a purchaser of a
				principal residence during the taxable year, there shall be allowed as a credit
				against the tax imposed by this chapter an amount equal to 10 percent of the
				purchase price of the residence.</text>
							</paragraph><paragraph id="HBE477FC311344784B2CEACD4A57D6918"><enum>(2)</enum><header>Dollar
				limitation</header><text>The amount of the credit allowed under paragraph (1)
				shall not exceed $15,000.</text>
							</paragraph><paragraph id="H95D0476C618941108F1CCE5B023242B0"><enum>(3)</enum><header>Allocation of
				credit amount</header><text>At the election of the taxpayer, the amount of the
				credit allowed under paragraph (1) (after application of paragraph (2)) may be
				equally divided among the 2 taxable years beginning with the taxable year in
				which the purchase of the principal residence is made.</text>
							</paragraph></subsection><subsection id="H9735CCE916614A389DFA8565D8600145"><enum>(b)</enum><header>Limitations</header>
							<paragraph id="HFF46253C933D43F8ADF5E553B5A6B658"><enum>(1)</enum><header>Date of
				purchase</header><text>The credit allowed under subsection (a) shall be allowed
				only with respect to purchases made during the 1-year period beginning with the
				date of the enactment of this section.</text>
							</paragraph><paragraph id="HF300137FD875401F9CC02370EB08647C"><enum>(2)</enum><header>Limitation based
				on amount of tax</header><text>In the case of a taxable year to which section
				26(a)(2) does not apply, the credit allowed under subsection (a) for any
				taxable year shall not exceed the excess of—</text>
								<subparagraph id="H88FE7FA385034377B51CCE4821B54B77"><enum>(A)</enum><text>the sum of the
				regular tax liability (as defined in section 26(b)) plus the tax imposed by
				section 55, over</text>
								</subparagraph><subparagraph id="H921D1F8735B2429BB72B00BF11F4F662"><enum>(B)</enum><text>the sum of the
				credits allowable under this subpart (other than this section) for the taxable
				year.</text>
								</subparagraph></paragraph><paragraph id="H8BA6434763AC4D6EB347E6F3CB445E74"><enum>(3)</enum><header>One-time
				only</header>
								<subparagraph id="H4F00FE0FFD7E4029ABE961C959FD2DF3"><enum>(A)</enum><header>In
				general</header><text>If a credit is allowed under this section in the case of
				any individual (and such individual's spouse, if married) with respect to the
				purchase of any principal residence, no credit shall be allowed under this
				section in any taxable year with respect to the purchase of any other principal
				residence by such individual or a spouse of such individual.</text>
								</subparagraph><subparagraph id="HD78D58AF23B444F0A82FE5F195E80086"><enum>(B)</enum><header>Joint
				purchase</header><text>In the case of a purchase of a principal residence by 2
				or more unmarried individuals or by 2 married individuals filing separately, no
				credit shall be allowed under this section if a credit under this section has
				been allowed to any of such individuals in any taxable year with respect to the
				purchase of any other principal residence.</text>
								</subparagraph></paragraph></subsection><subsection id="H6777773B0F6745969DB1866800A36935"><enum>(c)</enum><header>Principal
				residence</header><text>For purposes of this section, the term <term>principal
				residence</term> has the same meaning as when used in section 121.</text>
						</subsection><subsection id="H7B4230BEBA0A46709CD1795E697C0000"><enum>(d)</enum><header>Denial of double
				benefit</header><text>No credit shall be allowed under this section for any
				purchase for which a credit is allowed under section 36 or section
				1400C.</text>
						</subsection><subsection id="H102C782BAB83417595321D63470009AC"><enum>(e)</enum><header>Special
				rules</header>
							<paragraph id="HDC219FD765D94A8683DDFEC928ACE719"><enum>(1)</enum><header>Joint
				purchase</header>
								<subparagraph id="H02F35DC32D134776A1C026E6005E007C"><enum>(A)</enum><header>Married
				individuals filing separately</header><text>In the case of 2 married
				individuals filing separately, subsection (a) shall be applied to each such
				individual by substituting <quote>$7,500</quote> for <quote>$15,000</quote> in
				subsection (a)(1).</text>
								</subparagraph><subparagraph id="HAC3FB7150B9C4B07A52268EBAD555CE7"><enum>(B)</enum><header>Unmarried
				individuals</header><text>If 2 or more individuals who are not married purchase
				a principal residence, the amount of the credit allowed under subsection (a)
				shall be allocated among such individuals in such manner as the Secretary may
				prescribe, except that the total amount of the credits allowed to all such
				individuals shall not exceed $15,000.</text>
								</subparagraph></paragraph><paragraph id="H10F28690958E4CB3AD7D95D57310C349"><enum>(2)</enum><header>Purchase</header><text>In
				defining the purchase of a principal residence, rules similar to the rules of
				paragraphs (2) and (3) of section 1400C(e) (as in effect on the date of the
				enactment of this section) shall apply.</text>
							</paragraph><paragraph id="H779294761BA048E3B97E3F9E6B347431"><enum>(3)</enum><header>Reporting
				requirement</header><text>Rules similar to the rules of section 1400C(f) (as so
				in effect) shall apply.</text>
							</paragraph></subsection><subsection id="H4C91FF97D70C4E8788BE594C1E47F0A6"><enum>(f)</enum><header>Recapture of
				credit in the case of certain dispositions</header>
