		<official-title>To amend title 49, United States Code, to provide certain
		  exemptions to drivers of intrastate commercial motor vehicles engaged in
		  agricultural purposes, and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="H22FD2DCE839349E09DDE2B2F3C07091F" section-type="section-one"><enum>1.</enum><header>Exemptions for certain
			 commercial motor vehicle drivers</header><text display-inline="no-display-inline">Section 31102 of title 49, United States
			 Code, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HB5575166F207467BB761D6CC6969B141" style="OLC">
				<subsection id="H6ECB31F4FFD84020AE4873605113EEC1"><enum>(f)</enum><header>Exemptions for
				certain commercial motor vehicle drivers</header><text>The Secretary of
				Transportation shall not require a State that receives a grant under this
				section to require drivers of intrastate commercial vehicles engaged in
				agricultural-related purposes to comply with the following provisions of title
				49, Code of Federals Regulations—</text>
					<paragraph id="HB35508A7C7BD4DA98FA2B75957A6C467"><enum>(1)</enum><text>parts 380, 383,
				and 390;</text>
					</paragraph><paragraph id="H388508C4611344F692C6E9903CB5FDB8"><enum>(2)</enum><text>paragraphs (1),
				(6), or (8) of section 391.11(b) of part 391;</text>
					</paragraph><paragraph id="HC5A519D03ADC46D5969D8451F0A5CAF0"><enum>(3)</enum><text>subparts C, D, E
				(excluding section 391.41 which shall apply to a driver), and F of part
				391;</text>
					</paragraph><paragraph id="H1A992BB217D042318F46E3F26DB897BC"><enum>(4)</enum><text>part 395;
				and</text>
					</paragraph><paragraph id="H7D89365C81574B28A4D201834C027A30"><enum>(5)</enum><text>sections 396.11,
				396.13, and 396.15, and paragraphs (b) and (c) of section 396.3 of part
				396.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section display-inline="no-display-inline" id="H59FAED9DEECC4996BCD79DD5AD9BDB46"><enum>2.</enum><header>Motor vehicle
			 weight changes</header>
			<subsection id="H557C81676DBC423982C4C43B96289D36"><enum>(a)</enum><header>Safety
			 regulation</header><text display-inline="yes-display-inline">Section
			 31132(1)(A) of title 49, United States Code, is amended by striking
			 <quote>10,001</quote> and inserting <quote>26,001</quote>.</text>
			</subsection><subsection id="H149E941E525346F1AFDEC06627482061"><enum>(b)</enum><header>Commercial motor
			 vehicle operators</header><text>Section 31301(4) of title 49, United States
			 Code, is amended to read as follows:</text>
				<quoted-block id="H00E20D7C925049E884A94F33EA2DC712" style="OLC">
					<paragraph id="H089CB05502FF49BBB7A556CA18537627"><enum>(4)</enum><text><term>commercial
				motor vehicle</term> means a motor vehicle used in commerce to transport
				passengers or property that—</text>
						<subparagraph id="H5C64B309DDF4464B98759C36F35F1041"><enum>(A)</enum><text>has a gross
				vehicle weight rating or gross vehicle weight of at least 26,001 pounds,
				whichever is greater;</text>
						</subparagraph><subparagraph id="HA5FFE755D3434809ADA6B4D2E5EB8134"><enum>(B)</enum><text>is designed to
				transport at least 16 passengers, including the driver; or</text>
						</subparagraph><subparagraph id="HA621635A4C034FBFB9673401BAE48C94"><enum>(C)</enum><text>is used to
				transport material found by the Secretary to be hazardous under section 5103,
				except that a vehicle shall not be included as a commercial motor vehicle under
				this subparagraph if—</text>
							<clause id="H0291FF1A416D4D4D98007D3245BEB272"><enum>(i)</enum><text>the vehicle is
				transporting material listed as hazardous under section 306(a) of the
				Comprehensive Environmental Response, Compensation, and Liability Act of 1980
				(42 U.S.C. 9656(a)) and is not otherwise regulated by the Secretary or is
				transporting a consumer commodity or limited quantity of hazardous material as
				defined in section 171.8 of title 49, Code of Federal Regulations; and</text>
							</clause><clause id="H5FA992C011F842CF8557DAFD50086353"><enum>(ii)</enum><text>the Secretary
				does not deny the application of this exception to the vehicle (individually or
				as part of a class of motor vehicles) in the interest of
				safety.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HE9CAFDF528E74C82915164001DD81941"><enum>3.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall take effect on the date that is 90 days after the date of
			 enactment of this Act.</text>