							<paragraph id="H6760495D5A72454581739CEF0059A328"><enum>(1)</enum><header>In
				general</header><text>In the event that a taxpayer—</text>
								<subparagraph id="H72EA419981D34BA699659674CD78E71"><enum>(A)</enum><text>disposes of the
				principal residence with respect to which a credit was allowed under subsection
				(a), or</text>
								</subparagraph><subparagraph id="HF4D2572369BC442A9C8435C4B2FDA8C5"><enum>(B)</enum><text>fails to occupy
				such residence as the taxpayer's principal residence,</text>
								</subparagraph><continuation-text continuation-text-level="paragraph">at any
				time within 24 months after the date on which the taxpayer purchased such
				residence, then the tax imposed by this chapter for the taxable year during
				which such disposition occurred or in which the taxpayer failed to occupy the
				residence as a principal residence shall be increased by the amount of such
				credit.</continuation-text></paragraph><paragraph id="HFCE16AA405914511AAE827D709DBB3FF"><enum>(2)</enum><header>Exceptions</header>
								<subparagraph id="HA9E4A8DF77CF4A878DFC58008CB8CA37"><enum>(A)</enum><header>Death of
				taxpayer</header><text>Paragraph (1) shall not apply to any taxable year ending
				after the date of the taxpayer’s death.</text>
								</subparagraph><subparagraph id="H7D65C34DC3DF483DA745CA7DCD4F7DFD"><enum>(B)</enum><header>Involuntary
				conversion</header><text>Paragraph (1) shall not apply in the case of a
				residence which is compulsorily or involuntarily converted (within the meaning
				of section 1033(a)) if the taxpayer acquires a new principal residence within
				the 2-year period beginning on the date of the disposition or cessation
				referred to in such paragraph. Paragraph (1) shall apply to such new principal
				residence during the remainder of the 24-month period described in such
				paragraph as if such new principal residence were the converted
				residence.</text>
								</subparagraph><subparagraph id="H5A5014C61F7E4FA5A72B01995EED5120"><enum>(C)</enum><header>Transfers
				between spouses or incident to divorce</header><text>In the case of a transfer
				of a residence to which section 1041(a) applies—</text>
									<clause id="H9DA225F6A27C4F7A80E5C40035E79B38"><enum>(i)</enum><text>paragraph (1)
				shall not apply to such transfer, and</text>
									</clause><clause id="HEB0BE846BC7B4B60BF65607EA68253BA"><enum>(ii)</enum><text>in the case of
				taxable years ending after such transfer, paragraph (1) shall apply to the
				transferee in the same manner as if such transferee were the transferor (and
				shall not apply to the transferor).</text>
									</clause></subparagraph><subparagraph id="HABC9814CC4D0422F938719D40400F098"><enum>(D)</enum><header>Relocation of
				members of the Armed Forces</header><text>Paragraph (1) shall not apply in the
				case of a member of the Armed Forces of the United States on active duty who
				moves pursuant to a military order and incident to a permanent change of
				station.</text>
								</subparagraph></paragraph><paragraph id="HCCB6306D55794180A26EC834ED1B61B"><enum>(3)</enum><header>Joint
				returns</header><text>In the case of a credit allowed under subsection (a) with
				respect to a joint return, half of such credit shall be treated as having been
				allowed to each individual filing such return for purposes of this
				subsection.</text>
							</paragraph><paragraph id="HCE18698280AF49FEBA7420A1DFBA29D8"><enum>(4)</enum><header>Return
				requirement</header><text>If the tax imposed by this chapter for the taxable
				year is increased under this subsection, the taxpayer shall, notwithstanding
				section 6012, be required to file a return with respect to the taxes imposed
				under this subtitle.</text>
							</paragraph></subsection><subsection id="H85D993E68C3A4959A8111DCB282CA9C"><enum>(g)</enum><header>Basis
				adjustment</header><text>For purposes of this subtitle, if a credit is allowed
				under this section with respect to the purchase of any residence, the basis of
				such residence shall be reduced by the amount of the credit so
				allowed.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H55F412B4CDA94C38852FA3E723965BE4"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections for subpart A of part IV of
			 subchapter A of chapter 1 of such Code is amended by inserting after the item
			 relating to section 25D the following new item:</text>

					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H883A6AFFCDCE4BC598077CE630F000B9"><enum>(c)</enum><header>Sunset of
			 current first-time homebuyer credit</header>
				<paragraph id="H30B4565B7FB649B9B8356FF700E0B889"><enum>(1)</enum><header>In
			 general</header><text>Subsection (h) of section 36 of such Code is amended by
			 striking <quote>December 1, 2009</quote> and inserting <quote>the date of the
			 enactment of the <short-title>Homebuyer Tax Credit Act of
			 2009</short-title></quote>.</text>
				</paragraph><paragraph id="H798E72CFCDF94A62B4FE77CE2595CFBD"><enum>(2)</enum><header>Election to
			 treat purchase in prior year</header><text>Subsection (g) of section 36 of such
			 Code is amended by striking <quote>December 1, 2009</quote> and inserting
			 <quote>the date of the enactment of the <short-title>Homebuyer Tax Credit Act of
			 2009</short-title></quote>.</text>
				</paragraph></subsection><subsection id="H8861E1D0DC6E44DF95C6D05534CA478"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to purchases
			 after the date of the enactment of this Act.</text>
